The main response to the multiple crises besetting Western societis in the past decades has been the attempt of the academic and scientific as well as political circles to gain a sense of orientation—and of social cohesion—by two main modes of thinking: identity politics and evidence-based knowlegde. Regarding the latter, I argue that if scientific knowledge is reduced to facts, data and numbers, as the basis for political decisions without any alternatives, it would become a dogma propagating the truth—that is, (...) a new religion. Politicians will no longer have to struggle with other perspectives, once there is a consensus about following the line that “the numbers or the facts speak for themselves.” While many people would perhaps find in this new religion a guarantee of security in an insecure world, this sense would be illusionary. I argue that the role intellectuals should play in a spiritual crisis of this kind is paradoxically to cultivate a sense of more security by strengthening a culture of “insecureness” or docta ignorantia against the dogmas within science and religion. To create and encourage a new art of questioning and listening, and of learning to appreciate non-knowledge as the basis of coming together. This notion is found in the Greek and Christian as well as the Jewish tradition of European thought, and it continues in the works of modern thinkers such as Paul Ricoeur, Hermann Cohen, Martin Buber, Hartmut Rosa, and of philosophers who focus on the question of the ineffable. My aim is to present this quality of certainty within uncertainty by examples from different fields, including philosophy, art and psychotherapy, and to elaborate on the paradoxical question: does a troubled Geist need more trouble in order to help us find a sense of orientation through disorientation? There is a prima facie conflict between the semantical theory of direct reference and an intuitively plausible view often called 'individualism'. Direct reference theory is the view that certain expressions pick out their referent directly, without any intervening semantical mechanism. In order to describe the meaning of a sentence which contain such an expression, we have to mention the referent itself. Individualism is a view that mental states are individuated without reference to the subject's environment, either social or physical, and (...) therefore without mentioning an external object of reference. ;I argue that there is no conflict because it is a mistake to carry over the results of a semantical theory into a theory of mental content. My argument ultimately relies on a certain understanding of the difficult notions of mental content and linguistic meaning, gained in part by a close analysis of the historical context in which the theory of reference emerged out of the parallel work in the theory of intentionality. Fundamentally, the elucidation of these concepts is the principal aim of the dissertation, rather than the dismantling of an apparent conflict between two currently accepted views. ;There are two ways in which the conflict may be thought to arise. One argument relies on the identification of linguistic meaning with mental content. Against this I argue that we cannot hold both direct reference and the thesis, crucial to the argument, that linguistic meaning is identical to the thought-content of a competent. The short argument for conflict, therefore, fails. ;The second argument for the conflict is less direct. There are some thoughts, called De Re, which are said to constitute a direct connection between thinker and object. It is often thought that such thoughts are the ones attributed correctly using directly referential expressions. But what we attribute in such cases are just mental states whose attribution essentially involves the extra-mental objects of thought themselves, pace individualism. I argue that this argument depends on a conception of De Re, inherited from W. V. O. Quine, which mistakenly collapses issues of mental content with those of thought-attribution. (shrink)

It is virtuous for individual and collective agents to be tolerant. However, toleration is difficult, both in practice and in conceptualization. Firstly, given that toleration can be understood in various ways (Walzer 1997, Forst 2007), it seems that to determine what is the proper conception of toleration would be controversially difficult. Here I shall suggest one particular conception of toleration is more suitable than others. This conception allows, as I shall explain, us to better understandthe difficulties of toleration. Thus, this (...) particular conception of toleration should lead us to see what is more adequate for dealing with the difficulties of toleration. To be more precise, I shall argue for a political conception of toleration, which different from the attitudinal conception of toleration as being indifferent, or the ethical conception of toleration as respect. There is the suggestion of toleration as recognition (Galeotti 2002). These alternative understandings of toleration do not provide better diagnoses of the difficulties of toleration. The political conception of toleration is intended to be grounded on some moral considerations, notpragmatic purpose. It is political in that it recognizes the fact that toleration is essentially practiced to deal with a power relationship among the parties of toleration. Where these is no such power relationship, as I shall argue, there is no issue of toleration. Secondly, this proposed conception of toleration is political in the sense that it shall not deal with differences coming from, to use John Rawls’s phrase, the fact of pluralism by adopting any comprehensive doctrine such as an ethics of respect or recognition. This paper proposes a systematic framework for the analysis of tensions in corporate sustainability. The framework is based on the emerging integrative view on corporate sustainability, which stresses the need for a simultaneous integration of economic, environmental and social dimensions without, a priori, emphasising one over any other. The integrative view presupposes that firms need to accept tensions in corporate sustainability and pursue different sustainability aspects simultaneously even if they seem to contradict each other. The framework proposed in this paper (...) goes beyond the traditional triad of economic, environmental and social dimensions and argues that tensions in corporate sustainability occur between different levels, in change processes and within a temporal and spatial context. The framework provides vital groundwork for managing tensions in corporate sustainability based on paradox strategies. The paper then applies the framework to identify and characterise four selected tensions and illustrates how key approaches from the literature on strategic contradictions, tensions and paradoxes—i.e., acceptance and resolution strategies—can be used to manage these tensions. Thereby, it refines the emerging literature on the integrative view for the management of tensions in corporate sustainability. The framework also provides managers with a better understanding of tensions in corporate sustainability and enables them to embrace these tensions in their decision making. (shrink)

Corporate sustainability reports are supposed to provide a complete and balanced picture of corporate sustainability performance. They are, however, usually voluntary and thus prone to interpretation and even greenwashing tendencies. To overcome this problem, the Global Reporting Initiative (GRI) provides standardized reporting guidelines challenging companies to report positive and negative aspects of an organization’s sustainability performance. However, the reporting of “negative aspects” in particular can endanger corporate legitimacy if perceived by the stakeholders as not being in line with societal norms (...) and values. Starting from the theoretical lenses of economics-based disclosure theories and socio-political theories of disclosure, the focus of this study therefore was to analyze the communicative legitimation strategies companies use to report “negative aspects,” i.e., negative ecological and social impact caused by corporate activity. Using qualitative content analysis of GRI-oriented sustainability reports from companies listed on the US Dow Jones Industrial Average Index and on the German DAX Index, we identified six legitimation strategies. We discuss these strategies regarding to symbolic and substantial management of legitimacy. We show that symbolic legitimation strategies aiming at modifying the perception of legitimizing stakeholders dominate in the reports at hand. Such persuasion, however, does not meet the requirement of impartiality as postulated by the GRI guidelines. Building upon this conclusion we propose a concise characterization of “negative aspects” and develop a GRI-compliant schema of reporting about them. In doing so, we offer a way to improve the overall “balance” of sustainability reporting contributing to a true and fair view in sustainability disclosure. (shrink)

Um dennoch die realistische Hoffnung auf eine kosmopolitische Weltordnung in Aussicht zu stellen, konstruiert die Schrift einen Menschenrechtsansatz globaler Gerechtigkeit. Teil I beschäftigt sich mit der Frage der Praktikabilität. Das Problem wird zunächst an Kants kosmopolitischen Schriften herausgearbeitet, um es dann methodisch anhand von Rawls’ politischem Konstruktivismus und Honneths normativem Rekonstruktivismus zu lösen. Anschließend an Max Weber, Hans Jonas und Hannah Arendt wird dann in Teil (...) II eine Theorie politischer Verantwortung entwickelt, die sich auf globale politische Verantwortungsverhältnisse übertragen lässt. Teil III legt schließlich einen Menschenrechtsansatz globaler Gerechtigkeit vor. Diese realistische Utopie ist pragmatisch darin begründet, dass das globale Menschenrechtsregime bereits politische Verantwortungsverhältnisse für die wichtigsten menschlichen Interessen etabliert hat. Professor Hausman has written an interesting and instructive book. Though I am by no means favourably disposed to methodology for economists,, I found reading Hausman enjoyable and I came away having learned things worth learning. But not all is well, largely because Hausman is a philosopher first and an economist a poor second. There are also important questions where one would have expected philosophic help which are not asked at all.

I would like to ask what kind of answers one might expect when asking this question in an interdisciplinary context, in which social science, philosophy and jurisprudence play important roles.

In this paper I outline a critical justification of the practice of political whistleblowing as exemplified by the case of Edward Snowden. At first, I argue that the question of justifiability cannot be settled with regard to absolutely binding principles such as special loyalties or the categorical duty to inform fellow citizens. What is required instead is the careful weighing of all relevant consequential and deontic reasons. However, this weighing process has to be publically justified. I will therefore turn to (...) the theory of civil disobedience which provides us with two roots of public justification: widely accepted constitutional values and the primacy of public deliberation. In this view, political whistleblowing is to be seen as a special case of civil disobedience and can be justified along the lines of both liberal and republican approaches. However, in the end of the paper I will indicate that we have to transcend the state-based model of civil disobedience. Snowden’s acts of whistleblowing have a further cosmopolitan intention and need to be justified in terms of avant-garde principles of global justice. (shrink)

In this essay I reflect on fear and cultural exhaustion and their effect on our language, as possible causes, among many others, of the rise of nationalist and chauvinist feeling across Europe today. By fear I mean the fear of not understanding and of not being understood by the other, which may affect us in various ways; by exhaustion I refer to our modern work life with its permanent accessibility and the uncontrolled flood of pictures and information we are exposed (...) to by digitization, as well as to the more general cultural exhaustion when it comes to discussing “values” or “ideas,” which more and more people see as empty words. This pervasive sense of fear and exhaustion has a substantial effect on our language, for the use of readymade phrases, as in the German “Phrasendreschen”, tends to see them as identity markers and thus to induce resentment against those who do not belong to the same in-group. But language, once it is reduced to a mere instrument for transmitting information, generates the sense that everything has already been said, and in feeding our cultural exhaustion and boredom, leads us to abandon the notions of utopia, irony and poetry, all of which thrive on the creative inexhaustibility of language. Fear and exhaustion ultimately lead us to abandon any dialogue with others. What we need is a new way of listening, “new ears” with which to listen to what we initially perceive as “unheard” words, for without the ability to listen to “strange” words, the words of the “stranger,” no society can survive for long. HahnAmong the thornier issues surrounding the Parisian Franciscan collaborative compilation Summa Halensis1 is the matter of its sources, consideration of which most often involves discernment of its contributing authors and their engagement with near-contemporary texts and trends in twelfth- and thirteenth-century scholastic theology.2 Hiding in plain sight, and thus easily (...) overlooked in this array of detailed concerns, is the privileged place afforded to Augustine of Hippo—and more precisely, to historically underexamined and underutilized of his works—within certain sections of the Franciscan Summa, a dynamic that seems to indicate a deliberate Augustinian ressourcement alongside more standard scholastic uses of stock textual auctoritates.3 [End Page 59]In order to establish the plausibility and general contours of such ressourcement, the present study examines the deployment of Augustine's Contra Faustum and De spiritu et littera in the Franciscan Summa's treatise on law, outlining both the originality and significance of this usage. The study falls into three main parts. In the first part, I offer a brief introduction to these two works, noting their import vis-à-vis Augustine's broader corpus. In the second, I provide a rough sketch of their respective reception histories, limning the standards of use that obtain in twelfth- and thirteenth-century scholastic writings prior to the Franciscan Summa. And in the third part, I detail the employment of these two works in the Summa itself, attending to where and how they are used, and how this usage variously coheres with and moves beyond the preceding theological tradition. Finally, by way of conclusion, I gesture at the immediate impact of this usage, taking as my primary example the later Summa theologiae of Thomas Aquinas. As I aim to show, although these important Augustinian works were not entirely unknown in the twelfth and early thirteenth centuries, there is little evidence of their first-hand utilization in scholastic theology prior to that of the Summa Halensis. In this essay on ancient architectural technologies, I propose to challenge the largely conventional idea of the transcendent origins of philosophy, that philosophy dawned only when the mind turned inside, away from the world grasped by the body and senses. By focusing on one premier episode in the history of western thinking – the emergence of Greek philosophical thought in the cosmic architecture of Anaximander of Miletus – I am arguing that the abstract, speculative, rationalising thinking characteristic of philosophy, is (...) indeed rooted in practical activities, and emerges by means of them rather than in repudiation of them. The spirit of rational inquiry emerged from several factors but the contributing role of monumental architecture and building technologies has been vastly under-appreciated. In the process of figuring out how to build on an enormous scale that the eastern Greeks had never before tried, the architects discovered and revealed nature’s order in their thaumata, the very experience with which Aristotle claims that philosophy begins. Ancient architecture and building technologies were on display for decades with monumental temple building. In front of Anaximander and his community, a new vision of nature spawned that, surprisingly, humans could grasp and command. The building of these thaumata, these objects of wonder, offered proof of the human capacity to control nature, and opened a new vision of our human rational capacity to understand the world and our place in it. ABSTRACTThis article applies the idea of political reconciliation to current debates on the role and legitimacy of global governance. My underlying thesis is that the idea of reconciliation fits better with the non-ideal circumstances of global injustice. To this end, I will first of all develop a three-tiered model of political reconciliation and introduce the related concept of restorative justice. I will then look at some of the most obvious forms of international and global injustice – historical injustice, economic exploitation, (...) and political domination – and argue that a normative theory of political reconciliation provides better proposals for feasible global governance reforms than do theories of corrective, retributive, or distributive justice. Finally, I will make a few comments on the role of political philosophy as a medium of ‘narrative reconciliation’. (shrink)

In this paper, I use Hegel’s unique rendition on natural theology as a test-case for examining the intersection of traditional Christian religion and Idealist reason in Hegel’s philosophical modernity. Specifically, I raise the question of whether Hegel’s philosophy of religion is faithful to what philosopher William Desmond has called the “religious (...) between,” within which God exists as superior, transcendent other to the finite human being existing in created dependence on Him. I argue that Hegel’s Lectures on the Philosophy of Religion contain a German idealist conception of natural theology that counterfeits this “between” by subordinating it to a pseudo-mystical quest for noetic union with God that obliterates what should be the irreducible difference between the human and the divine essence. This Article discusses a triangle of forces that affect the activity of small-medium enterprises. These forces are: limited liability, shareholder guarantees, and bankruptcy. Limited liability encourages entrepreneurship by reducing the personal risks shareholders are exposed to as a result of business failure. However, the limited liability shield creates the potential moral hazard of overinvestment. That is, the entrepreneur may involve the corporation in overly risky projects. To combat this risk, the lending practice requires entrepreneurs to sign a personal guarantee for (...) corporate debt. The guarantee serves as a bonding device that forces the entrepreneur to internalize the costs of the corporate activity. This Article first argues that while personal guarantees can serve this economic goal, the lending industry demands them excessively and they are overused. The overuse of guarantees unnecessarily subjects good corporate borrowers as well as bad ones to this practice and causes underinvestment. The third force of the triangle, a discharge of the shareholder’s debts in bankruptcy, may balance this inefficiency. It potentially softens the effect of the guarantee and thus requires the lender to further gather borrowerspecific information at the lending stage. Unfortunately, personal bankruptcy is underused by individual debtors mainly because of the stigma it implies. To rebalance the triangle, this Article proposes to encourage the shareholder’s partial relief of the guarantee through an amicable procedure. I call this procedure Velvet Bankruptcy. Velvet Bankruptcy would first procedurally consolidate the private collection from the shareholder-guarantor with the pending corporate bankruptcy case, by authorizing the court to extend the automatic stay to protect the shareholder-guarantor. To the extent the court is convinced that the collection would render the shareholder insolvent, it could reduce the guarantor’s liability. This would effectively constitute discharge without officially declaring the shareholder bankrupt. (shrink)

In order to perform this end, I shortly make explicit the development of this problematic in Kant's practical philosophy and, soon after, we will accomplish the analysis of the Doctrine of virtue from the semantic point of view, in order to identify the mentioned problems and the solutions supplied by Kant for these problems. Hegel's most interesting and controversial claims about nonconceptual knowledge arise in contexts of value. This paper examines the relation between nonconceptual and conceptual knowledge in Hegel's Phenomenology, specifically in connection with early Greek aesthetics. I take up Hegel's claim that the ancient Greeks expressed in their myths, religious narratives, sculpture, and artistic materials certain high powered philosophical truths which they shouldn't express in words. I raise a paradox about his claims and show how his claims about ineffable knowledge clash with (...) his general propositional criterion of knowledge, namely, that for something to count as knowledge it must be expressible in words. However I argue that Hegel's thoughts about the matter were coherent and I solve the paradox. (shrink)

It is a crucial question whether practicalities should have an impact in developing an applicable theory of human rights—and if, how (far) such constraints can be justified. In the course of the non-ideal turn of today’s political philosophy, any entitlements (and social entitlements in particular) stand under the proviso of practical feasibility. It would, after all, be unreasonable to demand something which is, under the given political and economic circumstances, unachievable. Thus, many theorist—particularly those belonging to the liberal camp—begin to (...) question the very idea of social human rights on grounds of practical infeasibility. This new minimalism about human rights motivates an immanent critique arguing that even if we were to proceed from a liberal framework, we would still wind up with a justification of the full list of social human rights. In the first part of this article, I will present the central positions of the debate presented by Amartya Sen, Maurice Cranston and Pablo Gilabert. Initially arguing that a minimalism of human rights on grounds of practical infeasibility alone proves unjustifiable, however, I shall open up two further perspectives, which allow practical infeasibilities to become normatively determinate. Discussing contributions by James Griffin and Charles Beitz, I will defend the thesis that certain feasibility constraints on (social) human rights can be justified on the condition that they are grounded either in a normative idea of the appropriate implementation of these rights or in reflection of the practical function of a theory of human rights. The present paper aims to discuss Kant’s critical solution for the possibility problem of the transcendental idea of freedom. The problem consists in the supposed incompatibility between that idea and the natural causality. Despite the impossibility of a dogmatic solution for the conflict, the philosopher proposes a critical solution. This critical solution frequently is interpreted as a attempt to make freedom compatible with natural causation. There are, however, some divergences about the form and the implications of that compatibility. Why wasn’t Hume a sceptic about matters of taste? He was a thoroughgoing sceptic about fundamental matters in traditional metaphysics, such as cause, causal necessitation, inductive inferences, the self, even external objects. Yet, without exception, Hume’s aesthetics is read as abruptly reversing his sceptical position and promoting a timeless and objective standard for judging beauty. I reject the dominant approach for displacing the gains of his scepticism. To impute to Hume knowledge of a standard that depends essentially on a relation (...) to certain persons makes him sound more like an idealist than an empiricist philosopher with naturalistic leanings. Instead, I read his aesthetic naturalism against the background of his sceptical commitments, by reconstructing his dilemma of taste along the lines of his general scepticism about cause. I argue that he deduces ‘that’ an unknown standard is operative, but in a qualified sense not ruled out by his scepticism. (shrink)

The history of science is no exception. Indeed, criticism at this juncture should be all the more welcomed since the subjcct has now won its place in the curriculum of Anglo-Saxon educational institutions, particularly in the United States where Ph.D. (...) program offerings are multiplying almost faster than students. 1 The pioneering days of the 1930's and 1940's are past--if not totally forgotten--and men of the "second generation" like myself who received their training in the 1950's will gain much from having their methodological presuppositions questioned. Curiously enough, there has been little discussion of this kind in print for the last decade, with the exception of articles published in Poland and Russia, where the discipline is passing through its own pioneering crisis.2 In the West, the older debates stirred up largely by British Marxists are nowadays generally disregarded and have had surprisingly little productive effect upon the field. Within the last few years, the most effective methodological discussions have stemmed from Karl Popper and his generally brilliant lot of disciples. Dr. Joseph Ag~ssi, now Associate Professor of Philosophy at the University of Illinois and a member of this group, recently wrote a deliberately provocative essay entitled "Towards an historiography of science." a Agassi begins it with the arresting statement that the study of the history of science is "in a lamentable state" and ends with the implicit suggestion that an examination of the historiography of science is one of the most revealing ways to discover the discipline's failings. For Agassi, it is clear that the root of the historian's problems has been a false set of philosophical premises about the nature of science, and of its history as well. He finds that the discipline has suffered from two diseases named "inductive philosophy " and "conventionalist philosophy," for which there is a major new panacea, Popper's "critical philosophy of science." This refreshingly straightforward argument provides the essay with a ready-made structure, at the same time as it infuses it throughout with a polemical tone. Because of this tone and because of the importance of Agassi's message, he deserves to be answered. On one subject, I cannot agree more with Agassi--the need for a critical examination of the hisComell, Harvard, and the University of Wisconsin have a long-standing tradition of graduate study in the history of science. In the last few years, they have been joined by: the Case IImtitute of Technology; Indiana; Johns Hopkins; M.I.T.; Princeton ; the Universities of California (Berkeley and U.C.L.A.), Kansas, Oklahoma, Pennsylvania, and Washington; and Yale. On the other hand, his interpretation of the way history of science has and is being written seems more like a misinformed caricature than a sincere effort to understand the past in all its complexity. But let us first examine his discussion of "inductivism," "conventionalism," and "Popperianism." Inductivists or Baconians---he uses the terms interchangeably--write history the way they insist science itself has developed. Just as they assume scientific theories to have emerged from the collection of evidence, they expect that the piling up of historical facts strung along a time-axis adds up to history. As Agassi sagely observes, historians of science, like other induetivists, delude themselves into the belief that such an approach guards them from subjectivity and prejudice. Neonatal brain monitoring in the neonatal intensive care units (NICU) requires a continuous review of the spontaneous cortical activity, i.e., the electroencephalograph (EEG) background activity. This needs development of bedside methods for an automated assessment of the EEG background activity. In this paper, we present development of the key components of a neonatal EEG background classifier, starting from the visual background scoring to classifier design, and finally to possible bedside visualization of the classifier results. A dataset with 13,200 5-minute EEG (...) epochs (8–16 channels) from 27 infants with birth asphyxia was used for classifier training after scoring by two independent experts. We tested three classifier designs based on 98 computational features, and their performance was assessed with respect to scoring system, pre- and post-processing of labels and outputs, choice of channels, and visualization in monitor displays. The optimal solution achieved an overall classification accuracy of 97% with a range across subjects of 81–100%. We identified a set of 23 features that make the classifier highly robust to the choice of channels and missing data due to artefact rejection. Our results showed that an automated bedside classifier of EEG background is achievable, and we publish the full classifier algorithm to allow further clinical replication and validation studies. Hans Hahn, mathematician, philosopher and co-founder of the Vienna Circle, attempted to reconcile the validity and applicability of both logic and mathematics with a strict empiricism. This article begins with a review of this attempt, focusing on his view of the relation of language to logic and his answer to the question of why we need logic. I then turn to some recent work by Stephen Yablo in an attempt to show that Yablo's fictionalism, and in particular his use (...) of metaphor, can shed light on Hahn's philosophy of logic. (shrink)

I show that de Finetti’s coherence theorem is equivalent to the Hahn-Banach theorem and discuss some consequences of this result. First, the result unites two aspects of de Finetti’s thought in a nice way: a corollary of the result is that the coherence theorem implies the existence of a fair countable lottery, which de Finetti appealed to in his arguments against countable additivity. Another corollary of the result is the existence of sets that are not Lebesgue measurable. I offer (...) a subjectivist interpretation of this corollary that is concordant with de Finetti’s views. I conclude by pointing out that my result shows that there is a sense in which de Finetti’s theory of subjective probability is necessarily nonconstructive. This raises questions about whether the coherence theorem can underwrite a legitimate theory of rational belief. (shrink)
