The focus of this article is the question whether the notion of being in a position to know is closed under modus ponens. The question is answered negatively.

Does the real world, defined as a world of objects that exist independent of human interests, concerns, and cognitive activities, really exist? Jan Westerhoff argues that we have good reason to believe it does not. His discussion considers four main facets of the idea of the real world, ranging from the existence of a separate external and internal world, to the existence of an ontological foundation that grounds the existence of all the entities in the world, and the existence of (...) an ultimately true theory that provides a final account of all there is. As Westerhoff discusses the reasons for rejecting the postulation of an external world behind our representations, he asserts that the internal world is not as epistemically transparent as is usually assumed, and that there are good reasons for adopting an anti-foundational account of ontological dependence. Drawing on conclusions from the ancient Indian philosophical system of Madhyamaka Buddhism, Westerhoff defends his stance in a purely Western philosophical framework, and affirms that ontology, and philosophy more generally, need not be conceived as providing an ultimately true theory of the world. This article aims to present a detailed analysis of the “Christian natural philosophy” elaborated by the German humanist philosopher and theologian Otto Casmann (1562–1607) in his various works. To this end, Casmann’s general idea of philosophia Christiana is discussed and critically evaluated. Regarding natural philosophy, or physics, attention is paid mainly to topics such as cosmogony and cosmology, which Casmann promised to have developed biblically and independently of the pagan (namely Aristotelian) tradition. However, when Casmann’s natural philosophy is analyzed in (...) detail, his resolute emphasis on the literal reading of the Bible, the cornerstone of his entire concept, turns out to be problematic. The Indian philosopher Acarya Nagarjuna (c. 150-250 CE) was the founder of the Madhyamaka (Middle Path) school of Mahayana Buddhism and arguably the most influential Buddhist thinker after Buddha himself. Indeed, in the Tibetan and East Asian traditions, Nagarjuna is often referred to as the "second Buddha." This book presents a survey of the whole of Nagarjuna's philosophy based on his key philosophical writings. His primary contribution to Buddhist thought lies in the further development of the concept of sunyata or (...) "emptiness." For Nagarjuna, all phenomena are without any svabhava, literally "own-nature" or "self-nature," and thus without any underlying substance. Particular emphasis is put on discussing Nagarjuna's thinking as philosophy. The present discussion shows how his thoughts on metaphysics, epistemology, the self, language, and truth present a unified theory of reality with considerable systematic appeal. The book offers a systematic account of Nagarjuna's philosophical position. It reads Nagarjuna in his own philosophical context, but also shows that the issues of Indian and Tibetan Buddhist philosophy have at least family resemblances to issues in European philosophy. This paper analyses recent calls for so called “neurorights”, suggested novel human rights whose adoption is allegedly required because of advances in neuroscience, exemplified by a proposal of the Neurorights Initiative. Advances in neuroscience and technology are indeed impressive and pose a range of challenges for the law, and some novel applications give grounds for human rights concerns. But whether addressing these concerns requires adopting novel human rights, and whether the proposed neurorights are suitable candidates, are a different matter. This (...) paper argues that the proposed rights, as individuals and a class, should not be adopted and lobbying on their behalf should stop. The proposal tends to promote rights inflationism, is tainted by neuroexceptionalism and neuroessentialism, and lacks grounding in relevant scholarship. None of the proposed individual rights passes quality criteria debated in the field. While understandable from a moral perspective, the proposal is fundamentally flawed from a legal perspective. Rather than conjuring up novel human rights, existing rights should be further developed in face of changing societal circumstances and technological possibilities. (shrink)

With the emergence of Olympic internationalism, scholarly networking in East Central Europe came to be dominated by the idea of scholars representing their nations, which replaced the previously leading pattern of private elite scholars with extensive international contacts. This also formalised trans-border contacts, which became increasingly seen as international. In this article, we trace the relationship between these formal and informal networks from the late 19th century to the end of the socialist period, showing that even as formalisation grew, it (...) depended heavily on a variety of informal connections. Even during the period of socialism, when the state sought to control international exchange, scholars used informality to circumvent politically determined constraints. Nevertheless, these informal contacts were not outside the system, but were an integral part of it and depended on formal preconditions. Concentrating on Czechoslovak-Polish relations we argue that in addressing the issue of the relationship between the formal and the informal, a combination of sources must be used, which should then be scrutinised for the stories their authors wish to tell. While archival sources are used for the formal part, oral histories or memoirs reveal the informal part. In East Central Europe, formal sources are likely to ignore informality, especially when it was associated with illegality, whereas ego-documents, especially those produced after 1989, are likely to ignore or downplay connections to the state and overemphasise informality as a means of acting outside politics. Thus, writing the history of informality in socialist scholarship, not only in terms of international contacts but also in terms of everyday practices, is a way of developing counter-narratives to the state-centeredness of current research, which must be linked to a critical study of the contemporary memory of socialist scholarship that shapes the narratives told in oral history. International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts to discussion twenty-five (...) considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

Strategic ignorance is a widespread phenomenon. In a laboratory setting, many participants avoid learning information about the consequences of their behaviour in order to act egoistically. In real life, many consumers avoid information about their purchases or the working conditions in which they were produced in order to retain their lifestyle. The question is whether agents are blameworthy for such strategically ignorant behaviour. In this paper, I explore quality of will resources, according to which agents are blameworthy, roughly, depending on (...) their moral concern. The account I will propose—the Maximal Account—has three innovative features: it utilizes a suitable concept of maximal moral concern, it offers an accountability version of the account which significantly differs from the more familiar attributability variant, and it maintains that agents without maximal concern are blameworthy. Why act when the effects of one’s act are negligible? For example, why boycott sweatshop or animal products if doing so makes no difference for the better? According to recent proposals, one may still have a reason to boycott in order to avoid complicity or participation in harm. Julia Nefsky has argued that accounts of this kind suffer from the so-called “superfluity problem,” basically the question of why agents can be said to participate in harm if they make no difference (...) to it. There is unanimous agreement that Nāgārjuna (ca 150–250 AD) is the most important Buddhist philosopher after the historical Buddha himself and one of the most original and influential thinkers in the history of Indian philosophy. His philosophy of the “middle way” (madhyamaka) based around the central notion of “emptiness” (śūnyatā) influenced the Indian philosophical debate for a thousand years after his death; with the spread of Buddhism to Tibet, China, Japan and other Asian countries the writings of Nāgārjuna became an (...) indispensable point of reference for their own philosophical inquiries. A specific reading of Nāgārjuna's thought, called Prāsaṅgika-Madhyamaka, became the official philosophical position of Tibetan Buddhism which regards it as the pinnacle of philosophical sophistication up to the present day. Is knowledge-how, or “practical” knowledge, a species of knowledge-that, or “theoretical” knowledge? There is no comfortable position to take in the debate around this question. On the one hand, there are counterexamples against the anti-intellectualist thesis that practical knowledge is best analysed as an ability. They show that having an ability to ϕ is not necessary for knowing how to ϕ. On the other hand, the intellectualist analysis of practical knowledge as a subspecies of theoretical knowledge is threatened by its (...) own set of counterexamples, which convincingly establish that practical knowledge lacks many of the typical characteristics of theoretical knowledge. Most strikingly it does not even appear to require a belief. In this paper, I develop an account of practical knowledge that avoids these counterexamples. It also manages to preserve both the status of such knowledge as a cognitive achievement and its apparently close conceptual relation to abilities. I start with the counterexamples against the necessity of abilities for practical knowledge and show that they fail because they underestimate the cognitive demands of attempts. I then make use of the logic of dispositions to bridge the gap that counterexamples against the necessity of abilities for practical knowledge open. It is argued that, instead of the ability to ϕ, it is a specific disposition to have the ability to ϕ that constitutes practical knowledge about ϕ. The resulting theory is an anti-intellectualist position that preserves essential intellectualist motivations and thus should be satisfactory for proponents of both views. (shrink)

BackgroundSexual boundary violations in healthcare are harmful and exploitative sexual transgressions in the professional–client relationship. Persons with mental health issues or intellectual disabilities, especially those living in residential settings, are especially vulnerable to SBV because they often receive long-term intimate care. Promoting good sexual health and preventing SBV in these care contexts is a moral and practical challenge for healthcare organizations.MethodsWe carried out a qualitative interview study with 16 Dutch policy advisors, regulators, healthcare professionals and other relevant experts to explore (...) their perspectives on preventing SBV in mental health and disability care organizations. We used inductive thematic analysis to interpret our data.ResultsWe found three main themes on how healthcare organizations can prevent SBV in mental health and disability care: setting rules and regulations, engaging in dialogue about sexuality, and addressing systemic and organizational dimensions.ConclusionOur findings suggest that preventing SBV in mental health and disability care organizations necessitates setting suitable rules and regulations and facilitating dialogue about positive aspects of sexuality and intimacy, as well as about boundaries, and inappropriate behaviors or feelings. Combining both further requires organizational policies and practices that promote transparency and reflection, and focus on creating a safe environment. Our findings will help prevent SBV and promote sexual health in mental health and disability care organizations. (shrink)

This introduction provides an overview of the current state of the debate on the epistemic condition of moral responsibility. In sect. 1, we discuss the main concepts ‘ignorance’ and ‘responsibility’. In sect. 2, we ask why agents should inform themselves. In sect. 3, we describe what we take to be the core agreement among main participants in the debate. In sect. 4, we explain how this agreement invites a regress argument with a revisionist implication. In sect. 5, we provide an (...) overview of the main responses to the regress argument. In sect. 6, we address the question why blameless ignorance excuses. In sect. 7, we describe further issues that are addressed in the book. This paper explores and ultimately affirms the surprising claim that artificial intelligence (AI) can become part of the person, in a robust sense, and examines three ethical and legal implications. The argument is based on a rich, legally inspired conception of persons as free and independent rightholders and objects of heightened protection, but it is construed so broadly that it should also apply to mainstream philosophical conceptions of personhood. The claim is exemplified by a specific technology, devices that connect human (...) brains with computers and operate by AI-algorithms. Under philosophically reasonable and empirically realistic conditions, these devices and the AI running them become parts of the person, in the same way as arms, hearts, or mental capacities are. This transformation shall be called empersonification. It has normative and especially legal consequences because people have broader and stronger duties regarding other persons (and parts of them) than regarding things. Three consequences with practical implications are: (i) AI-devices cease to exist as independent legal entities and come to enjoy the special legal protection of persons; (ii) therefore, third parties such as manufacturers or authors of software lose (intellectual) property rights in device and software; (iii) persons become responsible for the outputs of the empersonified AI-devices to the same degree that they are for desires or intentions arising from the depths of their unconscious. More generally, empersonification marks a new step in the long history of human–machine interaction that deserves critical ethical reflection and calls for a stronger value-aligned development of these technologies. Group judgements are often – implicitly or explicitly – influenced by their members’ individual expertise. However, given that expertise is seldom recognized fully and that some distortions may occur (bias, correlation, etc.), it is not clear that differential weighting is an epistemically advantageous strategy with respect to straight averaging. Our paper characterizes a wide set of conditions under which differential weighting outperforms straight averaging and embeds the results into the multidisciplinary group decision-making literature.

Freedom of thought is a fundamental human right, enshrined in many human rights treaties. It might very well be the only human right without any practical application. The paper reconstructs scope and meaning of this forgotten right and proposes four principles for its interpretation. In the age of neuroscientific insights and interventions into mind and brain that afford to alter thoughts, the time for the law to define freedom of thought in a way that lives up to its theoretical significance (...) has come. The aim of this paper is twofold: The general aim is to shed light on the structure of species discoveries new to biology by bringing together a practice-oriented philosophy of science perspective with a philosophy of language perspective. The more specific aim is to argue that and to show how the overall structure of biological species discoveries comprises aspects of both institutional and non-institutional reality. The author proceeds as follows: he shows that placing the focus on the topic of scientific (...) discoveries enables us to circumvent two long-standing problems. He analyzes three fictional cases of discoveries in order to bring about a greater sensitivity for the concept of discovery. He takes a closer look at a real example – the discovery of a deep-sea anglerfish – and identifies the main structural features of species discovery processes in biology. In order to connect these results with Searle’s account of institutional reality, he provides an overview of the conceptual apparatus needed here. In bringing Searle’s account together with the structural features of species discoveries developed before, he shows to what extent declarative speech acts play a central role in species discovery processes in biology. The aim of this paper is to present a systematic reconstruction of the development of the pansophic idea in the work of Jan Amos Comenius. The concept of pansophia, rooted already in the ancient philosophical thinking, became a very popular topic of sixteenth- and seventeenth-century discussions, and it is one of the central topics of Comenius’s philosophy. It is assumed that Comenius elaborated the formulation of the pansophic program—i.e., the program for creating a universal science incorporating the findings of both (...) the profane and the divine—at the end of 1630s. This study therefore aims to analyse all relevant Comenius’s treatises and attempts to identify the individual development phases of Comenius’s pansophic idea until its transformation into the idea of the universal reform, panorthosia. The analysis of Comenius’s treatises is complemented with a reflection on Comenius’s correspondence, which facilitates the understanding of the author’s more private motives. (shrink)

Our aim in this study is to examine the attitude to violence expressed in the works of two leading figures in the history of Czech philosophical thought. Several scholars in the field of Comeniology have expressed the belief that not only clear parallels but also direct continuity can be traced between the views of Petr Chelčický and those of Jan Amos Comenius. To make a proper judgement as to whether Comenius and Chelčický shared identical attitudes to the question of the (...) legitimacy of violence, we focus first on Comenius’s climactic work, in which his point of view is most fully expressed. Subsequently we analyse Chelčický’s views and compare them with Comenius’s attitude. A comparison of the works of the two thinkers leads to the conclusion that on the one hand Comenius’s key opinions are much more comprehensively founded; on the other, he does not restrict himself to a critique of physical violence but also deals with the spiritual struggle. Any analogy between Chelčický and Comenius’s attitude to violence can therefore be related only to the early works of Comenius in which his concept of universal tolerance was not yet thoroughly thought through. The study therefore focuses on the issue of the development of Comenius’s concept of tolerance as well. (shrink)

From the ‘DuPont factory’ case in China, one can see that contemporary ecology is faced with two underlying problems: A lack of responsibility toward the environment beyond being economically profitable, and a lack of care for what is outside of one’s immediate environment. For the purpose of confronting these two problems, I suggest two Confucian concepts: 1. zhengming 正名 and 2. datong 大同 . These two concepts can be used to develop an environmental ethics and thus play a crucial role (...) in solving the two above-mentioned problems. Zhengming is originally a political concept that was put forward by Confucius. According to this concept, everyone should fulfill their duty to the utmost in accordance with their individual roles. Datong is Confucius’ political ideal and emphasizes gong 公 as a spirit for caring for tian xia 天下 .
