In this Article, Professor Suk defends the moral legitimacy of liberal states’ legal protection of minority languages. Many opponents of minority language protection have argued or assumed that legal intervention denies individuals the right to choose the majority language and the economic opportunities often attached to the dominant language. This Article argues that such arguments overlook another category of goods that are necessary to individual autonomy: relational resources. Individuals have an interest in maintaining their ancestral languages because doing so is (...) essential to maintaining one’s relationship to one’s family and community. The relational interest cannot easily be compared with economic opportunities, because these two dimensions of autonomy are incommensurable. As a result, a liberal state should avoid forcing its citizens to choose between these incommensurable goods. By adopting policies that protect minority languages, while also ensuring individuals’ access to economic and political participation in the majority language, a liberal state can manage and balance the conflict between these important competing aspects of autonomy. Most of the world’s constitutions contain clauses guaranteeing sex equality, and many also extend the special protection of the state to mothers. The constitutional protection of motherhood is undertheorized and neglected in global constitutional discourse, perhaps because jurisdictions like the United States view the special protection of women as contrary to gender equality. This Essay explores the feminist meanings and possibilities of constitutional motherhood clauses, by focusing on Germany, where they originated in 1919. While motherhood clauses have had complex relationships (...) with a range of feminist agendas, they solidified the notion that social reproduction was a subject for constitutional lawmaking. Addressing twenty-first century gender inequalities requires a more robust engagement of women’s disproportionate burdens in social reproduction. Having opened up a constitutional discourse around the challenges of social reproduction, motherhood clauses and gender equality guarantees can drive the search for new solutions. (shrink)

ObjectivesHostile attribution bias is reportedly common from non-clinical population to those with serious mental illness, such as schizophrenia, and is known to be closely related to theory of mind. This study aimed to investigate whether ToM skills mediate the relationship among neurocognitive ability, personality traits, and attribution bias.MethodsA total of 198 non-clinical youths were recruited. To assess their neurocognitive ability and ToM skills, the participants were asked to complete Raven’s Standard Progressive Matrices and the Korean version of the Reading the (...) Mind in Eyes Test. To determine their personality traits, the Eysenck Personality Questionnaire and interpersonal reactivity index were used. To evaluate hostile attribution bias, the Ambiguous Intentions Hostility Questionnaire was administered. Path analysis and bias-corrected percentile bootstrap methods were used to estimate model fit and the parameters of the mediating effects.ResultsBased on model comparison, the best model characterized two direct pathways from psychoticism and the K-RMET to hostility attribution bias and three indirect pathways, wherein SPM, perspective taking, and psychoticism influenced hostile attribution bias through K-RMET. The final model fit indices were good [x2/df = 1.126; comparative fit index = 0.996; root mean square error of approximation = 0.026; standard root mean square residual = 0.026 and Akaike information criterion = 28.251] and the K-RMET fully mediated the association between SPM, perspective taking, psychoticism, and hostile attribution bias.ConclusionThe main findings suggested that ToM skills, such as the RMET, play an important role in explaining the relationship among neurocognitive ability, personality traits, and hostile attribution bias. ToM skills and a remediation strategy may need to be developed to balance the enhanced hostility bias that underlies the paranoia. (shrink)

This volume is based on the talks given at the Workshop on Infinity and Truth held at the Institute for Mathematical Sciences, National University of Singapore, from 25 to 29 July 2011. The chapters are by leading experts in mathematical and philosophical logic that examine various aspects of the foundations of mathematics. The theme of the volume focuses on two basic foundational questions: (i) What is the nature of mathematical truth and how does one resolve questions that are formally unsolvable (...) within the Zermelo Fraenkel Set Theory with the Axiom of Choice, and (ii) Do the discoveries in mathematics provide evidence favoring one philosophical view over others? These issues are discussed from the vantage point of recent progresses in foundational studies. The final chapter features questions proposed by the participants of the Workshop that will drive foundational research. Labour issues in global supply chains have been a thorny problem for both buyer firms and their suppliers. Research initially focused mostly on the bilateral relationship between buyer firms and suppliers, looking at arm’s-length and close collaboration modes, and the associated mechanisms of coercion and cooperation. Yet continuing problems in the global supply chain suggest that neither governance type offers a comprehensive solution to the problem. This study investigates collaborative governance, an alternative governance type that is driven by buyer firms (...) setting up a coalition with competitor firms to increase leverage and address the supplier and/or host country-specific labour issues. Based on interviews with managers involved in the establishment and management of such coalitions and supplier firms in the garment industry, we examine the rationale behind collaborative governance and discuss its opportunities and challenges in addressing labour issues in global supply chains. This article uses the example of public sector outsourcing to explore how elite power can be fallible. A contract between the state and private companies represents a complex interweaving of different kinds of power with uncertain outcomes: the experience of outsourcing in the UK and elsewhere is that it frequently goes wrong, with fiascos creating political embarrassment for states and financial problems for companies. Drawing on Deleuze and Guattari, the article explores how the contract is a political device that can (...) be both tool and weapon but which has uncertain outcomes. In doing so, it makes a distinctive contribution by arguing that elite work is often about repair and managing the political or financial consequences of failure. (shrink)

The problem of theorizing privacy moves on two levels, the first consisting of an inadequate conceptual vocabulary and the second consisting of an inadequate institutional grammar. Privacy rights are supposed to protect individual subjects, and so conventional ways of understanding privacy are subject-centered, but subject-centered approaches to theorizing privacy also wrestle with deeply embedded contradictions. And privacy’s most enduring institutional failure modes flow from its insistence on placing the individual and individualized control at the center. Strategies for rescuing privacy from (...) irrelevance involve inverting both established ways of talking about privacy rights and established conventions for designing institutions to protect them. In terms of theory, turning privacy inside out entails focusing on the conditions that are needed to produce sufficiently private and privacy-valuing subjects. Some interesting exceptions notwithstanding, the traditional logic of economic efficiency has long favored hierarchical forms of organization and disfavored democracy in business. What does the balance of arguments look like, however, when values besides efficient revenue production are brought into the picture? The question is not hypothetical: In recent years, an ever increasing number of corporations have developed and adopted socially responsible behaviors, thereby hybridizing aspects of corporate businesses and social organizations. We argue that the joint pursuit of financial and (...) social objectives warrants significant rethinking of organizational democracy’s merits compared both to hierarchy and to non-democratic alternatives to hierarchy. In making this argument, we draw on an extensive literature review to document the relative lack of substantive discussion of organizational democracy since 1960. And we draw lessons from political theory, suggesting that the success of political democracy in integrating diverse values offers some grounds for asserting parallel virtues in the business case. In a series of powerful and challenging articles emerging since the mid-1990s, Brian Leiter has argued that certain theoretical strains in contemporary legal philosophy are ‘epistemologically bankrupt’, in virtue of their reliance on misguided argumentative devices: analysing concepts, such as the concepts of law and of authority; and doing so by appealing to intuitions regarding the correct way to understand the concepts in question. In response to this state of affairs, Leiter advocates that jurisprudence ought to attempt to catch-up with (...) ‘naturalistic’ developments which have influenced the direction of other branches of philosophy – such as epistemology, philosophy of mind, and moral philosophy – in the last few decades. This article offers a critical analysis of some of Leiter’s proposals for what Jurisprudence should become, in light of his views on the relevance of naturalism for this discipline. (shrink)

Within the political economy of informational capitalism, commercial surveillance practices are tools for resource extraction. That process requires an enabling legal construct, which this essay identifies and explores. Contemporary practices of personal information processing constitute a new type of public domain—a repository of raw materials that are there for the taking and that are framed as inputs to particular types of productive activity. As a legal construct, the biopolitical public domain shapes practices of appropriation and use of personal information in (...) two complementary and interrelated ways. First, it constitutes personal information as available and potentially valuable: as a pool of materials that may be freely appropriated as inputs to economic production. That framing supports the reorganization of sociotechnical activity in ways directed toward extraction and appropriation. Second, the biopolitical public domain constitutes the personal information harvested within networked information environments as raw. That framing creates the backdrop for culturally situated techniques of knowledge production and for the logic that designates those techniques as sites of legal privilege. (shrink)

Three experiments test the theory that verb meanings are more malleable than noun meanings in different semantic contexts, making a previously seen verb difficult to remember when it appears in a new semantic context. Experiment 1 revealed that changing the direct object noun in a transitive sentence reduced recognition of a previously seen verb, whereas changing the verb had little impact on noun recognition. Experiment 2 revealed that verbs exhibited context effects more similar to those shown by superordinate nouns rather (...) than basic-level nouns. Experiment 3 demonstrated that the degree of meaning change in a target word resulting from changes in semantic context influenced the magnitude of context effects, but context effects remained larger for verbs than for nouns even when the degree of meaning change was similar for nouns and verbs. These results are discussed with respect to the imageability and grammatical roles played by nouns and verbs in a sentence. (shrink)

I identify issues of philosophical concern in Eldred v. Ashcroft, the U.S. Supreme Court’s decision on copyright extension, and encourage the participation of philosophers in these public policy debates. Philosophers have contributions to make to the dialogue not captured exclusively by the technical and often narrow legal debate in the courts.

This paper is the first of two in a series. In this paper, we identify mental health needs and challenges in the age of COVID-19 among Nepali-speaking, Bhutanese resettled refugees in the USA. We argue for a public health justice framework that looks critically at social determinants impacting mental health (SDIMH) barriers, which negatively impact our Bhutanese population, and serves as a theoretical foundation toward public policy and law that will inform healthcare decisions and fair treatment of resettled refugees at (...) the clinical bedside and in the community. We first describe our Bhutanese refugee population and the critical mental health issues that, for many, originated during political persecution and violent ethnic cleansing initiatives, or while living in refugee camps prior to resettlement to the USA. We present a social justice framework emerging from an extensive literature review and incorporating core social determinants specific to mental health in the age of COVID-19, which are guided by the social determinants of economic stability; neighborhoods and physical environment; education; nutrition and exercise; community and social context; healthcare system; and legal system. We illustrate specific SDIMH of our resettled Bhutanese refugees during the pandemic, followed by a second paper that details recommendations for applying the SDIMH in a collective effort to address specific barriers to mental healthcare and support. Beyond the cultural gaps between researcher and subject, the Latin American people have their own perspectives about responsible conduct of research formed by sociopolitical thought and familial and community identity, which may be overlooked or ignored by the U.S. and other foreign nations. Just as the Havasupai Tribe in Arizona have challenged us to think about the role of culture and the need for improved regulations and practices in conducting research within the United States, through past abuses in human experimentation and the emergence of discourse between our Latin American neighbors, similar challenges confront us. Historically the terms “final,” “unconditional,” and “intrinsic” have played a foundational role in ethical theory. I argue that final/instrumental distinction is best understood in terms of the for-sake-of relation and involves a tri-part division of goods. I show that this first way of categorizing goods is more closely aligned with a second way of categorizing goods in terms of intrinsic/extrinsic goods than has thus far been acknowledged. Lastly, I distinguish yet a third way of categorizing goods: unconditional/conditional goods. While the (...) final/instrumental and intrinsic/extrinsic distinctions have received the lion’s share of philosophical attention, the unconditional/conditional distinction is no less important. Both Russell and Donnellan proposed direct, non-descriptive cognitive relations between thinkers and objects. They agreed that such relations couldn’t be initiated in evidence cases, but Donnellan, unlike Russell, thought direct cognitive relations could be transmitted from person to person. Kaplan (2012) suggests the issues of initiation and transmission are separable—allowing one to deny that evidence yields direct cognition while believing direct cognition is transmittable. Here, cases involving transmission, evidence, ordinary perception, and perception aided by technology are considered. It is concluded (...) that the same mechanism is at work in each case, and that the initiation issue cannot be separated from the transmission issue since transmission cases are evidence cases. This Article examines the regulatory state through the lens of evolving political economy, arguing that a significant reconstruction is now underway. The ongoing shift from an industrial mode of development to an informational one has created existential challenges for regulatory models and constructs developed in the context of the industrial economy. Contemporary contests over the substance of regulatory mandates and the shape of regulatory institutions are most usefully understood as moves within a larger struggle to chart a new direction for (...) the regulatory state in the era of informational capitalism. A regulatory state optimized for the information economy must develop rubrics for responding to three problems that have confounded existing regulatory regimes: platform power — the power to link facially separate markets and/or to constrain participation in markets by using technical protocols; infoglut — unmanageably voluminous, mediated information flows that create information overload; and systemic threat — nascent, probabilistically-defined harm to be realized at some point in the future. Additionally, it must develop institutions capable of exercising effective oversight of informationera activities. The information-era regulatory models that have begun to emerge are procedurally informal, mediated by networks of professional and technical expertise that define relevant standards, and financialized. Such models, however, also have tended to be both opaque to external observation and highly prone to capture. New institutional forms that might ensure their legal and political accountability have been slow to develop. (shrink)

This paper is the second of two in a series. In our first paper, we presented a social justice framework emerging from an extensive literature review and incorporating core social determinants specific to mental health in the age of COVID-19 and illustrated specific social determinants impacting mental health (SDIMH) of our resettled Bhutanese refugee population during the pandemic. This second paper details specific barriers to the SDIMH detrimental to the basic human rights and social justice of this population during this (...) pandemic. The SDIMH, as described, further informs the need for social justice measures and cultural humility in mental healthcare, public health, law, and community engagement. This work concludes with a proposed call to action toward mental health improvement and fair treatment for refugee populations in three core areas: communication and education, social stigma and discrimination, and accessibility and availability of resources. This volume consists of twelve essays, mostly newly published, on a variety of topics in Aristotelian scholarship ranging from the theoretical to the practical and productive parts of the corpus. The volume divides the papers into one group addressing topics in Aristotle's metaphysics, physics, epistemology, biology, and logic on one hand, and his ethics, politics, poetics, and rhetoric on the other. The contributors include established scholars in ancient philosophy, such as Cynthia Freeland, Deborah Modrak, Martha Nussbaum, and Charlotte Witt, and (...) younger scholars such as Angela Curran, as well as those in disciplines outside ancient philosophy, including literature, law, and political science. The latter group of essays includes a chapter by Luce Irigaray on Book IV of Aristotle's Physics from her work, An Ethics of Sexual Difference (1993), Freeland's interpretation of Irigaray's essay, as well as papers on Aristotelian political emotion, the historiography of Aristotle's rhetoric, and his political anthropology from Texas Law Review (1992). The very range of methodological perspective that lends breadth to the volume presents difficulties for an overview, in light of which four papers were selected for detailed comment, those on Aristotle's logic, Freeland's essay on Irigaray's reading of Physics IV, Aristotelian virtue ethics, and Aristotelian political emotion. In recent years, scholars of Jewish politics have invested political hopes in the revival of “political imagination.” If only we could recapture some of the imaginativeness that early Zionists displayed when wrestling with questions of regime design, it is argued, we might be able to advance more compelling “solutions” to the Israeli-Palestinian conflict. Yet how does one cultivate political imagination? Curiously, scholars who rehearse the catalogue of regimes that Jews have historically entertained seldom pose this question. In this Article, I (...) revisit a historical episode—the appropriation of diasporic historical narratives by Zionists in mandatory Palestine—in an effort to cultivate a richer political imaginary. I analyze the labor Zionist deployment of Simon Dubnow’s influential master narrative, focusing on a 1926 speech in which David Ben Gurion depicts the autonomist regime that he advocates as a variation upon diasporic political practices. On my reading, this episode illustrates the dilemmas that confront thinkers who invest political hopes in regime design. To realize the promise that new political configurations may emerge from reflections upon Jewish history, I argue, we must develop a new account of political agency, once foundational assumptions of the nation-state have been suspended. So absolute and necessary appear its fictions that continuity and tradition are always in the foreground, while change recedes to the distant horizon. It is this quality of timeless truth that characterizes the “myth of Venice”: Venice remains perfect and unchanged while other governments rise and fall. It remains unchanged because of two things: the “perfect” system of government, combining the best features of monarchy, oligarchy, and democracy; and the (...) reliance on impartial justice, the key to preserving harmony between conflicting groups. Élevée au pinacle, installée au panthéon des Français, elle devient un sujet en or pour les compositeurs et leurs librettistes, parce qu’elle permet d’aborder les thèmes les plus divers, de l’héroïque au religieux en passant par le pastoral et le tragique. Elle fait l’objet de nombreuses mises en scène dans des genres musicaux aussi variés que l’opéra, l’opéra-comique, le ballet, la mélodie, la pantomime ou le théâtre (...) en musique. La question centrale qui se pose pour chaque compositeur est la suivante : comment représenter Jeanne d’Arc, cette « figure sublime »? Comment donner voix à une héroïne que l’on a vue sous tous les jours, tour à tour grandiloquente, simple et pieuse, puis égérie nationale avant de devenir sainte en 1920? Au travers d’une étude sur la voix donnée à Jeanne, dans deux œuvres majeures du répertoire qui lui a été consacré, Giovanna d’Arco de Verdi, créée à la Scala de Milan en 1845, et Jeanne d’Arc au Bûcher de Paul Claudel et Arthur Honegger, créée à Bâle en 1938, nous essaierons de déceler l’esprit d’une époque, et par là de mieux distinguer quelques-unes des facettes données à la Pucelle d’Orléans. Historically, recordkeeping has been an essential task for health professionals. Today, this mandatory task increasingly takes place as digital documentation. This study critically examines problem constructions in practical documents on digital documentation strategies in Danish municipal healthcare and how these problem constructions imply particular solutions. A document analysis based on the approach presented in Bacchi's “What's the problem represented to be?” was applied. Forty practical documents in the form of guidelines, strategies, and quality control documents were included. The analysis uncovered (...) three problem representations: lack of coherence between health services in a complex healthcare system, lack of assessable data for management and political prioritization, and inefficiency in the healthcare system. The proposed solution is a digitalized and standardized practice that transforms recordkeeping in the municipalities. However, municipal healthcare is at risk of being fragmented due to digital documentation's focus on the organizational management of health with task‐oriented practices supplied by an anonymous health professional. We find that digital documentation functions as an organizational micromanagement approach that assigns the health professional a subject position as an employee acting according to the organization's framework rather than the profession's normative framework. The population of older adults worldwide is growing, with an urgent need for approaches that develop and maintain intrinsic capacity consistent with healthy aging. Theory and empirical research converge on feeling safe as central to healthy aging. However, there has been limited attention to resources that cultivate feeling safe to support healthy aging. Nostalgia, “a sentimental longing for one’s past,” is established as a source of comfort in response to social threat, existential threat, and self-threat. Drawing from extant theory and (...) research, we build on these findings to position nostalgia as a regulatory resource that cultivates feeling safe and contributes to intrinsic capacity to support healthy aging. Using a narrative review method, we: characterize feeling safe as a distinct affective dimension, summarize the character of nostalgia in alignment with feeling safe, propose a theoretical account of the mechanisms through which nostalgia cultivates feeling safe, highlight the contribution of nostalgia to feeling safe and emotional, physiological, and behavioral regulatory capabilities in healthy aging, and offer conclusions and direction for research.
