We examined the dilemmas posed by the involvement of expert witnesses in court cases and the institutional constraints on the ethics of expert testimony. The causes for the incorporation of bad science into legal decisions, potential solutions to this dilemma, and the limitations of these solutions are considered. We concluded that law, science, and experts must respond to the problems posed by expert witnessing.

An original study of the philosophical problems associated with inductive reasoning. Like most of the main questions in epistemology, the classical problem of induction arises from doubts about a mode of inference used to justify some of our most familiar and pervasive beliefs. The experience of each individual is limited and fragmentary, yet the scope of our beliefs is much wider; and it is the relation between belief and experience, in particular the belief that the future will in some respects (...) resemble the past and the unobserved the observed, which forms the subject of this book. Dr Blackburn's first aim is to state the problem of induction properly, to show that there does exist a genuine problem immune to the solutions in vogue at present, yet no tin principle insoluble. He gives an extended and original account of the concept of a reason and goes on to discuss prediction. In the end Dr Blackburn produces a rationale for belief in certain short-term predictions based on his reinterpretation of the classical principle of indifference. In this article, I will discuss two prominent views on the relevance and irrelevance of ontological investigations for the social sciences, namely, ontological foundationalism and anti-ontological pragmatism. I will argue that both views are unsatisfactory. The subsequent part of the article will introduce an alternative role for ontological projects in the philosophy of the social sciences that fares better in this respect by paying attention to the ontological assumptions of actual social scientific theories, models, and related explanatory practices. In some environmental circles, talk of relational values is very much in fashion. It is said that we must think in terms of such values if we are to understand how such things as canyons, mangroves, and coral reefs matter to people. But that is bad advice. Appeals to relational values are typically misleading in several respects. Granted, those who make such appeals often do so in order to make the important point that some values are neither intrinsic nor instrumental (...) in form, but that point can be made more clearly by referring to other concepts, such as that of constitutive value. To this objection, some may respond that appeals to relational value are nonetheless useful. However, as things stand, their usefulness remains unproven. (shrink)

In this paper I discuss the shapelessnesss hypothesis, which is often referred to and relied on by certain sorts of ethical and evaluative cognitivist, and which they use primarily in arguing against a certain, influential form of noncognitivism. I aim to (i) set out exactly what the hypothesis is; (ii) show that its original and traditional use is left wanting; and (iii) show that there is some rehabilitation on offer that might have a chance of convincing neutrals.

This article presents a reading of Nietzsche’s use of rhetoric as inseparable from his philosophical project. I provide an exegesis of Nietzsche’s own reflections on rhetoric and consider its actual deployment, arguing that Nietzsche’s rhetoric is often deliberately dissonant and oriented toward facilitating receptive effects. The aim, I suggest, is to shift politics of possibility—to alter what can and cannot be done and said politically. Dissonant rhetoric, rhetoric that marries aesthetic attunement with affective turbulence, helps to accomplish this end by (...) shaping the way that rhetoric is received by audiences. I conclude by suggesting that Nietzsche’s rhetoric has implications for contemporary theory, shifting how we might view critical political engagement in the public sphere. Understood in this way, Nietzsche’s rhetoric provides a perhaps surprising model for a critically robust form of rhetoric. (shrink)

The reanalysis of genomic sequencing results has the potential to provide results that are of considerable medical and personal importance to recipients. Employing interviews with forty-seven predominantly medically underserved families and ethnographic observations we argue that there is pressing need to standardize the approach taken to reanalysis. Our findings highlight that study participants were unclear as to the likelihood of reanalysis happening, the process of initiating reanalysis, and whether they would receive revised results. Their reflections mirror the lack a specific (...) focus upon reanalysis within consent and results sessions as observed in clinical settings. Mechanisms need to be put into place that standardize the approach to reanalysis in research and in clinical contexts. This would enable clinicians and genetic counsellors to communicate clearly with research participants with respect to potential for reanalysis of results and the process of reanalysis. We argue that that the role of reanalysis is too important to be referred to in an ad-hoc manner. Furthermore, the ad-hoc nature of the current process may increase health inequities given the likelihood that only those families who have the means to press for reanalysis are likely to receive it. The proposal that there is an illusion of conscious will has been supported by findings that priming of stimulus location in a task requiring judgements of action-authorship can enhance participants’ experience of agency. We attempted to replicate findings from the ‘Wheel of Fortune’ task [Aarts, H., Custers, R., & Wegner, D. M. . On the inference of personal authorship: enhancing experienced agency by priming effect information. Consciousness and Cognition, 14, 439–458]. We also examined participants’ performance on this task in relation (...) to self-reported passivity experiences and hallucination-proneness. We found a significant effect of priming, with primes being found to increase the experience of agency. An interaction between gender and priming was also found, with priming enhancing feelings of agency in women but not in men. There were no significant correlations between levels of self-reported passivity experiences or hallucination-proneness and participants’ susceptibility to the priming effect on ratings of agency. Implications of these findings are discussed with regard to a prominent model of passivity experiences. (shrink)

This paper looks at the current wave of protests and demonstrations and asks whether what we are witnessing is the emergence of a new movement against austerity and in favour of democracy, as many suggest. The wider context is the crisis of representative politics, which is in turn transforming the nature of mobilisation, contestation and politics more generally. In place of traditional organisational structures, we are seeing the emergence of cloud, swarm and connective initiatives with characteristics that challenge and supplant (...) traditional organisational politics. We are seeing the emergence of a politics that is resistant to ‘politicians’ of whatever ideology, seeking to recuperate power and agency from representatives. This creates an interesting tension at the heart of democracy: whether and to what extent democracy needs to ‘reboot’ or whether new political parties and movements can ally the connective to representational styles of politics to provide a way in which democracy can evolve.Este artículo examina la ola de protestas y manifestaciones, preguntándonos si, como muchos sugieren, lo que estamos presenciando es el surgimiento de un nuevo movimiento contra la austeridad y a favor de la democracia. El contexto político está marcado por una generalizada crisis de la política representativa, hecho que a su vez marca la transformación de la naturaleza de la movilización, de la contestación y de la política en general. Estamos presenciando el surgimiento de iniciativas con características cloud, swarm y conectivas que desafían y suplantan a las estructuras organizativas tradicionales. This book is the first treatment at length of negative, or apophatic, theology within the analytic tradition. Apophatic theology holds that there is a significant sense in which we cannot say what God is. Important negative theological elements are present in a host of Christian thinkers, from Gregory of Nyssa to Aquinas, and yet apophaticism is neglected in philosophical theology as practiced within the analytic tradition. By contrast, Hewitt shows how apophatic theology is integral to how Christians have thought about (...) God, and how it can be defended against standard attacks in the philosophical literature. Hewitt diagnoses the unease with apophaticism amongst contempory philosophical theologicans as rooted in a certain picture of how language functions, here called referentialism. Arguing that this picture is not compulsory, an account of language which sits more comfortably with negative theology (originating from work of later Wittgenstein) is invoked, and applied to key themes in philosophical theology including divine personhood, the Trinity, the Incarnation and the afterlife. In many cases, rivers, mountains, forests, and other so-called natural entities have value for us because they contribute to our well-being. According to the standard model of such value, they have instrumental or “service” value for us on account of their causal powers. That model tends, however, to come up short when applied to cases when nature contributes to our well-being by virtue of the religious, political, historical, personal, or mythic meanings it bears. To make sense of such cases, a (...) new model of nature’s value is needed, one that registers the fact that nature can have constitutive value for us on account of the role it plays in certain meaningful wholes, such as a person’s sense of who he or she is. The threshold problem for knowledge is the problem of saying where the threshold for knowledge lies in various cases and explaining why it lies there rather than elsewhere. Pragmatic encroachment is the idea that the knowledge-threshold is sensitive to practical factors. The latter idea seems to help us make progress on the former problem. However, Jessica Brown has argued that appearances are deceiving in this case: the threshold problem is still a thorny one even for those who accept pragmatic encroachment. (...) This paper takes a look at Brown’s arguments and at Michael Hannon’s recent attempt to respond to them. Hannon’s response is shown to face serious difficulties and a novel alternative response to Brown is provided. The paper also takes up an issue Brown raises very briefly concerning cases in which a proposition is relevant to multiple stakes which a subject faces at a given time. It turns out that there is a good deal more to be said about how defenders of pragmatic encroachment should try to handle such cases than Brown permits. (shrink)

Anthropological insights into the use of race/ethnicity to explore genetic contributions to disparities in health were developed using in-depth qualitative interviews with editorial staff from nineteen genetics journals, focusing on the methodological and conceptual mechanisms required to make race/ethnicity a genetic variable. As such, these analyses explore how and why race/ethnicity comes to be used in the context of genetic research, set against the background of continuing critiques from anthropology and related human sciences that focus on the social construction, structural (...) correlates and limited genetic validity of racial/ethnic categories. The analyses demonstrate how these critiques have failed to engage geneticists, and how geneticists use a range of essentially cultural devices to protect and separate their use of race/ethnicity as a genetic construct from its use as a societal and social science resource. Given its multidisciplinary, biosocial nature and the cultural gaze of its ethnographic methodologies, anthropology is well placed to explore the cultural separation of science and society, and of natural and social science disciplines. Anthropological insights into the use of race/ethnicity to explore disparities in health suggest that moving beyond genetic explanations of innate difference might benefit from a more even-handed critique of how both the natural and social sciences tend to essentialize selective elements of race/ethnicity. Drawing on the example of HIV/AIDS, this paper demonstrates how public health has been undermined by the use of race/ethnicity as an analytical variable, both as a cipher for innate genetic differences in susceptibility and response to treatment, and in its use to identify at greater risk of becoming infected and infecting others. Clearly, a tendency for biological reductionism can place many biomedical issues beyond the scope of public health interventions, while socio-cultural essentialization has tended to stigmatize and the communities where these are more prevalent. Some years ago, without realizing what it might mean, I accepted a dinner invitation from a Jewish colleague for dinner on Friday night. I should say that my colleague had never appeared particularly orthodox, and he would have known that I am an atheist. However, in the course of the meal, some kind of observance was put in train, and it turned out I was expected to play along—put on a hat, or some such. I demurred, saying that I felt (...) uncomfortable doing something that might be the expression of some belief that I do not hold, or of joining a “fellowship” with which I felt no special community, and with which I would not have any particular fellow-feeling beyond whatever I feel for human beings in general. I was assured that what it would signify, if I went through with the observance, was not that I shared the world views or beliefs of my host, or wished myself to identify uniquely with some particular small subset of humanity, but only that I respected his beliefs, or perhaps his stance. Grammatical asymmetries in possessive constructions are overtly coded in about 18% of the world’s languages according to the World Atlas of Language Structures What primarily motivates these grammatical asymmetries is controversial and has been at the crux of the “iconicity vs. frequency” debate This paper contributes to this debate by focusing on the grammatical asymmetries of Paamese possessive constructions, and looking for the primary motivating factor in their multidimensional experiential context. After a careful account of four experiential dimensions of distance, (...) the degrees of experiential distance are shown to systematically correspond to the degrees of formal distance of the possessive constructions used to refer to these experiences. Relevant anthropological and linguistic data concerning Paamese is used to explore whether this correspondence between language and experience is primarily motivated by iconicity or economy. I argue that diagrammatic iconicity is the primary motivating factor for the grammatical asymmetries in Paamese possessive constructions, and that economy can account for some, but not all cases. I also show that economy and iconicity can collaborate in motivating some cases, and thus do not necessarily need to be opposed. (shrink)

Cognitive scientists have long noted that automated behavior is the rule, while consciousness acts of self-regulation are the exception to the rule. On the face of it automated actions appear to be immune to moral appraisal because they are not subject to conscious control. Conventional wisdom suggests that sleepwalking exculpates, while the mere fact that a person is performing a well-versed task unthinkingly does not. However, our apparent lack of conscious control while we are undergoing automaticity challenges the idea that (...) there is a relevant moral difference between these two forms of unconscious behavior. In both cases the agent lacks access to information that might help them guide their actions so as to avoid harms. In response it is argued that the crucial distinction between the automatic agent and the agent undergoing an automatism, such as somnambulism or petit mal epilepsy, lies in the fact that the former can preprogram the activation and interruption of automatic behavior. Given that, it is argued that there is elbowroom for attributing responsibility to automated agents based on the quality of their will. (shrink)

The tourism industry is one of the largest industries in the world, and despite recent events that have made its operating environment more complex, the industry continues to grow [Theobald, 2005, Global Tourism, 3rd edn., Butterworth-Heinemann/Elsevier]. Commensurate to the size of the industry is a growth in the number of students pursuing degree courses in tourism around the world. Despite an increasingly sophisticated literature, the relative recency of the industry and its study has meant little attention has been paid in (...) the ethics literature to the dilemmas facing tourism managers and its students. Based on interviews with senior members of the tourism industry six scenarios are developed with pertinence to the challenges faced by industry practitioners today. This paper then applies the Multidimensional Ethics Scale [Reidenbach and Robin, 1990, Journal of Business Ethics, 9, 639–653] to tourism students at three prominent universities in the U.K., Canada and Australia. In total, 438 responses are achieved. The results have importance for the instruction of tourism students for the future, but also in informing decisions about the tools tourism destinations can effectively employ to control the future direction of the industry. This article examines Derrida's critique of Hegel. It argues that there are two key issues that Derrida misunderstands in Hegel's thought: first, Hegel's response to the concept-intuition dichotomy that plagued Kant's critical thought; second, that Hegel's notions of reason and the dialectic, when they are conceived non-metaphysically, are not tools employed to subsume differences but are, like Derrida's différance , fundamentally concerned with thought's instability. The article shows the way in which Derrida develops the notion of singularity by an examination (...) of the discussion of responsibility in his later writings. It is argued that the way that Hegel and Derrida consider the notion of singularity is a much better marker for distinguishing these two thinkers than Derrida's own interpretation of Hegel.
