This Essay examines debates surrounding Qu Tongzu's ‘Confucianization of law’ theory. Qu's theory claims that Chinese law underwent a process of ‘Confucianization’ starting in the Han dynasty (202 BC–220 AD) and ending and culminating in the Tang dynasty (618–907), where the Confucian concept of li and other Confucian moral teachings were introduced and incorporated into the written law. I argue that Qu's theory should be properly characterised as a theory of descriptive jurisprudence and also a form of the mirror thesis. (...) In light of this characterisation, this Essay then lays out the possible counterarguments that could be raised against Qu's theory and then situates existing scholarship in the debate in these categories. I then test Qu's theory using a case study about kinship concealment in traditional Chinese law The Essay then concludes by urging that the debate should include more jurisprudential approaches. To be Black means to have ancestors whose humanity has been de-nied by slavery, colonialism, neo-colonialism, and segregation, as well as by many theories elaborated in order to justify and intensify these modes of domination. To be Black also means having to face the enduring legacies of these systems and theories, which predomi-nantly manifest through overexposure to violence and death. Today, premature death and habituation to loss remain constitutive fea-tures of Black experience. Dignity, often de????ined as the inherent value of (...) every single human being, has been a core concept in ethics since Kant, at least. But in both philosophy and modern politics, the claim of respect for the dignity of people has coexisted with deep antiblack-ness. However, apart from the Western understanding of dignity stands another tradition. The concept of dignity is pervasive in Black radicalism, Caribbean philosophy, and African thought since the 18th century. This article draws inspiration from the legacy of these thinkers to elaborate an ethics centred on the speci????icities of racial-ized life. (shrink)

Leibniz, Husserl and the Brain is about the structural relations between phenomenological and neurophysiological aspects of perception, consciousness and time. Its focus lies with auditory perception, since nearly all perceived qualities in hearing - such as pitch, rhythm and the localization or origin of a sound - are most intimately related to temporal patterns and regularities. Here striking analogies are shown between the structural features of perceptual states, as dealt with in philosophical phenomenology, and of their physical counterparts, as dealt (...) with in neurophysiology. Accordingly, the comprehensive and consolidating references to the work of Leibniz and Husserl are not for philological reasons, but, rather, to work towards philosophical orientation in a conceptual maze. They allow for a fresh view on several issues in contemporary philosophy of mind and also in psychophysics - in particular, on the transition from unconscious to conscious states and on the constitution of time consciousness. Vers 1918 Hermann Weyl abandonnait le logicisme et donc la tentative de réduire les mathématiques à la logique et la théorie des ensembles. Au niveau philosophique, ses points de référence furent ensuite Husserl et Fichte. Dans les années 1920 il distingua leurs positions, entre une direction intuitionniste-phénoménologique d’un côté, et formaliste-constructiviste de l’autre. Peu après Weyl, Oskar Becker adopta une distinction similaire. Mais à la différence du phénoménologue Becker, Weyl considérait l’approche active du constructivisme de Fichte comme supérieure à la (...) vision d’essences passive de Husserl. Dans cet essai, je montre ce développement dans la pensée de Weyl. Bien que certains points dans sa réception de Husserl et Fichte ne soient pas soutenables, je vais argumenter en faveur de la distinction fondamentale mentionnée ci-dessus. (shrink)

Dieses Buch handelt davon, was Zeitliches ausmacht, warum sich die Wirklichkeit zeitlich ordnet und was das mit der wechselseitigen Taktung von Ereignissen und Autonomieerfahrungen zu tun hat. As children in elementary school we were taught to recite the alphabet in order: “Aay, Bee, See, Dee, Eii, Eff, Ghee, Aaych, …, Why and Zee”. There is nothing natural about this particular ordering: it is strictly a matter of convention. (When and where it was settled upon I haven’t the remotest notion.) Then, having mastered the ordering, we were taught to apply that knowledge to alphabetize lists of words. The procedure is surprisingly complex, and its mastery by mere eight-year (...) olds attests to the elevated intellectual capacities of human beings. One merely has to try to write down the procedure in a flow chart to see how complex it truly is. In any event, most of us probably emerged from the exercise of learning to use a dictionary believing that we knew all there is to know about alphabetizing. If only that were all there is to it. The trouble is that our third-grade teachers had not reckoned on our having to program computers to alphabetize.. (shrink)

Since then, it has received steady attention from a number of astrophysicists, in particular, those promoting one version or another of an Anthropic Principle (see e.g. Barrow et al. 1986). In his tower, walled off from the rest of the world, he pursues mathematics. Having started out modestly with theorizing that flipping two coins will yield two heads with a probability of 25%, he has lately gone on to more ambitious projects. Most recently he has published a paper, earning wide acclaim, (...) in which he has theorized that, since there are exactly four possible pairings (female-female; male-male; female-male; and male-female) of adult human beings, there is, then, a 25% probability that a household is headed by two women; a 25% probability that a household is headed by two men; and a 50% probability that a household is headed by one man and one woman. This article investigates an intertwined systematic and historical view on theories of matter. It follows an approach brought forward by Hermann Weyl around 1925, applies it to recent theories of matter in physics (including geometrodynamics and quantum gravity), and embeds it into a more general philosophical framework. First, I shall discuss the physical and philosophical problems of a unified field theory on the basis of Weyl's own abandonment of his 1918 ‘pure field theory’ in favour of an ‘agent theory’ of (...) matter. The difference between agent and field theories of matter is then used to establish a sort of dialectic meta-view. With reference to Weyl this view can be understood as being a particular Fichtean transcendental idealist approach which attempts to combine the strengths of the Husserlian phenomenology and Cassirer's neo-Kantianism. First published in 1962, this book provides a systematic account of the development of Plato’s theory of knowledge. Beginning with a consideration of the Socratic and other influences which determined the form in which the problem of knowledge first presented itself to Plato, the author then works through the dialogues from the Meno to the Laws and examines in detail Plato’s progressive attempts to solve the problem.

Discusses Anglo-American capitalism, exemplified by the commercial and financial systems of Wall Street and the City of London and including the ethics of the stock market, the morality of takeovers, and the problem of business and the environment.

In this paper I wish to examine the meaning of the doctrine of anamnesis, with particular regard to the role assigned in it to sense-experience. I shall argue that an empirical interpretation of the doctrine as it is presented in the Meno is false, and that Plato is not concerned at all in the Meno with the question of the role of sense-experience in recollection; that the doctrine of the Phaedo shows an inadequate appreciation of the problems involved in assigning (...) a role to sense-experience, and is seriously inconsistent with what Plato says elsewhere, in the Phaedo and in other dialogues, about the senses and sensible images; that the revised and more responsible presentation of this doctrine in the Phaedrus is self-contradictory; that misinterpretations of the theory of anamnesis are due principally to either misinterpretation or neglect of what is said about it in the Meno, the custom of taking Phaedo 73 c ff. as specially representative of Plato's doctrine. This research explored the feasibility of using multidimensional scaling (MDS) analysis in novel combination with other techniques to study comprehension of epistemic adverbs expressing doubt and certainty (e.g., evidently, obviously, probably ) as they relate to health communication in clinical settings. In Study 1, Australian English speakers performed a dissimilarity-rating task with sentence pairs containing the target stimuli, presented as “doctors' opinions.” Ratings were analyzed using a combination of cultural consensus analysis (factor analysis across participants), weighted-data classical-MDS, and cluster analysis. Analyses revealed strong within-community consistency for a 3-dimensional semantic space solution that took into account individual differences, strong statistical acceptability of the MDS results in terms of stress and explained variance, and semantic configurations that were interpretable in terms of linguistic analyses of the target adverbs. The results confirmed the feasibility of using MDS in this context. Study 2 replicated the results with Canadian English speakers on the same task. Semantic analyses and stress decomposition analysis were performed on the Australian and Canadian data sets, revealing similarities and differences between the two groups. Overall, the results support using MDS to study comprehension of words critical for health communication, including in future studies, for example, second language speaking patients and/or practitioners. More broadly, the results indicate that the techniques described should be promising for comprehension studies in many communicative domains, in both clinical settings and beyond, and including those targeting other aspects of language and focusing on comparisons across different speech communities.
