In recent years there has been a significant growth in interest of the so-called 'law in context' extending legal studies beyond black letter law. This book looks at the relationship between statute law and legal practice. It examines how law is applied in reality and more precisely how law is perceived by the general public in contrast to the legal profession. The authors look at a number of themes that are central to examining ways in which myths about law are (...) formed, and how there is inevitably a constitutive power aspect to this myth making. At the same time they explore to what extent law itself creates and sustains myths. Resumo: A atuação do tradutor e intérprete de língua de sinais no contexto educacional inclusivo é tema de constantes embates teóricos acerca da concepção de seu ‘papel’. Desse modo, verificam-se prescrições que delimitam suas práticas e atribuições pela caracterização de uma pretensa ‘identidade’ profissional. Na contramão disso, esse estudo tenciona um adensamento analítico acerca daquilo que é produzido na atividade interpretativo-pedagógica do intérprete educacional, fora do âmbito da ‘identidade profissional’, mas no âmbito das efetivas ações produzidas pela posição e contextos (...) de ensino, assumidos na prática cotidiana. Assim, entende-se que essa função interpretativa se constitui na lógica da ‘diferença’, pela ativação relacional e pedagógica com o sujeito surdo no contexto escolar. A tese empreendida é a de que a função pedagógica do intérprete educacional é estabelecida como efeito do ato educativo. Nosso foco se dará na análise do aprender surdo e sua co-construção de conhecimento, produzidos com e pelos signos emitidos pelo intérprete educacional como efeito do acontecimento educativo. The role of the educational interpreter and deaf learning: an analysis of the master position in the educational relationship in an inclusive classroom Abstract: Sign language translators and interpreter’s part within inclusive education constantly rises theoretical debates about the conception of their 'role'. Thus, we commonly see prescriptions that delimit their practices and attributions by characterizing a supposed professional "identity". Nevertheless, this study aims to analyze what is produced in the interpretive-pedagogical activity of the educational interpreter, beyond the scope of 'professional identity', and within the effective actions produced by the position and context assumed on a daily basis. Thus, we understand that this interpretative function is constituted in the logic of 'difference', by relational and pedagogical activation with the deaf subject in the school context. The thesis undertaken is that the pedagogical function of the educational interpreter is established as an effect of the educational act. We focus on the analysis of deaf learning and its co-construction of knowledge, produced with and by the signs emitted by the educational interpreter as an effect of the educational event. Therefore, this article analyzes the conceptual movement of the master position from the studies of the hermeneutics of the subject, in Michel Foucault, assuming it as an articulator of the interpretative-pedagogical function of the educational interpreter that materializes in and through the teaching context. Apresenta-se resultados de uma pesquisa desenvolvida na área da educação de surdos, realizada no período de 2015 a 2017, com financiamento da Fundação de Amparo à Pesquisa do Estado de São Paulo. A investigação aconteceu em salas de aulas do ensino fundamental II, com a presença de alunos surdos e intérpretes educacionais, de uma escola municipal inclusiva no interior do estado de São Paulo. Percebe-se em que medida o percurso escolar anterior dos alunos surdos facilitaram a interação com os profissionais (...) tradutores e intérpretes de língua de sinais educacional. Slips of the tongue, unwitting favoritism and stereotyped assumptions are just some examples of microaggression. Nearly all of us commit microaggressions at some point, even if we don’t intend to. Yet over time a pattern of microaggression can cause considerable harm by reminding members of marginalized groups of their precarious position. Deepfake technology uses machine learning to fabricate video and audio recordings that represent people doing and saying things they've never done. In coming years, malicious actors will likely use this technology in attempts to manipulate public discourse. This paper prepares for that danger by explicating the unappreciated way in which recordings have so far provided an epistemic backstop to our testimonial practices. Our reasonable trust in the testimony of others depends, to a surprising extent, on the regulative effects of the (...) ever-present possibility of recordings of the events they testify about. As deepfakes erode the epistemic value of recordings, we may then face an even more consequential challenge to the reliability of our testimonial practices themselves. (shrink)

This article presents an analytic critique of the predominant revisionist theoretical paradigm of just war (henceforth: revisionism). This is accomplished by means of a precise description and explanation of the practicability problem that confronts it, namely that soldiers that revisionism would deem “unjust” are bound to fail to fulfil the duties that revisionism imposes on them, because these duties are overdemanding. The article locates the origin of the practicability problem in revisionism’s overidealized conception of a soldier as an individual rational (...) agent analogous to the aggressor or defender in a case of lethal self-defense, who is capable of reflecting on the morality of his status in war and of the killing he performs and thus of recognizing his revisionist duties. Revisionism, however, ignores the following fact: Killing in war is not a natural human behavior. This is why training soldiers to kill is—and arguably always has been—a necessity for the existence of war and the killing that occurs in it. Moreover, this training involves a certain level of moral desensitization to violence whose goal is to prevent soldiers from thoroughly reflecting on the morality of the killing they engage in. Hence, war and killing can only exist if soldiers are trained in such a way that they do not reflect on whether they could be addressees of revisionist duties in the first place. This means that military training is a “constitutive condition” of soldiers and war, which is why it cannot excuse their noncompliance with revisionist duties, thus making these duties categorically overdemanding. The argument here draws on the paradigmatic example of modern US military killing conditioning (MC), but embeds it into a broader military-historical perspective that describes how soldiers have always needed to be mentally and morally influenced in order to enable war and killing. The article’s explanation of revisionism’s practicability problem has a constructive consequence for future theory-building in the ethics of war: It implies that a potentially revised ethical theory of war must necessarily analyze the institutions that allocate belligerent resources, if it aims to morally assess battlefield behavior in a practicable manner. Recent empirical work appears to suggest that the moral intuitions of professional philosophers are just as vulnerable to distorting psychological factors as are those of ordinary people. This paper assesses these recent tests of the ‘expertise defense’ of philosophical intuition. I argue that the use of familiar cases and principles constitutes a methodological problem. Since these items are familiar to philosophers, but not ordinary people, the two subject groups do not confront identical cognitive tasks. This article argues that military conditioning (MC) systematically violates the human dignity of soldiers. The argument relies on an absolute deontologist account of human dignity understood as a claim-right to live in self-respect, which is a right to decide on one’s own behalf about, and to be in control of, essential aspects of one’s own life. The article claims that MC violates soldiers’ dignity so understood because the largely automatic physical killing reflex that MC instills aims to remove their freedom (...) of choice to kill or not to kill, while the MC practices that rationalize the killing of opponents aim to subvert soldiers’ moral deliberation in relation to this behavior. MC thus aims to take away soldiers’ control over a very essential aspect of human life: the decision whether to take life in war. Thereby, MC systematically violates their human dignity. The article concludes with a proposal for an amendment to international law that would allow legal institutions to do more justice to soldiers’ dignity. (shrink)

The aim of this study was to find out what interpretive repertoires young people use in the symbolic management of the pandemic. Qualitative research using several methods on a sample of 172 young people in three countries, Slovakia, the Czech Republic and Austria, and the subsequent discursive analysis showed that young people symbolically coped during the Covid-19 pandemic with the help of widespread concepts such as cutting off, closing sci-fi and panic. The interpretations used by young people to symbolically deal (...) with the pandemic are close to those present in the public discourse—the discourses of threat, loss, emotion—but there was also a search for the concepts and language for use by experts and the general public in communicating about the pandemic. There were no significant differences in the interpretations of life during the Covid-19 pandemic in the three Central European countries. (shrink)

Many of our cognitive capacities are shaped by enculturation. Enculturation is the acquisition of cognitive practices such as symbol-based mathematical practices, reading, and writing during ontogeny. Enculturation is associated with significant changes to the organization and connectivity of the brain and to the functional profiles of embodied actions and motor programs. Furthermore, it relies on scaffolded cultural learning in the cognitive niche. The purpose of this paper is to explore the components of symbol-based mathematical practices. Phylogenetically, these practices are the (...) result of concerted organism-niche interactions that have led from approximate number estimations to the emergence of discrete, symbol-based mathematical operations. Ontogenetically, symbol-based mathematical practices are associated with plastic changes to neural circuitry, action schemata, and motor programs. It will be suggested that these practices rely on previously acquired capacities such as subitizing and counting. With these considerations in place, I will argue that computations, understood in the sense of Turing (1936), are a specific kind of symbol-based mathematical practices that can be realized by human organisms, machines, or by hybrid organism-machine systems. In sum, this paper suggests a new way to think about mathematical cognition and computation. (shrink)

Many of our cognitive capacities are the result of enculturation. Enculturation is the temporally extended transformative acquisition of cognitive practices in the cognitive niche. Cognitive practices are embodied and normatively constrained ways to interact with epistemic resources in the cognitive niche in order to complete a cognitive task. The emerging predictive processing perspective offers new functional principles and conceptual tools to account for the cerebral and extra-cerebral bodily components that give rise to cognitive practices. According to this emerging perspective, many (...) cases of perception, action, and cognition are realized by the on-going minimization of prediction error. Predictive processing provides us with a mechanistic perspective that helps investigate the functional details of the acquisition of cognitive practices. The argument of this paper is that research on enculturation and recent work on predictive processing are complementary. The main reason is that predictive processing operates at a sub-personal level and on a physiological time scale of explanation only. A complete account of enculturated cognition needs to take additional levels and temporal scales of explanation into account. This complementarity assumption leads to a new framework—enculturated predictive processing—that operates on multiple levels and temporal scales for the explanation of the enculturated predictive acquisition of cognitive practices. Enculturated predictive processing is committed to explanatory pluralism. That is, it subscribes to the idea that we need multiple perspectives and explanatory strategies to account for the complexity of enculturation. The upshot is that predictive processing needs to be complemented by additional considerations and conceptual tools to realize its full explanatory potential. (shrink)

Contemporary and emerging chatbots can be fine-tuned to imitate the style, tenor, and knowledge of a corpus, including the corpus of a particular individual. This makes it possible to build chatbots that imitate people who are no longer alive — deathbots. Such deathbots can be used in many ways, but one prominent way is to facilitate the process of grieving. In this paper, we present a framework that helps make sense of this process. In particular, we argue that deathbots can (...) serve as affective scaffolds, modulating and shaping the emotions of the bereaved. We contextualize this affective scaffolding by comparing it to earlier technologies that have also been used to scaffold the process of grieving, arguing that deathbots offer some interesting novelties that may transform the continuing bonds of intimacy that the bereaved can have with the dead. This paper presents a regress challenge to the selective psychological debunking of moral judgments. A selective psychological debunking argument conjoins an empirical claim about the psychological origins of certain moral judgments to a theoretical claim that these psychological origins cannot track moral truth, leading to the conclusion that the moral judgments are unreliable. I argue that psychological debunking arguments are vulnerable to a regress challenge, because the theoretical claim that ‘such-and-such psychological process is not moral-truth-tracking’ relies upon moral judgments. We (...) must then ask about the psychological origins of these judgments, and then make a further evaluative judgment about these psychological origins… and so on. This chain of empirical and evaluative claims may continue indefinitely and, I will argue, proponents of the debunking argument are in a dialectical position where they may not simply call a halt to the process. Hence, their argument cannot terminate, and its debunking conclusion cannot be upheld. (shrink)

Theories of skill acquisition have made radically different predictions about the role of general problem‐solving methods in acquiring rules that promote effective transfer to new problems. Under one view, methods that focus on reaching specific goals, such as means‐ends analysis, are assumed to provide the basis for efficient knowledge compilation (Anderson, 1987), whereas under an alternative view such methods are believed to disrupt rule induction (Sweller, 1988). We suggest that the role of general methods in learning varies with both the (...) specificity of the problem solver's goal and the systematicity of the strategies used for testing hypotheses about rules. In the absence of a specific goal people are more likely to use a rule‐induction learning strategy, whereas provision of a specific goal fosters use of difference reduction, which tends to be a non‐rule‐induction strategy. We performed two experiments to investigate the impact of goal specificity and systematicity of rule‐induction strategies in learning and transfer within a complex dynamic system. The results of Experiment 1 indicated that during free exploration of a problem space, greater learning occurred if participants adopted more systematic strategies for rule induction, and that participants come to favor such strategies. Experiment 2 revealed that participants who were provided with a specific goal performed well on the initial problem but were impaired on a transfer test using a similar problem with a different goal. Instruction on a systematic rule‐induction strategy facilitated solution for both the initial and transfer problems, but participants' use of this strategy declined if they had a specific goal. Our results support Sweller's (1988) proposal that general problemsolving methods applied to a specific goal foster acquisition of knowledge about an isolated solution path but do not provide an effective way of learning the overall structure of a problem space. We interpret these results in terms of dualspace theories of search through problem space. (shrink)

We report the results of one visual‐world eye‐tracking experiment and two referent selection tasks in which we investigated the effects of information structure in the form of prosody and word order manipulation on the processing of subject pronouns er and der in German. Factors such as subjecthood, focus, and topicality, as well as order of mention have been linked to an increased probability of certain referents being selected as the pronoun's antecedent and described as increasing this referent's prominence, salience, or (...) accessibility. The goal of this study was to find out whether pronoun processing is primarily guided by linguistic factors (e.g., grammatical role) or nonlinguistic factors (e.g., first‐mention), and whether pronoun interpretation can be described in terms of referents' “prominence” / “accessibility” / “salience.” The results showed an overall subject preference for er, whereas der was affected by the object role and focus marking. While focus increases the attentional load and enhances memory representation for the focused referent making the focused referent more available, ultimately it did not affect the final interpretation of er, suggesting that “prominence” or the related concepts do not explain referent selection preferences. Overall, the results suggest a primacy of linguistic factors in determining pronoun resolution. (shrink)

Deepfakes are algorithmically modified video and audio recordings that project one person’s appearance on to that of another, creating an apparent recording of an event that never took place. Many scholars and journalists have begun attending to the political risks of deepfake deception. Here we investigate other ways in which deepfakes have the potential to cause deeper harms than have been appreciated. First, we consider a form of objectification that occurs in deepfaked ‘frankenporn’ that digitally fuses the parts of different (...) women to create pliable characters incapable of giving consent to their depiction. Next, we develop the idea of ‘illocutionary wronging’, in which an individual is forced to engage in speech acts they would prefer to avoid in order to deny or correct the misleading evidence of a publicized deepfake. Finally, we consider the risk that deepfakes may facilitate campaigns of ‘panoptic gaslighting’, where many systematically altered recordings of a single person's life undermine their memory, eroding their sense of self and ability to engage with others. Taken together, these harms illustrate the roles that social epistemology and technological vulnerabilities play in human ethical life. (shrink)

Abstract pictures are distinguished from depictive pictures in that no visibly recognizable objects can be seen in them. Abstract pictures are thus non-depictive and non-figurative. The question still remains, however, if abstract pictures can be representations. The aim of this chapter is to defend the view that abstract pictures can be representational and therefore have content or subject matter. A microaggression is a small insulting act made disproportionately harmful by its part in an oppressive pattern of similar insults. How should you respond when made the victim of a microaggression? In this paper I survey several morally salient factors, including effects upon victims, perpetrators, and third parties. I argue, contrary to popular views, that ‘growing a thicker skin’ is not good advice nor is expressing reasonable anger always the best way to contribute to confronting oppression. Since at least 2016, many have worried that social media enables authoritarians to meddle in democratic politics. The concern is that trolls and bots amplify deceptive content. In this chapter I argue that these tactics have a more insidious anti-democratic purpose. Lies implanted in democratic discourse by authoritarians are often intended to be caught. Their primary goal is not to successfully deceive, but rather to undermine the democratic value of testimony. In well-functioning democracies, our mutual reliance on testimony also generates (...) a distinctively democratic value: decentralized testimonial networks evade control by the state or powerful actors. The deliberate exposure of deception in democratic testimonial networks undermines this value by implicating citizens in their own epistemic corruption, weakening the resilience of democratic society against authoritarian pressure. In this chapter I illustrate that danger through a close reading of recent Russian social media interference operations, showing both their epistemic underpinnings and their ongoing political threat. This article argues that the reduction of the morality of killing in war to the morality of killing in self-defense by ‘reductive-individualist’ revisionist just war theories is inconsistent, because when those theories apply the moral notion of self-defense to the morality of killing in war, they do not preserve the two conceptions of the “individual” inherent in this notion. The article demonstrates this inconsistency in two steps: First, it disentangles the two conceptions of the individual inherent to the notion of (...) self-defense, namely (1) that the individual is an “entity” potentially bearing a right to self-defense (unlike, e.g., groups) and (2) that the individual is a “particular,” where “particular” signifies that every human is different from every other human. The conception of the individual as a “particular” is tied to the idea that a justification grounded in a rule of self-defense is necessarily “concrete,” in the sense of referring to individually given and specific perceptions or cases, as opposed to “abstract,” in the sense of being detached from specific perceptions or cases. The article then demonstrates that reductive individualism reflects the first notion of the individual, but not the second. Due to the “loss” of the individual as a “particular”, the reductive-individualist reduction of the morality of killing in war to the morality of killing in self-defense is inconsistent, and hence its justification of killing in war grounded in self-defense is not concrete. Since such a justification must be concrete, reductive individualism cannot offer a justification for belligerent killing. (shrink)

The aim of this chapter is to argue against the semiotic reading of Husserl’s theory of depiction according to which depiction [Abbildung] must necessarily involve symbolic function. I aim to show that Husserl’s notes on depiction can be divided into two parts: those that deal with internal depiction and those concerned with external depiction. This division provides a constructive way to explain Husserl’s asemiotic view on depiction, but it has not received proper attention from Husserlian scholars. Symptom Checker Applications (SCA) are mobile applications often designed for the end-user to assist with symptom assessment and self-triage. SCA are meant to provide the user with easily accessible information about their own health conditions. However, SCA raise questions regarding ethical, legal, and social aspects (ELSA), for example, regarding fair access to this new technology. The aim of this scoping review is to identify the ELSA of SCA in the scientific literature. A scoping review was conducted to identify the ELSA (...) of SCA. Ten databases (e.g., Web of Science and PubMed) were used. Studies on SCA that address ELSA, written in English or German, were included in the review. The ELSA of SCA were extracted and synthesized using qualitative content analysis. A total of 25,061 references were identified, of which 39 were included in the analysis. The identified aspects were allotted to three main categories: (1) Technology; (2) Individual Level; and (3) Healthcare system. The results show that there are controversial debates in the literature on the ethical and social challenges of SCA usage. Furthermore, the debates are characterised by a lack of a specific legal perspective and empirical data. The review provides an overview on the spectrum of ELSA regarding SCA. It offers guidance to stakeholders in the healthcare system, for example, patients, healthcare professionals, and insurance providers and could be used in future empirical research to investigate the perspectives of those affected, such as users. This short piece draws on political philosophy to show how social media interference operations can be used by hostile states to weaken the apparent legitimacy of democratic governments. Democratic societies are particularly vulnerable to this form of attack because democratic governments depend for their legitimacy on citizens' trust in one another. But when citizen see one another as complicit in the distribution of deceptive content, they lose confidence in the epistemic preconditions for democracy. Recent work on enculturation suggests that our cognitive capacities are significantly transformed in the course of the scaffolded acquisition of cognitive practices such as reading and writing. Phylogenetically, enculturation is the result of the co-evolution of human organisms and their socio-culturally structured cognitive niche. It is rendered possible by evolved cerebral and extra-cerebral bodily learning mechanisms that make human organisms apt to acquire culturally inherited cognitive practices. In addition, cultural learning allows for the intergenerational transmission of relevant knowledge and skills. (...) Ontogenetically, enculturation is associated with neural plasticity and the development of new motor routines and action schemas. It relies on scaffolded learning that structures novice-teacher interactions. The acquisition of reading and writing are paradigm examples of enculturation. Based on an empirically informed analysis of the components of enculturation, I will apply the emerging account of enculturated cognition to narrative practices. To date, research on the impact of narratives on the constitution of the self and our understanding of folk psychology has not paid much attention to the question how narratives are influenced by cumulative cultural evolution and our capacity to acquire reading and writing during ontogeny. I will argue that textual narratives, above and beyond oral narratives, provide genuinely new ways of narration. Therefore, the enculturated interaction with textual narratives has the potential to contribute to a better understanding of ourselves and other cognitive agents. (shrink)

Trust and trustworthiness are essential for good healthcare, especially in mental healthcare. New technologies, such as mobile health apps, can affect trust relationships. In mental health, some apps need the trust of their users for therapeutic efficacy and explicitly ask for it, for example, through an avatar. Suppose an artificial character in an app delivers healthcare. In that case, the following questions arise: Whom does the user direct their trust to? Whether and when can an avatar be considered trustworthy? Our (...) study aims to analyze different dimensions of trustworthiness in the context of mobile health app use. We integrate O'Neill's account of autonomy, trust, and trustworthiness into a model of trustworthiness as a relational concept with four relata: B is trustworthy with respect to A regarding the performance of Z because of C. Together with O'Neill's criteria of trustworthiness (honesty, competence, and reliability), this four-sided model is used to analyze different dimensions of trustworthiness in an exemplary case of mobile health app use. Our example focuses on an app that uses an avatar and is intended to treat sleep difficulties. The conceptual analysis shows that interpreting trust and trustworthiness in health app use is multi-layered and involves a net of interwoven universal obligations. At the same time, O'Neill's approach to autonomy, trust, and trustworthiness offers a normative account to structure and analyze these complex relations of trust and trustworthiness using mobile health apps. Major depression is a prevalent mental disorder that leads to persistent negative mood and tremendous suffering in affected individuals. However, the biological realization of this disorder and associated symptom clusters remain poorly understood. Recently, phenomenological accounts of major depressive disorder and contributions to the emerging predictive processing account have provided valuable insights into the phenomenological and neuro-functional components that lead to manifestations of major depressive episodes. The purpose of this paper is to weave together these different strands of research to (...) develop a predictive processing account of major depressive disorder. In doing so, I will relate personal-level descriptions of associated phenomenal experiences to a sub-personal-level predictive processing account of the functional realization of major depression. I will argue that pervasive symptoms of the disorder, which include a diminished sense of agency, fatigue, social withdrawal, and rumination, are integrated by existential feelings of loss and impossibility. These phenomenal experiences, I will argue, are associated with dysfunctional processes of prediction error minimization, which are characterized by an overall decrease of the causal contributions of active inference and by distorted precision estimates. The emerging account promises to contribute to a better understanding of the complex processes that give rise to depressive experiences. (shrink)

Cognitive innovation has shaped and transformed our cognitive capacities throughout history. Until recently, cognitive innovation has not received much attention by empirical and conceptual research in the cognitive sciences. This paper is a first attempt to help close this gap. It will be argued that cognitive innovation is best understood in connection with cumulative cultural evolution and enculturation. Cumulative cultural evolution plays a vital role for the inter-generational transmission of the products of cognitive innovation. Furthermore, there are at least two (...) important functions of enculturation for cognitive innovation. First, enculturation is responsible for the ontogenetic acquisition of cognitive practices governing the interaction with innovative products. Second, successful processes of enculturation provide opportunities for subsequent innovative processes. The trans-generational trajectory of calculation from mathematical symbol systems to the first digital computers will serve as a paradigm example of the delicate interplay of cognitive innovation, cumulative cultural evolution, and enculturation. It is a philosophical truism that we must think of others as moral agents, not merely as causal or statistical objects. But why? I argue that this follows from the best resolution of an antinomy between our experience of morality as necessarily binding on the will and our knowledge that all moral beliefs originate in contingent histories. We can address this antinomy only by understanding moral deliberation via interpersonal relationships, which simultaneously vindicate and constrains morality’s bind on the will. This (...) means that moral agency is fundamentally social. I model an attitude toward our causal nature on sociologist Erving Goffman’s concept of ‘civil inattention’; our social practice of agency requires that we give minimal attention to the contingent origins of moral judgments in ourselves and others. Understood this way, seeing ourselves as moral agents requires avoiding appeal to causal aetiology to settle substantive moral disagreement. (shrink)

This study explores the reflective processes of Scottish artist, Norman Gilbert, as he created twenty-five drawings depicting his wife, Pat Gilbert, as she lay dying following an Alzheimer’s-related stroke. Norman, ninety-one, had drawn Pat regularly over their sixty-five-year marriage. One week after Pat died, Norman was interviewed by a family friend to chronicle his reflections on the drawings. The drawings along with the interview transcript are analyzed qualitatively as a case study. Norman’s Hospital Drawings of Pat transform what was initially (...) a private experience into a shared comprehension of end of life and bereavement. (shrink)
