Background While most countries that allow abortion on women’s request also grant physicians a right to conscientious objection (CO), this has proven to constitute a potential barrier to abortion access. Conscientious objection is regarded as an understudied phenomenon the effects of which have not yet been examined in Germany. Based on expert interviews, this study aims to exemplarily reconstruct the processes of abortion in a mid-sized city in Germany, and to identify potential effects of conscientious objection. Methods Five semi-structured interviews (...) with experts from all instances involved have been conducted in April 2020. The experts gave an insight into the medical care structures with regard to abortion procedures, the application and manifestations of conscientious objection in medical practice, and its impact on the care of pregnant women. A content analysis of the transcribed interviews was performed. Results Both the procedural processes and the effects of conscientious objection are reported to differ significantly between early abortions performed before the 12th week of pregnancy and late abortions performed at the second and third trimester. Conscientious objection shows structural consequences as it is experienced to further reduce the number of possible providers, especially for early abortions. On the individual level of the doctor-patient relationship, the experts confirmed the neutrality and patient-orientation of the vast majority of doctors. Still, it is especially late abortions that seem to be vulnerable to barriers imposed by conscientious objection in individual medical encounters. Conclusion Our findings indicate that conscientious objection possibly imposes barriers to both early and late abortion provision and especially in the last procedural steps, which from an ethical point of view is especially problematic. To oblige hospitals to partake in abortion provision in Germany has the potential to prevent negative impacts of conscientious objection on women’s rights on an individual as well as on a structural level. In his posthumously published lectures, Politics in Commercial Society, István Hont argues that Jean-Jacques Rousseau and Adam Smith should be understood as theorists of commercial society. This article challenges Hont’s interpretation of both thinkers and shows that some of his key claims depend on conflating the terms ‘commercial society’ and ‘commercial sociability’. I argue that, for Smith, commercial society should not be defined in terms of the moral psychology of commercial sociability, before questioning Hont’s Epicurean interpretation of Smith’s theory of (...) sociability. I then turn to Rousseau and outline some of the difficulties involved with classifying him as a theorist of commercial society, the most important of which is that he often appeared to be more deeply opposed to commercial progress than Hont suggests. I conclude by highlighting some of the most salient differences between Rousseau’s and Smith’s views of the politics of eighteenth-century Europe. (shrink)

This article reports some findings from a study of verbal interaction from sittings between members of the public and mediums: people who claim to be able to talk to the dead on behalf of the living. Instead of trying to debunk the ontological status of the mediums' claimed powers and the existence of the afterlife, the article examines mediums' discourse as a form of institutional interaction. It focuses on instances in which mediums report the words of their spirit contacts in (...) their sittings with clients. It is argued that this is a key practice by which mediums establish the basis of a favourable assessment of the authenticity of their powers. The analysis examines the recurrent organizational properties of utterances in which the spirits' words are introduced into the sitting, and describes some of the inferential or rhetorical tasks addressed by these reports. The debate over the political power of business has witnessed a revival after the global financial crisis of 2007—2009. We begin by arguing that business political fragmentation or unity has important consequences for policy outcomes. The structure of the U.S. government is conducive to incremental policy changes, often in response to business pressures. In turn, these changes shape the political interests and alliances of business. We illustrate this dynamic through an analysis of the political processes leading to the enactment of (...) the Financial Modernization Act of 1999, which repealed Depression-era regulations and allowed commercial banks to enter the securities and insurance business and vice versa. The FMA condoned the emergence of largely unregulated diversified financial institutions, which proved “too big to fail” during the crisis. Several factors contributed to the FMA: political institutions, international competition, the ideological convergence of the Republican and Democratic parties, and the political interests of financial industry actors. This article presents a novel conception of groups and social processes within and among groups from a communication-ecological perspective that integrates approaches as different as Garfinkel’s ethnomethodology, Heideggerian praxeology, and Luhmann’s systems theory into an innovative social-theoretical framework. A group is understood as a social entity capable of collective action that is an object to itself and insofar possesses an identity. The elementary operations of groups consist in social processes with communicative, pre-communicative, and non-communicative episodes. Groups operate in a number (...) of environments that are conceived of as both correlates of their own processes and providing groups with the raw materials for the fabrication of their constituents. These environments include but are not limited to spatial, discursive, emotional, institutional, semiotic-medial, psychic-personal, technical, and groupal environments. The article paves the way to combine studies on intergroup and intragroup communication in one comprehensive theoretical framework situated on such an abstract level that it can be concretized in view of utterly different cultural contexts and the emic perspectives of actors therein. Accordingly, the framework provides researchers with the conceptual devices to balance the comparability of different lifeworlds with the faithfulness to actors’ inside views. The methodological implications laid out in this article prioritize qualitative, especially ethnographic methods as a starting point for research on group communication. (shrink)

Perhaps the real paradox of Zeno's Arrow is that, although entirely stationary, it has, against all odds, successfully traversed over two millennia of human thought to trouble successive generations of philosophers. The prospects were not good: few original Zenonian fragments survive, and our access to the paradoxes has been for the most part through unsympathetic commentaries. Moreover, like its sister paradoxes of motion, the Arrow has repeatedly been dismissed as specious and easily dissolved. Even those commentators who have taken it (...) seriously have propounded solutions with which they profess themselves to be perfectly satisfied. This thesis examines the nature of the supplementary relationship between Husserlian phenomenology and deconstruction. Chapter 1 gives an account of the strategies and aims of deconstruction, determining these to be an attempt to respond, using ‘other names’, to the other which is excluded by phenomenology/philosophy in its attempts to master its own limits. In Chapter 2, it is found that alterity is encountered by phenomenology on its own thresholds, informing the genetic turn in phenomenology which is necessitated as a result (...) of the inquiries into the temporal constitution which founds the possibility of an object’s being given as such to consciousness. Furthermore, it is shown how the possibility of the genetic turn resides in the indication relation examined in the phenomenology of signification. Chapter 3 focusses on the deconstruction of phenomenology, and investigates the double movement in phenomenology which the deconstruction reveals, taking time and language as guiding threads. On the one hand, the genetic turn appears to reveal a founding alterity, which, on the other hand, phenomenology strives to suppress in accordance with its adherence to its own ‘principle of principles’. It is argued that the deconstruction aims to accord phenomenological respect to the alterity uncovered by phenomenological descriptions. This is done through thematising certain operative concepts, concepts which remain unthemtised in phenomenology precisely because such thematisation would reveal a founding non-presence intolerable to phenomenology. Deconstruction supplements phenomenology to the extent that it attempts to name, on the fissured margins of phenomenology, the radical alterity uncovered by phenomenology in a way which does not reduce the very otherness of the alterity. However, in the final Chapter, it is argued, from the perspective of Levinas, that Derrida does not in fact manage to find a sense for founding alterity in phenomenology which is ‘beyond metaphysics’. The thesis concludes by arguing that, in order to achieve its strategic aims, as detailed in Chapter 1, the deconstruction of phenomenology needs to be ethically supplemenred, one example of such an ethically supplemented deconstructive reading of Husserl being found in some of the most recent texts of Levinas. Using testosterone alone as a measure of dominance presents problems, especially when dominance is loosely defined to include a range of behaviors that may arise from multiple causes. Testosterone should be examined in relation to other hormonal and neurotransmitter factors, such as serotonin. Various hypotheses about the relationship between high and low levels of testosterone with serotonin and with impulse control are suggested for future study.

While the cultivation of genetically modified organisms (GMO) and the spread of genetically engineered (GE) foods has gone largely unnoticed by the majority of Americans, a growing number of vocal civil society groups are opposing the technology and with it the entire conventional system of food provision. As with other alternative food movements, non-GMO activists focus on changing individual consumption habits as the best means of altering the practices of food manufacturers and thereby what and how food is produced. In (...) this paper I argue that the increasing use of consumerist tactics reflect the neoliberalization of food activism in the United States – a process that rather than heralding sustainable agricultural and economic futures may reinforce the status quo. Using the emerging non-GMO movement, and the associated market for non-GMO products, I challenge the assumptions that consumer sovereignty and freedom of choice will bring about the small-scale, localized alternatives espoused by activists and scholars in the field. Specifically, I explore three critical limitations of contemporary alternative food politics. First, the neoliberalization of activism shifts the responsibility for social reforms from the state and manufactures to individual consumers, bringing with it important social justice implications. Second, focusing on choice opens new spaces for the profit without seriously threatening contemporary market structures or agro-ecological practices. Third, contemporary consumerist politics focus on eating right not less and thereby provide few alternatives to the current trends towards convenience and processed foods. (shrink)

The field of business ethics has been active for several decades, but it has yet to develop a generally agreed upon applied ethical perspective for the discipline. Academics in business disciplines have developed useful science-based models explaining why business people behave ethically but without a generally accepted definition of ethical behavior. Academics in moral philosophy have attempted to formulate what they believe ethical behavior is, but many seem to ignore or reject the basic mission of business. The purpose of this (...) article is to offer one view of ethics in business that accommodates the mission of business. An ambitious and wide-ranging synthesis of the history of environmental thought by a leading philosopher.

Theorizing about human character to understand what it is to be a morally good person and how being morally good relates to acting rightly and living well has always been a central concern of moral philosophy. Traditional virtue theory, however, neglects two significant matters. The first is the sociopolitical dimensions of character: how character is shaped by, supports, and resists domination and subordination. While feminist ethics has begun to theorize virtue in relation to oppression, it shares with traditional virtue theory (...) a second problematic inattention to something of equal importance for understanding character and moral life, namely, bad character or vice. I argue that rich accounts of vice are needed to achieve the aims not only of traditional and feminist ethical theory but also of every moral agent facing the central moral task of trying to become a morally good person leading a morally worthy life. This paper explicates a substantive reorientation in moral theory in general and feminist ethics in particular, arguing for two changes. The first is a move to “critical character theory,” which seeks to understand moral character as both a site and source of domination and subordination, as a center of resistance both to oppression and to change, and as both subject and object of liberatory struggle. The second change is more serious and sustained attention to theorizing vice both as damage inflicted by domination, subordination, and by struggles both to maintain and to resist and overthrow them, and as a mechanism through which domination persists and emancipation is thwarted. Can room be found in between the matter and void of a Newtonian universe for an immaterial and immortal soul? Can followers of Locke with his agnosticism about the nature of substances claim to know that some of them are immaterial? Samuel Clarke, well versed in Locke's thought and a defender both of Newtonian science and Christian orthodoxy, believed he could do both and attempted to prove his case by means of some hard-boiled reductionism. Anthony Collins, a deist whose only (...) lapse from materialism concerned God himself, rejected Clarke's argument. In this paper I discuss their controversy' in order to bring out the state of debate about material systems and consciousness among people influenced by Locke and Newton in the early eighteenth century, and I also assess Clarke's reductionist premise, as he himself frequently invites "the impartial reader" to do. This article analyses Adam Smith's and Sophie de Grouchy's accounts of sympathy to show how they arrive at strikingly different views on whether inequality is a threat to, or precondition of, social order. Where many scholars have recently sought to recover Smith's egalitarianism, I instead focus on how his account of sympathy in The Theory of Moral Sentiments naturalises socioeconomic inequalities, while also highlighting the wider inegalitarian implications of his analysis. I demonstrate that Grouchy was alert to these implications and (...) reveal how her own account of sympathy challenges the moral psychology underlying Smith's position on inequality. By reconstructing Grouchy's response to Smith, I illustrate how retrieving the insights of long‐overlooked thinkers can reorient the way we understand key debates in the history of philosophy, since Grouchy was far more concerned than Smith with exposing how economic inequality imperils the prospects of relating to one another as equals. According to a plausible and influential account of perceptual knowledge, the truth-makers of beliefs that constitute perceptual knowledge must feature in the causal explanation of how we acquire those beliefs. However, this account runs into difficulties when it tries to accommodate time perception – specifically perception of order and duration – since the features we are apparently tracking in such perception are not causal. The central aim of the paper is to solve this epistemological puzzle. Two strategies are examined. The (...) first strategy locates the causal truth-makers within the psychological mechanism underlying time perception, thus treating facts about time order and duration as mind-dependent. This strategy, however, is problematic. The second strategy modifies the causal account of perceptual knowledge to include a non-causal component in the explanation of belief-acquisition, namely chronometric explanation. Applying this much more satisfactory approach to perceptual knowledge of time, we can preserve the mind-independence of order and duration, but not that of time's flow. (shrink)

Christian realism has provided a theological understanding of politics that identifies the limits within which all political choices are made. Those limits are set by a theological understanding of judgment, which reserves the ultimate meaning of history to divine judgment, and by a theological understanding of responsibility, which gives proximate meaning to the choices between greater and lesser goods that are available to human politics. The assessments of global politics offered by Reinhold Niebuhr and other Christian realists during the Second (...) World War and the Cold War which followed owe their influence partly to an astute and historically informed reading of events, but primarily, their influence is due to this basic theological understanding of politics. While the world has changed in ways that clearly reveal limitations in the original formulations of Christian realism, the theological principles of judgment and responsibility continue to provide an understanding of global politics adequate to the new realities of the twenty-first century. This marks the loss of an aspirational element that has been historically important in American public life, and it tends toward the privatization of all moral arguments, not just those that depend on theological claims. To maintain theological integrity, Christian public reasoning will have to become more distinctively Christian, simply because there will be less shared ground to occupy with others. (...)
