BackgroundCentral to ethically justified clinical trial design is the need for an informed consent process responsive to how potential subjects actually comprehend study participation, especially study goals, risks, and potential benefits. This will be particularly challenging when studying deep brain stimulation and whether it impedes symptom progression in Parkinson’s disease, since potential subjects will be Parkinson’s patients for whom deep brain stimulation will likely have therapeutic value in the future as their disease progresses.MethodAs part of an expanded informed consent process (...) for a pilot Phase I study of deep brain stimulation in early stage Parkinson’s disease, an ethics questionnaire composed of 13 open-ended questions was distributed to potential subjects. The questionnaire was designed to guide potential subjects in thinking about their potential participation.ResultsWhile the purpose of the study (safety and tolerability) was extensively presented during the informed consent process, in returned responses 70 percent focused on effectiveness and 91 percent included personal benefit as potential benefit from enrolling. However, 91 percent also indicated helping other Parkinson’s patients as motivation when considering whether or not to enroll.ConclusionsThis combination of responses highlights two issues to which investigators need to pay close attention in future trial designs: (1) how, and in what ways, informed consent processes reinforce potential subjects’ preconceived understandings of benefit, and (2) that potential subjects see themselves as part of a community of Parkinson’s sufferers with responsibilities extending beyond self-interest. More importantly, it invites speculation that a different paradigm for informed consent may be needed. (shrink)

An observation of Hume’s has received a lot of attention over the last decade and a half: Although we can standardly imagine the most implausible scenarios, we encounter resistance when imagining propositions at odds with established moral (or perhaps more generally evaluative) convictions. The literature is ripe with ‘solutions’ to this so-called ‘Puzzle of Imaginative Resistance’. Few, however, question the plausibility of the empirical assumption at the heart of the puzzle. In this paper, we explore empirically whether the difficulty we (...) witness in imagining certain propositions is indeed due to claim type (evaluative v. non-evaluative) or whether it is much rather driven by mundane features of content. Our findings suggest that claim type plays but a marginal role, and that there might hence not be much of a ‘puzzle’ to be solved. (shrink)

Stephen Nathanson's clear-sighted abridgment of Principles of Political Economy, Mill's first major work in moral and political philosophy, provides a challenging, sometimes surprising account of Mill's views on many important topics: socialism, population, the status of women, the cultural bases of economic productivity, the causes and possible cures of poverty, the nature of property rights, taxation, and the legitimate functions of government. Nathanson cuts through the dated and less relevant sections of this large work and includes significant material omitted in (...) other editions, making it possible to see the connections between the views Mill expressed in Principles of Political Economy and the ideas he defended in his later works, particularly On Liberty. Indeed, studying Principles of Political Economy, Nathanson argues in his general Introduction, can help to resolve the apparent contradiction between Mill's views in On Liberty and those in Utilitarianism, making it a key text for understanding Mill’s philosophy as a whole. This essay seeks to set to work on the question of race and the futures of the postcolonial in post-apartheid South Africa through abiding by the site of the indeterminacy between problem and critique. Arguing that reading, in the robust sense offered by Gayatri Spivak and Stuart Hall, is a necessary and urgent response to the question, the paper examines the interventions of three key figures for thinking radical black thought in our time, namely Achille Mbembe's Critique of Black (...) Reason, Nahum Chandler's X: The Problem of the negro as a Problem for Thought, and Qadri Ismail's Culture and Eurocentrism. Through abiding by the stakes of the work of reading in this conjuncture, I argue that it is through resisting the easy route of cultural and relativized difference that the pedagogical work of reading, and teaching reading, for the future, becomes possible. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. X: The Problem of the Negro as a Problem for Thought offers an original account of the African American as an object of discourse, knowledge, and general social practice, conceiving the focus of such a concern -- with W.E.B. Du Bois -- as forms of social and historical problems on an epochal scale, above all the global-level "problem of the color line," as the mark of both historical limit and possibility.

In a recent pair of publications, Richard Bradley has offered two novel no-go theorems involving the principle of Preservation for conditionals, which guarantees that one’s prior conditional beliefs will exhibit a certain degree of inertia in the face of a change in one’s non-conditional beliefs. We first note that Bradley’s original discussions of these results—in which he finds motivation for rejecting Preservation, first in a principle of Commutativity, then in a doxastic analogue of the rule of modus ponens —are problematic (...) in a significant number of respects. We then turn to a recent U-turn on his part, in which he winds up rescinding his commitment to modus ponens, on the grounds of a tension with the rule of Import-Export for conditionals. Here we offer an important positive contribution to the literature, settling the following crucial question that Bradley leaves unanswered: assuming that one gives up on full-blown modus ponens on the grounds of its incompatibility with Import-Export, what weakened version of the principle should one be settling for instead? Our discussion of the issue turns out to unearth an interesting connection between epistemic undermining and the apparent failures of modus ponens in McGee’s famous counterexamples. (shrink)

The field of iterated belief change has focused mainly on revision, with the other main operator of AGM belief change theory, i.e. contraction, receiving relatively little attention. In this paper we extend the Harper Identity from single-step change to define iterated contraction in terms of iterated revision. Specifically, just as the Harper Identity provides a recipe for defining the belief set resulting from contracting A in terms of (i) the initial belief set and (ii) the belief set resulting from revision (...) by ¬A, we look at ways to define the plausibility ordering over worlds resulting from contracting A in terms of (iii) the initial plausibility ordering, and (iv) the plausibility ordering resulting from revision by ¬A. After noting that the most straightforward such extension leads to a trivialisation of the space of permissible orderings, we provide a family of operators for combining plausibility orderings that avoid such a result. These operators are characterised in our domain of interest by a pair of intuitively compelling properties, which turn out to enable the derivation of a number of iterated contraction postulates from postulates for iterated revision. We finish by observing that a salient member of this family allows for the derivation of counterparts for contraction of some well known iterated revision operators, as well as for defining new iterated contraction operators. Development of the cochlear implant, discussed in this article, depended vitally on deaf people being persuaded to undergo implantation. Media "reconstruction" of the device as the "bionic ear" was typically encouraged by implant pioneers. Unexpectedly, however, a "counter-rhetoric" based on a very different understanding of deafness emerged. With it, deaf people are slowly succeeding in gaining influence over the further deployment of the technology. The analysis suggests modifications to existing theoretical models of technological change in medicine.

Against the background assumptions that knowing what clinical ethics consultation represents to those with whom ethics consultants work most closely is a necessary component for being responsible in the practice of ethics consultation, and the complexities of soliciting and understanding colleague evaluations require another inherent responsibility for the methods by which ethics consultations are evaluated, in this article we report our experience soliciting, analyzing, and trying to understand retrospective evaluations of our Clinical Ethics Consultation Service. These evaluations were collected through (...) a quality assessment effort at our institution. Drawing from the qualitative elements of our survey instrument, we describe unexpected variations among the requests for ethics consultation and the retrospective reports from those colleagues making the requests. Focusing on just one aspect – the reason for request – raised several core questions about how we should evaluate those retrospective reports, what could be learned from the differences that we were now encountering, and what we could learn about the process of evaluating our practices. Working through these questions, we suggest several issues to consider in ongoing efforts to describe and evaluate clinical ethics consultation: the role of time and memory in evaluating retrospective evaluations, the importance of attending to the language of moral shift or disruption with which our colleagues describe their experiences, and how to understand the role of ethics consultation in creating ‘moral space’ for colleagues to process their moral experiences. Darwiche and Pearl’s seminal 1997 article outlined a number of baseline principles for a logic of iterated belief revision. These principles, the DP postulates, have been supplemented in a number of alternative ways. Most suggestions have resulted in a form of ‘reductionism’ that identifies belief states with orderings of worlds. However, this position has recently been criticised as being unacceptably strong. Other proposals, such as the popular principle (P), aka ‘Independence’, characteristic of ‘admissible’ operators, remain commendably more modest. In this (...) paper, we supplement the DP postulates and (P) with a number of novel conditions. While the DP postulates constrain the relation between a prior and a posterior conditional belief set, our new principles notably govern the relation between two posterior conditional belief sets obtained from a common prior by different revisions. We show that operators from the resulting family, which subsumes both lexicographic and restrained revision, can be represented as relating belief states associated with a ‘proper ordinal interval’ (POI) assignment, a structure more fine-grained than a simple ordering of worlds. We close the paper by noting that these operators satisfy iterated versions of many AGM era postulates, including Superexpansion, that are not sound for admissible operators in general. (shrink)

The ideas of technological determinism and the autonomy of technology are long-standing and widespread. This article explores why the use of certain technologies is perceived to be obligatory, thus fueling the fatalism of technological determinism and undermining our sense of freedom vis-à-vis the use of technologies. Three main mechanisms that might explain “obligatory technologies” (technologies that must be adopted) are explored. First, competition between individuals or groups drives the adoption of technologies that enhance or extend human capacities. Second, individuals and (...) groups may become dependent on technologies. Third, technologies induce changes in social norms and values that may come to be enforced through various social mechanisms, including the law. The widespread ideology of the beneficence and inevitability of technological progress in our culture helps this process along. (shrink)

“Lambeth Palace is my Washpot. Over Fulham have I cast my breeches.” So declared the novelist and secularist H. G. Wells in a letter to his mistress, Rebecca West, in May 1917. His claim was that, because of him, Britain was “full of theological discussion” and theological books were “selling like hot cakes”. He was lunching with liberal churchmen and dining with bishops. Certainly, the first of the books published during Wells’s short “religious period”, the novel Mr. Britling Sees It (...) Through, had sold very well on both sides of the Atlantic and made Wells financially secure. Geoffrey Studdert Kennedy (“Woodbine Willie”) wrote that, “Everyone ought to read Mr. H. G. Wells’s great novel, Mr. Britling Sees It Through. It is a gallant and illuminating attempt to state the question, and to answer it. His thought has brought him to a very real and living faith in God revealed in Jesus Christ, and has also brought relief to many troubled minds among the officers of the British Army.” Yet, Wells’s God was explicitly a finite God, and his theology was far from orthodox. How can we account for his boast and for the clerical affirmation which he certainly did receive? This article examines and re-evaluates previous accounts of the responses of clergy to Wells’s writing, correcting some narratives. It discusses the way in which many clergy used Mr. Britling as a means by which to engage in a populist way with the question of theodicy, and examines the letters which Wells received from several prominent clerics, locating their responses in the context of their own theological writings. This is shown to be key to understanding the reaction of writers such as Studdert Kennedy to Mr. Britling Sees It Through. Im Aufsatz werden zunächst einige ältere Deutungen der Zustimmung führender Kleriker zu Wells’ Roman untersucht und einige der dabei leitenden Deutungsmuster kritisch infrage gestellt. Deutlich wird, dass nicht wenige anglikanische Geistliche Mr. Britling dazu nutzten, um höchst populistisch das umstrittene Theodizeeproblem anzusprechen. Auch werden die Briefe prominenter Geistlicher an Wells analysiert, mit Blick auf ihre eigenen Publikationen. Diese Reaktionen haben stark Studdert Kennedys Haltung zu Mr. Britling Sees It Through beeinflusst. Besonders aufrichtig war Wells mit Blick auf sich selbst allerdings nicht. The use of Lacanian psychoanalysis in political study has expanded in recent years, however, existing scholarly work focuses on contemporary political issues. Little attempt has been made to apply elements of Lacan’s psychoanalytic theories to moments in political history. This paper is the first to address this. As the popularisation of Lacan in this discipline has largely emerged on the back of the work of Slavoj Žižek, this paper utilises Lacanian theory as interpreted by Žižek. This study selects three aspects (...) of the so-called ‘Chilean Miracle’ and applies elements of Lacanian theory to them to provide fresh insights and understandings. These are: the 1973 coup that replaced Salvador Allende with General Augusto Pinochet as head of state, which is reimagined through Lacan’s ‘Symbolic’; the transition to democracy of 1988-1990, which is submitted to a reinterpretation through Lacan’s ‘transference’; and the reconstruction of the Chilean Socialist Party between 1973 and 1990, which is reinterpreted through Lacanian conceptualisations of ‘desire’. In providing fresh interpretations of these constituent processes of the ‘Chilean Miracle’, this paper demonstrates the validity of ‘taking Lacan back in time’ while simultaneously offering new theoretical approaches to understanding the foundations of contemporary capitalism. Recognizing the right of LGBT students and educators to be out at school.

For much economics research, ethics committee approval is not required. This is seen by some as indicating that there are no ethical issues in economics research. However, ethical research requires more than simply meeting regulatory requirements. If economics research has an impact on perceptions and resulting decisions, then there may be concerns about the nature of the research and its impact. There are a number of arguments that could be raised as to why economics does not describe the real world. (...) What we see is shaped by how we see, so it is important to consider context. This paper considers the simplification that is an inevitable aspect of research. Implications for economic approaches are described, recognising that criticisms can apply to heterodox as well as mainstream approaches. Subjectivity is then discussed, questioning the traditional positive-normative distinction. An additional section relates to the application of economics. It focuses on the significance of rhetoric and the differing roles played by economists, each of which may have their own obligations and expectations. A theme throughout the paper is that of groups and group membership shaping perceptions and behaviour. The paper concludes that there are ethical issues in relation to both how and why economists undertake their work. For many people, open-air preaching is associated with a particularly limited understanding of the nature of the event. In part this is related to the fact that open-air preaching has received relatively little serious academic study. From a variety of sources, however, it is possible to piece together something of a critically analytic sketch of the practice. This sketch demonstrates that not only can open-air preaching claim longevity but that in turn it is a practice with considerable diversity as open-air (...) preachers seek to make meaning through their gathering and encounter with audiences. Background: New Zealand health and disability providers are expected to have local open disclosure policies in place, however, empirical analysis of these policies has not been undertaken. Aim: This study aims to examine the scope and content of open disclosure policies in New Zealand compare open disclosure policies in New Zealand, and provide baseline results for future research. Methods: Open disclosure policies were requested from all twenty New Zealand District Health Boards in June 2016. A total of twenty-one policies were (...) received, with nineteen policies included in the review. The data were analysed using conventional content analysis. Areas of identified guidance were categorised categorized under the headings: 1) identification of an adverse event, 2) actions before disclosure, 3) disclosure of harm, and 4) actions after disclosure. Results: A total of forty-six distinct areas of guidance could be categorized under the different phases of the open disclosure life-cycle. Conclusion: This review has identified significant unwarranted heterogeneity and important gaps in open disclosure documents in New Zealand which urgently needs to be addressed. Open disclosure policies which are both flexible and specific should enhance the likelihood that injured patients’ needs will be met. (shrink)

The political thought of Mohandas K. Gandhi has been increasingly used as a paradigmatic example of hybrid political thought that developed out of a cross-cultural dialogue of eastern and western influences. With a novel unpacking of this hybridity, this article focuses on the conceptual influences that Gandhi explicitly stressed in his autobiography and other writings, particularly the works of Leo Tolstoy and the Bhagavad Gītā. This new tracing of influence in the development of Gandhi’s thought alters the substantive thrust of (...) Gandhi’s thought away from more familiar quasi-liberal interpretations and towards a far more substantive bhakti or devotional understanding of politics. The analysis reveals a conception of politics that is not pragmatic in its use of non-violence, but instead points to a devotional focus on cultivating the self (ātman), ultimately dissolving the public/private distinction that many readings of Gandhi’s thought depend upon.
