It is well-known that Chatton is among the earliest and most vehement critics of Ockham’s theory of judgment, but scholars have overlooked the role Chatton’s criticisms play in shaping Ockham’s final account. In this paper, I demonstrate that Ockham’s most mature treatment of judgment not only contains revisions that resolve the problems Chatton identifies in his earlier theories, but also that these revisions ultimately bring his final account of the objects of judgment surprisingly close to Chatton’s own. To explain the causal relation between institutional rules and people’s actions and expectations, Searle relies upon his concept of the Background, the thesis that intentional states function only given a background of capacities that do not themselves consist in intentional phenomena. Any sentence, for instance, only acquires truth conditions or other conditions of satisfaction against a background of capacities, dispositions, know-how, etc. that are not themselves part of the content of the sentence. This collection of thirteen new essays is the first to examine, from a range of disciplinary perspectives, how the new technologies and global reach of the Internet are changing the theory and practice of free speech.

A defendant’s failure to show remorse is one of the most powerful factors in criminal sentencing, including capital sentencing. Yet there is currently no evidence that remorse can be accurately evaluated in a courtroom. Conversely there is evidence that race and other impermissible factors create hurdles to evaluating remorse. There is thus an urgent need for studies about whether and how remorse can be accurately evaluated. Moreover, there is little evidence that remorse is correlated with future law-abiding behavior or other (...) legitimate penal purposes, and, in fact, there is evidence that remorse is often conflated with shame, which is correlated with increased future criminality. More accurate information on the nature and evaluation of remorse can be used to reform the criminal justice system. (shrink)

Public bioethics bodies are used internationally as institutions with the declared aims of facilitating societal debate and providing policy advice in certain areas of scientific inquiry raising questions of values and legitimate science. In the United States, bioethical experts in these institutions use the language of consensus building to justify and define the outcome of the enterprise. However, the implications of public bioethics at science-policy boundaries are underexamined. Political interest in such bodies continues while their influence on societal consensus, public (...) debate, and science policy remains ambiguous. This article presents a theoretical discussion of public bioethics bodies as boundary organizations and examines them in terms of relationship to the moral and cognitive authority of science and other forms of expertise, mechanisms for public participation in controversial science policy, and the deployment of consensus models. Variability in the symptom experience in patients diagnosed with chronic conditions may be related to social determinants of health (SDoH). The purpose of this critical review was to (1) summarize the existing literature on SDoH and symptom clusters (i.e., multiple, co‐occurring symptoms) in patients diagnosed with common chronic conditions, (2) evaluate current variables and measures used to represent SDoH, (3) identify gaps in the evidence base, and (4) provide recommendations for the incorporation of SDoH into future symptom cluster research. We (...) identified 118 articles including information on SDoH in chronic condition symptom cluster research. Articles primarily focused on cancer populations. Few articles had the explicit purpose of investigating relationships between SDoH and symptom clusters, and the inclusion of SDoH was often limited to variables used to describe samples. Future studies should be designed to “move beyond Table 1” in their utilization of SDoH as variables and examine relationships between SDoH and symptom clusters. Attention should be paid to the appropriateness of measures being used to collect information on SDoH, and analysis methods that estimate causal connections between variables should be considered. Research regarding the relationship of SDoH with symptom clusters in patients with chronic conditions has the potential to reveal mechanisms of symptom disparities and guide changes to alleviate these disparities. BackgroundThe public and healthcare workers have a high expectation of animal research which they perceive as necessary to predict the safety and efficacy of drugs before testing in clinical trials. However, the expectation is not always realised and there is evidence that the research often fails to stand up to scientific scrutiny and its 'predictive value' is either weak or absent.DiscussionProblems with the use of animals as models of humans arise from a variety of biases and systemic failures including: 1) (...) bias and poor practice in research methodology and data analysis ; 2) lack of transparency in scientific assessment and regulation of the research; 3) long-term denial of weaknesses in cross-species translation; 4) profit-driven motives overriding patient interests; 5) lack of accountability of expenditure on animal research; 6) reductionist-materialism in science which tends to dictate scientific inquiry and control the direction of funding in biomedical research.SummaryBias in animal research needs to be addressed before medical research and healthcare decision-making can be more evidence-based. Research funding may be misdirected on studying 'disease mechanisms' in animals that cannot be replicated outside tightly controlled laboratory conditions, and without sufficient critical evaluation animal research may divert attention away from avenues of research that hold promise for human health. The potential for harm to patients and trial volunteers from reliance on biased animal data1 requires measures to improve its conduct, regulation and analysis. This article draws attention to a few of the many forms of bias in animal research that have come to light in the last decade and offers a strategy incorporating ten recommendations stated at the end of each section on bias. The proposals need development through open debate and subsequent rigorous implementation so that reviewers may determine the value of animal research to human health. A theory of conceptual development must provide an account of the innate representational repertoire, must characterize how these initial representations differ from the adult state, and must provide an account of the processes that transform the initial into mature representations. In Carey, 2009 (The Origin of Concepts), I defend three theses: 1) the initial state includes rich conceptual representations, 2) nonetheless, there are radical discontinuities between early and later developing conceptual systems, 3) Quinean bootstrapping is one learning mechanism that underlies (...) the creation of new representational resources, enabling such discontinuity. I also claim that the theory of conceptual development developed in The Origin of Concepts addresses two of Fodor's challenges to cognitive science; namely, to show how learning could possibly lead to an increase in expressive power and to defeat Mad Dog Nativism, the thesis that all concepts lexicalized as mono-morphemic words are innate. A recent article by Georges Rey (Mind & Language, 29.2, 2014) argues that my responses to Fodor's challenges fail, because, he says, I fail to distinguish concept possession from manifestation and I do not confront Goodman's new riddle of induction. My response is to show that, and how, new primitives in a language of thought can be learned, that there are easy routes and hard ones to doing so, and that characterizing the learning mechanisms involved is the key to understanding both concept possession and constraints on induction. This paper traces a rather peculiar debate between William Ockham, Walter Chatton, and Robert Holcot over whether it is possible for God to know more than he knows. Although the debate specifically addresses a theological question about divine knowledge, the central issue at stake in it is a purely philosophical question about the nature and ontological status of propositions. The theories of propositions that emerge from the discussion appear deeply puzzling, however. My aim in this paper is to show that (...) there is a way of making sense of these views (and, by implication, of much of what is puzzling about medieval theories of propositions). The key, I argue, lies in getting clear about the precise theoretical roles these thinkers assign to propositions in their accounts of propositional attitudes. (shrink)

Critical discourse analysis (CDA) and other forms of discourse analysis are regularly used to study identity, but rarely do researchers systematically compare and contrast them with other theories to identify exactly what a discursive approach contributes. In this paper, we take the example of a particular identity – the older worker – and systematically compare the contribution of CDA with other approaches, including economics, labour market research, gerontology and cultural studies. In so doing, we show the kinds of research questions (...) that CDA can address, which other theories grappling with identity cannot. In this way, we hope to delineate more clearly what CDA is, to identify specifically how it contributes to the study of identity, and to show what it can do, compared to other theories. (shrink)

The 2011 Historical Materialism Conference in London saw the launch of a Marxist-Feminist set of panels. This issue is inspired by the success of those panels, and the remarkably sustained interest in reviving and moving beyond older debates and discussions. The special issue’s focus, Social-Reproduction Feminism, reflects and contextualises the ongoing work and engagement with that thematic that has threaded through the conferences in the 2010s. This Introduction provides a summary overview of the Social-Reproduction Feminism framework, situating it within Marxist-Feminist (...) thinking and politics more generally, and calls on readers to consider its promise and potential as an historical-materialist approach to understanding capitalist social relations in terms of an integrated totality. In introducing the works included in this special issue, this essay identifies some general ways that these and other narratives can function in ethical explorations in the field of education. The essay not only articulates ways that narratives can be useful to education scholars, but it also provides pedagogical reasons to connect stories with ethics in classrooms. Moral naturalism, as I use the term here, is the view that there are moral facts in the natural world – facts that are both natural and normative – and that moral claims are true or false in virtue of their corresponding or not to these natural facts. Moral naturalists argue that, since moral claims are about natural facts, we can establish the truth about moral claims through empirical investigation. Moral knowledge, on this view, is a form of empirical knowledge.One (...) objection to this metaethical view is that even if moral naturalists are correct in their claims about truth, they cannot answer the question of normativity. With the male body, the trajectory has been different. Fashion has taken the lead, the movies have followed. Hollywood may have been a chest-fest in the fifties, but it was male clothing designers [e.g., Calvin Klein] who went south and violated the really powerful taboos--not (...) just against the explicit depiction of penises and male bottoms but against the admission of all sorts of forbidden "feminine" qualities into mainstream conceptions of manliness. . . . Images of masculinity that will do double (or triple or quadruple) duty with a variety of consumers, straight and gay, male and female, are not difficult to create in a culture like ours, in which the muscular, male body has a long and glorious aesthetic history. The chapter focuses on “The Bicentennial Man” for a discussion of Machine Metaethics. It argues that a good idea is to begin to make ethics computable by creating a program enabling a machine to act as an ethical advisor for human beings facing traditional ethical dilemmas. The ultimate goal of Machine Ethics, to create autonomous ethical machines, will be a far more difficult task. In particular, it will require that a judgment be made about the status of the machine itself, (...) which is difficult to make. The chapter considers whether a robot like Andrew possessed the characteristics philosophers have considered necessary for having moral standing and so whether it was wrong to force him to follow principles that expected him to be a slave for human being. It finally argues that Asimov's “Three Laws of Robotics” are an unsatisfactory basis for Machine Ethics, regardless of the status of the machine. (shrink)
