Even in the Netherlands, where the practice of physician-assisted death (PAD) has been legalized for over 20 years, there is no such thing as a ‘right to die’. Especially patients with extraordinary requests, such as a wish for PAD based on psychiatric suffering, advanced dementia, or (a limited number of) multiple geriatric syndromes, encounter barriers in access to PAD. In this paper, we discuss whether these barriers can be justified in the context of the Dutch situation where PAD is legally (...) permitted for those who suffer unbearably and hopelessly as a result of medical conditions. Furthermore, we explore whether there are options to address some of the barriers or their consequences, both within the Dutch legal framework or by adjusting the legal framework, and whether these options are feasible. We conclude that although there are insufficient arguments to overrule the doctor’s freedom of conscience in the Netherlands, there are ways to address some of the barriers, mainly by offering support to doctors that would be willing to support a request. Moreover, we believe it is morally required to reduce or mitigate where possible the negative consequences of the barriers for patients, such as the long waiting time for those who suffer from psychiatric disorders, because it is unlikely the adjustments suggested to the system will ensure reasonable access for these patient groups. This book analyzes its role and its rhetoric in Hegel, Nietzsche, Benjamin, Adorno, and Heidegger in order to account for the topic's enduring persistence. Philosophy's role is typically a reflective one. Yet this stance is in peril of being corrupted. Because it is being driven to specialized inquiries, the subdisciplines of which it is comprised may develop into separate fields, whose presence will then need to be justified in the same way the sciences are. This is impossible, however, given their diverging objectives. In the first three sections, I argue that Hobbes has a distinctive conception of philosophy, the highest value of which is not truth, but human benefit; and that his philosophical utterances are constrained by this value (both insofar as they are philosophical in particular, and insofar as they are public utterances of any kind). I address an evidentiary problem for this view in the penultimate section, and then turn to the question of how such a conception of philosophy (...) requires different interpretations of particular philosophical positions. ONE OF THE PECULIARITIES of philosophy is that every attempt to isolate a particular philosophical question, a question about the most familiar aspect of our daily experience, is transformed, the moment we begin to reflect carefully about the meaning of that question, into the universal problem of the nature of philosophy itself. The decision, for example, to concentrate our attention upon the analysis of the "logic" of ordinary linguistic usage, depends, if it is truly philosophical, upon prior decisions (...) concerning the meanings of "logic" and "ordinary," upon a decision concerning a "criterion of significance" or the decision process itself: upon the "meaning of meaning." We cannot ask a philosophical question unless philosophy is already present as a response to the fundamental or universal questions underlying every particular question. Of course, as members of an established philosophical movement, we may beg these universal questions by assuming them to have already been answered, but the moment we do this, we cease to be philosophers, and become technicians instead. Technë is not in itself philosophical, but is an instrument of philosophy; as an instrument, it may be employed by mutually contradictory philosophies, and its significance depends upon the end toward which it is applied. More specifically, a technë is a way of doing, and so there are as many technai as there are ways of doing. In each case, a technë is a skill in doing something which one has previously decided to do, on grounds other than the technë itself. If we decide to do something merely because we are able to do it, then we may be successful, but we shall not be philosophers. In such a case, philosophy is present only when the significance of success is questioned. (shrink)

The aim of Dimitris Vardoulakis’s paper, ‘Toward a Critique of the Ineffectual: Heidegger’s Reading of Aristotle and the Construction of an Action without Ends’, is to provide the foundation for a critique of aimless action by tracing its genesis to Heidegger’s putative misinterpretation of Aristotelian phronēsis (practical wisdom) in the 1920s. Inasmuch as ‘the ineffectual’—the name Vardoulakis gives to action devoid of ends—plays a crucial role in post-Heideggerian continental philosophy, he thereby seeks to diagnose and to provide an aetiology (...) of an illness afflicting contemporary thought. In my response, I will first argue that, while Vardoulakis is right to identify an emphasis on the ineffectual in Heidegger, he is mistaken about its origin. Heidegger does not strip phronēsis of instrumentality, nor does he mistranslate Nichomachean Ethics 1139a31–32. Second, I trace an alternative source for the ineffectual, which is not simply a negative alternative to technological machination but stems from a positive experience of what Meister Eckhart, and Heidegger in his wake, called life without why. Finally, I look at a couple of texts, including one discussed by Vardoulakis, in which even the later Heidegger is not entirely dismissive of calculative instrumentality but instead assigns the latter to a secondary, restricted site of competence. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

Theodor Adorno’s reputation as a cultural critic has been well-established for some time, but his status as a philosopher remains unclear. In _Adorno and the Ends of Philosophy_ Andrew Bowie seeks to establish what Adorno can contribute to philosophy today. Adorno’s published texts are notably difficult and have tended to hinder his reception by a broad philosophical audience. His main influence as a philosopher when he was alive was, though, often based on his very lucid public lectures. The “end of history” by Fukuyama is mainly based on Hegel’s treatise of the end of history and Kojeve’s corresponding interpretation. But Hegel’s “end of history” is a purely philosophical question, i.e., an ontological premise that must be fulfilled to complete “absolute knowledge.” When Kojeve further demonstrates its “universal and homogeneous state,” Fukuyama extends it into a political view: The victory of the Western system of freedom and democracy marks the end of the development of human history and Marxist theory (...) and practice. This is a misunderstanding of Hegel. Marx analyzes, scientifically, the historical limitation of Western capitalism and maintains, by way of a kind of revolutionary teleology, the expectation of and belief in human liberation, which is the highest historical goal.
