Documenting capacity assessments and identifying substitute decisionmakers in healthcare facilities is ethically required for optimal patient care. Lack of such documentation has the potential to generate confusion and contention among patients, their family members, and members of the healthcare team. An overview of our research at the Ottawa Hospital and issues that influence the consistency of documentation in the Canadian context are presented here, as well as ideas for the mitigation of these issues and ways to encourage better documentation.

Ethics consultation services provide support to staff, patients, and family members who find themselves in morally difficult situations in healthcare settings. Not unlike other clinical consultation services, ethics consultation activities should be well documented. Good documentation allows for evaluation of the consultation process and the ability to refer back to consults when needed, and provides data for future research in healthcare ethics (HCE).In our exploration of existing HCE documentation systems, we identified two main points of interest. First, HCE information documentation (...) systems are powerful tools for providing information on ethics consultation services. These documentation systems can be used to produce detailed reports on various HCE activities both institutionally and cross-institutionally. Second, our findings indicate greater agreement in the language and terminology of HCE needs to be established. Cultivation of such common language is needed in order to develop a standard healthcare ethicists can use to document and categorize consults. Standardization of language would allow data to be readily comparable and lead to more consistency in documentation of ethics consultations. Ultimately, standardization of documentation can also constitute a standard of practice for HCE in general. The development of such standards is essential for any developing profession, and will be required for HCE as it moves in towards professionalization in Canada. (shrink)

It is becoming widely recognized that dissemination of research results to participants is an important action for the conclusion of a research study. Most research institutions have standardized consent documents or templates that they require their researchers to use. Consent forms are an ideal place to indicate that results of research will be provided to participants, and the practice of inserting statements to this effect is becoming more conventional. In order to determine the acceptance of this practice across Canada we (...) conducted an assessment of 121 institutional consent document templates from 65 institutions looking for language that endorsed results dissemination to participants. About half of the documents we examined had language included which stated that results should be made available. Lockdown measures in response to the COVID-19 pandemic involve placing huge burdens on some members of society for the sake of benefiting other members of society. How should we decide when these policies are permissible? Many writers propose we should address this question using cost-benefit analysis, a broadly consequentialist approach. We argue for an alternative non-consequentialist approach, grounded in contractualist moral theorising. The first section sets up key issues in the ethics of lockdown, and sketches the apparent appeal of addressing (...) these problems in a CBA frame. The second section argues that CBA fundamentally distorts the normative landscape in two ways: first, in principle, it allows very many morally trivial preferences—say, for a coffee—might outweigh morally weighty life-and-death concerns; second, it is insensitive to the core moral distinction between victims and vectors of disease. The third section sketches our non-consequentialist alternative, grounded in Thomas Scanlon’s contractualist moral theory. On this account, the ethics of self-defence implies a strong default presumption in favour of a highly restrictive, universal lockdown policy: we then ask whether there are alternatives to such a policy which are justifiable to all affected parties, paying particular attention to the complaints of those most burdened by policy. In the fourth section, we defend our contractualist approach against the charge that it is impractical or counterintuitive, noting that actual CBAs face similar, or worse, challenges. (shrink)

The received view in Thomas Hobbes scholarship is that theindividual rights described by Hobbes in his political writings andspecifically in Leviathan are simple freedoms or libertyrights, that is, rights that are not correlated with duties orobligations on the part of others. In other words, it is usually arguedthat there are no claim rights for individuals in Hobbes''s politicaltheory. This paper argues, against that view, that Hobbes does describeclaim rights, that they come into being when individuals conform to thesecond law (...) of nature and that they are genuine moral claim rights, thatis, rights that are the ground of the obligations of others to forebearfrom interfering with their exercise. This argument is defended againstboth Jean Hampton''s and Howard Warrender''s interpretations of rights inHobbes''s theory. This book is a comprehensive and unique text and reference in medical ethics. By far the most inclusive set of primary documents and articles in the field ever published, it contains over 100 selections. Virtually all pieces appear in their entirety, and a significant number would be difficult to obtain elsewhere. The volume draws upon the literature of history, medicine, philosophical and religious ethics, economics, and sociology. A wide range of topics and issues are covered, such as law and medicine, (...) truth-telling by the physician, research, population policy, genetics, abortion, dying, and individual rights in medical care. He was too human, too sensritive, too blunt. On rereading the book forty-two years 1ater I say, yes, he certainly will be canonized precisely because he was human and sensitive and blunt. He had these qualities because he was honest. He was painfully honest. His greatest virtue was his honesty. He said what he thought and, since at times he thought some very unpopular thoughts, he got into plenty of trouble. As an Anglican he saw that the great stumbling block for himself and his friends in the via media was the Thirty Nine Articles. How could he and the others subscribe to them, so Protestant were they in tone? Newman wanted to show that the articles condemning ' Roman doctrine ' were really affirming ' Catholic teaching ' of early centuries, were condemning only some of the ' Roman doctrine ' while affirming others, and were clearly condemning the dominant error of Roman devotional practices. So he wrote his famous Tract 90. The roof fell in. It was condemned by Oxford dons 1and, as Newman wrote in the Apologia, "in every part of the country and every class of society, through every organ and opportunity of opinion, in newspapers, in periodicals, at meetings, in pulpits, at dinner tables, in coffee-rooms, in railway carriages, I was denounced as a traitor." As 1a Catholic he followed the same sort of scenario when he became editor of the Rambler. He had long been meditating on the role of the BOOK REVIEWS 761 layman in the Catholic Church and published his thoughts in the Rambler. His " On Consulting the Faithful in Matters of Doctrine " put him in a very bad light with the English Catholic bishops, one of whom sent the essay to Rome with the charge of heresy. So again he was denounced, and as a result lost his position of honor among the English Catholics. Only after he had written some years later that masterpiece of honesty, the Apologia, was his reputation restored in England, and only after he had been named a Cardinal by the gallant Leo XIII, was it restored in Rome. Miller's book is a fascinating account of Newman's honest thoughts about the Church. Newman was not a systematic theologian,.never wrote a systematic treatment on the Church. One has to comb through his books to piece together a coherent picture. Miller has gone further. He has combed through the recently published Letters and Diaries to catch the fuller view. In the days of a beleaguered Pius IX, a watchful Propaganda and the English ultramontanists, Newman was circumspect in his published remarks about the Church. He saw how wrong it would be to stir up trouble before a watching, largely Church of England world. So he was patient and publicly silent before decisions made by prominent ecclesiastics he did not agree with, and he trusted that the Lord would bring things right in good time. But in letters to close friends he was candid and blunt. This candor and bluntness is the heart, and also the spice, of Miller's book. The two most prominent preoccupations of Newman concerning the Church were the role ·of theology and the position of the layman. Curran engages both of these concerns by critically tracing five historical strands that have shaped moral theology: sin, reconciliation, and the manuals of moral theology; Thomas Aquinas and the Thomistic tradition; natural law; the papal teaching office; and the Second Vatican Council.The bulk of Curran’s discussion consists of chapter-length treatments of each of these strands. This approach lends analytical clarity to a tradition with a varied, [End Page 219] complex history, and provides the foundation for his later synthetic, evaluative discussion. The first chapter is characteristic of the manner in which subsequent chapters proceed: Curran begins with biblical treatments of the rupturing effects of sin before moving on to the emergence of formalized approaches to dealing with sin via penitential processes and, later, the manuals of moral theology. Incorporated into this historical discussion are evaluative and prescriptive claims. For example, in contrast to the dynamic and rich biblical understanding of the nature of sin, Curran suggests that the manuals of moral theology both possess an insufficiently full understanding of the reality of sin and conversion and distort the meaning of sin by focusing on the objective act alone (24).The second through fourth chapters proceed in similar fashion, with critical readings of the varied history of each strand that underscore the internal pluralism of Catholic moral theology. The lack of an initial chapter establishing the meaning and significance of Curran’s study or of a conceptual framework to guide the reader in navigating deep and what are sure to many to be unfamiliar historical waters may leave some readers disoriented. Such a chapter would have been helpful in establishing a broader context for the study and identifying themes that arise repeatedly in the course of the discussion, for example: the nature of authority and dissent, the relationship between philosophy and theology, the relationship between truth and historical consciousness, and the nature of tradition as “living,” to name a few. Autism research is increasingly moving to a view centred around sensorimotor atypicalities instead of traditional, ethically problematical, views predicated on social-cognitive deficits. We explore how an enactivist approach to autism illuminates how social differences, stereotypically associated with autism, arise from such sensorimotor atypicalities. Indeed, in a state space description, this can be taken as a skewing of sensorimotor variables that influences social interaction and so also enculturation and habituation. We argue that this construal leads to autism being treated on a (...) par with other sensorimotor atypicalities such as blindness or atypical height. This leads to our conclusion that, insofar there is an ethical call to inclusion in our public sphere regardless of contingent bodily difference, an enactivist take on autism naturally leads to extending such inclusion to autism. Moreover, our analysis suggests a concrete way forward to achieve inclusion of autistics: by being more attentive to autistic sensorimotor specifics. (shrink)

When infrastructural technology is functioning correctly, it is often considered to recede from view and become invisible. According to this perspective, visibility is restored in cases of breakdown and malfunction, which for this reason, are often understood to represent important epistemic opportunities for grasping previously hidden aspects of infrastructure. This article seeks to outline the limitations of the idea that infrastructural failure has a positive epistemic function by distinguishing between two fundamentally different ways in which the nature of technological function (...) can be conceptualised; the first understands function as stemming primarily from the way a technology was designed and produced, the second as a process sustained by constant human activities of maintenance and repair. After illustrating how a number of recent studies of infrastructure build upon insights granted by the latter process perspective, this article aims to demonstrate how the experience of breakdown itself does little to facilitate a shift towards understanding infrastructure in this way. For this reason, this article ends with a suggestion for a shift in emphasis in studies of infrastructure, away from breakdown and towards a sustained examination of everyday practices of maintenance, repair and modification of infrastructural technologies. Industrial emissions of greenhouse gases are significant contributors to climate change, which poses a grave threat to social and economic systems. Our understanding of what might drive firms to reduce their emissions of these gases, however, is incomplete, and it is not clear that the knowledge gained from other environmental issues will readily apply to these emissions. We argue and find that indicators of environmental injustice previously shown to relate to toxic pollutants, for example, are poor predictors of greenhouse gas (...) emissions. Instead, we show that the degree of belief in and concern about climate change in a local community is a significant predictor of the facility’s rate of emission improvements. Furthermore, we find that beliefs at both the facility and headquarter communities influence emission reduction, and that those effects are substitutes for each other. (shrink)

Most comparisons of Thomas Hobbes and Baruch Spinoza focus on the difference in understanding of natural right. We argue that Hobbes also places more weight on a rudimentary and exclusive education of the public by the state. We show that the difference is related to deeper disagreements over the prospect of Enlightenment. Hobbes is more sanguine than Spinoza about using the state to make people rational. Spinoza considers misguided an overemphasis on publicly educating everyone out of superstition—public education is (...) important, but modes of superstition may remain and must be offset by institutions and a civil religion. The differences are confirmed by Spinoza’s interest in the philosopher who stands apart and whose flourishing may be protected, but not simply brought about, by rudimentary public education. Spinoza’s openness to a wisdom-loving elite in a democracy also sets up an interesting parallel with Thomas Jefferson’s own commitment to the natural aristocracy needed to sustain republicanism. In demonstrating the 17th century philosopher’s skepticism toward using the state exclusively to promote rationality, even as he recognizes the importance of a sovereign pedagogical role and the protection of philosophy, we move to suggest that Spinoza is relevant to contemporary debates about public education and may reinvigorate moral and political discourse in a liberal democracy. Robots equipped with artificial intelligence pose a huge challenge to traditional ontological differentiations between the spheres of the human and the non-human. Drawing mainly from neo-animistic and perspectivist approaches in anthropology and science and technology studies, the paper explores the potential of new forms of interconnectedness and rhizomatic entanglements between humans and a world transcending the boundaries between species and material spheres. We argue that intelligent robots meet virtually all criteria Western biology came up with to define ‘life’ and that (...) it ultimately makes sense to recognize them as a new species that is part of our social universe. Contrasting dualistic concepts of man and nature with a monistic approach, we show that traditional properties of life (agency, self-replication, etc.) may apply to artefacts and that, once we accept the idea that social relationships are ultimately open connections to matter of any kind, the seemingly strict boundaries between species and material spheres can no longer be sustained. Instead, we propose to include ‘matter’ and ideas into the sphere of the social as agents in their own right to form a _relational ontology of multi-species assemblages_ (ROMA). (shrink)

This article describes the development, implementation, and evaluation of a complex methotrexate ethics case used in teaching a Pharmacy Law and Ethics course. Qualitative analysis of student reflective writings provided useful insight into the students’ experience and comfort level with the final ethics case in the course. These data demonstrate a greater student appreciation of different perspectives, the potential for conflict in communicating about such cases, and the importance of patient autonomy. Faculty lessons learned are also described, facilitating adoption of (...) this methotrexate ethics case by other healthcare profession educators. (shrink)

David Hilbert sought to secure the epistemic foundations of mathematics by providing consistency proofs of axiomatized mathematical theories from within the finite standpoint. This standpoint requires concrete constructions without reference to completed infinities. In 1938, Gerhardt Gentzen proved the consistency of first-order Peano Arithmetic relying on the well-ordering of certain ordinal notations. This was thought by Gentzen and Paul Bernays to be finitistically acceptable. However, a finitistically acceptable proof of the relevant well-ordering was not available until Gaisi Takeuti’s proof in (...) 1978. Beginning with the proposition that Takeuti’s proof conforms to the finite standpoint, this chapter explores the limits of a finitism based on the methods of Gentzen and Takeuti. It is argued that the upper limit is the Feferman-Schütte ordinal, and thus that finitism may be extended to strong subsystems of second-order arithmetic-systems strong enough to provide a theory of the ordinals for which Gentzen employed notations. Within the scope of the POPULISMUS research project, we have engaged in a methodological cross-fertilization between Essex School-inspired methods of analysis and computer-assisted text analysis. In this chapter, emphasis is placed on the Greek case and the material analyzed involves newspaper articles from the 2014–5 period. In particular, the analysis focuses on the antagonistic language games developed around representations of ‘the people’ and ‘populism’. Highlighting the need to study anti-populism together with populism, something that has not attracted much attention in (...) the relevant bibliography, and focusing on their mutual constitution from a discourse-theoretical as well as lexicometric perspective, we articulate a comprehensive analysis of the populist and anti-populist press in Greece, with broader implications for populism research globally. In the European Enlightenments it was often argued that moral conduct rather than adherence to certain theological doctrines was the true measure of religious belief. Thomas Ahnert argues that this characteristically “enlightened” emphasis on conduct in religion was less reliant on arguments from reason alone than is commonly believed. In fact, the champions of the Scottish Enlightenment were deeply skeptical of the power of unassisted natural reason in achieving “enlightened” virtue and piety. They advocated a practical program of “moral (...) culture,” in which revealed religion was of central importance. Ahnert traces this to theological controversies going back as far as the Reformation concerning the key question of early modern theology, the conditions of salvation. Public participation is well known for its practitioner insights and wealth of case reports. This knowledge is essential and has been well employed. Likewise, the theoretical literature on public participation is growing rapidly. The need for better conceptual and theoretical understandings of public participation has become clear. Public participation theories have not received great attention, and few have been proposed or tested. Yet theory offers much to practitioners of various interventions. The authors summarize work toward developing a public participation theory (...) and propose a way to conceptualize its skeletal components. The authors recognize that any theory must acknowledge that different people have different beliefs about what public participation should accomplish. Further, contextual variables affect a process’s character and outcomes. The authors begin with a discussion of theory’s importance to scholars, practitioners, and participants and provide an overview of existing approaches. The authors present findings from two empirical case studies used to further develop their theory of fair and competent public participation. They conclude with some observations about challenges and ways forward. (shrink)

In this discussion I argue that Peter Sullivan is wrong to suggest that Wittgenstein's position in the Philosophical Investigations involves a commitment to transcendental idealism. I show that Sullivan's interpretation involves holding that transcendental idealism was employed by Wittgenstein in the attempt to combat a Platonist mythology. I show, through a detailed appraisal of Wittgenstein's discussion of samples, that Wittgenstein's approach to Platonism does not involve any such employment of transcendental idealism. I conclude that there is no such motivation as (...) Sullivan finds in Wittgenstein for endorsing transcendental idealism, and that we ought not, therefore, ascribe to him such a view. (shrink)

Eugene Wigner's several general discussions of symmetry and invariance principles are among the canonical texts of contemporary philosophy of physics. Wigner spoke from a position of authority, having pioneered for recognition of the importance of symmetry principles from nuclear to molecular physics. But perhaps recent commentators have not sufficiently stressed that Wigner always took care to situate the notion of invariance principles with respect to two others, initial conditions and laws of nature. Wigner's first such general consideration of invariance principles, (...) an address presented at Einstein's 70th birthday celebration, held in Princeton on 19 March 1949, began by laying out just this distinction, and in a way that seems to suggest that the three notions arise through abstraction in an analysis of the general problem of cognition in the natural sciences: The world is very complicated and it is clearly impossible for the human mind to understand it completely. Man has therefore devised an artifice which permits the complicated nature of the world to be blamed on something which is called accidental and thus permits him to abstract a domain in which simple laws can be found. The complications are called initial conditions; the domain of regularities, laws of nature. the underlying abstraction is probably one of the most fruitful the human mind has made. It has often been observed that color is a highly preferred attribute for use in distinguishing descriptions, that is, referring expressions produced with the purpose of identifying an object within a visual scene. However, most of these observations were based on visual displays containing only colors that were maximally different in hue and for which the language of experimentation possessed basic color terms. The experiments described in this paper investigate whether speakers’ preference for color is reduced if the color of (...) the target referent is similar to that of the distractors. Because colors that look similar are often also harder to distinguish linguistically, we also examine the impact of the codability of color values. As a third factor, we investigate the salience of available alternative attributes and its impact on the use of color. The results of our experiments show that, while speakers are indeed less likely to use color when the colors in a display are similar, this effect is mostly due to the difficulty in naming similar colors. Color use for color with a basic color term is affected only when the colors of target and distractors are very similar (yet still distinguishable). The salience of our alternative attribute size, manipulated by varying the difference in size between target and distractors, had no impact on the use of color. (shrink)

For successful goal-directed behavior, a performance monitoring system is essential. It detects behavioral errors and initiates behavioral adaptations to improve performance. Two electrophysiological potentials are known to follow errors in reaction time tasks: the error-related negativity, which is linked to error processing, and the error positivity, which is associated with subjective error awareness. Furthermore, the correct-related negativity is linked to uncertainty about the response outcome. Here we attempted to identify the involvement of the nucleus accumbens in the aforementioned performance monitoring (...) processes. To this end, we simultaneously recorded cortical activity and local field potentials during a flanker task performed by four patients with severe opioid abuse disorder who underwent electrode implantation in the NAc for deep brain stimulation. We observed significant accuracy-related modulations in the LFPs at the time of the ERN/CRN in two patients and at the time of Pe in three patients. These modulations correlated with the ERN in 2/8, with CRN in 5/8 and with Pe in 6/8, recorded channels, respectively. Our results demonstrate the functional interrelation of striatal and cortical processes in performance monitoring specifically related to error processing and subjective error awareness. (shrink)
