Civil law norms give a considerable space for ethical value judgments. In this respect, the key role is played by the provisions called “general clauses” that refer to extra-juridical value judgments and oblige to take them into account in the process of deciding in civil law cases. The purpose of such clauses is to ensure the necessary flexibility of law and to influence the shaping of proper human relations. In the field of economic activity they are to favour the attitudes (...) of honesty, of mutual trust and of readiness to serve others – the values which constitute a basis for the system of free market competition. A separate question is how to realize these assumptions in the practice of adjudicating which remains the task of courts and tribunals and their case law. (shrink)

In this paper, we are interested in parallels to the classical notions of special subsets in defined in the generalized Cantor and Baire spaces (2κ and ). We consider generalizations of the well‐known classes of special subsets, like Lusin sets, strongly null sets, concentrated sets, perfectly meagre sets, σ‐sets, γ‐sets, sets with the Menger, the Rothberger, or the Hurewicz property, but also of some less‐know classes like X‐small sets, meagre additive sets, Ramsey null sets, Marczewski, Silver, Miller, and Laver‐null sets. (...) We notice that many classical theorems regarding these classes can be relatively easy generalized to higher cardinals although sometimes with some additional assumptions. We present the (Lascar) Galois group of any countable theory as a quotient of a compact Polish group by an F_σ normal subgroup: in general, as a topological group, and under NIP, also in terms of Borel cardinality. This allows us to obtain similar results for arbitrary strong types defined on a single complete type over ∅. As an easy conclusion of our main theorem, we get the main result of [K. Krupiński, A. Pillay and T. Rzepecki, Topological dynamics and (...) the complexity of strong types, Israel J. Math.228 (2018) 863–932] which says that for any strong type defined on a single complete type over ∅, smoothness is equivalent to type-definability. We also explain how similar results are obtained in the case of bounded quotients of type-definable groups. This gives us a generalization of a former result from the paper mentioned above about bounded quotients of type-definable subgroups of definable groups. (shrink)

Composite Structure of Personal Networks, Age, and Well-being in Poland Traditionally aging research focused on the disintegration of social ties, however it has recently been observed that whom we contact has a larger impact on well-being. The authors used data from the Social Networks II module of the International Social Survey Programme to investigate the role of social network components in successful aging. A factor analysis on 1221 Polish participants revealed 4 factors that were interpreted as: close, medium, and distant (...) family, and friends. Well-being variables were most strongly related to contact with distant family, while SS variables were most strongly related to friends. Given SS was strongly related to distant family, while perceived SS was strongly related to close family. All family contacts decreased with age, though only distant family contacts were proactively managed. These results indicate the importance of distant family in Poland, in contrast to other countries. (shrink)

In this interview, Tomasz Zarębski speaks with Allan Janik, co-author of _Wittgenstein’s Vienna_ (1973, with Stephen Toulmin), on the occasion of the 50 th anniversary of the publication of this pathbreaking book. The conversation concerns the circumstances, motivations and reasons for his undertaking the work on the book, as well as its reception and place in Wittgenstein scholarship. A large part of the discussion refers to his perspective of Wittgenstein, Toulmin’s philosophical writings, and Janik’s own vision of philosophy. The article proves that the term mouseion used by Plato in Phaedrus 278b cannot mean “sanctuary/shrine of the Muses” here, but it probably refers to the cicadas chirping under the plane tree of which Socrates speaks earlier in the dialogue (259b-c). Such an interpretation is consistent with our knowledge of the early stage of development of the concept of mouseion, and also with its use elsewhere in Plato’s dialogue (267b). It should therefore be concluded that the cult of the Muses (...) at the Ilissus, known from late testimonies, did not come from the classical era and appeared under the influence of reading Plato’s dialogue. Plato’s testimony should also not be raised as an important argument in disputes regarding the relationship of the nymphs and the Muses and the early identification of the Muses with water. (shrink)

Farm animal welfare is a knowledge domain that can be regarded as a model for new ways of organizing learning and making higher education more responsive to the needs of society. Global concern for animal welfare has resulted in a great demand for knowledge. As a complement to traditional education in farm animal welfare, higher education can be more demand driven and look at a broad range of methods to make knowledge available. The result of an inventory on farm animal (...) welfare, e-learning, learning resources, and open educational resources in three different search engines is presented. A huge amount of information on animal welfare is available on the Internet but many of the providers lock in the knowledge in a traditional course context. Only a few universities develop and disseminate open learning resources within the subject. Higher education institutions are encouraged to develop open educational resources in animal welfare for the benefit of teachers, students, society, and, indirectly, animal welfare. (shrink)

What is the concept of sexuality? And do we still need it today? In the article I discuss problems related to the socio-cultural construction of sexuality, normalization politics and sexual citizenship, sexual segregation and anti-sex paranoia. I show how the division into us (friends) and them (strangers), according to sexual scripts, takes away the right not only to be part of society, but above all to be yourself. I wonder if – following the words of M. Foucault – it is (...) not the time to look for a new solution, for example, to replace the concept of sexuality with the forms of pleasure. I illustrate my considerations with examples from the observation of the public sphere and the reaction of the normative public to non-normative objects appearing in their surroundings. Most of the examples concern contemporary Poland – both in political and socio-cultural contexts. (shrink)

According to psychological research, people are more eager to help identified individuals than unidentified ones. This phenomenon significantly influences many important decisions, both individual and public, regarding, for example, vaccinations or the distribution of healthcare resources. This paper aims at presenting definitions of various levels of identifiability as well as a critical analysis of the main philosophical arguments regarding the normative significance of the identifiability effect, which refer to: (1) ex ante contractualism; (2) fair distribution of chances and risks; (3) (...) anti-aggregationist principles that recommend the distribution of bad effects and the concentration of good ones. I will show that these arguments, although connected with interesting philosophical problems regarding e.g. counterfactuals, aggregation, or probability, are unconvincing. (shrink)

In his pioneering study of Grande Dame Guignol (also referred to as hag horror or psycho-biddy), a female-centric 1960s subgenre of horror film, Peter Shelley explains that the grande dame, a stock character in this form of cinematic expression, “may pine for a lost youth and glory, or she may be trapped by idealized memories of childhood, with a trauma that haunts her past” (8). Indeed, a typical Grande Dame Guignol female protagonist/antagonist (as these two roles often merge) usually deals (...) with various kinds of traumatic experiences: loss of a child, domestic violence, childhood abuse, family conflicts or sudden end of career in the fickle artistic industry, etc. Unable to cope with her problems, but also incapable of facing the inevitable process of aging and dying, she gradually yields to mental and physical illnesses that further strengthen the trauma and lead to her social exclusion, making her life even more unbearable. Unsurprisingly, scholars such as Charles Derry choose to name psycho-biddies horrors of personality, drawing attention to the insightful psychological portrayal of their characters. Thus, it would be relevant and illuminating to discuss films such as Die! Die! My Darling! (1965) and Whoever Slew Auntie Roo? (1971) as narratives of trauma. W artykule autor przedstawia dorobek o. Ziemiańskiego SJ na polu metafizyki. Okazją do tego był jubileusz 90. urodzin, z którego perspektywy można pełniej docenić wkład Jubilata w tę dziedzinę filozofii. Prezentację rozpoczyna przybliżenie kontekstu historycznego kształtowania się myśli filozoficznej o. Ziemiańskiego, gdzie podstawową rolę odegrała filozofia tomistyczna, skoncentrowana w ówczesnych polskich realiach na dyskusji z marksizmem. Dyskusja ta nie sprowadzała się wyłącznie do odkrywania ograniczeń i krytyki marksizmu. Przedstawiciele tomizmu proponowali własną interpretację rzeczywistości, odznaczającą się większym realizmem i bardziej przekonującą (...) racjonalnością. Kolejny punkt poświęcony został koncepcji metafizyki o. Ziemiańskiego, nawiązującej do tradycji arystotelesowsko-tomistycznej, wzbogaconej elementami zaczerpniętymi ze współczesnych kierunków filozoficznych oraz nauk szczegółowych. Pośród najbardziej charakterystycznych cech tego ujęcia wskazano oparcie na doświadczeniu i zorientowanie na byt realnie istniejący, metodę _abstractio totius_, poznawczy realizm i maksymalizm, jak też ukierunkowanie na poznanie bytu absolutnego. W dalszej kolejności omówiono wkład Ziemiańskiego w interpretację kluczowych zagadnień metafizycznych, takich jak transcendentalia, przygodność, celowość czy struktura bytu. Podkreślono, iż opowiadał się on za egzystencjalną naturą transcendentaliów, a przez to ich niesprowadzalnością do pojęć uniwersalnych. Ponadto, w ciekawy sposób przedstawił specyfikę relacji wiążącej byt przygodny z bytem koniecznym, jak również uzasadnienie konieczności istnienia przyczyny celowej oparte na analizie wewnętrznej struktury bytu. Ważnym jego wkładem do refleksji nad strukturą bytu było także opracowanie problematyki relacji w ujęciu F. Suareza oraz ukazanie funkcjonalnych aspektów złożenia bytu z istoty i istnienia. W zakończeniu odnotowano wnioski koncentrujące się na znaczeniu metafizyki jako bazowej dziedziny poznania filozoficznego. (shrink)

In this paper we investigate Boolean connexive logics in a language with modal operators: □, ◊. In such logics, negation, conjunction, and disjunction behave in a classical, Boolean way. Only implication is non-classical. We construct these logics by mixing relating semantics with possible worlds. This way, we obtain connexive counterparts of basic normal modal logics. However, most of their traditional axioms formulated in terms of modalities and implication do not hold anymore without additional constraints, since our implication is weaker than (...) the material one. In the final section, we present a tableau approach to the discussed modal logics. (shrink)

Standard deontic logic (SDL) is defined on the basis of possible world semantics and is a logic of alethic-deontic modalities rather than deontic modalities alone. The interpretation of the concepts of obligation and permission comes down exclusively to the logical value that a sentence adopts for the accessible deontic alternatives. Here, we set forth a different approach, this being a logic which additionally takes into consideration whether sentences stand in relation to the normative system or to the system of values (...) under which we predicate the deontic qualifications. By taking this aspect into account, we arrive at a logical system which preserves laws proper to a deontic logic but where the standard paradoxes of deontic logic do not arise. According to constitutive reductionism of Derek Parfit, a subject/person is not a separate existing being but his existence consists in the existence of a brain and body, performance of actions, thinking and occurrence of other physical and mental events. The identity of the subject in time comes down only to “Relation R” - mental consistency and/or connectedness – elicited by appropriate reasons. In the following article, I will try, relying on Frank Johnson's Knowledge Argument, to argue in favour of the (...) following conclusions: a person/subject is a “fact”irreducible to body and physical relations with the environment and a subject is something/”fact” non-reducible to mental occurrences. The paper will compare two methods used in the design of diagnostic strategies. The first one is a method that precises predictive value of diagnostic tests. The second one is based on the use of Bayes’ theorem. The main aim of this article is to identify the epistemological assumptions underlying both of these methods. For the purpose of this objective, example projects of one and multi-stage diagnostic strategy developed using both methods will be considered.

Gideon Rosen described the difficulties faced by those who claim that statements about possible worlds cannot be literally true. According to his argument, if the truth of modal sentences could be explained by referring to the hypothesis of the plurality of possible worlds, which is a sort of fiction for modal irrealists, the position would have antinomic consequence. I argue that the advocate of broad modal fictionalism can avoid such a devastating conclusion. To that end, her position should be given (...) in meta-language describing the necessary and sufficient conditions of accepting modal sentences as true in terms of fiction of possible worlds. I show that there is a coherent way of reading ‘it is accepted as true’ that allows one to maintain that the disjunction of two mutually contradictory propositions can be accepted without accepting either of them. According to the New Angle, any explanation of the Knobe effect must be gradable and asymmetric. It has been argued that only Hindriks’ approach meets both criteria. First, we argue that Holton’s hypothesis also meets the criteria. Second, we show that the authors are not justified in taking the criteria to be empirically justified. We have failed to replicate the asymmetry result in two experiments. Moreover, gradability can be objective or epistemic. We show that the New Angle presupposes objective gradability. (...) In our experiments, the patterns of responses to questions about epistemic and objective gradability are the same, irrespective of whether the feature is objectively gradable (e.g., blameworthiness) or not (e.g., intentionality). Our results thus question the extent to which the New Angle is empirically grounded. Moreover, they raise doubt whether the answers to questions about epistemic and objective gradability can be taken at face value at all. (shrink)

Considering the large number of adverts inundating the average consumer every day, the marketing industry is seeking methods to reach clients in a more subtle manner than traditional marketing messages. One such tool is product placement. The article addresses issues of effectiveness of product placement in comparison to a traditional commercial. The objective of the study was to check how participants would recall the content of persuasive messages in conditions of artificially-inducted cognitive load (in conditions of traditional advertisement and product (...) placement). Two studies were conducted – a pilot study intended to assess the usefulness of the selected stimuli, and the main experiment. The experiment devoted to this question was planned using an ANOVA scheme 2 (Type of advert: traditional vs. product placement) x 2 (neutral conditions vs. cognitive load). It turned out that the commercial was better retained in neutral conditions than in conditions of cognitive load. The traditional commercial was remembered better than product placement. From the perspective of the study’s ecological validity, of importance is also comparison of retention of brands viewed in a traditional commercial in conditions of cognitive load with retention of brands in conditions of product placement without load. These comparisons indicate the superiority of product placement – brands presented in this manner were more frequently recalled by viewers. (shrink)

The article discusses the issue of the necessity of obtaining informed consent from an individual who is to be a participant in an experiment. Codes of ethics concerning the behaviour of a psychologist fundamentally do not permit conducting experiments without informing their participants in advance that they will be conducted. Meanwhile, the act of obtaining prior consent can have a significant impact on results. The article describes an experiment in the field of social influence psychology during which one group was (...) asked for their informed consent to participate in a study, while the second was simply presented with the main request. The results demonstrate the strong influence of awareness that a study is being conducted on the decisions taken in the course of the experiment. (shrink)

Here, we discuss historical, philosophical and technical problems associated with relating logic and relating semantics. To do so, we proceed in three steps. First, Section 1 is devoted to providing an introduction to both relating logic and relating semantics. Second, we address the history of relating semantics and some of the main research directions and their philosophical applications. Third, we discuss some technical problems related to relating semantics, particularly whether the direct incorporation of the relation into the language of relating (...) logic is needed. The starting point for our considerations presented here is the 1st Workshop On Relating Logic and the selected papers for this issue. (shrink)

In the late 2010s, various international committees, expert groups, and national strategy boards have voiced the demand to ‘open’ the algorithmic black box, to audit, expound, and demystify artificial intelligence. The opening of the algorithmic black box, however, cannot be seen only as an engineering challenge. In this article, I argue that only the sort of transparency that arises from critique—a method of theoretical examination that, by revealing pre-existing power structures, aims to challenge them—can help us produce technological systems that (...) are less deceptive and more just. I relate the question of AI transparency to the broader challenge of responsible making, contending that future action must aim to systematically reconcile design—as a way of concealing—with critique—as a manner of revealing. In this paper we study the method of refutation rules in the modal logic K4. We introduce refutation rules with certain normal forms that provide a new syntactic decision procedure for this logic. As corollaries we obtain such results for the following important extensions: S4, the provability logic G, and Grzegorczyk's logic. We also show that tree-type models can be constructed from syntactic refutations of this kind.

In order to understand how the environment influences business owner/managers’ attitudes towards tax morale, we build a theoretical model based on a neo-institutionalist framework. Our model combines three complementary perspectives on institutions—normative, cultural–cognitive and regulatory–instrumental. This enables a broader understanding of factors that influence business owner–managers’ attitudes towards tax evasion. We test the resulting hypotheses using regression analysis on survey data on business owner/managers in Latvia—a transition country, which has undergone massive institutional changes since it was part of the Soviet (...) Union over 25 years ago. We find that legitimacy of the tax authorities and the government, feeling of belonging to the nation and perceptions of the risk and severity of punishment are all associated with higher tax morale for business owners and managers. Feminist Auto/biography as a Means of Empowering Women: A Case Study of Sylvia Plath's The Bell Jar and Janet Frame's Faces in the Water Feminism, as a political, social and cultural movement, pays much attention to the importance of text. Text is the carrier of important thoughts, truths, ideas. It becomes a means of empowering women, a support in their fight for free expression, equality, intellectual emancipation. By "text" one should understand not only official documents, manifestos or articles. The term (...) also refers to a wide range of literary products—poetry, novels, diaries. The language of literature enables female authors to omit obstacles and constraints imposed by the phallogocentric world, a world dominated by masculine propaganda. Through writing, female authors have an opportunity to liberate their creative potential and regain the territory for unlimited expression. In order to produce a truly powerful text, they resort to a variety of writing styles and techniques. Here the notions of a situated knowledge and context sensitivity prove useful. There are three methodologies working within situated knowledge, namely, the politics of location, self-reflexivity and feminist auto/biography. All of them regard text as a fundamental tool to signify one's authority, yet feminist auto/biography, a concept widely discussed by the British theorist Liz Stanley, appears to be the most empowering mode of writing. It challenges the overused genre of auto/biography and reconstructs its role within feminist epistemologies, thus creating a favourable environment for text production. The works by Sylvia Plath and Janet Frame can be analyzed from the point of view of auto/biographical empowerment, even though their auto/biographical potential is mainly instinctive. Nevertheless, they help to comprehend the strength of the auto/biographical.The aim of this article is to "investigate" two novels by these authors, The Bell Jar by Sylvia Plath and Faces in the Water by Janet Frame, and their compatibility with Stanley's concept. The paper attempts to answer several questions. Are these novels actual feminist auto/biographies or rather fictional auto/biographies with feminist undertones? What kind of narrative strategy is used to achieve the effect of authority over the text? Last but not least, what is the function of auto/biographical narration in the case of these two novels? The article also explores the idea of writing as a means of regaining control over one's life. (shrink)

It is part of the phenomenology of perceptual experiences that objects seem to be presented to us. The first guide to objects is their perceptual presence. Further reflection shows that we take the objects of our perceptual experiences to be among the causes of our experiences. However, not all causes of the experience are also objects of the experience. This raises the question indicated in the title of this paper. We argue that taking phenomenal presence as the guide to the (...) objects of perception, we can see that at least in two sensory modalities, smell and touch, there is no uniform answer to this question. The objects of olfactory and tactile experiences can move along the causal chain. Accordingly, the content of olfactory and tactile experience may vary. (shrink)

We show that truth conditions for counterfactuals need not always be given in terms of a vague notion of similarity. To this end, we single out the important class of historical counterfactuals and give formally rigorous truth conditions for these counterfactuals, employing a partial ordering relation called "comparative closeness" that is defined in the framework of branching space-times. Among other applications, we provide a detailed analysis of counterfactuals uttered in the context of lost bets.
