The article presents the results of a study of the interaction between the public and private sectors in the field of outer space exploration. The purpose of the study was to identify the peculiarities of interaction between public authorities and private companies involved in space activities. It has been established that all leading space powers create favorable conditions for attracting private companies to space exploration. The main areas of space activity that are most attractive (...) for private investment are identified: 1) production, launch and operation of spacecraft and launch vehicles; 2)production and operation of ground equipment; 3) space research; 4) satellite observation of the Earth; 5) TV and radio broadcasting and lease of repeaters; 6) satellite internet; 7) mining in space; 8) space tourism; 9) space waste management; 10) cargo delivery to Earth orbit, etc. The current state of the space industry in Ukraine is determined. The main obstacles to space commercialization in Ukraine are also highlighted: 1) legal regulation lags far behind and does not meet the needs of space activities in Ukraine; 2) international agreements are not in line with the level of national regulation of advanced countries and new global trends; 3) Ukraine’s space industry is focused mainly on less profitable areas of the space economy, which reduces the attractiveness for private investors; 4) there is no clear distinction between national interests and commercial activities in space; 5) mechanisms for coordinating private, state and public interests in the context of space commercialization are either absent or extremely ineffective; 6) there are no effective mechanisms for attracting foreign capital to space exploration. The authors identify two main competitive models of the interplay between the public and private sectors in space exploration: “American” and “European.” It is emphasized that both models can serve as a model for the space policy implementation in Ukraine. However, given a number of considerations, it is determined that the “European” model is more optimal. (shrink)

As a result of the increasing economical exploitation of outer space, humanity faces a new challenge that, as well as having economic advantages, also entails a great many ecological hazards. At present, the human race is encroaching on outer space, particularly in the form of almost 5000 active satellites and the corresponding space debris they produce. For the large part, this debris burns up on entering the Earth’s atmosphere, yet time and again it still does (...) cause damage. However, this could change dramatically if, as is now foreseeable, further uses of outer space, such as tourism, so-called satellite mega-constellations, regular transport flights to the moon or even Mars and the extraction of water and valuable rocks from celestial bodies, are expanded. There is a danger that ecological damage like that of the earlier phases of economic development will become externalised and ultimately pose a threat to the whole of humanity. Sautter’s ‘global “sustainability trilemma”’ remains unresolved. This trilemma consists in the fact that, in political resolutions, ‘the growth of resource-intensive prosperity is weighted far more highly than the conservation of functioning ecosystems and the implementation of inter- and intragenerational “justice”’ and that there are ‘up until now no efficient and ethically acceptable solutions’ for this problem. In this situation, it is therefore more important that rules for the sustainable use of outer space be established and enshrined as legally binding so that it becomes possible to minimise or even to preclude negative ecological consequences.Contribution: Although the commercial use of outer space does not seem to be a crucial point, it marks a new step of the dynamics of modern economics that has to be identified as an important ethical challenge. This also provides for a considerable amount of uncertainty regarding how the legal framework could or (...) may need to be changed to accommodate private interests. The article analyzes the two main international treaties relevant from this perspective, as well as their backgrounds, in order to outline the current legal status of celestial bodies and the resulting legal rights and obligations pertinent to both private exploitation and exploration. Based on such an analysis, it concludes by highlighting an approach that could actually incentivize the private sector and the science community to work together in a manner conducive to their interests in exploitation and exploration respectively. Human space exploration requires massive budgets every fiscal year. Especially under severe financial constraint conditions, governments are forced to justify to society why spending so much tax revenue for human space exploration is worth the cost. The value of human space exploration might be estimated in many ways, but its social significance and cost-effectiveness are two key ways to gauge that worth. Since these measures should be applied country by country because sociopolitical conditions differ in each country (...) and must be taken into consideration, the study on the social significance of human space exploration must take the coloration of a case-study. This paper, focusing on the case of Japan with surveying Japanese literary and national documents as well as taking its sociopolitical conditions into account, examines the social significance of human space exploration. -/- First, we give an overview of the circumstances surrounding Japan's human space exploration program. Derived from the statements of such relevant parties as scholars, journalists, policy makers, and astronauts, this overview indicates that the main concerns about human space exploration in Japan are its social significance and cost-effectiveness (Section 1). Next, an overview of behavioral science—an essential field for human space exploration (referred to in this paper as space behavioral science) that provides support for astronauts—is presented from the perspective of stress research in isolated and confined environments (Section 2). We then give two examples of where such knowledge from space behavioral science research has been applied to terrestrial isolated and confined environments. One is JAXA’s support in 2009 for people who were vulnerable to infection by a new strain of flu and accordingly placed in an isolated and confined facility under the Infectious Disease Law and the Quarantine Law. The other is NASA's support in 2010 for Chilean mine workers who were trapped 700 m underground after a mining accident (Section 3). Based on these case studies, we illustrate the further social utility of such knowledge through a discussion of potential applications in other situations in Japan. Focusing on Japan for its geographical and social features in being an earthquake-prone archipelago and having the world's preeminent aging society, we show that refugees living in evacuation centers and people in an elderly-elderly homecare situation pose socially problematic situations specific to Japan. We then argue that space behavioral scientific knowledge can be applied to support people under these and other isolated and confined environments in various ways (Section 4). Finally, we demonstrate that such an application can be understood as an ethical contribution to Japanese society and that this contribution can be embedded in Japan's space policy (Section 5). We conclude that human space exploration can be a socially significant and cost-effective endeavor that is worthy of tax revenue expenditures because space behavioral science is highly likely to provide unique and useful knowledge to help address various social problems concerning terrestrial isolated and confined environments and support people in sufferings there. This review of Matthew Lipman’s autobiography, A Life Teaching Thinking, is a reflection on the themes and patterns of his extraordinarily productive career. His book begins with memories of earliest childhood and his preoccupation with the possibility of being able to fly, moves through the years in which his family struggled with the effects of the Great Depression, through his service in the military during World War II, his discovery of the joy and beauty of philosophy, his academic rise at (...) Columbia University, his Fullbright sojourn in Paris, and his early and later career. Lipman’s educational project led in four related directions: the practice of philosophy for children, which he invented, and which presents an epistemological challenge to a second field, philosophy of education, which is as startling as was Rousseau’s two hundred years before. Third, it led to a realm of theory called philosophy of childhood, upon which the practice of philosophy for children is a kind of action-meditation, prompting adults as it does to reflect on children’s differences from and similarities to adults at the same time, and in the same discursive space. Finally, his praxis also implicitly challenged those accounts of children’s philosophies, paradigmatically represented by Piaget’s work, which represent childhood epistemology as evidence for various genetic and epigenetic stage-based theories of cognitive development. The consequence for education of this confluence was a methodology—community of inquiry—that serves as a bridge between the two most influential philosophers of education of the 20th century—John Dewey and Paulo Freire. The educational praxis that emerged from his venture, for all its apparent simplicity, operationalizes a postcolonial standpoint epistemology vis a vis childhood and children, pulls the linchpin that holds in place the school as ideological state apparatus, and empowers the elementary classroom as a primary site for democratic theory and practice. The paper examines the open problems that experts of space law shall increasingly address over the next few years, according to four different sets of legal issues. Such differentiation sheds light on what is old and what is new with today’s troubles of space law, e.g., the privatization of space, vis-à-vis the challenges that AI raises in this field. Some AI challenges depend on its unique features, e.g., autonomy and opacity, and how they affect pillars of the (...) law, whether on Earth or in space missions. The paper insists on a further class of legal issues that AI systems raise, however, only in outer space. We shall never overlook the constraints of a hazardous and hostile environment, such as on a mission between Mars and the Moon. The aim of this paper is to illustrate what is still mostly unexplored or in its infancy in this kind of research, namely, the fourfold ways in which the uniqueness of AI and that of outer space impact both ethical and legal standards. Such standards shall provide for thresholds of evaluation according to which courts and legislators evaluate the pros and cons of technology. Our claim is that a new generation of sui generis standards of space law, stricter or more flexible standards for AI systems in outer space, down to the “principle of equality” between human standards and robotic standards, will follow as a result of this twofold uniqueness of AI and of outer space. The 2016 much acclaimed American sci-fi movie Arrival is based on the so-called “Sapir-Whorf” hypothesis, a linguistic theory set forth in the first half of the 20th century, according to which one’s native language dictates the way in which one perceives reality. By taking into account the latest in human knowledge, this paper tries to provide arguments as to why such a claim works wonderfully in fiction, but not in science.

The most skeptical contribution to this volume enumerates and discusses a broad set of challenges connected with the so-called human factor in a mission to Mars. Discussed issues include rationales for a human versus uncrewed mission, financial challenges affected mostly by unclear and weak rationales for human mission, challenges of sustainable development, complex hazardous impacts of space environment for human mental, and physiological health. The last of the discussed challenges, the idea of human enhancement applied for the purpose of (...) human deep-space missions, shows how technological issues—mostly long journey or ineffective countermeasures—might affect ethical concerns. While this idea might seem to be too far in the future, the chapter shows that it may be a serious and possibly unexpected long-term consequence of this program. This chapter does not determine whether a human mission to Mars is possible or not, nor whether such a mission makes any sense at all. One side of this chapter assumes that it is hard to find a strong rationale as measured in financial terms. The question of rationale is getting harder when a cost–benefit analysis—including risks for human health and life—is applied. On the other side, these skeptical remarks are designed to show that the idea of making humans a multi-planetary species is, in fact, extrapolation and projection of all problems and challenges known on Earth, which is intensified by putting Mars astronauts in the hazardous space environment. Many books explain what is known about the universe. This book investigates what cannot be known. Rather than exploring the amazing facts that science, mathematics, and reason have revealed to us, this work studies what science, mathematics, and reason tell us cannot be revealed. In The Outer Limits of Reason, Noson Yanofsky considers what cannot be predicted, described, or known, and what will never be understood. He discusses the limitations of computers, physics, logic, and our own thought processes. Yanofsky (...) describes simple tasks that would take computers trillions of centuries to complete and other problems that computers can never solve; perfectly formed English sentences that make no sense; different levels of infinity; the bizarre world of the quantum; the relevance of relativity theory; the causes of chaos theory; math problems that cannot be solved by normal means; and statements that are true but cannot be proven. He explains the limitations of our intuitions about the world -- our ideas about space, time, and motion, and the complex relationship between the knower and the known. Moving from the concrete to the abstract, from problems of everyday language to straightforward philosophical questions to the formalities of physics and mathematics, Yanofsky demonstrates a myriad of unsolvable problems and paradoxes. Exploring the various limitations of our knowledge, he shows that many of these limitations have a similar pattern and that by investigating these patterns, we can better understand the structure and limitations of reason itself. The article attempts to answer the following questions: What criminal law, if any, is applied in outer space when a crime is committed there? How will the issues of demarcation of criminal jurisdiction be resolved? Who and how will investigate such crimes? Which international or national institution will decide the issue of criminal prosecution and application of sanctions for crimes in space? Basing on the analysis of the sources of space and international law, it was concluded (...) that today there is no detailed procedure for investigating and bringing to criminal responsibility for committing a crime in space. There is also no international legal act that would establish a list of space criminal offenses. To solve existing problems, it is suggested to adopt the Convention on Criminal Liability for Space Crimes and to create a Space Criminal Statute (code). This paper tackles the problem of the nature of the space of perception. Based both on philosophical arguments and on results obtained from original experimental situations, it attempts to show how space is constituted concretely, before any distinction between the “inner” and the “outer” can be made. It thus sheds light on the presuppositions of the well-known debate between internalism and externalism in the philosophy of mind; it argues in favor of the latter position, but with arguments (...) that are foundationally antecedent to this debate. We call the position we defend enactive externalism. It is based on experimental settings which, in virtue of their minimalism, make it possible both to defend a sensori-motor/enactive theory of perception; and, especially, to inquire into the origin of the space of perception, showing how it is concretely enacted before the controversy between internalism and externalism can even take place. Kant’s Third Analogy of Experience seeks to establish the mutual interaction of all objects of experience as a transcendental condition on the possibility of our experience of coexistence, and by extension of any cohesive or unified experience. Of Kant’s three Analogies, the Third has received both the least attention and the most criticism. I present an analysis of the Third Analogy focussing on the spatial aspect of Kant’s argument. I examine the interrelated nature of the forms of inner and (...) class='Hi'>outer sense in the Third Analogy, linking this to their function in the Transcendental Deduction and subsequently turning to look at the problem posed by Kant’s argument regarding empty space in the Third Analogy. I present a tentative interpretation whereby the Third Analogy establishes a mutual dependence between space as a singular pure intuition, and the instantiation of the category of community in experience. In this paper I propose a novel interpretation of Kant’s proof of the existence of the outer world in the Refutation of Idealism. According to this interpretation, Kant’s proof does not provide a regressive explanation of our capacity to determine the temporal order of our experiences. Rather, it expresses a counterfactual reflection on what it takes for something to be actual in contrast to being merely imagined. On the ground of this reflection, Kant argues against the Cartesian sceptic that, (...) even if all our representations of empirical objects other than ourselves failed to be veridical, we would still know a priori that in every situation in which we, as thinking things, actually exist, something outside us in space must necessarily exist. Amidst demonstrations of warlike scientific superiority involving the development of intercontinental missiles, research satellites, and pioneering manned spaceflight, the superpowers worked to install secret orbital systems for monitoring nuclear arsenals, whose entry into operation began to provide effective technologies to the government of nuclear terror and to the diplomatic-military administration of the conflicts arising from its planetary confrontation. In addition to retrieving information about the Cold War, the problematization of the space race also contributes to the genealogical study of the space-planetary programs of monitoring that affirm themselves as elements of the devices of power of the contemporary societies of control. In lieu of an abstract, here is a brief excerpt of the content:Book Reviews 133 Beyond the Outer Shores: The Untold Odyssey of Ed Ricketts, the Pioneering Ecologist Who Inspired John Steinbeck and Joseph Campbell BY ERIC ENNO TAMM New York: Thunder’s Mouth Press, 2004 REVIEWED BY GEORGE MEADOWS How do you write a biography of someone who is best known as a fictional character? This is the challenge Erik Tamm has taken on in his recent biography of Edward (...) Ricketts, Beyond the Outer Shores. While some may know Ricketts as a pioneering ecologist and the author of the classic marine biology text, Between Pacific Tides, most know him as the model for “Doc” in the popular John Steinbeck novel Cannery Row, and the eponymous film adaptation. Much of the challenge arises from the fact that the fictional Doc as portrayed in Cannery Row is one of the most endearing characters in Steinbeck’s works. And according to all sources, Ed Ricketts shared many of Doc’s best qualities, and many of the incidents, people, and places in the novel are based on things Ed did and the people he knew. I would guess that many would be satisfied with knowing Ed Ricketts as Doc. It’s very tempting to do just that. The Monterey Peninsula, the location for the novel, is a beautiful place and it’s hard not to sense the presence of both Doc and Ed there. You might see them in Rickett’s restored laboratory/home, just a few feet from the entrance to the Monterey Bay Aquarium, or in the bronze statue of Ricketts placed near the site of his untimely death at the age of fifty-­ one. There’s also a Steinbeck monument in Steinbeck Plaza depicting the writer, Ed Ricketts, and several figures who play important roles in Cannery Row. The tide pools, which play such an important role in both Ed and Doc’s work are nearby and easily accessible. As a reader (and re-­reader) of Cannery Row and a frequent visitor to the Monterey Peninsula, I find it tempting to let Ed be Doc. To do so though would largely ignore the role he played in the development of ecology. Tamm’s book does focus on these achievements, and it does so in a way that would make sense to an ecologist: examining place and the ENVIRONMENT, SPACE, PLACE / VOLUME 13 / ISSUE 2 / 2021 134 relationships among individuals as they are influenced by that place. Thus, we have chapters titled “The Lab,” “The Great Tide Pool,” and “Clayoquot, Stubbs Island.” Other chapters deal with collecting trips to the Gulf of California and Juneau, Alaska. Each of these chapters provides a great deal of information about Ricketts’s ecological work in the area but also discuss his personal relationships as they developed in that space. This makes for interesting reading when we consider that these relationships involved such people as John Steinbeck, Henry Miller, and Joseph Campbell. The best example of this comes during the description of Ricketts’s 1932 collecting trip to Juneau with a young Campbell. The pair spent three months observing and collecting samples of marine life from the coastal areas. They also engaged in a number of discussions integrating ecology, biology, mythology, and religion. The discussion would continue for some time after, largely by mail, and their relationship takes up again in the final chapters of the book. While this approach does provide much of value, it can also make for a challenging read. The linear sequence that we might expect in a biography is somewhat absent in this book, to the degree that other reviewers describe the book as “nonlinear and disorganized,” or “confusing in sequence.” The focus on place and relationships, central to ecology, is difficult to mesh with the focus on an individual that we expect in biography, and this can be a difficult conflict to resolve. Individual organisms might be interesting, but that interest arises from the organism’s physical and social place. Ed Ricketts as an individual is not all that important. Our understanding of Ed should derive from his presence in certain locations and the relationships he had in those places. Or, as Michael Lannoo notes in Leopold’s Shack and Ricketts... (shrink)

How should we think about the role of visual spatial awareness in perception and perceptual knowledge? A common view, which finds a characteristic expression in Kant but has an intellectual heritage reaching back farther than that, is that an account of spatial awareness is fundamental to a theory of experience because spatiality is the defining characteristic of “outer sense”, of our perceptual awareness of how things are in the parts of the world that surround us. A natural counterpart to (...) this idea is to treat self-consciousness as residing in a kind of sense that is fundamentally “inner”, such as introspection or whatever else gives one privileged access to his own mental states as well as the proprioceptive and kinesthetic awareness of bodily position. This division is compatible, of course, with the idea that inner sense provides an awareness of a distinctive kind of “body space”, but it treats that as importantly different from the awareness of the worldly space around one. -/- In contrast to such a picture, this dissertation proposes an account of visual spatial awareness according to which it is no less a source of self-consciousness than of the awareness of the objects around us, and an account of self-awareness in which visual experience is essentially implicated. I begin by arguing that we should think of visual spatial awareness not as necessary for the individuation of visual sensations but rather as an essential element in the awareness of an experientially objective world. In the subsequent chapters, I argue that in being visually aware of the egocentric positions of the worldly objects around us we are often aware also of our own spatial locations with respect to them, and that the visual experience of the world around one and one’s own situation in it is often an essential component in the knowledge that a human agent will have of his own intentional actions. Space warfare is warfare that takes place in outer space. It involves ground-to-space, space-to-ground, and space-to-space violence between nations or peoples. The violence can involve kinetic weapons, directed energy weapons, or electronic destruction. International law, specifically, the Outer Space Treaty and SALT I, currently bans weapons of mass destruction from being put into space, although one wonders if one country were to violate the ban whether others would follow suit. In (...) this paper, I argue that that if there is a non-consequentialist morality of space war, then one country can unjustly attack a second country’s space vehicles. This in turn depends on property rights. But there is no adequate theory of property rights with regard to space war. Hence, there is no non-consequentialist morality of a space war. (shrink)

With the rising influence of digitalization and its immense penetration intoeven everyday life, the last decade of the 20th Century addressed to a critical threshold in the successive transformation process of the spatiality in its long-term run. The advanced digital technologies of ubiquitous computing and generative design, as well as the invention of smart materials in late 90’s have all provoked the fluid characteristics of spatiality, and strengthen the transformative capacities of the architectural space through the emergence of computer-augmented (...) territories. Additionally, while they are becoming as the body extensions, the advent of novel apparatuses and gadgets further enhanced the inte- gration of the corporal and incorporal bodies with the spatio-temporal multiplicities, where the hyperdimensionality of the space has been triggered to its outmost range, in relation to the “soft and smart technologically augmented immanent millieu”, in Spuybroek terms. Thus, like Spuybroek points out as the “haptonomist” presence of the body merges itself with these diverse bodily extensions on one hand; and on the other hand, as the rising influence of nomadic view of the world further stimulates the unboundedness and endless fluidity of space, so that the spatiality becomes a landscape of successive transformations, a topology of emergence or a plane of becoming, which is merely defined by lines of forces, and occures as an alive territory rather than a limited space of predefined boarders. Therefore, this evolvable territory which is affectable and being affected by the lines of forces –inner and outer forces–, emerges as an animated existence, an interactive organism. So, by interacting with the Deleuzian Philosophy and their notions like lines of forces, folding, becoming, smooth space, territory, spatium, this article aims to reveal the relevance of these notions in architectural discourse, as well as the emergence of the smooth space in the contemporary architectural practice, by magnifiying one of the very initial examples of its kind; in terms of unfolding the Fresh Water Pavilion of NOX Architecture by Lars Spuybroek into question to reveal the essences of thecontemporary transformable-evolvable architectural spatiality.
