This paper examines Michael Oakeshott's ideas on the relation between political philosophy and normative thought. To this end, some of the most controversial concepts of his thought are considered in the context of the philosophical debates that developed after the success of analytic philosophy and, in particular, of Ayer's Language, Truth, and Logic. First, the paper argues that, in contrast to analytic and ordinary language thinkers, Oakeshott defends the legitimacy and the rationality of normative thinking. To this end, the importance (...) of the Oakeshottian concepts of tradition and moral practice is stressed, and the controversial notion of ‘pursuit of intimations’ is considered. This paper contends thatMichael Oakeshott's analogy of conversation conveys a conception of philosophy that can be connected with 'philosophical criticism', as interpreted by British Idealists such as Andrew Seth and Edward Caird. Firstly, my claim is that Oakeshott's notion of philosophical definition is animated by a dialectical 'refutation' of current ideas, articulated in the logical study of their presuppositions. Moreover, I show that this critical idea of philosophy is expressed through a re-interpretation of the Socratic Method that can be compared (...) to that of other Idealists. By means of an examination of textual evidence, I stress the consistency of this perspective throughout all Oakeshott's career. Secondly, I consider the image of conversation as an answer to the Idealist question about the possibility of the unity of knowledge. At the outset, I highlight that Oakeshott's position can be juxtaposed to the critiques of Modern philosophy and science paradigmatically put forward by Edward Caird and R.G. Collingwood. I argue that 'conversation' is consistent with Oakeshott's conception of modality, which is a critique both of the possibility of a final synthesis between different forms of understanding and of all reductionisms. Therefore, I analyze the theoretical foundations of this conception, which I have identified with the nature of postulates, the unity ofmind, and the non-propositional character of judgments. In the conclusion, I suggest that this reading has implications for a broader understanding of Oakeshott's Idealism, of his political theory and of the debate with Analytic philosophy. (shrink)

In the debate about Michael Oakeshott’s philosophy there is very little agreement on the theoretical and historical meaning of his skepticism. Starting from the assumption that skepticism is not a fixed theory but a tradition of ideas, this article draws on both published texts and archival materials to contend that Oakeshott developed his thought by confronting himself with, and even merging, different strands of skepticism: the ancient, the modern, as represented by Hobbes and Montaigne, and the idealist, as conceived by (...) F. H. Bradley. The article firstly shows Oakeshott’s awareness of ancient skepticism, even though its impact on his thought is contested and controversial. With regard to modern skepticism, it looks at how Oakeshott defines Hobbes’s skepticism in his “Introduction to Leviathan.” It also examines the relevance of Montaigne to Oakeshott’s image of conversation, his idea of human agency and conception of politics. Finally, the article illustrates the influence of Bradley’s skepticism on Oakeshott’s conception of philosophy and reveals the consistency between Oakeshott’s skepticism and idealism. What emerges is a complex picture, in which Oakeshott’s skepticism is a constellation of elements taken from a variety of sources. (shrink)

The denial of the intrinsic value of acts apart from both motives and consequences lies at the heart of Ross’s deontology and his opposition to ideal utilitarianism. Moreover, the claim that acts can have intrinsic value is a staple element of early and contemporary attempts to “consequentialise” all of morality. I first show why Ross’s denial is relevant both for his philosophy and for current debates. Then I consider and reject as inconclusive some of Ross’s explicit and implicit motivations for (...) his claim, stemming from his philosophy of action, his axiology, and his concept of intrinsic value, or a combination of these. I also criticize Ross’s later view that all right acts somehow produce some good, but that the value of some of these goods is explained by the prior rightness of the act. In the course of the discussion, the idea that acts can have intrinsic value apart from motives and consequences gains credibility both from the weaknesses in Ross’s arguments and from some putative examples. So, finally, I distinguish two attitudes in the history of ideal utilitarianism towards the necessity or not to give a detailed account of the intrinsic value of acts, and suggest that a Why Bother attitude is more promising than a Constructive one. According to the doctrine of the guise of the good, all that is desired is seen by the subject as good to some extent. As a claim about action, the idea is that intentional action, or acting for a reason, is action that is seen as good by the agent. I explore the thesis' main attractions: it provides an account of intentional behavior as something that makes sense to the agent, it paves the way for various views in meta-ethics and (...) normative ethics, and it offers a unified account of practical and theoretical reason. In response to common objections, I examine points of current debate: what is it for something to appear as good? Is value or normative reasons the basic concept at work? How to explain akrasia, perversity in action, and expressive action? I conclude with an overview of alternatives to the guise of the good. (shrink)

The fitting attitude analysis of value states that for objects to have value is for them to be the fitting targets of attitudes. Good objects are the fitting targets of positive attitudes, while bad objects are the fitting targets of negative attitudes. The following paper presents an argument to the effect that value and the fittingness of attitudes differ in terms of their explanations. Whereas the fittingness of attitudes is explained, inter alia, by both the properties of attitudes and those (...) of their fitting targets, the explanation of value tends to have a different content. In particular, objects have value in virtue of the features that make them valuable, and these need not involve any attitudinal properties. If this is right, then there are reasons to doubt the claim that for objects to have value is just for them to be the fitting targets of attitudes. Insofar as value is a property, it appears to be distinct from the property of objects being the fitting targets of attitudes. (shrink)

In this paper I argue that Bykvist’s recent challenges to the fitting-attitude account of value (FA) can be successfully met. The challenge from solitary goods claims that FA cannot account for the value of states of affairs which necessarily rule out the presence of favouring subjects. I point out the modal reasons why FA can account for solitary goods by appealing to contemplative attitudes. Bykvist’s second challenge, the ‘distance problem’, questions the ability of FA to match facts about the intensity (...) of fitting attitudes and facts about value, particularly in the case of solitary goods. I argue that this challenge can be met by including the notion of a veil of ignorance in the formulation of FA, and understanding its role as bracketing the relevance of certain facts when determining the fittingness of attitudes to states of affairs. The guise of the good is the thesis that an agent can only want, or intentionally do or pursue something, if and because this seems good to the agent in some respect or other. Bernard Williams criticizes the guise of the good in Ethics and the Limits of Philosophy. In this paper I reconstruct and assess his hitherto unnoticed critical remarks. Williams's opposition is based on the idea that it takes an “extra step” to go from desiring or pursuing something (...) to thinking of it as good. To show this, he employs an argument from elimination (with two strands: an argument from personal ends and an argument from immediate ends), and a separate argument which I call the one‐desire argument. I review and reject two types of answers to Williams's objections: answers that explore different varieties of what it can mean to “think of as good,” and answers that focus on different varieties of goodness under the guise of which one can desire something. I then consider whether a different, but nearby thesis, namely the guise of normative reasons, can accommodate Williams's objections, concluding that this alternative also fails. The paper presents a positive argument for a version of metaphysically light ethical non-naturalism from the nature of mental states such as desires. It uses as its premise the time-honoured, and recently rediscovered, doctrine of the guise of the good, whereby it is essential to desire that the object of desire be conceived as good or as normatively favoured under some description. The argument is that if the guise of the good is a correct theory of desire, then a certain (...) version of non-naturalism is better placed than other meta-ethical views to make sense of it. First I define ethical non-naturalism and the guise of the good, providing also an initial defence of the latter. Then I briefly survey some historical precedents and proceed to the argument. For each major meta-ethical view I consider I offer reasons why combining them with the guise of the good leads to consequences that are or should be unwelcome by the guise of the good. At the end of this elimination process a form of relatively metaphysically light non-naturalism will emerge as the view that best fits with the guise of the good. (shrink)

The recent #metoo movement has turned public attention to the problem of sex under conditions of power inequality. Is consent impaired, when you have plenty to lose (e.g. a great professional opportunity) from saying “no” to a sexual advance? And even if consent is valid, is this a morally acceptable situation, especially if one party is aware that their position of relative power will influence the other’s decision to have sex? Such situations bring to the fore not only the issues (...) of coerced sex and quid pro quo harassment (asking for sex in exchange for benefits), but the much more controversial question of whether sex between unequal but otherwise competent consenting adult partners is in principle OK—and whether institutions such as companies, universities, or the state itself should be in the business of regulating such relations. In what follows, I will outline the central concept of power asymmetry and its ethical relevance (section 2). I will then distinguish two main views about the ethics of sexual interaction under conditions of power asymmetry: a Kantian view, which categorically condemns such interactions, and a Millian view, which justifies at least some such interactions (section 3). I then briefly consider three contexts, which raise difficult questions about sex between unequals: the workplace, the university (section 4), and voluntary prostitution (section 5). Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. The guise of the good doctrine is the view that whatever we desire, we desire it under the guise of the good, i.e. it appears good to us in some way. In this paper I first clarify the role that the doctrine of the guise of the good plays in the first step of J. S. Mill’s proof of the principle of utility (in which he shows that one’s happiness is desirable as an end). Then I provide textual evidence in (...) favour of ascribing the doctrine to Mill, arguing that he commits to it to the extent that he equates finding something pleasant and thinking it desirable. Finally I counter two potential sources of evidence against ascribing the guise of the good to Mill: apparent desires based on ‘fixed ideas’, and those habitual desires which are no longer associated with finding their objects pleasant. I argue that ‘fixed ideas’ do not feed actual desires, and that the habitual desires which seem to escape the guise of the good, even if not uncommon, have a secondary status as desires. (shrink)

For an agent to be motivated by a normatively perverse reason is to be motivated by a normative or evaluative thought as such which, if true, would count as such against the action that it motivates the agent to perform, or against the attitude that it motivates the agent to take. For example, that an action is morally wrong or prudentially bad counts, as such, against performing the action. When the thought that an action is morally wrong or prudentially bad (...) motivates me as such to perform the action, my motivating reason is normatively perverse. If being motivated by normatively perverse reasons is possible, then what, if anything, is wrong about it? I present and reject some accounts of what may be wrong about normative perversity. In the course of this discussion some desiderata emerge. Then I defend the suggestion that normative perversion is socially undesirable, in that it undermines certain valuable interpersonal and intrapersonal relations. Entering and maintaining these relations is constitutive of valuing people as beings to whom reasonable justification is owed. I show how this account satisfies the desiderata. (shrink)

In Treatise 2.3.4 Hume provides an explanation of why ‘we naturally desire what is forbid, and take a pleasure in performing actions, merely because they are unlawful’. Hume’s explanation of this phenomenon has barely received any attention so far. But a detailed analysis bears fruit for both Humean scholarship and contemporary moral psychology. After putting the passage in its context, I explain why desiring and taking pleasure in performing certain actions merely because they are unlawful poses a challenge to Hume’s (...) theory of evaluation. Then I propose a solution of the challenge which draws on Hume’s treatment of malice, and highlights the role played by comparison and the self in these apparently paradoxical passions. Finally, I distinguish three views in contemporary discussions of desiring something under the guise of the bad (negationism, parasitism, at-face-valuism), and I argue that Hume’s account stands out as a particularly plausible version of the third view. Neuroscientists have formulated the model of emotional intelligence based on brain imaging findings of individual differences in EI. The main objective of our study was to operationalize the advantage of high EI individuals in emotional information processing and regulation both at behavioral and neural levels of investigation. We used a self-report measure and a cognitive reappraisal task to demonstrate the role of EI in emotional perception and regulation. Participants saw pictures with negative or neutral captions and shifted from negative context (...) to neutral while we registered brain activation. Behavioral results showed that higher EI participants reported more unpleasant emotions. The Utilization of emotions scores negatively correlated with the valence ratings and the subjective difficulty of reappraisal. In the negative condition, we found activation in hippocampus, parahippocampal gyrus, cingulate cortex, insula and superior temporal lobe. In the neutral context, we found elevated activation in vision-related areas and HC. During reappraisal condition, we found activation in the medial frontal gyrus, temporal areas, vision-related regions and in cingulate gyrus. We conclude that higher EI is associated with intensive affective experiences even if emotions are unpleasant. Strong skills in utilizing emotions enable one not to repress negative feelings but to use them as source of information. High EI individuals use effective cognitive processes such as directing attention to relevant details; have advantages in allocation of cognitive resources, in conceptualization of emotional scenes and in building emotional memories; they use visual cues, imagination and executive functions to regulate negative emotions effectively. In this innovative study, Lea David critically investigates the relationship between human rights and memory, suggesting that, instead of understanding human rights in a normative fashion, human rights should be treated as an ideology. Conceptualizing human rights as an ideology gives us useful theoretical and methodological tools to recognize the real impact human rights has on the ground. David traces the rise of the global phenomenon that is the human rights memorialization agenda, termed 'Moral Remembrance', and explores what happens once (...) this agenda becomes implemented. Based on evidence from the Western Balkans and Israel/Palestine, she argues that the human rights memorialization agenda does not lead to a better appreciation of human rights but, contrary to what would be expected, it merely serves to strengthen national sentiments, divisions and animosities along ethnic lines, and leads to the new forms of societal inequalities that are closely connected to different forms of corruptions. Liberal thinkers of the eighteenth and nineteenth centuries were alert to the political costs and human cruelties involved in European colonialism, but they also thought that European expansion held out progressive possibilities. In Progress, Pluralism, and Politics David Williams examines the colonial and anti-colonial arguments of Adam Smith, Immanuel Kant, Jeremy Bentham, and L.T. Hobhouse. Williams locates their ambivalent attitude towards European conquest and colonial rule in a set of tensions between the impact of colonialism on European states, the possibilities (...) of progress in distant and diverse places, and the relationship between universalism and cultural pluralism. In so doing he reveals some of the central ambiguities that characterize the ways that liberal thought has dealt with the reality of an illiberal world. Confronted with the apparent explanatory gap between physical processes and consciousness, there are many possible reactions. Some deny that any explanatory gap exists at all. Some hold that there is an explanatory gap for now, but that it will eventually be closed. Some hold that the explanatory gap corresponds to an ontological gap in nature.

The explanatory objection against the fitting attitude account of value states that if the properties of attitudes explain fittingness facts, but do not always explain value facts, then value facts cannot be identical with or reduced to fittingness facts. One reply to this objection is to claim that the constitutive properties of attitudes also explain value facts, for they are enablers for the value possessed by an object. In this paper we argue that the enabling maneuver exposes FA to a (...) new explanatory objection, to the extent that the explanatory role played by the constitutive properties of attitudes in value facts is assumed to be different from the explanatory role they play in fittingness facts.
