Might fiction help us to develop and advance new theories about the nature of consciousness? And might such theories, in turn, inform our understanding of the process of reading fiction? Three recent volumes—one by English critic and novelist, David Lodge; another by literary theorist, Alan Palmer; and a third by philosopher and (now) novelist, Dan Lloyd—raise these important, genre-bending questions, and they offer challenging if not always convincing answers to them. More generally, these volumes make valuable contributions to the fruitful cross-pollination that has developed between philosophers, scientists, literary theorists, and novelists who are interested in the nature of consciousness.Lodge's new collection of essays is called Consciousness and the Novel: Connected Essays, and like all of the criticism he has written since the late eighties, this volume is intended for a general audience, not for [End Page 299] literary theorists. The title essay, "Consciousness and the Novel," is a revised version of the Richard Ellman Lectures in Modern Literature that Lodge gave at Emory University in 2001, and the other nine essays, all previously published, cover such topics as Howards End; the novels of Evelyn Waugh; The Letters of Kingsley Amis; Martin Amis's memoir, Experience; and the relationship between literature and criticism. I will focus on "Consciousness and the Novel."Lodge's thesis in this essay is that novels play an essential role in our exploration of the nature of human consciousness. This thesis is certainly true, but it is also entirely banal. Much more interesting is what Lodge says in support of it. He argues that because of the unique representative possibilities of the novel, conscious experiences can be represented more effectively in novels than they can be in scientific writing. Taken literally, as an assertion about the relative representational power of novels and scientific discourse, this is extremely implausible. However, taken more loosely—as an invitation to those of us interested in consciousness to take a closer look at the ways conscious experiences are represented in novels—Lodge's claim is sensible and appealing. I will consider the literal reading of Lodge's claim first and then turn to the looser one.It is undoubtedly true that, as a whole, novelists devote more energy to representing conscious experiences than writers of scientific discourse do. However, science writers can use whatever techniques best serve their aims, including the aim of describing conscious experiences, so there is no reason to think that conscious experiences can, in principle, be represented more effectively in novels than in broadly scientific discourse. Given that Lodge discusses such creative science writers as Antonio Damasio, Daniel Dennett, and Steven Pinker in the course of his essay, it is surprising and disappointing to find him caricature scientific writing in the following way: "science... is a third-person discourse. The first-person pronoun is not used in scientific papers. If there were any hint of qualia in a scientific paper... it would be edited out" (p. 11). Qualia are the supposedly subjective qualitative aspects of conscious experiences. How the plucked string of a cello sounds to you; how the rotting fish in the garbage smells to you; and how it feels for you to inch down into the smooth, almost-too-hot water of a perfect bubble bath—these are all (supposedly) examples of qualia. Lodge is simply mistaken when he says that there is no hint of qualia in scientific writing. There is no consensus about whether qualia can be explained scientifically. Could there be a power world? That is to say, could there be a world consisting of nothing but dispositional properties? If there couldn't be, then, obviously, the actual world is not such a world. That is one reason why answering this question is important. However, even if one thinks it is already obvious that the actual world is not a power world, answering this question is still important, because whether there could be a power world depends, in part, on (...) whether all the properties in a world could be dispositional . It also depends on whether dispositional properties require nondispositional bases. Could water solubility, for example, be a brute feature of salt, or must this disposition be explicable in terms of some further, nondispositional property that salt also possesses? Answering these questions about the nature of properties is clearly essential to arriving at a plausible ontology of the actual world. (shrink)

In his classic paper, ‘Why abortion is immoral’, Don Marquis argues that what makes killing an adult seriously immoral is that it deprives the victim of the valuable future he/she would have otherwise had. Moreover, Marquis contends, because abortion deprives a fetus of the very same thing, aborting a fetus is just as seriously wrong as killing an adult. Marquis’ argument has received a great deal of critical attention in the two decades since its publication. Nonetheless, there is a potential (...) challenge to it that seems to have gone unnoticed. A significant percentage of fetuses are lost to spontaneous abortion. Once we bring this fact to our attention, it becomes less clear whether Marquis can use his account of the wrongness of killing to show that abortion is the moral equivalent of murder. In this paper, I explore the relevance of the rate of spontaneous abortion to Marquis’ classic anti-abortion argument. I introduce a case I call Unexpected Death in which someone is about to commit murder, but, just as the would-be murderer is about to strike, his would-be victim dies unexpectedly. I then ask: what does Marquis’ account of killing imply about the moral status of what the would-be murderer was about to do? I consider four responses Marquis could give to this question, and I examine what implications these responses have for Marquis’ strategy of using his account of the wrongness of killing an adult to show that abortion is in the same moral category. According to the Humean theory of motivation, a person can only be motivated to act by a desire together with a relevantly related belief. More specifically, a person can only be motivated to ϕ by a desire to ψ together with a belief that ϕ-ing is a means to or a way of ψ-ing. In recent writings, Michael Smith gives what has become a very influential argument in favour of the Humean claim that desire is a necessary part of motivation, (...) and a great deal has been written about Smith's defence of this Humean claim. However, no one has yet identified the fundamental weakness of his defence. The fundamental weakness is that there is no single conception of directions of fit that does all the work Smith needs it to do throughout the various stages of his defence. (shrink)

In my dissertation I aim to further our understanding of practical reasons and practical reasoning. In chapter one I evaluate and reject the most commonly accepted accounts of practical reasons, viz., Objectivism and Humeanism. They each offer an account of the conditions under which we have reasons, but they cannot tell us why these conditions have normative significance for us. I also argue that we cannot use a claim about the relationship between reasons and motivation to determine the nature of (...) practical reasons. ;In chapter two I claim that an acceptable account of what motivates us to act must be compatible with the fact that actions are things we do. I argue that neither desire-based nor belief-based accounts of motivation can accommodate this fact, and I sketch an alternative account according to which we are motivated to act by our decisions. ;I argue in chapter three that to make decisions is to hold oneself subject to certain constitutive laws about how to make decisions. I also claim that person P has a reason to do A if and only if it would be correct for P to decide to do A. A decision is correct, I contend, just in case it conforms with the constitutive laws of decision-making. Furthermore, the conditions under which we have reasons to act have this special status for us because we cannot avoid making decisions about how to act. ;In chapter four I claim that it seems as if there is no room in the world, as science understands it, for the performance of actions. I respond to this worry in two steps. First, I claim that our making decisions and carrying them out in action is compatible with the fact that our bodies move in accordance with physical laws. Second, I argue that our decisions are our own doings in a very deep sense. Therefore, the scientific world view does not preclude the kind of self-expression essential to action. (shrink)

Background Biobanking and genomic research requires collection and storage of human tissue from study participants. From participants’ perspectives within the African context, this can be associated with fears and misgivings due to a myriad of factors including myths and mistrust of researchers. From the researchers angle ethical dilemmas may arise especially with consenting and sample reuse during storage. The aim of this paper was to explore these ethical considerations in the establishment and conduct of biobanking and genomic studies in Africa. (...) Methods We conducted a narrative synthesis following a comprehensive search of nine (9) databases and grey literature. All primary research study designs were eligible for inclusion as well as both quantitative and qualitative evidence from peer reviewed journals, spanning a maximum of 20 years (2000–2020). It focused on research work conducted in Africa, even if data was stored or analysed outside the region. Results Of 2,663 title and abstracts screened, 94 full texts were retrieved and reviewed for eligibility. We included 12 studies (7 qualitative; 4 quantitative and one mixed methods). Ethical issues described in these papers related to community knowledge and understanding of biobanking and genomic research, regulation, and governance of same by research ethics committees, enrolment of participants, types of informed consents, data collection, storage, usage and sharing as well as material transfer, returning results and benefit sharing. ca. Biospecimen collection and storage is given in trust and participants expect confidentially of data and results generated. Most participants are comfortable with broad consent due to trust in researchers, though a few would like to be contacted for reconsenting in future studies, and this would depend on whether the new research is for good cause. Sharing data with external partners is welcome in some contexts but some research participants did not trust foreign researchers. Conclusion Biobanking and genomic studies are a real need in Africa. Linked to this are ethical considerations related to setting up and participation in biobanks as well as data storage, export, use and sharing. There is emerging or pre-existing consensus around the acceptability of broad consent as a suitable model of consent, the need for Africans to take the lead in international collaborative studies, with deliberate efforts to build capacity in local storage and analysis of samples and employ processes of sample collection and use that build trust of communities and potential study participants. Research ethics committees, researchers and communities need to work together to work together to adapt and use clearly defined ethical frameworks, guidelines, and policy documents to harmonize the establishment and running of biobanking and genomic research in Africa. BackgroundCountries are increasingly devoting significant resources to creating or strengthening research ethics committees, but there has been insufficient attention to assessing whether these committees are actually improving the protection of human research participants.DiscussionResearch ethics committees face numerous obstacles to achieving their goal of improving research participant protection. These include the inherently amorphous nature of ethics review, the tendency of regulatory systems to encourage a focus on form over substance, financial and resource constraints, and conflicts of interest. Auditing and accreditation programs (...) can improve the quality of ethics review by encouraging the development of standardized policies and procedures, promoting a common base of knowledge, and enhancing the status of research ethics committees within their own institutions. However, these mechanisms focus largely on questions of structure and process and are therefore incapable of answering many critical questions about ethics committees' actual impact on research practices.The first step in determining whether research ethics committees are achieving their intended function is to identify what prospective research participants and their communities hope to get out of the ethics review process. Answers to this question can help guide the development of effective outcomes assessment measures. It is also important to determine whether research ethics committees' guidance to investigators is actually being followed. Finally, the information developed through outcomes assessment must be disseminated to key decision-makers and incorporated into practice. This article offers concrete suggestions for achieving these goals.ConclusionOutcomes assessment of research ethics committees should address the following questions: First, does research ethics committee review improve participants' understanding of the risks and potential benefits of studies? Second, does the process affect prospective participants' decisions about whether to participate in research? Third, does it change participants' subjective experiences in studies or their attitudes about research? Fourth, does it reduce the riskiness of research? Fifth, does it result in more research responsive to the local community's self-identified needs? Sixth, is research ethics committees' guidance to researchers actually being followed? (shrink)

Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. In “Constitutivism without Normative Thresholds,” Kathryn Lindeman raises two objections to what she aptly calls Threshold Constitutivism. My aim in this short discussion is to respond to her first objection. Although I will argue that this objection fails, I will also argue that thinking through how to respond to it reminds us of something important, namely, that many of the Norm-Governed Kinds that are directly related to intentional action are social kinds, that is, kinds whose existence conditions we ourselves collectively (...) write. This study examines the outcomes of a four-year faculty learning community (FLC) that aimed to transform departmental ethics curriculum by supporting Earth Sciences faculty members as they ethically inquired into their teaching of ethics and refined existing courses in alignment with an Integrated Community-Engaged Learning and Ethical Reflection (ICELER) framework. We present ethnographic case studies that unpack processes through which three faculty members transformed undergraduate courses. We assembled case studies by triangulating interview data, course artifacts, and faculty reflections. We examine (...) how faculty (1) built awareness around teaching ethics, (2) took responsibility for and made judgments about teaching ethics, (3) experimented by designing and implementing ICELER-inspired courses, and (4) interrogated the outcomes of their ethics teaching, utilizing findings to enhance awareness and revise courses. Frank Jackson's knowledge argument imagines a super-smart scientist, Mary, forced to investigate the mysteries of human colour vision using only black and white resources. This paper discusses Claytons theory on Comprehensive enrolment of children by their parents. This paper supports Claytons view that we should not enrol children. However, Cameron raises objections which cause problems for the application of this framework. Namely, the cost of giving up a belief, choices made for us in childhood and the application of the PRR (Public Reason Restriction) to the way the parent-child relationship should function. Some modifications to Clayton’s framework and further debate is required to fully (...) address these issues. The conclusion is that we should be able to enrol children in activities that would be of low future cost if rejected but we should not enrol children in activities of high future rejection cost. This enrolment is tempered by the statement “the fundamental motivation of parents should be to conform with public reason i.e. to treat their children in accordance with norms that are capable of acceptance by any free and equal person”. As Clayton states: “I am not ruling out the imposition of a comprehensive doctrine on the child. I am rejecting its imposition in the absence of an argument from public reason”. The structure of this essay is as follows: In Section One I explore Clayton’s theories of end state autonomy and autonomy as a precondition, I then look at the plausible relationship between the state-citizen and child-parent relationships. The Public Reason Restriction is then examined in connection with comprehensive enrolment. In the next section, I look at objections to Clayton’s view from Cameron and any subsequent replies to this from Clayton. I then conclude by discussing the differences between the two views and add my own view to this. (shrink)

According to the knowledge argument, physicalism fails because when physically omniscient Mary first sees red, her gain in phenomenal knowledge involves a gain in factual knowledge. Thus not all facts are physical facts. According to the ability hypothesis, the knowledge argument fails because Mary only acquires abilities to imagine, remember and recognise redness, and not new factual knowledge. I argue that reducing Mary’s new knowledge to abilities does not affect the issue of whether she also learns factually: (...) I show that gaining specific new phenomenal knowledge is required for acquiring abilities of the relevant kind. Phenomenal knowledge being basic to abilities, and not vice versa, it is left an open question whether someone who acquires such abilities also learns something factual. The answer depends on whether the new phenomenal knowledge involved is factual. But this is the same question we wanted to settle when first considering the knowledge argument. The ability hypothesis, therefore, has offered us no dialectical progress with the knowledge argument, and is best forgotten. (shrink)

Frank Jackson's case of Mary the colour scientist, and the knowledge argument against physicalism built upon it, are well known. This paper starts from Jackson's other, more neglected, thought experiment, about Fred, who sees a unique shade of red. It explores two senses in which properties are said to be 'objective', roughly corresponding to the ideas of a property's being intersubjectively accessible, on the one hand, and its being knowable without the need for special experiences, on the other. These (...) senses of the objective are contrasted, and their links to the doctrine of physicalism explored, and it is argued that, in the sense of objectivity we should embrace, mental qualities come out as objective and physical properties. The paper ends up by proposing a novel theory about how mental qualities fit into the world—as determinates of determinable physical properties, a view that is distinguished from the closely related 'Russellian monism'. Nineteenth-century imperialist discourses constructed European colonisation of indigenous inhabitants as an inevitable and necessary process for the progress of the colonies and the extension of the British Empire. Within this construct, imperialist and patriarchal discourses intersected to construct ‘white women’ in a manner that denied them legitimacy as autonomous individuals but simultaneously positioned them as actors within the imperial endeavour. Recent feminist scholarship has extended this historiography by considering how some women in nineteenth-century New Zealand were complexly positioned as both (...) agents and critics of colonisation, involved in imperial strategies and yet disruptive of practices of cultural assimilation of Maori. This article furthers this scholarship through an illustrative case study of one woman who embodied this complex positioning within patriarchal and imperialist discourses. English-born wife of the first Chief Justice of New Zealand, and outspoken critic of colonial policies associated with government appropriation of Maori land, Mary Ann Martin was actively involved in establishing Anglican training institutions for young Maori men and women, and in dispensing medical assistance to Maori. Examination of her positioning on the margins of imperial discourses offers an opportunity to consider the operation of colonialism as a discourse implicated by gendered, racialised identities. Detailed textual analyses of selected extracts of her reminiscences of her 34-year residence in New Zealand, which focus on her positioning as a member of the ‘inferior’ sex in the dominant race, offer an opportunity to examine the ways in which she simultaneously challenged and reinforced Victorian prescriptions of respectable womanhood; how her views on and interactions with Maori may have destabilised accepted notions of women's appropriate spheres of influence; and the extent to which her challenges to dominant views on race relations may have been inflected by her positioning within gendered discourses of femininity. This paper deals with various connections that are found to exist between statistical estimation methods for decision-making and rules of group choice in the social choice area. Initially the aggregation of individual opinions is formulated as a pattern recognition problem; firstly it is shown that individual preferences lead to a natural representation in terms of binary patterns. Then we proceed to show how the search for a group preference pattern can be conducted by classifying the input preference patterns into various (...) ‘pattern classes’ and using the resulting classification boundaries to define the area of mutual agreement over some of the available alternatives. This leads to a decision-theoretic problem which consists in defining a decision rule (for classification) that is least likely to lead to misrecognition of arbitrary preference patterns. A maximum likelihood solution is obtained and compared with some well-known rules of group decision-making. Other solutions are also possible, on the basis of different optimality criteria, and their social choice interpretation is suggested. Finally, a method using Coleman's linear model for attributes is applied to yield group decision rules by feature weighting of election issues. (shrink)

Jules Coleman, one of the world's leading philosophers of law, here presents his most mature work so far on substantive issues in legal theory and the appropriate methodology for legal theorizing. In doing so, he takes on the views of highly respected contemporaries such as Brian Leiter, Stephen Perry, and Ronald Dworkin.

There is much to like about the idea that justification should be understood in terms of normality or normic support (Smith 2016, Goodman and Salow 2018). The view does a nice job explaining why we should think that lottery beliefs differ in justificatory status from mundane perceptual or testimonial beliefs. And it seems to do that in a way that is friendly to a broadly internalist approach to justification. In spite of its attractions, we think that the normic support view (...) faces two serious challenges. The first is that it delivers the wrong result in preface cases. These cases suggest that the view is either too sceptical or too externalist. The second is that the view struggles with certain kinds of Moorean absurdities. It turns out that these problems can easily be avoided. If we think of normality as a condition on *knowledge*, we can characterise justification in terms of its connection to knowledge and thereby avoid the difficulties discussed here. The resulting view does an equally good job explaining why we should think that our perceptual and testimonial beliefs are justified when lottery beliefs cannot be. Thus, it seems that little could be lost and much could be gained by revising the proposal and adopting a view on which it is knowledge, not justification, that depends directly upon normality. American Academy of Pediatrics (AAP) and American College of Medical Genetics (ACMG) recently provided two recommendations about predictive genetic testing of children. The Clinical Sequencing Exploratory Research Consortium's Pediatrics Working Group compared these recommendations, focusing on operational and ethical issues specific to decision making for children. Content analysis of the statements addresses two issues: (1) how these recommendations characterize and analyze locus of decision making, as well as the risks and benefits of testing, and (2) whether the guidelines conflict or (...) come to different but compatible conclusions because they consider different testing scenarios. These statements differ in ethically significant ways. AAP/ACMG analyzes risks and benefits using best interests of the child and recommends that, absent ameliorative interventions available during childhood, clinicians should generally decline to order testing. Parents authorize focused tests. ACMG analyzes risks and benefits using the interests of the child and other family members and recommends that sequencing results be examined for additional variants that can lead to ameliorative interventions, regardless of age, which laboratories should report to clinicians who should contextualize the results. Parents must accept additional analysis. The ethical arguments in these statements appear to be in tension with each other. (shrink)

This book by one of America's preeminent legal theorists is concerned with the conflict between the goals of justice and economic efficiency in the allocation of risk, especially risk pertaining to safety. The author approaches his subject from the premise that the market is central to liberal political, moral, and legal theory. In the first part of the book, he rejects traditional "rational choice" liberalism in favor of the view that the market operates as a rational way of fostering stable (...) relationships and institutions within communities of individuals with broadly divergent conceptions of the good. However, markets are needed most where they are most difficult to create and sustain, and one way to understand contract law in liberal legal theory, according to Professor Coleman, is as an institution designed to reduce uncertainty and thereby make markets possible. Another target of this book is the prevalent view that tort law helps rectify market failures when transaction costs are too high to permit contracting. The author argues instead that tort law should be understood as a way of rectifying wrongful losses not inefficient exchanges. (shrink)

Crockett develops a constructive radical theology from the philosophy of Kant. Reading The Critique of Judgment back into The Critique of Pure Reason, Crockett draws upon the insights of such continental philosophers as Heidegger, Derrida, Lyotard and Deleuze. This book shows how existential notions of self, time and imagination are interrelated in Kantian thinking, and demonstrates their importance for theology. There has been a considerable amount of debate about the norms of belief, but little discussion to date about what the reasons associated with these norms demand from us. By working out an account of what reasons demand, we can better understand the nature of justification.

A theory of rational belief should get the cases right. It should also reach its verdicts using the right theoretical assumptions. Leading theories seem to predict the wrong things. With only one exception, they don't accommodate principles that we should use to explain these verdicts. We offer a theory of rational belief that combines an attractive picture of epistemic desirability with plausible principles connecting desirability to rationality. On our view, it's rational to believe when it's sufficiently likely that you'd know (...) because believing when it's sufficiently likely that you'd know minimises expected objective epistemic undesirability. First published in 1997, Alain Badiou's _Deleuze: The Clamor of Being_ cast Gilles Deleuze as a secret philosopher of the One. In this work, Clayton Crockett rehabilitates Deleuze's position within contemporary political and philosophical thought, advancing an original reading of the thinker's major works and a constructive conception of his philosophical ontology. Through close readings of Deleuze's _Difference and Repetition_, _Capitalism and Schizophrenia_ (with Felix Guattari), and _Cinema 2_, Crockett argues that Deleuze is anything but the austere, quietistic, and (...) aristocratic intellectual Badiou had portrayed. Instead, Crockett underscores Deleuze's radical aesthetics and innovative scientific, political, and mathematical forms of thought. He also refutes the notion Deleuze retreated from politics toward the end of his life. Using Badiou's critique as a foil, Crockett maintains the profound continuity of Deleuze's work and builds a general interpretation of his more obscure formulations. (shrink)

The internalism-externalism debate is one of the oldest debates in epistemology. Internalists assert that the justification of our beliefs can only depend on facts internal to us, while externalists insist that justification can depend on additional, for example environmental, factors. Clayton Littlejohn proposes and defends a new strategy for resolving this debate. Focussing on the connections between practical and theoretical reason, he explores the question of whether the priority of the good to the right might be used to defend (...) an epistemological version of consequentialism, and proceeds to formulate a new 'deontological externalist' view. On this view, the justificatory status of a belief depends upon whether it is fit for the purposes of practical reasoning. Only beliefs that meet externalist standards are fit for such a purpose. If we want to understand how a wide range of norms (e.g., moral norms) apply to rational agents regardless of what their evidence or outlook is like, we have to embrace an externalist account of the justification. In response to the increasing number of mentally ill people experiencing homelessness, some policy‐makers have called for the expanded use of involuntary commitment, even for individuals who are not engaging in behaviors that are immediately life‐threatening. Yet there is no evidence that involuntary commitment offers long‐term benefits, and significant reasons to believe that expanding the practice will cause harm. In addition, these proposals ignore research showing that most people with mental illness have the capacity to make medical decisions for themselves. (...) Rather than expanding the use of involuntary commitment, policy‐makers should support approaches proven to decrease the prevalence of homelessness, such as supportive housing. In addition, states should reevaluate their commitment standards for persons who pose no risk of harm to others. One promising approach is Northern Ireland's Mental Health Capacity Act of 2016, which establishes a uniform standard for imposing nonconsensual health care interventions, without any distinction between mental illnesses and other conditions in which capacity might be compromised.
