Core sustainability issues concerning the governance of seeds revolve around knowledge aspects, such as intellectual property rights over genetic information or the role of traditional knowledge in plant breeding, seed production and seed use. While the importance of knowledge management for efficient and equitable seed governance has been emphasized in the scientific discourse on Seed Commons, knowledge aspects have not yet been comprehensively studied. With this paper, we aim to (i) to analyze the governance of knowledge aspects in both global (...) and local/regional Seed Commons, (ii) to highlight disconnections in knowledge governance between the local Seed Commons and global governance of plant genetic resources, and (iii) to investigate the contribution of knowledge commoning to environmentally sustainable and culturally adapted food systems. For this purpose, we will analyze knowledge governance by the International Seed Treaty (ITPGRFA) and by two local Seed Commons, a Philippine farmer-led network and a German organic-breeding association. We take the analytical lens of commoning, focusing on social practices rather than specific resources. The main challenges include finding institutional arrangements, which fruitfully integrate aspects from both traditional and scientific knowledge systems, taking into account the complex interrelation between knowledge-related, material and cultural aspects of seeds. En premier lieu, l’on doit distinguer l’ordre public « gardien des marchés », de l’ordre public « promoteur des marchés », de l’ordre public « architecte des marchés ». En passant de l’un à l’autre, la dimension politique, voire souveraine, de l’ordre public économique s’accroît. En second lieu, l’on doit distinguer l’ordre public de « constitution des marchés » de l’ordre public posant des « (...) octrois aux marchés ». En effet, à l’intérieur des marchés, c’est par des règles d’ordre public que le Droit garde les marchés, les bâtit ou les conçoit. Mais un ordre public économique premier plus radical construit des « octrois de marchés » pour empêcher que les objets de désir, objets naturels d’échanges, deviennent de ce seul fait objets de marché. Cet ordre public économique hautement politique brise des élans de désir. Si on ne l’admet pas, alors que cette nature-là concrétise la prétention que constitue l’ordre public économique, le Droit ne serait plus que l’agent d’effectivité de l’Économie, donnant efficacité à une simple société d’ajustement des désirs individuels. The interdisciplinary field of neurorobotics looks to neuroscience to overcome the limitations of modern robotics technology, to robotics to advance our understanding of the neural system’s inner workings, and to information technology to develop tools that support those complementary endeavours. The development of these technologies is still at an early stage, which makes them an ideal candidate for proactive and anticipatory ethical reflection. This article explains the current state of neurorobotics development within the Human Brain Project, originating from a close (...) collaboration between the scientific and technical experts who drive neurorobotics innovation, and the humanities and social sciences scholars who provide contextualising and reflective capabilities. This article discusses some of the ethical issues which can reasonably be expected. On this basis, the article explores possible gaps identified within this collaborative, ethical reflection that calls for attention to ensure that the development of neurorobotics is ethically sound and socially acceptable and desirable. Ainsi la Législation créée par Carbonnier offrit à chaque famille la liberté de tisser chaque jour son droit. Mais c’est pourtant bien au Législateur seul que revint et doit revenir l’enfance de l’art consistant à tendre la toile sur le métier. Il est alors possible, comme le fit Bacon, d’obtenir un objet immobile qui permet que surgissent sans cesse les figures mobiles. Le Droit est aujourd'hui placé devant un impératif stratégique : tourner sa force vers le futur, pour faire face à des enjeux (numérique et climat) sur lesquels la loi et le contrat n'ont pas l'emprise requise, puisque trop locale ou trop peu systémique, tandis que la responsabilité ex post n'est pas adéquate face à l'irréparable. La responsabilité se saisit donc de l'avenir, le juge devenant le personnage central du monde sans qu'il l'ait voulu. Ce déplacement dans le temps peut continuer (...) à s'ancrer dans le passé, du fait d'engagements des États ou des entreprises. Mais cette responsabilité pour le futur engendrant une obligation non de réparer mais de faire peut venir plus directement encore du seul fait que l'entité visée est « en position » d'agir pour qu'autrui soit préservé. Preuves préconstituées, office ex ante du juge, devoir pour autrui mais aussi pouvoirs de l'entreprise et de l'État pour porter cette responsabilité ex ante, pilier du droit de la compliance, droit de l'avenir, sont les nouvelles règles qui se mettent en place. C’est par le Droit que l’être humain a acquis en Occident une unité (I). Ce que la Religion avait pu faire, le Droit l’a également fait en posant sur chaque être humain la notion indétachable de lui de « personne » (I.A). Mais c’est cela qui est remis en cause aujourd’hui, non pas la personnalité et le pouvoir que l’être humain a d’exprimer sa liberté mais l’unité que cela implique dans la disposition que l’on a de soi en repoussant le (...) désir qu’autrui a toujours eu de disposer de nous. Le Droit actuel tend en effet à « pulvériser » les êtres humains en données et à transformer en prestations juridiques neutres ce qui était considéré comme de la dévoration d’autrui. La notion juridique de « consentement », cessant d’être une preuve d’une volonté libre mais devenue une notion autonome, y suffirait (I.B.). Pour empêcher que ne règne plus que la « loi des désirs », laquelle ne fait que traduire l’ajustement des forces, il faut requérir ici et maintenant la souveraineté éthique du Droit, parce que le Droit ne peut pas être qu’une technique d’ajustement des intérêts (II). L’on peut former cette requête si l’on ne veut pas vivre dans un univers a-moral (II. A), si l’on constate que l’unité de la personne est l’invention juridique qui protège l’être humain faible (II.B.). Si on en admet l’impératif, il faut alors se demander enfin qui en Droit va l’exprimer et l’imposer, notamment de la Loi, ou du Juge, car nous semblons avoir perdu la capacité de rappeler ce principe de la Personne sur laquelle l’Occident fut si centré. Or, les principes qui ne sont plus dits disparaissent. Il ne resterait plus alors que l’ajustement au cas par cas des intérêts entre êtres humains dans le champ mondial des forces particulières. À cette aune, le Droit ne serait plus qu’une technique de sécurisation des ajustements particuliers. (II. C). Réduit à cela, le Droit aurait perdu son lien avec l’Éthique. (shrink)

Aristotle believes that an agent lacks virtue unless she enjoys the performance of virtuous actions, while Kant claims that the person who does her duty despite contrary inclinations exhibits a moral worth that the person who acts from inclination lacks. Despite these differences, this chapter argues that Aristotle and Kant share a distinctive view of the object of human choice and locus of moral value: that what we choose, and what has moral value, are not mere acts, but actions: acts (...) done for the sake of ends. Morally good actions embody a kind of intrinsic value that inspires us to do them from duty (in Kant) or for the sake of the noble (in Aristotle). The chapter traces the difference in their attitudes about doing one's duty with pleasure to a difference in their attitudes towards pleasure itself: Aristotle sees it as a perception of the good, while Kant thinks of it as mere feeling. Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. In this paper, we consider the question of whether there exists an essential relation between emotions and wellbeing. We distinguish three ways in which emotions and wellbeing might be essentially related: constitutive, causal, and epistemic. We argue that, while there is some room for holding that emotions are constitutive ingredients of an individual’s wellbeing, all the attempts to characterise the causal and epistemic relations in an essentialist way are vulnerable to some important objections. ABSTRACT The problem of the captivated gaze has been taken up repeatedly in philosophy. Plato's Allegory of the Cave stands paradigmatically for this. Here, the gaze at the shadowy images prevents people from taking the path to the sun. Denis Diderot's critical reinterpretation of Plato's Allegory of the Cave is less well known. In Diderot, the view of the artificial light images is just as captivating as Plato's shadow images. Unlike there, however, Diderot does not distinguish between perception and cognition (...) but instead focuses on the significance of the seemingly unimportant shift of the gaze within the cave. Diderot determines the starting point of the realisation of freedom in the liberation of one's own gaze from the captivation intended by third parties. Prerequisites for the liberation of the gaze are the realisation of an interruption. It is shifts in the alignment of the eyeballs that become visible here as lucid intervals and which, in Diderot, become the starting point of power analysis and the site of revolt and freedom practice. In this article, I will show how Diderot's demand for enabling the individual realisation of lucid intervals is not first and foremost an aesthetic, but a highly political one. The criteria of art, which are defined by Diderot and have not lost their relevance until today, are based on his explosive insight that the incessant captivation of the gaze stands in the way of democratisation. Some are concerned about the possibility that offering money for research participation can constitute coercion or undue influence capable of distorting the judgment of potential research subjects and compromising the voluntariness of their informed consent. The author recognizes that more often than not there are multiple influences leading to decisions, including decisions about research participation. The concept of undue influence is explored, as well as the question of whether or not there is something uniquely distorting about money as opposed to (...) a chance for treatment or medical care. An amount of money that is not excessive and is calculated on the basis of time or contribution may, rather than constitute an undue inducement, be an indication of respect for the time and contribution that research subjects make. Although evidence of teaching behaviour has been identified in some nonhuman species, human teaching appears to be unique in terms of both the breadth of contexts within which it is observed, and in its responsiveness to needs of the learner. Similarly, cultural evolution is observable in other species, but human cultural evolution appears strikingly distinct. This has led to speculation that the evolutionary origins of these capacities may be causally linked. Here we provide an overview of contrasting perspectives on the (...) relationship between teaching and cultural evolution in humans, and briefly review previous research which suggests that cumulative culture can occur without teaching. We then report the results of a novel experimental study in which we investigated how the benefits of teaching may depend on the complexity of the skill to be acquired. Participants were asked to tie knots of varying complexity. In our Teaching condition, opportunities to interact with an experienced partner aided transmission of the most complex knots, but not simpler equivalents, relative to exposure to completed products alone, and also relative to information about the process of completion. We conclude by considering the plausibility of various accounts of the evolutionary relationship between teaching and cultural evolution in humans. (shrink)

Purpose/methods: This study investigated the relationship between ethics education and training, and the use and usefulness of ethics resources, confidence in moral decisions, and moral action/activism through a survey of practicing nurses and social workers from four United States (US) census regions. Findings: The sample (n = 1215) was primarily Caucasian (83%), female (85%), well educated (57% with a master's degree). no ethics education at all was reported by 14% of study participants (8% of social workers had no ethics education, (...) versus 23% of nurses), and only 57% of participants had ethics education in their professional educational program. Those with both professional ethics education and in-service or continuing education were more confident in their moral judgments and more likely to use ethics resources and to take moral action. Social workers had more overall education, more ethics education, and higher confidence and moral action scores, and were more likely to use ethics resources than nurses. Conclusion: Ethics education has a significant positive influence on moral confidence, moral action, and use of ethics resources by nurses and social workers. (shrink)

Despite the widespread use of the notion of moral intuition, its psychological features remain a matter of debate and it is unclear why the capacity to experience moral intuitions evolved in humans. We first survey standard accounts of moral intuition, pointing out their interesting and problematic aspects. Drawing lessons from this analysis, we propose a novel account of moral intuitions which captures their phenomenological, mechanistic, and evolutionary features. Moral intuitions are composed of two elements: an evaluative mental state and a (...) feeling of rightness (FOR). We illustrate the phenomenology of the FOR with examples of non-moral and moral cases, and provide a biological and mechanistic account: the emergence of human reasoning capacities created a need for the co-evolution of a psychological system producing the feeling of rightness (the FORs). This system is triggered when we experience conflicting evaluations. The FORs renders evaluations resulting from rational deliberation less compelling than the evaluations produced by simple evolved systems. It thus facilitates optimal decision-making, preventing excessive interference by rational deliberation. Our account sheds light on why moral intuitions are so frequently experienced and why they are so compelling and resistant to argument. In addition, the account fuels interesting speculations about common metaethical intuitions. (shrink)

The concept of moral distress comes from nursing ethics, and was initially defined as ‘…when one knows the right thing to do, but institutional constraints make it nearly impossible to pursue the right course of action’. There is a large body of literature associated with moral distress, yet multiple definitions now exist, significantly limiting its usefulness. We undertook a systematic review of the argument-based bioethics literature on this topic as the basis for a critical appraisal, identifying 55 papers for analysis. (...) We found that moral distress is most frequently framed around individual experiences of distress in relation to local practices and constraints, and understood in terms of power relations and workplace hierarchies. This understanding is directly derived from, and often still seen as specific to, nursing. Frequently the perspective of the morally distressed individual is privileged. Understandings of moral distress have evolved towards an ‘occupational health approach’, with the assumption that moral distress should be measured and prevented. Counter-perspectives were identified, highlighting conceptual problems. Based on our review, we propose a redefinition of moral distress: ‘Ethical unease or disquiet resulting from a situation where a clinician believes they have contributed to avoidable patient or community harm through their involvement in an action, inaction or decision that conflicts with their own values’. This definition is specific enough for research use, anchored in clinicians’ professional responsibilities and concerns about harms to patients, framed relationally rather than hierarchically, and amenable to multiple perspectives on any given morally distressing situation. I shall hear address the question of whether or not feminist philosophers should accept Kantian markers for the boundary between the aesthetic and nonaesthetic realms. I shall look at the way gender operates at the point in Kant's philosophy at which the aesthetic and ethical attitudes intersect: in the experience of the sublime. As we shall see, the later developments within the Kantian system mean that women fit comfortably neither side of the aesthetic/ethical divide and, indeed, fall outside personhood altogether.

In this commentary, we discuss Tom Cochrane’s theory of emotions. Cochrane offers an appealingly unified account of valent representations, ranging from simple responses to complex representations within a mechanistic framework. This offers some guidance as to how we might conceive of emotions as simple action-guiding responses in infants and animals, as well as context-sensitive evaluative states. While Cochrane argues for the centrality of bodily feelings, he does not consider his approach to be embodied in the narrower sense. We question his (...) reasons and suggest to think of emotions as embodied action-oriented representations. We, furthermore, suggest developing the approach with regard to the multiple roles that social norms play, and delve further into the nuanced relationship between bodily self-regulation and the formative influence of social norms on emotions.
