The Internet has been used as a place for and site of an array of research activities. From online ethnographies to public data sets and online surveys, researchers and research regulators have struggled with an array of ethical issues around the conduct of online research. This paper presents a discussion and findings from Buchanan and Ess's study on US-based institutional review boards and the state of internet research ethics.

E-games are a dramatically expanding dimension of contemporary exploitations of computing and computer network technologies - one that, thus far, has evoked much more heat among parents and politicians than light in the form of serious scholarly and philosophical analysis. We argue that e-games deserve such analysis in part because of their intrinsic philosophical interest as they raise primary philosophical questions of ontology, epistemology, human nature, the character of "gameplay," - and most especially, of ethics. We further suggest that such (...) analyses - exemplified by the articles collected here - may also contribute to resolving the larger social and political debates evoked by e-games. (shrink)

Pluralism in Theory and Practice not only brings McKeon to the attention of contemporary philosophers and students; it also puts his theories into practice. Some of the essays explicate aspects of McKeon's thought or situate him in the context of American intellectual and practical engagement. Barbara Fried takes the view that uniform taxation—that is, a single rate applicable to all income levels—cannot be defended on any grounds of justice. She goes further by saying that, of all possible rate structures, it might be “the hardest one”? to ground in “a”? theory of fairness. Using the contractarian-constitutional perspective advanced by John Rawls and James Buchanan, this article argues that tax uniformity can be seen as a requirement of justice. After modelling how the political world realistically decides (...) to distribute tax shares (self-interested parties act under a majority constraint), I show how the uniformity principle could emerge from the constitutional contract. In other words, rational individuals would choose uniformity as a procedural constraint under a “veil of uncertainty”?; that is, with limited knowledge regarding their positions under the future application of the rule. Moreover, I elucidate how the uniformity requirement integrates generalized criteria of fairness and efficiency into fiscal politics as it precludes fiscal exploitation and constrains majorities, and their most influential subgroups, to opt for policies in the direction of the Pareto frontier, and as such promotes outcomes acceptable to all participants. In this paper we discuss James Buchanan’s contribution in the narrow domain of understanding committee voting under majority rule. We then go on to discuss Charles Plott’s seminal experimental work on the topic that sparked a wave of public choice experimental work. However, given Plott’s claims that Buchanan influenced him significantly, it is puzzling that his work with Morris Fiorina explores a question outside of those which Buchanan and Tullock found interesting. We suggest several ways to resolve this tension. (...) The publication of Darwin's On the Origin of Species in 1859 ignited a public storm he neither wanted nor enjoyed. Having offered his book as a contribution to science, Darwin discovered to his dismay that it was received as an affront by many scientists and as a sacrilege by clergy and Christian citizens. To answer the criticism that his theory was a theory only, and a wild one at that, he published two volumes in 1868 to demonstrate that evolution was (...) obvious to anyone who cared to look at a bull in a pasture or a dog on a hearth. In response to those who insisted that species were distinct since creation, Darwin pointed to breeders of pigs and pigeons. In reply to those who protested that human intervention is one thing and natural selection another, he argued, "If organic beings had not possessed an inherent tendency to vary, man could have done nothing." To counter those who scorned his descriptions of species in exotic places, he submitted local evidence of cabbages and cauliflower. Based on a wide array of sources, from ancient pictographs to Polish roosters, from skins and from skeletons, from scientific journals and breeding manuals, Darwin assembled a mass of proof--and a hypothesis about species reversion that risked his reputation anew. The Variation of Animals and Plants under Domestication is a two-volume compilation of his thorough and intensive research and the revolutionary conclusions that resulted. The first portion of his work is dedicated to a meticulous analysis of various aspects of plant and animal life, including an inventory of varieties and their physical and behavioral characteristics, investigation of the impact of a species' surrounding environment and the role that both natural and forced changes in this environment have had. Darwin then turns to a richly detailed discussion of the roles of inheritance and crossing in the development of species. A wealth of illustrations further support and enhance his findings. This fascinating, invaluable, and courageous undertaking eventually formed the foundation for our current understanding of evolution. "In science as in politics the victors tend to write the history books. As a result, the record of the past is edited, intentionally or unintentionally, so that it focuses mainly on the precursors of contemporary orthodoxy. Such a focus may accurately represent the genealogy of modern ideas, but it almost inevitably misrepresents the historical experience of their progenitors... Even the powerful, persuasive, and ultimately triumphant theory of evolution by natural selection required not only defense, but repeated buttressing and revision. Nearly everyone has wronged another. Who among us has not longed to be forgiven? Who has not struggled to forgive? Charles Griswold has written the first comprehensive philosophical book on forgiveness in both its interpersonal and political contexts, as well as its relation to reconciliation. Having examined the place of forgiveness in ancient philosophy and in modern thought, he discusses what forgiveness is, what conditions the parties to it must meet, its relation to revenge and hatred, when it is (...) permissible and whether it is obligatory, and why it is a virtue. Griswold argues that forgiveness is inappropriate in politics, and analyzes the nature and limits of political apology with reference to historical examples. This book proposes a new paradigm for the interpretation of Plato's early and middle dialogues. Rejecting the usual assumption of a distinct 'Socratic' period in the development of Plato's thought, this view regards the earlier works as deliberate preparation for the exposition of Plato's mature philosophy. Differences between the dialogues do not represent different stages in Plato's own thinking but rather different aspects and moments in the presentation of a new and unfamiliar view of reality. Once the fictional character of (...) the Socratic genre is recognised, there is no reason to regard Plato's early dialogues as representing the philosophy of the historical Socrates. The result is a unified interpretation of all of the dialogues down to the Republic and the Phaedrus. (shrink)

The purpose of this volume is to help develop, through a variety of exploratory essays, the art and science of institutional design. The authors look at a variety of good societies as artifacts, as products—at least partly—of design, and consider how such societies can be crafted. They identify themselves with the New Constitutionalism movement, which aims to develop and promote the knowledge necessary for institutional reform and institutional creation through understanding the designer's, creator's, founder's, or reformer's perspective. Mills argues that Tolkien designs a racial hierarchy in the novels that recapitulates the central racist myth of European thought.

In reflecting on the relation between early empiricist conceptions of the mind and more experimentally motivated materialist philosophies of mind in the mid-eighteenth century, I suggest that we take seriously the existence of what I shall call ‘phantom philosophical projects’. A canonical empiricist like Locke goes out of his way to state that their project to investigate and articulate the ‘logic of ideas’ is not a scientific project: “I shall not at present meddle with the Physical consideration of the Mind” (...) (Essay, I.i.2). An equally prominent thinker, Immanuel Kant, seems to make an elementary mistake, given such a clear statement, when he claims that Locke’s project was a “physiology of the understanding,” in the Preface to the A edition of the first Critique). A first question, then, would be: what is this physiology of the understanding, if it was not Locke’s project? Did anyone undertake such a project? If not, what would it have resembled? My second and related case comes out of a remark the Hieronymus Gaub makes in a letter to Charles Bonnet of 1761: criticizing materialist accounts of mind and mind-body relations such as La Mettrie’s, Gaub suggests that what is needed is a thorough study of the “mechanics of the soul,” and that Bonnet could write such a study. What is the mechanics of the soul, especially given that it is presented as a non-materialist project? To what extent does it resemble the purported “physiology of the understanding”? And more generally, what do both of these phantom projects have to do with a process we might describe as a ‘naturalization of the soul’? (shrink)

Epitaphium Damonis, Milton's lament for his friend Charles Diodati, is usually described as most strongly indebted to Theocritus? idylls, to Virgil's eclogues, and to Ovid's lament for Tibullus. However, closer examination reveals that Milton was even more closely indebted to Neo-Latin poets such as Sannazaro, Buchanan, Castiglione, Mantuan, and Zanchi. Whereas there are lines in Epitaphium Damonis that resemble those in Virgil and Ovid, there are just as many that resemble those in Neo-Latin poets. Although a pastoral, the tone (...) and atmosphere of the epitaph resemble more its Renaissance contemporaries than its more distant Latin and Greek forebears. This is especially evident in the intimate tone Milton assumes in addressing Damon-Diodati and in the elaborate digression he incorporates into the poem when he confides to his dead friend his plans for a future epic on an Arthurian theme. Milton's attempt to wed a Christian sensibility to a classical form also signals his indebtedness to his Renaissance predecessors, who similarly used classical pastoral to express Christian consolation. Counterfactual imaginings are known to have far reaching implications. In the present experiment, we ask if imagining events from one's past can affect memory for childhood events. We draw on the social psychology literature showing that imagining a future event increases the subjective likelihood that the event will occur. The concepts of cognitive availability and the source monitoring framework provide reasons to expect that imagination may inflate confidence that a childhood event occurred. However, people routinely produce myriad counterfactual imaginings (i.e., (...) daydreams and fantasies) but usually do not confuse them with past experiences. To determine the effects of imagining a childhood event, we pretested subjects on how confident they were that a number of childhood events had happened, asked them to imagine some of those events, and then gathered new confidence measures. For each of the target items, imagination inflated confidence that the event had occurred in childhood. We discuss implications for situations in which imagination is used as an aid in searching for presumably lost memories. (shrink)

Although Fried does argue that the existence of equipoise cannot justify failure to obtain consent from research subjects, informed consent by itself (...) does not supplant ill subjects' rights to personalized judgment and care embodied in Fried's equipoise. Most modern analytic philosophers have ignored works of Indian philosophy such as Vasubandhu's 'Treasury of Metaphysics'. This neglect is unjustified. The account of the nature of the physical world given in the 'Treasury' is a one-category ontology of dharmas, which are simple, momentary tropes. They include basic physical tropes, the most fundamental level of the physical world, as well as higher-level tropes, including sensible properties such as colours, which are known as derived form. I argue that the relationship between the (...) basic physical tropes and derived form is one of supervenience. Vasubandhu's theory is a powerful and flexible one, which can be adapted so as to be consistent with modern science. (shrink)

In this article, I argue that justice is necessarily inapplicable to the global scale, since there is no such thing as a global society in the proper sense. I examine why this is so, and criticize two types of arguments for global justice—maximalist conceptions (such as those of Charles Beitz and Allen Buchanan) that argue for a robust notion of redistribution on the global scale, and minimalist conceptions (such as those of Thomas Pogge and Iris Young) that argue for (...) a notion of redress or solidarity across borders. In the study reported here we examined the impact of population size and two proxies of risk of resource failure on the diversity and complexity of the food-getting toolkits of hunter–gatherers and small-scale food producers. We tested three hypotheses: the risk hypothesis, the population-size hypothesis, and a hypothesis derived from niche construction theory. Our analyses indicated that the toolkits of hunter–gatherers are more affected by risk than are the toolkits of food producers. They also showed that the toolkits of food (...) producers are more affected by population size than are the toolkits of hunter–gatherers. This pattern is inconsistent with the predictions of both the risk hypothesis and the population-size hypothesis. In contrast, it is consistent with the predictions of the niche construction hypothesis. Our results indicate that niche construction has affected the evolution of technology in small-scale societies and imply that niche construction must be taken into account when seeking to understand technological variation among food producers and the technological changes that occurred in association with the various transitions to farming that have occurred over the last 10,000 years. In this essay I renew the case for Conditional Excluded Middle in light of recent developments in the semantics of the subjunctive conditional. I argue that Michael Tooley's recent backward causation counterexample to the Stalnaker-Lewis comparative world similarity semantics undermines the strongest argument against CXM, and I offer a new, principled argument for the validity of CXM that is in no way undermined by Tooley's counterexample. Finally, I formulate a simple semantics for the subjunctive conditional that is consistent with both (...) CXM and Tooley's counterexample. (shrink)

Jean-Jacques Rousseau and Adam Smith are giants of eighteenth century thought. The heated controversy provoked by their competing visions of human nature and society still resonates today.
