  2. From Nomos to Hegung: Sovereignty and the Laws of War in Schmitt’s International Order.Johanna Jacques - 2015 - The Modern Law Review 78 (3):411-430.
Carl Schmitt's notion of nomos is commonly regarded as the international equivalent to the national sovereign's decision on the exception. But can concrete spatial order alone turn a constellation of forces into an international order? This article looks at Schmitt's work The Nomos of the Earth and proposes that it is the process of bracketing war called Hegung which takes the place of the sovereign in the international order Schmitt describes. Beginning from an analysis of nomos, the ordering function of (...)

  4. Property and the Interests of Things: The Case of the Donative Trust.Johanna Jacques - 2019 - Law and Critique 30 (2):201-220.
Within a liberal, ‘law of things’ understanding of property, the donative trust is seen as a species of gift. Control over trust property passes from the hands of settlors to beneficiaries, from owners to owners. Trust property, like all other property, is silent and passive, its fate determined by its owners. This article questions this understanding of the trust by showing how beneath the facade of ownership, the trust inverts the relation between owner and owned, person and thing. It analyses (...)

What does it mean to act politically? This paper contributes an answer to this question by looking at the role that necessity plays in the political theory of Carl Schmitt. It argues that necessity, whether in the form of existential danger or absolute values, does not affect the sovereign decision, which must be free from normative determinations if it is to be a decision in Schmitt’s sense at all. The paper then provides a reading of Schmitt in line with Weber’s (...)

  6. A ‘Most Astonishing’ Circumstance: The Survival of Jewish POWs in German War Captivity During the Second World War.Johanna Jacques - 2021 - Social and Legal Studies 30 (3):362-383.
During the Second World War, more than 60,000 Jewish members of the American, British and French armed forces became prisoners of war in Germany. Against all expectations, these prisoners were treated in accordance with the 1929 Geneva Convention, and the majority made it home alive. This article seeks to explain this most astonishing circumstance. It begins by collating the references to the experiences of Western Jewish POWs from the historical literature to provide a hitherto-unseen overview of their treatment in captivity. (...)

  7. Where Nothing Happened: The Experience of War Captivity and Levinas’s Concept of the ‘There Is’.Johanna Jacques - 2017 - Social and Legal Studies 26 (2):230-248.
This article takes as its subject matter the juridico-political space of the prisoner of war (POW) camp. It sets out to determine the nature of this space by looking at the experience of war captivity by Jewish members of the Western forces in World War II, focusing on the experience of Emmanuel Levinas, who spent 5 years in German war captivity. On the basis of a historical analysis of the conditions in which Levinas spent his time in captivity, it argues (...)

On Not Saying, Not Knowing and Thinking about Nothing: Adorno, Dionysius, Derrida and the Negation of Art.Johanna Malt - 2018 - Paragraph 41 (2):196-217.
This article examines accounts of negation or the apophatic in Pseudo-Dionysius, Theodor Adorno and Jacques Derrida alongside a contemporary work of art by London Fieldworks, Null Object: Gustav Metzger Thinks about Nothing. By exploring models of negative knowledge offered in these works, it asks what happens to the work of art when it becomes preoccupied with negation and how a work of art might embody or manifest — without reproducing — philosophical discourses about negation.

Specters of Marx: The State of the Debt, the Work of Mourning and the New International.Jacques Derrida - 1994 - Routledge.
Prodigiously influential, Jacques Derrida gave rise to a comprehensive rethinking of the basic concepts and categories of Western philosophy in the latter part of the twentieth century, with writings central to our understanding of language, meaning, identity, ethics and values. In 1993, a conference was organized around the question, 'Whither Marxism?’, and Derrida was invited to open the proceedings. His plenary address, 'Specters of Marx', delivered in two parts, forms the basis of this book. Hotly debated when it was (...)

Being otherwise: On the possibility of a non-dualistic approach in feminist phenomenology.Marzena Adamiak - 2022 - Technoetic Arts 20 (1):11-25.
This article reflects on the current philosophical tendency to construct non-dualistic subjectivity models in response to the criticism of the traditional authoritarian human subject. Following thinkers such as Emmanuel Lévinas, Michel Foucault or Jacques Derrida, the literature has largely identified traditional metaphysics based on dualistic hierarchies as the major source of violence. Perceiving phenomenology as a method that focuses on the concepts of the lived experience and situatedness, I combine this approach with the feminist calls for dismantling the hierarchical (...)

I shall speak of ghost [revenant], of flame and of ashes. And of what, for Heidegger, avoiding means. What is avoiding? Heidegger on several occasions uses the common word Vermeiden: to avoid, to flee, to dodge. What might he have meant when it comes to “spirit” or the “spiritual”? I specify immediately: not spirit or the spiritual but Geist, geistig, geistlich, for this question will be, through and through, that of language. Do these German words allow themselves to be translated? In another (...)

This book offers a case-study approach to stakeholder theory that moves beyond theoretical analysis to the applied. As stakeholder theory has moved into the mainstream of management thinking in business ethics and a number of the management disciplines, there is an increasing need to explore the subtleties of stakeholder engagement via examples from practice. The case studies in this volume explore a number of aspects of the idea of stakeholder engagement, via the method of clinical case studies. Edited by leading (...)

The mathematician's mind: the psychology of invention in the mathematical field.Jacques Hadamard - 1945 - Princeton, N.J.: Princeton University Press.
Fifty years ago when Jacques Hadamard set out to explore how mathematicians invent new ideas, he considered the creative experiences of some of the greatest thinkers of his generation, such as George Polya, Claude Le;vi-Strauss, and Albert Einstein. It appeared that inspiration could strike anytime, particularly after an individual had worked hard on a problem for days and then turned attention to another activity. In exploring this phenomenon, Hadamard produced one of the most famous and cogent cases for the (...)

This article is concerned with the deprivation of patients’ liberty while undergoing psychiatric treatment, with special reference to the situation in Finland. It is based on a review of Finnish law, health care statistics, and empirical and theoretical studies. Relevant research findings from other countries are also discussed. In Finland, it is required that patients are cared for by mutual understanding with themselves; coercive measures may be applied only if they are necessary for the treatment of the illness, or for (...)

The problem of Genesis in Husserl's philosophy.Jacques Derrida - 2003 - Chicago: University of Chicago Press.
Derrida's first book-length work, The Problem of Genesis in Husserl's Philosophy , was originally written as a dissertation for his diplôme d'etudes superieures in 1953 and 1954. Surveying Husserl's major works on phenomenology, Derrida reveals what he sees as an internal tension in Husserl's central notion of genesis, and gives us our first glimpse into the concerns and frustrations that would later lead Derrida to abandon phenomenology and develop his now famous method of deconstruction. For Derrida, the problem of genesis (...)

Event-based prospective memory tasks require the realisation of a delayed intention at the occurrence of a specific target event. The present research investigates how performance in this kind of prospective memory task is influenced by the current affective state. By manipulating participants’ mood during intention realisation we tested two competing models of mood effects on memory (i.e., a capacity consuming account and a processing style account). Furthermore, we manipulated the valence of the target event to investigate mood-congruency effects in prospective (...)

Those who have read me, in particular those who have read “Paul de Man’s War,” know very well that I would have quite easily accepted a genuine critique, the expression of an argued disagreement with my reading of de Man, with my evaluation of these articles from 1940-42, and so on. After all, what I wrote on this subject was complicated enough, divided, tormented, most often hazarded as hypothesis, open enough to discussion, itself discussing itself enough in advance for me (...)

Integrative Social Robotics is a new proposal for how to generate responsible, i.e. culturally and ethically sustainable, social robotics applications. Starting point for the discussion are the five principles that characterize an ISR approach, which are discussed in application to the three use cases for (...)

This article studies the idea of Corporate Social Performance (CSP) from a critical perspective using empirical elements derived from analysis of year 2000 ARESE data. ARESE is the French first mover social rating agency providing quantified data about the Social Performance of French companies. The paper starts out by reviewing leading CSP models and discussing problems inherent to the measurement of this construct before going on to present and analyse ARESE data - whose suitability for existing models will be discussed.

Jacques Derrida’s Cinders is among the most remarkable and revealing of this distinguished author’s many writings. White Derrida customarily devotes his powers of analysis to exacting readings of texts from Plato and Aristotle to Freud and Heidegger, readers of Cinders will soon discover that here Derrida is engaged in a poetic self-analysis. Ranging across his numerous writings over the past twenty years, Derrida discerns a recurrent cluster of arguments and images, all involving in one way or another ashes and (...)

A medical student's ability to present a case history is a critical skill that is difficult to teach. Case histories presented without theatrical engagement may fail to catch the attention of their intended recipients. More engaging presentations incorporate ‘stage presence’, eye contact, vocal inflection, interesting detail and succinct, well organised performances. They convey stories effectively without wasting time. To address the didactic challenge for instructing future doctors in how to ‘act’, the Mayo Medical School and The Mayo Clinic Center for (...)

    On Knowledge through Connaturality.Jacques Maritain - 1951 - Review of Metaphysics 4 (4):473 - 481.
This notion of knowledge through connaturality is classical in the Thomist school. Thomas Aquinas refers in this connection to the Pseudo--Dionysius, and to the Nicomachean Ethics, Book 10, chapter V, where Aristotle states that the virtuous man is the rule and measure of human actions. I have no doubt that this notion, or equivalent notions, had, before Thomas Aquinas, a long history in human thought; an inquiry into this particular chapter in the history of ideas,--which would perhaps have to take (...)
