The possibilities of non-invasive prenatal testing (NIPT) are expanding, and the use of NIPT for adult-onset conditions may become widely available in the near future. If parents use NIPT to test for these conditions, and the pregnancy is continued, they will have information about the child’s genetic predisposition from birth. In this paper, we argue that prospective parents should be able to access NIPT for an adult-onset condition, even when they have no intention to terminate the pregnancy. We begin by (...) outlining the arguments against testing in such a situation, which generally apply the same considerations that apply in the predictive testing of a minor to the fetus in utero. We then contend, firstly, that there are important practical considerations that support availability of testing for prospective parents regardless of their stated intentions. Secondly, we object to the ethical equation of a fetus in utero with a minor. We base our analysis on a view of pregnancy that conceptualises the fetus as a part of the gestational parent, as opposed to the more common ‘container’ model of pregnancy. We suggest that fetal information is best conceptualised as shared information between the gestational parent and future child. Thus, it should be approached in similar ways as other kinds of shared information (such as genetic information with implications for family members), where a person has a claim over their own information, but should be encouraged to consider the interests of other relevant parties. This article examines Re Imogen (No 6) (2020) 61 Fam LR 344, a decision of the Family Court of Australia, which held that an application to the Family Court is mandatory if a parent or a medical practitioner of a child or adolescent diagnosed with gender dysphoria disputes the diagnosis, the capacity to consent, or the proposed treatment. First, we explain the regulatory framework for the medical treatment of gender dysphoria in children and adolescents, including the development of the welfare (...) jurisdiction under Section 67ZC of the Family Law Act 1975 (Cth). We then provide an overview of the Re Imogen decision, and discuss the balancing exercise involved in determining a child’s best interests in the medical treatment context. We challenge the Family Court’s conclusion that, in relation to a dispute about diagnosis or treatment, a finding that the child or adolescent is Gillick competent to consent to treatment is not determinative, and the Family Court must determine the dispute. We argue that this conclusion represents an unjustified incursion into the right of Gillick competent transgender children and adolescents to make decisions about their own bodies and identities, and that the protective role of parents and the Family Court cannot justify interfering with their bodily autonomy in this context. Finally, we propose an alternative regulatory framework that removes the Family Court from the medical treatment process for gender dysphoria in circumstances of dispute between a parent and their Gillick competent child. The national ethical guidelines relevant to assisted reproductive technology have recently been reviewed by the National Health and Medical Research Council. The review process paid particular attention to the issue of non-medical sex selection, although ultimately, the updated ethical guidelines maintain the pre-consultation position of a prohibition on non-medical sex selection. Whilst this recent review process provided a public forum for debate and discussion of this ethically contentious issue, the Victorian case of JS and LS v Patient Review Panel [2011] (...) VCAT 856 provides a rare instance where the prohibition on non-medical sex selection has been explored by a court or tribunal in Australia. This paper analyses the reasoning in that decision, focusing specifically on how the Victorian Civil and Administrative Tribunal applied the statutory framework relevant to ART and its comparison to other uses of embryo selection technologies. The Tribunal relied heavily upon the welfare-of-the-child principle under the Assisted Reproductive Treatment Act 2008. The Tribunal also compared non-medical sex selection with saviour sibling selection. Our analysis leads us to conclude that the Tribunal’s reasoning fails to adequately justify the denial of the applicants’ request to utilize ART services to select the sex of their prospective child. Drawing on writings of Michel Foucault, Charles Taylor, Friedrich Nietzsche, and Martin Heidegger in order to illuminate artworks by Robert Smithson and Hans Holbein, René Arcilla argues for a revised idea of the human that is rooted not in some authentic, essential identity of ours, (...) but in an unruly language in which we all participate. BackgroundInaccurate, false or incomplete research publications may mislead readers including researchers and decision-makers. It is therefore important that such problems are identified and rectified promptly. This usually involves collaboration between the research institutions and academic journals involved, but these interactions can be problematic.MethodsThese recommendations were developed following discussions at World Conferences on Research Integrity in 2013 and 2017, and at a specially convened 3-day workshop in 2016 involving participants from 7 countries with expertise in publication ethics and research integrity. The (...) recommendations aim to address issues surrounding cooperation and liaison between institutions and journals about possible and actual problems with the integrity of reported research arising before and after publication.ResultsThe main recommendations are that research institutions should: develop mechanisms for assessing the integrity of reported research that are distinct from processes to determine whether individual researchers have committed misconduct;release relevant sections of reports of research integrity or misconduct investigations to all journals that have published research that was investigated;take responsibility for research performed under their auspices regardless of whether the researcher still works at that institution or how long ago the work was done;work with funders to ensure essential research data is retained for at least 10 years.Journals should: respond to institutions about research integrity cases in a timely manner;have criteria for determining whether, and what type of, information and evidence relating to the integrity of research reports should be passed on to institutions;pass on research integrity concerns to institutions, regardless of whether they intend to accept the work for publication;retain peer review records for at least 10 years to enable the investigation of peer review manipulation or other inappropriate behaviour by authors or reviewers.ConclusionsVarious difficulties can prevent effective cooperation between academic journals and research institutions about research integrity concerns and hinder the correction of the research record if problems are discovered. While the issues and their solutions may vary across different settings, we encourage research institutions, journals and funders to consider how they might improve future collaboration and cooperation on research integrity cases. This essay recounts the author’s journey with her father during his prolonged decline due to dementia. The experience pushed her to break out of the confines of conventional scholarly research in her academic field of architectural history to a multi-disciplinary consideration of nineteenth-century environmental, sensory and horticultural therapies for the mentally ill. During her father’s illness, she discovered the tangible therapeutic benefits of momentary engagements with his environment through his five senses and through the emotional filter of poetry. The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

The aim of this review is to show the fruitfulness of using images of facial expressions as experimental stimuli in order to study how neural systems support biologically relevant learning as it relates to social interactions. Here we consider facial expressions as naturally conditioned stimuli which, when presented in experimental paradigms, evoke activation in amygdala–prefrontal neural circuits that serve to decipher the predictive meaning of the expressions. Facial expressions offer a relatively innocuous strategy with which to investigate these normal variations (...) in affective information processing, as well as the promise of elucidating what role the aberrance of such processing might play in emotional disorders. Infant and young child electrophysiology studies have provided information regarding the maturation of face-encoding neural processes. A limitation of previous research is that very few studies have examined face-encoding processes in children 12–48 months of age, a developmental period characterized by rapid changes in the ability to encode facial information. The present study sought to fill this gap in the literature via a longitudinal study examining the maturation of a primary node in the face-encoding network—the left and right fusiform gyrus. (...) Whole-brain magnetoencephalography data were obtained from 25 infants with typical development at 4–12 months, and with follow-up MEG exams every ∼12 months until 3–4 years old. Children were presented with color images of Face stimuli and visual noise images that served as Non-Face stimuli. Using distributed source modeling, left and right face-sensitive FFG evoked waveforms were obtained from each child at each visit, with face-sensitive activity identified via examining the difference between the Non-Face and Face FFG timecourses. Before 24 months of age the face-sensitive FFG M290 response was the dominant response, observed in the left and right FFG ∼250–450 ms post-stimulus. By 3–4 years old, the left and right face-sensitive FFG response occurred at a latency consistent with a face-sensitive M170 response ∼100–250 ms post-stimulus. Face-sensitive left and right FFG peak latencies decreased as a function of age, and with an adult-like FFG latency observed at 3–4 years old. Study findings thus showed face-sensitive FFG maturational changes across the first 4 years of life. Whereas a face-sensitive M290 response was observed under 2 years of age, by 3–4 years old, an adult-like face-sensitive M170 response was observed bilaterally. Future studies evaluating the maturation of face-sensitive FFG activity in infants at risk for neurodevelopmental disorders are of interest, with the present findings suggesting age-specific face-sensitive neural markers of a priori interest. Beauchamp and Childress’ biomedical principlism is nearly synonymous with medical ethics for most clinicians. Their four principles are theoretically derived from the “common morality”, a universal cache of moral beliefs and claims shared by all morally serious humans. Others have challenged the viability of the common morality, but none have attempted to explain why the common morality makes intuitive sense to Western ethicists. Here I use the work of Charles Taylor to trace how events in the Western history of (...) ideas made the common morality seem plausible and yet, ironically, underscore the cultural particularity of the so-called common morality. I conclude that the supposedly universal common morality is actually quite culturally contained. Importantly, this should give us pause about the global authority of principlism and Beauchamp and Childress’ claim to a global bioethics project. (shrink)

The work of feminist sexologist Shere Hite in the 1970s and 1980s was critiqued by sexologists and feminists alike: sexologists complained that the 1976 Hite Report was political and thus undermined the scientific prestige of sexology, while feminists criticized Hite for aspiring to a masculine scientific authority.8 Describing the relationship between feminism and sexology, Irvine notes that “the incompatibility of their concerns—science and market, on the one hand, versus shows that what we consider “healthy” is thoroughly political and that the effect of doctors’ practices is normalizing whatever their intentions may be. This article illustrates ways in which the concepts of the norm and normativity are implicated in relations of power. Specifically, I argue that these concepts have come to function in a normalizing manner. I outline Michel Foucault’s thinking on the norm and normalization and then provide an overview of Jürgen Habermas’s thinking on the norm and normativity in order to show that Habermas’s conceptualizations of the norm and normativity are not, as he posits, necessary foundations for ethics and politics, but (...) in fact simply one philosophical approach among many. Uncritically accepting a Habermasian framework therefore produces normalizing effects and inhibits alternative and potentially emancipatory thinking about ethics and politics. Having problematized the requirement of normative foundations as it is currently articulated, I conclude by examining the emancipatory potential of a particular aspect of Foucault’s work for the practice of philosophy. In a 1983 interview, Michel Foucault contrasts our contemporary interest in sexual identity with the ancient Greek preoccupation with diet, arguing that sex has replaced food as the privileged medium of self-constitution in the modern West. In the same interview, Foucault argues that modern liberation movements should return to the ancient model of ethics, of which diet was a prime example, as aesthetics or self-transformative practice. In this paper I take up Foucault's argument with respect to the Animal Liberation Movement (...) and the dietetics of ethical vegetarianism. Contra Foucault, I suggest that diet has not been replaced by sexuality in the modern West, and that food choices, along with and intertwined with sexuality, continue to function as practices of self-constitution in both disciplinary and aesthetic fashions. I then consider the implications of this argument for the Animal Liberation Movement, exploring ways in which it might (and to some degree already does) take on aesthetic rather than moral strategies in order to pursue what Foucault once described as “an ethics of acts and their pleasures which would be able to take into account the pleasure of the other.”. Foucault's influence has waned little over recent years and the once avant-garde theorist is now mainstream for countless subjects in the humanities and social sciences. He continues to out-sell his contemporaries and there remains strong demand for books that offer readers fresh exegesis of his work.

This paper problematizes the claim that Michel Foucault's work is normatively lacking and therefore possesses only limited political relevance. While Foucault does not articulate a traditional normative framework for political activity, I argue that his work nonetheless reflects certain normative commitments to, for example, practicing freedom and improving the state of the world. I elucidate these commitments by sketching out Foucault's notion of critique as a mode of existence characterized by practices of the self, arguing that such practices possess political (...) significance within the context of what Foucault refers to as a way of life, and analyzing points of intersection and departure between Kant's and Foucault's respective responses to the question `What is Enlightenment?' in order to clarify the connection Foucault makes between self-practices and freedom. Through this analysis I also show that Foucault reconceptualizes normative concepts such as obligation, freedom, autonomy and publicity in non-normalizing, politically compelling ways, and argue that his work opens onto a similar reconceptualization of the notion of political unity. I conclude with a preliminary investigation into the political efficacy of Foucault's ethos by discussing its relevance specifically for feminist politics. (shrink)

In the first volume of the History of Sexuality , Michel Foucault states in passing that prostitution and pornography, like the sexual sciences of medicine and psychiatry, are involved in the proliferation of sexualities and the perverse implantation. Against an influential misinterpretation of this passage on the part of film studies scholar Linda Williams, this paper takes up Foucault’s claim and attempts to explain the mechanism through which the sex industry, and pornography in particular, functions analogously to the sexual sciences (...) in terms of the normalizing form of power that Foucault describes. Whereas Williams sets the question of prostitution aside, and argues that pornography must be a confessional discourse for Foucault, this paper argues that consumption rather than confession is the mechanism through which both prostitution and pornography deploy sexualities within a disciplinary system of power. Drawing on the writings of Michel Foucault, this paper argues that the establishment of a new nomenclature and treatment model for intersexed individuals expands both the number of disciplines and the number of physical elements recognized as involved in (im)proper sex development and further, that the temporalization of these elements works to establish sex development as a discipline . Sex development thus emerges as a field of power/knowledge that allows for the distribution of not just individuals with intersex conditions, but (...) of all individuals, in relation to a norm. Further, while many see this model of treatment as finally acknowledging the calls of intersex activists for patient involvement in decision making, for the delaying of unnecessary surgical and hormonal treatment, and for urging honesty among physicians, patients and parents, this article argues that for some these may be hollow victories, requiring that both the patient and his or her family be disciplined into the right attitudes, behaviours and responses to treatment—and that they themselves discipline others accordingly—in order to enjoy these gains. In this paper I argue that “monstrous” women – violators of both moral and gender norms – mark the limits of acceptable behavior through such violation and thus provide particular insight into the workings of gendered power relations within contemporary western societies. Drawing upon Michel Foucault’s 1975 College de France course titled Abnormal , I begin by arguing that gendered power relations in western societies can be characterized as “normalizing.” Next, I refer to Foucault’s discussion of “natural” and “moral” monsters (...) in order to provide a sketch of the monstrous woman, and then show how specific monstrous women violate moral and gender norms. By way of conclusion I argue that the figure of the monstrous women is not wholly negative but rather ambivalent. As Foucault asserts, monsters are “limit figures;” monstrous women challenge limits – including prevailing norms governing the feminine and the human – in ways that render them explicit such that they are denaturalized and ultimately opened up to critical interrogation. Drawing on interviews and observational work with practicing U.K. plant scientists, this article uses Michel Callon's work as a tool to explore the issue of collaboration between academic science and business, in particular, calls by the Biotechnology and Biological Sciences Research Council for a return to “public good” plant science. In an article titled “Is Science a Public Good?” Callon contributed to the debate about the commercialization of science by suggesting that commercialization and the public good need not be incompatible. Moving away from arguments that center on the effects of business involvement in science, he suggested that analysts use another model, centered on “diversity.” This model allows us to ask what society might want from science, what public good science might look like, and how public good science can be ensured while also recognizing that science cannot be easily separated from the market. This paper provides an overview of Michel Foucault's continually changing observations on familial power, as well as the feminist-Foucauldian literature on the family. It suggests that these accounts offer fragments of a genealogy of the family that undermine any all-encompassing or transhistorical account of the institution. Approaching the family genealogically, rather than seeking a single model of power that can explain it, shows that far from this institution being a quasi-natural formation or a bedrock of unassailable values, it is in (...) fact a continually contested fiction that masks its own histories of becoming. Drawing on Michel Foucault's writings as well as the writings of feminist scholars bell hooks and Jane Gallop, this paper examines faculty–student sexual relations and the discourses and policies that surround them. It argues that the dominant discourses on professor–student sex and the policies that follow from them misunderstand the form of power that is at work within pedagogical institutions, and it examines some of the consequences that result from this misunderstanding. In Foucault's terms, we tend to theorize faculty–student relations (...) using a model of sovereign power in which people have or lack power and in which power operates in a static, stable, and exclusively top-down manner. We should, however, recognize the ways in which individuals in pedagogical institutions are situated within disciplinary and thus dynamic, reciprocal, and complex networks of power, as well as the ways in which the pedagogical relation may be a technique of the self and not only of domination. If we reconsider these relations in terms of Foucault's accounts of discipline and technologies of the self, we can recognize that prohibitions on faculty—student sexual relations within institutions such as the university are productive rather than repressive of desire, and that such relations can be opportunities for development and not only for abuse. Moreover, this paper suggests that the dominant discourses on professor—student relations today contribute to a construction of professors as dangerous and students as vulnerable, which denies the agency of (mostly female) students and obscures the multiplicity of forms of sexual abuse that occur within the university context. Self-regulation, especially the regulation of emotion, is an important component of athletic performance. In our study, we tested the effect of a self-distancing strategy on athletes’ performance in an aggression-inducing experimental task in the laboratory. To this end, we modified an established paradigm of interpersonal provocation [Taylor Aggression Paradigm ], which has the potential to complement field studies in order to increase our understanding of effective emotion regulation of athletes in critical situations in competitions. In our experimental setting, we (...) first tested the applicability of the self-distancing perspective and the athletes’ ability to dynamically adapt besides the self-distanced perspective a self-immersed perspective to provocation in the TAP. Secondly, we investigated how this altered perspective modulated regulatory abilities of negative affectivity, anger, and aggression. The experiment consisted of two conditions in which the participant adopted either a self-immersed or a self-distanced perspective. Forty athletes from different team and individual sports with a mean age of 23.83 years competed individually in a reaction-time task against a opponent. Results show that athletes are equally able to adopt both perspectives. In addition, within-person analyses indicate that self-distancing decreased aggressive behavior and negative affect compared to the self-immersed perspective. Our results suggest that self-distancing modulates different levels of athletes’ experience and behavior. Furthermore, this demonstrates the feasibility of testing self-regulation of emotion in athletes in a laboratory setting and allows for further application in research in sports and exercise psychology. In 1977 Michel Foucault contemplated the idea of punishing rape only as a crime of violence, while in 1978 he argued that non-coercive sex between adults and minors should be decriminalized entirely. Feminists have consistently criticized these suggestions by Foucault. This paper argues that these feminist responses have failed to sufficiently understand the theoretical motivations behind Foucault's statements on sex-crime legislation reform, and will offer a new feminist appraisal of Foucault's suggestions.

This following essay explores the meaning and implications of philosophical critique and creativity within the work of Gilles Deleuze and Michel Foucault. The two philosophers’ appeals to ontology, as an important site upon which their ethico-political commitments to critique and creativity simultaneously converge and diverge, frame this exploration. The first part of the essay shows how Deleuze’s and Foucault’s respective ontologies further critique and creativity. The second part of the essay focuses on a point of divergence in the two thinkers’ (...) appeals to ontology: the relationship between philosophy and history. From a Foucauldian perspective, the ahistorical character of Deleuze’s ontology of difference threatens to undermine its transformative potential, whereas from a Deleuzian perspective, the historical character of Foucault’s ontology of the present, while it may not undermine transformation, certainly does not facilitate it. In conclusion, I argue that it is precisely from within these tensions that important, productive, and transformative aspects of Deleuze’s and Foucault’s work emerge. (shrink)
