No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

This paper presents results found through searching publicly available U.S. data sources for information about how to handle incidental fndings (IF) in human subjects research, especially in genetics and genomics research, neuroimaging research, and CT colonography research. We searched the Web sites of 14 federal agencies, 22 professional societies, and 100 universities, as well as used the search engine Google for actual consent forms that had been posted on the Internet. Our analysis of these documents showed that there is very (...) little public guidance available for researchers as to how to deal with incidental fndings. Researchers in the health sciences regularly discover information of potential health importance unrelated to their object of study in the course of their research. However, there appears to be little guidance available on what researchers should do with this information, known in the scientific literature as incidental findings. The study described here was designed to determine the extent of guidance available to researchers from public sources. This empirical study was part of a larger two-year project funded by the National Human (...) Genome Research Institute to generate guidance on how incidental findings should be managed in human subjects research, especially genetics, genomics, and imaging research. We generated empirical analysis of publicly available guidance and consent forms to help guide a multidisciplinary Working Group of experts in their formulation of normative recommendations reported in this symposium. As part of “Nanodiagnostics and Nanotherapeutics: Building Research Ethics and Oversight,” an empirical search was conducted to identify publicly available resources that guided understanding about human subjects issues in nanomedicine or nanotechnology including policy statements, guidance documents, or consent forms. The authors conducted 5,083 internet searches and analyzed 175 documents. Results show that very little guidance is publicly available and most documents focused on occupational and environmental concerns.

Nanotechnology not only offers the promise of new enhancements to existing materials but also allows for the development of new materials and devices. The potential applications of nanotechnology range from medicine to agriculture to health and environmental science and beyond. Nanotechnology is growing at such a rate that Lux Research in 2007 estimated that nanotechnology will be incorporated into 15% of global manufactured goods by 2014. The U.S. National Nanotechnology Initiative defines nanotechnology as the following: “ Research and technology development (...) involving structures with at least one dimension in the range of 1-100 nanometers, frequently with atomic/molecular precision; Creating and using structures, devices, and systems that have unique properties and functions because of their nanoscale dimensions; The ability to control or manipulate on the atomic scale.” Nanomedicine and its subcategories of nanotherapeutics and in vivo nanodiagnostics incorporate nanoscale materials with unique properties that can enable new or improved treatments and diagnostics for many diseases and disorders. The law applicable to genomics in the United States is currently in transition and under debate. The rapid evolution of the science, burgeoning clinical research, and growing clinical application pose serious challenges for federal and state law. Although there has been some empirical work in this area, this is the first paper to survey and interview key scientific and legal stakeholders in the field of genomics to help ground identification of the most important legal problems that must be solved to (...) successfully integrate genomics into clinical care. The respondents in this study identified a wide range of interconnected issues, focusing specifically on the need for clear guidelines about how to use these data, fear of liability for those who use these data, and the need to protect patients from use of this information particularly by insurers, while endorsing data sharing. Developing legal strategies to support appropriate use of genomics now and in the future clearly will require making trade-offs, taking into account the full complexity of this legal ecosystem. Nanomedicine is yielding new and improved treatments and diagnostics for a range of diseases and disorders. Nanomedicine applications incorporate materials and components with nanoscale dimensions where novel physiochemical properties emerge as a result of size-dependent phenomena and high surface-to-mass ratio. Nanotherapeutics and in vivo nanodiagnostics are a subset of nanomedicine products that enter the human body. These include drugs, biological products, implantable medical devices, and combination products that are designed to function in the body in ways unachievable at larger scales. (...) Nanotherapeutics andin vivonanodiagnostics incorporate materials that are engineered at the nanoscale to express novel properties that are medicinally useful. These nanomedicine applications can also contain nanomaterials that are biologically active, producing interactions that depend on biological triggers. Examples include nanoscale formulations of insoluble drugs to improve bioavailability and pharmacokinetics, drugs encapsulated in hollow nanoparticles with the ability to target and cross cellular and tissue membranes and to release their payload at a specific time or location, imaging agents that demonstrate novel optical properties to aid in locating micrometastases, and antimicrobial and drug-eluting components or coatings of implantable medical devices such as stents. Members of the public, with diverse interests and perspectives, must have a role in determining our future as a species.

If you retain your belief upon learning that a large number and percentage of your recognized epistemic superiors disagree with you, then what happens to the epistemic status of your belief? I investigate that theoretical question as well has the applied case of philosophical disagreement—especially disagreement regarding purely philosophical error theories, theories that do not have much empirical support and that reject large swaths of our most commonsensical beliefs. I argue that even if all those error theories are false, either (...) (a) the average philosopher’s true commonsensical beliefs are epistemically impoverished, or (b) a good portion of philosophy is bunk and philosophers should give up most of their error theories despite the fact that their supporting arguments are generally as good as or even better than other philosophical arguments. Spengler’s Untergang des Abendlandes (The Decline of the West) (1918–22) was a sensational success in its own time, but has since slipped into oblivion. In this article I attempt to restore those aspects of his doctrine which could speak to us today and alert us to a crisis of the European Geist and its survival exigencies. This involves a reorientation on several issues on which our present perspectives differ from those that were current 100 years ago, such as the precedence (...) of his philosophical approach over the historical approach; the diminished importance of his extensive analysis and depiction of defunct civilisations, which serve at best as illustrative material rather than as direct comparisons on a somewhat risky notion of “simultaneity.” I also propose more relevant criteria in justification of his Faustianism (its sources and inception), and, not least, point to a differentiation between prediction and prognosis. The intention is to highlight the rationale behind Spengler’s enquiries into history—namely to situate Western civilisation in the overall scheme of human civilisations by alerting us to a decisive crossroads. This required of its author a means of identifying the symptoms that we must be aware of in order to sustain our world without tumbling unawares into a major catastrophe. The Untergang does not compulsorily wipe our civilisation out unless we provoke this to occur; instead, our civilisation may merge or blend peacefully with whatever culture(s) may be waiting to inaugurate a new cycle. Although Western and Chinese philosophy evolved from disparate doctrinal foundations, the department of ethics is a notable exception. “How to live the good life” is a subject treated by Confucius and Aristotle in a manner that exhibits many surprising points of coincidence, not least in the colossal influence of both these philosophers on the social and political shape of their respective civilisations. This article is an attempt to correlate the relevant ideas which, as it were, build a bridge between East (...) and West on the perennial issues that affect all mankind in the context of a civil society. There is a long history of using facts about disagreement to argue that many of our most precious beliefs are false in a way that can make a difference in our lives. In this essay I go over a series of such arguments, arguing that the best arguments target beliefs that meet two conditions: (i) they have been investigated and debated for a very long time by a great many very smart people who are your epistemic superiors on the matter (...) and have worked very hard under optimal circumstances to figure out if the belief is true, and (ii) as far as you know these people have not come to any significant agreement on the belief and as far as you know those who agree with you are not, as a group, in a better position to judge the belief than those who disagree with you. For two millennia philosophy has restlessly stalked a fundamental problem the answer to the question "what is art, really?" Aesthetic discourse, focused on the Platonic Matrix of truth and beauty, arthood and object, imitation and representation, form and idea, has not delivered on its promise, leaving us in bewilderment over principles that are either ignored or contradicted by the arts themselves. In this searching critique, some astonishing faux pas are brought to light. Notably that aesthetics makes do without a knower, (...) the heuristics of art, and the dynamics of self-exploration that are central to the aesthetic experience. What this book seeks to accomplish is a thorough reformulation of the terms of reference, based on the actual "form of life" that is art. This amounts to a framework for a wholly new philosophy of art. It demonstrates that art is quintessentially involved in the meaning of life, and through its heuristic dimension serves our impulse for self-knowledge and an understanding of the human condition. The book is in the first instance a philosophical treatise and therefore suitable for academic study in all grades, though perhaps with greatest benefit at post-graduate level. But it has been written in an approachable style to encourage a wider audience to engage with its tenets: accordingly it seeks also to address art aficionados, whether professional or dilettante, as well as general readers with an interest in these ever perplexing and profoundly intriguing issues of our human estate. Arthur Danto’s Transfiguration of the Commonplace is a new theory of art, seeking to catch the flavour and essence of its contemporary phenomenology. It is obliged, however, to pit itself in toto against aesthetic philosophy, leaning on the derivatives from deuteropraxis and institutional definition while committing itself to a concept of arthood extracted from exoteric ideas, which are held to comprise the artworks’ individuation and identity. This paper examines the principal notions in support of his contentions and contrasts them to (...) the chief principles of aesthetic philosophy. In this juxtaposition, it transpires that conviction eludes Danto, as his suppression of aesthetic criteria yields unsuspected aporias from a disconjugate amalgam of inherence, ontology, epistemology and concept integration. Although the emlocus classicus /emof the concept of recognition is the master/slave episode of the Phenomenology, it is readily portable into the emPhilosophy of Right/em. However, the fact that the term occurs only six times in the 400 pages of the emPhilosophy of Right/em has obscured its structural role, and accordingly scholarly effort is scant on the concept as it might pertain to this work. It is the argument of this paper that despite its lsquo;invisibilityrsquo; it governs foreground proceedings as (...) if from behind a curtain, for it cannot be gainsaid that the conceptual foundation of the Rights empresupposes/em the principle of recognition. The suspicion has been voiced that Hegel deliberately emsuppressed/em reminders of the presence of emAnerkennung/em in his philosophy of rights in order to distance himself from the perceived limitations of the Fichtean exposition of the concept. This article examines the rift in Leibniz’s conception of determinism after being rebuffed by the Parisian theologian Antoine Arnauld in their correspondence of 1686. As, in addition, his study of surds infracted his confidence in the “complete concept,” Leibniz embarked on a new, dynamic doctrine of substance or “law of the series.” In the literature, this strategy has been widely understood as “tweaking” the system to allow some self-assertion of free will. But as this article will show, it amounts to (...) a revolutionary conception that culminates in the unmasking of determinism as an insupportable, indeed incoherent doctrine. As all forms of determinism are profoundly entangled with human self-perception, the Leibnizian Kehre invites us to a new engagement with human freedom and autonomy and the disentanglement from a philosophical position for which neither a metaphysical nor an empirical proof can be given. In this bold, provocative account, the author argues that the phenomena of life and mind elude purely materialistic explanations. Living matter occupies a unique phase of existence which results from the complex transformation of its biochemical synergies. Analogous phase changes account for mind and self-reflexive consciousness. A central role in the living state is played by intelligence, which has not been recognised as a non-negotiable precondition of organic existence. Yet the concept of evolutionary adaptivity relies tacitly on it. Thus the (...) book amounts to a serious challenge to the overly theoretical paradigmata of the last half-century with their timorous evasion of biological fundamentals. However, although the work relies on up-to-date research of the life sciences, it is a primarily philosophical enquiry, dealing head on with many unsolved problems of life and mind, and culminating in a detailed "ontological proof" of the mind system. In the mid-eighteenth century music underwent a sudden and drastic revolution when composers “discovered” a new dimension to their art. This had immense repercussions on the philosophy of art, for the music created before and after this divide represents two different species of aesthetic experience, which in due course affected our understanding of the meaning and import of the other arts as well. Despite the immense aesthetic repercussions of this Copernican revolution in music, philosophers of art seem not to have (...) taken much notice of it. In this article we confront the ineffability of music to seek out a tenable conception of profound depths being plumbed in many such works. We take our initial bearings from the writings of the late Peter Kivy, who was a musically trained thinker and tackled the subject no less than four times. Our main interest lies in his outright dismissal of the idea. However, the scaffolding of his arguments reveals that he privileges the discursive metier without any evidence in his (...) support. Hence the bulk of the article is devoted to an analysis of the criteria relevant to this form of experience and to the construction of a more tenable perspective. It will be shown that the issue of profundity in music cannot be segregated from the implications of our reactions and responses to literature and, by extension, to the arts as a whole. (shrink)

By considering the epistemology and relations among certain philosophical problems, I argue for a disjunctive thesis: either (1) it is highly probable that there are (i) several (ii) mutually independent philosophical reductios of highly commonsensical propositions that are successful—so several aspects of philosophy have succeeded at refuting common sense—or (2) there is enough hidden semantic structure in even simple sentences of natural language to make philosophers highly unreliable at spotting deductive validity in some of the simplest cases—so we are much (...) worse at logic than we think and cannot, in general, know when our own arguments are valid. Those of us who take skepticism seriously typically have two relevant beliefs: (a) it’s plausible (even if false) that in order to know that I have hands I have to be able to epistemically neutralize, to some significant degree, some skeptical hypotheses, such as the brain-in-a-vat (BIV) one; and (b) it’s also plausible (even if false) that I can’t so neutralize those hypotheses. There is no reason for us to also think (c) that the BIV hypothesis, for instance, is plausible (...) or probably true. In order to take skepticism seriously it’s sufficient to hold (a) and (b); one need not hold (c). Indeed, philosophers who accept (a) and (b) never endorse (c). Show me a philosopher who suspects that he is a brain in a vat and I’ll show you someone who is deranged! That’s one thing that bothers undergraduates in philosophy. They object: why on earth do some philosophers take the BIV hypothesis to pose any threat at all to our beliefs given that those very same philosophers think that there’s no real chance that the BIV hypothesis is true? Sure, the BIV hypothesis is formally inconsistent with my belief that I have hands, so if the former is true then my belief is false. But so what? Why should that bare inconsistency matter so much? Is this strange attitude amongst philosophers the result of some logic fetish infecting the philosophical community? It is sometimes said that the skeptical hypotheses are not only inconsistent with our beliefs but are explanatory of our experiences, which is supposed to make them more of a threat. But students aren’t fooled: although the skeptical hypotheses may attempt to explain why our experience is as it is, it’s the kind of attempt appropriate for science fiction movies that are all special effects and virtually no plot. No one with any sense of reality will take the evil demon hypothesis to be even tenuously explanatory. (shrink)

A common kind of explanation in cognitive neuroscience might be called functiontheoretic: with some target cognitive capacity in view, the theorist hypothesizes that the system computes a well-defined function (in the mathematical sense) and explains how computing this function constitutes (in the system’s normal environment) the exercise of the cognitive capacity. Recently, proponents of the so-called ‘new mechanist’ approach in philosophy of science have argued that a model of a cognitive capacity is explanatory only to the extent that it reveals (...) the causal structure of the mechanism underlying the capacity. If they are right, then a cognitive model that resists a transparent mapping to known neural mechanisms fails to be explanatory. I argue that a functiontheoretic characterization of a cognitive capacity can be genuinely explanatory even absent an account of how the capacity is realized in neural hardware. (shrink)

The purpose of this article is to investigate how cultural meanings associated with the left ventricular assist device inform acceptance and experience of this innovative technology when it is used as a destination therapy. We conducted open-ended, semistructured interviews with family caregivers and patients who had undergone LVAD-DT procedures at six U.S. hospitals. A grounded theory approach was used for the analysis. Thirty-nine patients and 42 caregivers participated. Participants described a sense of obligation to undergo the procedure because of its (...) promise for salvation. However, once the device was implanted, patients described being placed into a liminal state of being neither sick nor healthy, with no culturally scripted role. Consideration of end-of-life decisions was complicated by the uncertainties about how patients with LVADs die. Pre-implantation communications among patient, family, and clinicians should take into account the impact of the technology on meaning, identity, and patient experience. (shrink)

A good portion of the work in the ontology of color focuses on color properties, trying to figure out how they are related to more straightforwardly physical properties. Another focus is realism: are ordinary material objects such as pumpkins really colored? A third emphasis is the nature of what is referred to by the terms ‘what it’s like’ or ‘phenomenal character’, as applied to color. In contrast, this essay is exclusively about select color tokens. I will be arguing that whether (...) or not ordinary objects such as pumpkins are colored, regardless of what the true theory of color properties is, and independently of any talk of phenomenal character or what-it’s-likeness, some afterimage experiences are very hard to fit into any plausible ontology, physicalist or not. Il donne corps au concept de Figura serpentinata, en construisant une longue montée, en (...) guise de " gamme ", de la caverne au monde, puis du monde à l'univers. Techniquement, Laruelle transforme la réminiscence de Platon en réminiscience, ajoutant à la montée philosophique les concepts de quantique (la philosophie ne peut plus être l'objet d'une automodélisation) et de générique (l'universel est " surbaissé ", aucune philosophie n'a de suprématie sur les autres). La superposition de ces concepts hétérogènes produit une " invention " au sens de Bach, une superposition de voix qui réorganise le matériau musical et conduit à un cogito philomusical, qui réinterprète le silence, et permet de faire entendre autrement le tissu musical. Dans un dernier temps, en une longue descente depuis l'univers, la musique insonore revient comme vécu des sujets humains. L'ensemble est une vaste réflexion sur le sens musical de la vie humaine.
