In this article the relations between philosophy and applied ethics are considered. The presented deliberation is concentrated on the question whether philosophy has contributed to applied ethics, especially to business ethics. Trying to find an answer to this question I will refer to the discussion which was started by R. Rorty in which he presented his own point of view on the issues related to moral development and the role of philosophy and philosophers in the modern world. Rorty points at (...) proper tools which, in his opinion, can be helpful to business ethicists and formulates the goal they should try to aim at. His opinions has started a vivid discussion. Patricia H. Werhane, Daryl Koehn and Richard T. De George try to discuss with Rorty’s statement. They oppose Rorty’s argument that philosophy is not more relevant to applied ethics than any other academic disciplines. They point to the facts which document philosophers’ contribution in forming business ethics. This article presents their arguments as well as an attempt of their critical assessment. (shrink)

With the emergence of Olympic internationalism, scholarly networking in East Central Europe came to be dominated by the idea of scholars representing their nations, which replaced the previously leading pattern of private elite scholars with extensive international contacts. This also formalised trans-border contacts, which became increasingly seen as international. In this article, we trace the relationship between these formal and informal networks from the late 19th century to the end of the socialist period, showing that even as formalisation grew, it (...) depended heavily on a variety of informal connections. Even during the period of socialism, when the state sought to control international exchange, scholars used informality to circumvent politically determined constraints. Nevertheless, these informal contacts were not outside the system, but were an integral part of it and depended on formal preconditions. Concentrating on Czechoslovak-Polish relations we argue that in addressing the issue of the relationship between the formal and the informal, a combination of sources must be used, which should then be scrutinised for the stories their authors wish to tell. While archival sources are used for the formal part, oral histories or memoirs reveal the informal part. In East Central Europe, formal sources are likely to ignore informality, especially when it was associated with illegality, whereas ego-documents, especially those produced after 1989, are likely to ignore or downplay connections to the state and overemphasise informality as a means of acting outside politics. Thus, writing the history of informality in socialist scholarship, not only in terms of international contacts but also in terms of everyday practices, is a way of developing counter-narratives to the state-centeredness of current research, which must be linked to a critical study of the contemporary memory of socialist scholarship that shapes the narratives told in oral history. “April is the cruelest month, breeding Lilacs out of the dead land, mixing memory and desire… ” So, begins T.S. Eliot’s iconic poem, “The Wasteland,” challenging the memory of Chaucer’s April from Canterbury Tales, as being a delightful month to go on pilgrimage. Platonic teachings emphasize that you don’t create, you just remember. Might the inverse might also be true, “You don’t remember, you just create.” As the oneirocritic, Robert Bosnak, contends, you do not actually remember your dreams. You remember (...) your memory you recreate the dream in this time. Since the challenges of post-modernism, this is no longer a far-fetched idea. The eminent historian of immigration, Deborah Dash Moore, defines history in this regard, as “a search for a plausible narrative.” “History” is not a record of what happened, but rather, is a record of what we believe happened, or what we want to believe happened. This brings to the fore Foucault’s documenting the relationship of knowledge to power, as well as Freud’s assertion that material which is unacceptable to the ego, is disguised, in order to make them palatable. This places the notion of memory in a different light. There are incidents that occurred fifty years ago that seem as if they occurred five minutes ago. The depth psychologist and champion of the imagination, James Hillman, referred to this process as “soul-making.” Back to T.S. Eliot: when he studied Sanskrit at Harvard, he was certainly aware that the Sanskrit word for memory, smara (from which smrti “that which is remembered,” is derived) is also an epithet for Kama Deva, the Indian Cupid. Hence, the mixing of memory and desire. Perhaps, in this light, the study of history, which is a form of collective memory, is also a form of mass therapy, an effort to process the collective past. Hegel and Marx both believed classical India to be an inferior civilization because it had “no history,” but collections of mythologies. Maybe classical India, however, held an awareness that all memory is myth, a word which in its early Greek form literally translates as “plot.” Jesus declares (in the Gospel story) “Let the dead bury the dead.” As the Jesus narrative exemplifies, however, burying the dead is no easy task. Perhaps our ongoing, ever-morphing narratives, allow us an oblique opportunity to connect with and process our pain. And in this theatre of memory, the goal may not be to accumulate or catalogue what has been spoken (itihasa), but look a good miller, to process the grain into its essence: from what has passed, and is passing, and is to come, into what always is. Perhaps, the pilgrimage of the mind, on its endless perigination of story, is meant to ultimately take us to love, but that may be unspeakable. Already in his 1913 Ideen I, Husserl claimed that there are two types of intuition: experiencing, that is, sense, intuition and ideal intuition. The former provides us with contingent facts, whereas the latter provides essences. Commenting on this dichotomy in his own book-length work, Appearance and Sense, published in 1914, Shpet believed Husserl had overlooked an important and distinct type of phenomenon that we call “social” and thereby omitted a corresponding third type of intuition that reveals the social function or (...) purpose of a thing. This oversight on Husserl’s part led him to claim that an “I,” or ego, stood behind or possessed the human individual’s consciousness. Husserl failed to notice that we can and do meaningfully speak of a social consciousness that, as such, belongs to no single individual. Apart from the “evidence” of ordinary language, Husserl’s strict dichotomy leaves unaddressed how we can proceed from external appearances to their understanding, which cognitively is always in terms of concepts, traditionally called “universals.” That is, we frame our experiences and express them verbally, the words employed being meaningful to us and hopefully to “the other.” Realizing the problem of transiting from the intuition of the contingent to that of the ideal, Shpet in early 1917 downplayed the difference, preferring to call them different degrees of seeing with different conscious attitudes. He called the conscious “seeing” associated with an understanding of words “intelligible intuition.” With an interest in historical methodology predating his acquaintance with phenomenology, Shpet recognized that the only tool available to the historian is the words appearing on documents, which serve as signs. How we understand these signs forms the study of hermeneutics, which functions as the epistemology of history. However, the fear remains that if we conceive the understanding of signs and “intelligible intuition” subjectively, we lapse into a psychologism. We must not forget the social origin of language, that language is no more the possession of an individual than is consciousness. The sense of words is established in an intersubjective context. Thus, Shpet turned to a study of language much as he had previously turned to consciousness and saw neither as subjective. (shrink)

The purpose of this article is to present a phenomenological description of how athletes in specific risk sports explore human interaction with natural elements. Skydivers play with, and surf on, the encountering air while falling towards the ground. Kayakers play on the waves and with the stoppers and currents in the rivers. Climbers are ballerinas of the vertical, using cracks and holds in the cliffs to pull upwards against gravity forces. The theoretical background for the description is found in the (...) phenomenology of Heidegger and Merleau-Ponty. The phenomenology of Husserl focused on the theoretical intentionality of the transcendental ego. With Heidegger the human being's concrete and practical interaction with the environing world moved to the foreground. Heidegger's analyses of ?equipmentality? also throw important light on equipmentality in sports and how we deal with tools and equipment in sports. However, in Heidegger's analyses the body resides in the background both as subject and object. The importance of the active body-subject is well documented in the work of Merleau-Ponty, and also Todes. The human being is a bodily ?being-in-the-world? and the body is the active medium through which the world is grasped. The body is however also situated and aligned with the fundamental dimensions of the world, with vertical gravity and with horizontal action space. In this article I show in a concrete way how in some sports we use fundamental characteristics of the environing world in a mode of playfulness. In these sports human beings play in an extreme way with fundamental elements of nature. The article thus puts phenomenology to a test. It should be able to move from general characteristics to specific features of our bodily human involvement with the environing world. (shrink)

ABSTRACTNegative feedback has paradoxical features to it. This form of feedback can have informational value under some circumstances, but it can also threaten the ego, potentially upsetting behaviour as a result. To investigate possible consequences of the latter type, two experiments presented positive or negative feedback within a sequence-prediction task that could not be solved. Following feedback, participants had to control their behaviours as effectively as possible in a motor control task. Relative to positive feedback, negative feedback undermined control in (...) a manner suggesting emotional upset. These reactions lasted for at least three seconds and were especially pronounced among people reporting that they typically lose control in the context of their negative emotions. The findings document a novel form of behavioural dysregulation that occurs in response to negative feedback while also highlighting the utility of motor control perspectives on self... (shrink)

In their recent book Buchanan and Powell claim that there is moral progress. Their analysis focuses on increasing inclusiveness, yet they also suggest other dimensions as possible indicators-improvements in the concept of morality and refinements in moral motivation. In the following I present empirical data on changes in moral understanding that occurred during the second half of the 20th century in Germany. These changes concern an increasing delimitation of the moral realm, the rise of an ethics of responsibility, the displacement (...) of an orientation to super ego dictates by a more ego-syntonic type of moral motivation. This research largely follows the ‘cognitivist’ paradigm which I start off defending against Haidt’s counter proposal of moral intuitionism. Feasible explanatory factors for the changes documented are put forward-processes of secularization and changes in socialization styles-and their interpretation as indicators of moral progress is discussed. The paper ends with brief speculations concerning possible reasons for current moral regressions. (shrink)

Furthermore, the psychoanalytic concept of the unconscious serves to point towards the fundamental unpredictability of pedagogical praxis. In the first part of his paper, published in the previous issue of this journal, the author dwelt on Sri Aurobindo's social, economic, political and nationalistic writings in Aurobindo's pre-Pondicherry days. In this second part, the paper crystallizes Sri Aurobindo's ideas and writings during the four decades he spent in Pondicherry. This paper looks at Aurobindo's metaphysical search for answers to the most fundamental questions of existence. The future that Sri Aurobindo was seeking out was not a particular future of (...) any single nation but that of the human personality itself, both in its individual and collective manifestations. The author documents with great fidelity Aurobindo's vision of the birth of a new consciousness which will liberate the individual from his ego and create a framework of life within which man can seek and grow into his real self and divinity. Gaston Berger, le fondateur des Études philosophiques , a joué un rôle décisif dans l’introduction intellectuelle, mais aussi matérielle et institutionnelle, de la phénoménologie de Husserl en France. À partir de documents inédits et d’une lecture, dès lors renouvelée, de la thèse sur Le cogito dans la philosophie de Husserl, cette étude montre l’originalité de l’interprétation que donne Berger de la phénoménologie husserlienne, ainsi que les réserves qu’il formule à l’égard de certains thèmes : le moi absolu, la tension (...) entre l’intention et l’intuition, sans oublier la réappropriation de la réduction phénoménologique sous le mode d’un détachement. En ce sens, il apparaît, d’une part, que Berger est un représentant typique de la première génération française des « disciples » de Husserl et que, d’autre part, la réception qu’il en fait est déjà révélatrice de problématiques propres à certains phénoménologues contemporains.Gaston Berger, the founder of Études philosophiques , played a decisive role in the intellectual and also material and institutional introduction of Husserl’s phenomenology into France. Based on unpublished documents permitting a new reading of his thesis Le cogito dans la philosophie de Husserl, this study shows the originality of Berger’s interpretation of Husserlian phenomenology, as well as the reservations he developed with regard to certain themes : the absolute ego, the tension between intention and intuition, not to mention the reappropriation of the phenomenological reduction by means of a detachment. In this sense, it appears, on the one hand, that Berger is a typical representative of the first French generation of « disciples » of Husserl and, on the other hand, that the reception he offered is itself revealing as to the problematics of certain contemporary phenomenologists. An Authorship as a theme (...) of his texts, as a prefiguration of nonexistent “Man” and his own authorship as a problem, as a way of “detaching myself from myself” – all these are the forms of Foucauldian ideas about an authorship and, at the same time, forms of his consciousness of his own authorship. Foucault historicizes and dissipates an authorship: an author is a function rather than the originator of texts. Writing, in this perspective, is a kind of conversion, decomposition of subjectivity into something else and even explosion. To say “I” doesn’t prove to be an ego. Additionally, Foucault notoriously suggests that his books are fiction. To be an author in this way is a way of being within the discourse and, as a consequence of it, to be trapped in its power. Foucault’s own rewriting of his theoretical biography includes turns and returns: as he repeatedly claims, he wrote in order to transform himself. He uses the processes of writing to simulate production of his subjective identity and, at the same time, to summarize, recapitulate his own oeuvre from current position. To cope with this suggestive and bizarre claims one should employ Roland Barthes distinction: écrivains (authors) et écrivants (writers). When Foucault-écrivain decomposes his ego, his own mode of existence by the use of writing, Foucault-écrivant, in an act of writing, writes himself, as an author. When Foucault-écrivain “writes fictions”, Foucault écrivant, in an act of “self-writing” (l’écriture de soi), establishes the object of a critique – Foucault. (shrink)

Each exquisite image in this pictorial essay teases (...) out the possible paths Miss Rimini—an alter-ego for Manon who “happened” upon a beauty pageant in the early 1970s and walked away with the crown—could have taken. A small-town diva? A hypersensitive viola player? Perhaps even a psychiatric patient? She Was Once MISS RIMINI is a trenchant meditation on the art, or artifice, of growing older. Costume, lipstick, lighting, attitude—all aspects of self-presentation are in concert here with quiet critiques of social and economic systems that limit the options of older women. Around 990, somewhere in Catalonia, a certain Julius was staying in the house of a certain Ramió. Unbeknownst to Ramió, Julius was stealing from him: mostly bread and wine, and perhaps other things as well. Eventually Ramió figured out what was going on, but instead of dragging Julius to the comital court, Ramió made a deal with him. As part of this deal, Ramió promised Julius not to involve the lawyers: neither he nor his descendants would get any count, viscount, (...) or advocate to prosecute the matter of the theft, under the heavy penalty of a pound of gold. How do we know about all this? Because Julius got Ramió to write up a document recording it: a scriptura securitate, which is currently preserved in the episcopal archive of Vic. This is the only such document that I have come across in Catalan sources, and it is absent from an influential tenth-century formula book from Catalonia. The scribe himself did not quite know how to handle the situation, as he began the document with the formula for a simple gift, as if Ramió were granting something tangible to Julius: “In nomine Domini. Ego Ramio donator …” Historians who do not work on Catalonia are no doubt tired of hearing those who do refer to the apparent mania for the written word in this society, but it is documents like this that lie behind such claims. If we may judge by the rarity of their names in contemporary documents from this region, Ramió and Julius are nobodies—a small-time landowner and a petty thief—but for some reason, in working out their dispute they decided that it was necessary to round up three witnesses and hire a scribe to put something down on parchment. The question of the so-called collective hallucination is neither as arcane nor as irrelevant to everyday life as it might first appear. On the contrary, it illuminates a much larger philosophical issue. In Group Psychology and the Analysis of the Ego, his 1921 book devoted to the relationship between individual and group psychology, Sigmund Freud lamented that there was still “no explanation of the nature of suggestion, that is, of the conditions under which influence without adequate logical foundation takes place.”2 (...) What the science of psychology lacked, in other words, was an understanding of ideological transference—the process by which one individual imposed his or her beliefs and convictions on another. How did an idea spread, so to speak, from one person to the next, resulting in the formation of a group consciousness? The phenomenon of the collective hallucination puts the issue starkly—if ambiguously—in relief. If a ghost or apparition can be said to represent, in Freud’s terms, an idea “without adequate logical foundation,” a delusion, then the process by which two people convince each other that they have seen one—and in turn attempt to convince others—might be taken to epitomize the formation of ideology itself.In what follows I shall examine a case of collective hallucination—certainly the most notorious and well documented in the annals of modern psychical research—precisely as a way of spotlighting this larger problem. My goal in so doing is not so much to expose the folly of people who claim to see ghosts but the difficulty that inevitably besets anyone who attempts to debunk such claims on supposedly rationalist grounds. For in the absence of any satisfying explanation of how such “folly” spreads—how a private delusion becomes a folie à deux —the labors of the skeptic are doomed to result only in a peculiar rhetorical and epistemological impasse. 2. In what follows I explore the question of fictionality in history writing. First, I venture into the unfamiliar genre of ego-histoire and make my own professional training in the tenets of positivist or realist historiography an object of theoretical reflection and critical analysis. Then as a way of dealing with the literary dimension of written history, I make a canonical work in history of education an object of rhetorical analysis. Finally, as another way of coming to terms with the “fictions (...) of historiography,” I revisit one of my own productions and make it an object of metacritical consideration. My central theme is that historiographical realism alone will not suffice, that historians are as dependant upon literary invention as upon documents, that history cannot be written without the aid of the “fictions of historiography,” and that the difference between the historian and the novelist is narrower than we may have been accustomed to think. I further argue that attention to the literary or rhetorical dimension of history is long overdue in history of education, where it flourishes unacknowledged. I conclude that historical writing is not just a literary pastime and the issue remains: how to come to grips with fictionalizing and the truth claims of historiography. (shrink)

The Gathas, a corpus of seventeen poems in Old Avestan composed by the ancient Iranian poet-priest Zarathushtra (Zoroaster) ca. 1200 B.C.E., is the foundation document of Zoroastrian religion. Even though the dualistic axiology of the Gathas has been widely noted, it has proved very difficult to understand the meaning and genre of the corpus or the position of Zarathushtra’s ideas with regard to other religious philosophies. Relying on recent advances in translation and decryptions of Gathic poetry, I shall here develop (...) a philosophical interpretation of the Gathas, including, as shall be discussed here in detail, explication of the revelation he reports in the poem known as Yasna 30. I argue that, similarly to Marx, Henry, and Schutz, Zarathushtra connects social criticism with an original philosophy of (inter)subjectivity and existential reflection, placing his account in the context of a fully developed metaphysics which includes the human-divine sharing of mental properties. I show that in order to accommodate this complicated problematic, Zarathushtra uses the vehicle of multiple realities. Reflecting the spontaneity of life, the dynamics of various ontological modes in the text create a reference to subjectivity. A description of the dream in Yasna 30 is sufficiently within the limits of possibility for a dream experience, and thereby delivers three original phenomenological reductions. The reductions initiate a genetic account of the phenomenalization of invisible impulses which give rise to moral choices, and define the human-divine relationship. The opposing moral choices open into a reverse axiological intentionality in the sphere of intersubjectivity, and are said to plot life for the rightful and lifelessness for the wrongful. It can be concluded that Zarathushtra’s theism and views of the social world are “the first philosophy”, with a unique and original phenomenological ontology of intersubjectivity at its core. A Life Decoded is an exhilarating document, to begin with, reading like a novel or even a science epic. In the author’s own words, it is “a tale of seemingly impossible quests and grand objectives”, of “great rivalries and bitter disputes”, of “battles of ideologies, morals and ethics” and of “clashes of egos” (p. 2), an adventure that swept the author “from peaks of incredible exhilaration as I marshaled a relatively small but dedicated army of scientists, computers and robots to (...) achieve what seemed almost impossible, and then plunged me into black pits of depression as I faced opposition from Nobel laureates and senior government officials, my colleagues, and even my wife” (p. 2). Moreover, besides being an autobiography proper, the book also contains a series of reflections on the genes present in the author’s own genome, one of the first individual genomes that was sequenced and made publicly available on the web – the “recipe” that made Craig Venter, as he himself describes it. In separate boxes dedicated to his sequenced genome, he especially focuses on genes that are associated with behavioural characteristics such as thrill-seeking behaviour, ADHD and the ability to cope with almost superhuman amounts of stress. Thus, in Venter’s case, autobiography and the genome are connected in more than one way with one another. (shrink)

That interest has been the traditional stock in the trade of philosophers since the ancient Greeks, and most crucially since the subjectivization of the aesthetic sphere in the speculative thought of Kant and German idealism. But the point is that there is a gap between those philosophers who speculated about perception, aesthetic pleasure, and the enjoyment of the senses, and who tried to justify those speculations through wide-ranging inquiries into the order of the world and its understanding through our ego and its potentialities--betweenthem and Dilthey, who knows that this age-old enthusiasm for metaphysical and epistemological inquiries has become obsolete. The earlier display of erudition may be vast and awe inspiring. But in Dilthey's mind an interest in those inquiries is no longer foremost. Commendable as all of them may be, they approach the world of the work of art and its experience from the outside, in an independent, self-sufficient, and almost autonomous manner, without facing up to the horizon of the world in which an artistic work is rooted. This horizon of the world emerges as the leitmotif of Heinen's book. Heinen reminds the reader that those who create are immersed in this horizon. The conditions under which they work, the tools they have, the methods they use, the materials that are available to them, the ideas they have in mind--all this can be traced back to the world which surrounds them. Moreover, they belong to an historical world. They are oriented toward a past they remember, a future they anticipate; and all they think, or feel, or will, stands in an historical context, long before they are conscious of themselves in this respect. Heinen rightly points out that this creates a problem not only for the analysis of the artistic expression but for the field of hermeneutics, for the method of understanding this expression. It is not so much something that is understood in its meaning by referring to an ego, or a system of cognitive faculties. It emerges from the socio-historical world; and we must place it back in the same horizon from which it emerges. Heinen agrees with Dilthey that we always find ourselves within the whole of life; and when understanding something--a work of art or any other historical object--we have to do it within the full context of life to which we belong. It is an objectification of life that we have to understand from life itself. This may help to explain why a work of art is more than an object created by an artist through his inspiration and the unconscious production of his genius. From his Hegelian perspective Heinen tells us that whenever an artist is involved in the creation of something he is dependent upon the world in which he lives and upon a dialectic between himself and the horizon of life. Heinen expressly defends the probability of this dialectic in a chapter on the presuppositions of Dilthey's aesthetics (pp. 134-162). He studies Dilthey's attempt to discover a methodological basis for the human sciences. He calls attention to the remarkable sequence of sketches in which Dilthey distinguishes between Geisteswissenschaften and Naturwissenschaften, between human sciences that, in one way or another, deal with historical and other manifestations of 488 HISTORY OF PHILOSOPHY life and inner experience, and natural sciences that deal with phenomena, with objects of nature. Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. Plagiarism detection is the process of finding similarities on electronic based documents. Recently, this process is highly required because of the large number of available documents on the internet and the ability to copy and paste the text of relevant documents with simply Control+C and Control+V commands. The proposed solution is to investigate and develop an easy, fast, and multi-language support plagiarism detector with the easy of one click to detect the document plagiarism. This process will be (...) done with the support of intelligent system that can learn, change and adapt to the input document and make a cross-fast search for the content on the local repository and the online repository and link the content of the file with the matching content everywhere found. Furthermore, the supported document type that we will use is word, text and in some cases, the pdf files –where is the text can be extracting from them- and this made possible by using the DLL file from Word application that Microsoft provided on OS. The using of DLL will let us to not constrain on how to get the text from files; and will help us to apply the file on our Delphi project and walk throw our methodology and read the file word by word to grantee the best working scenarios for the calculation. Existing social disparities in the United States are inconsistent with Lincoln’s promise of democracy; therefore, there is a need for a critical conceptualization of the first principles that undergird American democracy and the genesis of democratic social change in America. This study aimed to construct a grounded theory that provides an understanding of the process of American democratic social change. Evidences are important proofs to support judicial trials. Automatically extracting evidences from judgement documents can be used to assess the trial quality and support “Intelligent Court”. Current evidence extraction is primarily depended on sequence labelling models. Despite their success, they can only assign a label to a token, which is difficult to recognize nested evidence entities in judgment documents, where a token may belong to several evidences at the same time. In this paper, we present a novel evidence (...) extraction architecture called ATT-MRC, in which extracting evidence entities is formalized as a question answer problem, where all evidence spans are screened out as possible correct answers. Furthermore, to address the data imbalance problem in the judgement documents, we revised the loss function and combined it with a data enhancement technique. In a span of twenty years, two of the autocephalous churches of the Orthodox Christian world released documents addressing the social realities of contemporary life: the Russian Orthodox Church's Basis of the Social Concept (2000) and the Ecumenical Patriarch's For the Life of the World: Toward a Social Ethos of the Orthodox Church (2020). This article offers a side-by-side comparison and analysis of the documents’ treatments of matters of birth and death, including childbirth, abortion, miscarriage, end-of-life care, euthanasia, (...) suicide, and a vision of a good death. Detailed comparison demonstrates remarkable accord between the two churches on many of these matters. Differences of omission and emphasis appear to be indicative of contrasting demographic and historical situations, with the exception of one, notable divergence between the churches, all of which are discussed. The striking degree and depth of consonance between the documents offers potential for cooperation and unity as the two churches negotiate their conflicts while also seeking to guide their flocks and offer Orthodox Christian witness in an increasingly desacralized world. Introduction Numerous guidelines and policies for ethical research practice have evolved over time, how this translates to global health practice in resource-constrained settings is unclear. The purpose of this paper is to describe how the concept of ancillary care has evolved over time and how it is included in the ethics guidelines and policy documents that guide the conduct of research in the global south with both an international focus and providing a specific example of Malawi, where the first (...) author lives and works, as a case study. Methods Discourse analysis was conducted on 34 international ethics guidelines and policy documents. Documents were purposively selected if they contained a set of key terms that reflect the concept of ancillary care. Following a process of inductive discourse analysis, five key interrelated text phrases relating to ancillary care were extracted from the documents. The evolution of these phrases over time was explored as they represented the development of the concept of ancillary care as a component of ethical health research guidance and practice. Results We found key interrelated phrases that represent discourses regarding the evolution of ancillary care including participant protection; provide care as appropriate; supererogation; patient needs prevail over science; and ancillary care as an obligation. Arguments for the provision of ancillary care were characterised by safeguarding the safety, health rights and well-being of study participants. However, despite the evolution of discourse around ethical obligations to provide ancillary care, this is rarely made explicit within guidance documents, leaving interpretive space for differential application in practice. Conclusion While there have been major changes to the ethics guidance that reflect significant evolution in the ethical conduct of research, the specific vocabulary or language used to explain the ethics of researchers' ancillary care obligations to the health needs of their research participants, lacks clarity and consistency. As a result, the concept of ancillary care continues to be under-represented in local ethical guidelines and regulations, with no clear directives for country-level research ethics committees to apply in regulating ancillary care responsibilities. We present an annotation scheme describing the argument structure of judgement documents, a central construct in Japanese law. To support the final goal of this work, namely summarisation aimed at the legal professions, we have designed blueprint models of summaries of various granularities, and our annotation model in turn is fitted around the information needed for the summaries. In this paper we report results of a manual annotation study, showing that the annotation is stable. The annotated corpus we created (...) contains 89 documents. We also designed and implemented the first two stages of an algorithm for the automatic extraction of argument structure, and present evaluation results. (shrink)

BackgroundScientific researchers are expected to follow the professional norms in their own domain. With a growing number of scientific publications retracted and research misconduct cases revealed in recent years, Chinese biomedical research integrity is questioned. As institutions educating and training future researchers, universities and the guidance they provide are important for the research quality and integrity of the country. Therefore, through a review of the guidance and policy documents on research integrity in Chinese universities, this work aims to investigate (...) how the professional norms are specified in these documents.MethodsAfter a stratified sampling, 53 universities were selected. Their guidance and policy documents on research integrity were collected via a web search of their official websites. The search was confirmed by these universities. Then the content of all the collected documents were analyzed using inductive content analysis.Results118 active university documents were collected and analyzed. Most of the Chinese universities we investigated had their own guidance or policy on research integrity. They listed principles or examples of desired and undesired academic practices, investigation procedures and punishments of academic misconduct, and put forward measures to promote research integrity. Differences on specific practices and principles were observed between university groups and with European university documents.ConclusionDespite the discrepancy they have, all these documents were designed to promote research integrity and cultivate a good research environment in Chinese biomedical domain. Understanding the nature of science has long been a desired outcome of science education, despite ongoing disagreements about the content, structure, and focus of NOS expectations. Addressing the concern that teachers likely focus only on student learning expectations appearing in standards documents, this study examines the current state of NOS in science education standards documents from nine diverse countries to determine the overt NOS learning expectations that appeared, NOS statements provided near those learning expectations, but not identified as (...) learning outcomes, and NOS statements found in ancillary text. Findings indicate that NOS ideas rarely occur as expectations for student learning and are far more commonly found in ancillary material. Moreover, consensus was not apparent in the overt learning outcomes for students. Given the well-documented poor state of NOS instruction and the consistent lack of NOS appearing in published curriculum materials, the NOS standards appearing in nearly all documents analyzed are unlikely to provide sufficient conceptual or pedagogical support for NOS to be accurately interpreted or translated into meaningful experiences for students. Children and adults with dementia are vulnerable populations. Both groups are also relatively seldom included in biomedical research. However, including them in clinical trials is necessary, since both groups are in need of scientific innovation and new therapies. Their dependence and limited decision‐making capacities increase their vulnerability, necessitating extra precautions when including them in clinical trials. Beside these similarities there are also many differences between the groups. The most obvious one is that children have an entire life ahead of them (...) and will become persons with certain ideals and preferences, while adults with dementia have lived a life in which they have expressed their ideals and preferences. Some of the available research guidelines recognize these differences, setting one list of specific requirements for groups of incapacitated adults and another list for children. Other documents, however, do not differentiate and only set requirements for subjects unable to consent as a single category of subjects.In this article we analyse to what extent the similarities and differences between the two groups are represented in legal documents and ethical guidelines. The article presents an overview and an analysis of the requirements for doing research with children and dementia patients. We conclude with suggestions about how to better incorporate the morally relevant aspects of these two groups in legislation and ethical guidelines. (shrink)

Informed consent forms have been useful in clinical practice and they constitute a part of the shared decision making in the informed consent process. They provide information to patients about clinical procedures and techniques. They also act as a remainder of the information discussed after the medical interview. Sometimes these documents are not readable to everybody. Belgian law specifies that all information that patients receive has to be proportionate verbally, but written information is also handled. The present research analyzes (...) the readability of the Flemish informed consent forms located in the webs of all General Hospitals using a simple random sample of 75 informed consent forms. By using the Douma tool, which bases its analysis in the length of words and sentences, the readability mean of the sample was 46, level “Difficult”. The 59% of them had a difficult level. The 11% were normal. It is a fact, then, that the 59% of the informed consent forms evaluated in this study are not suitable for everybody in Flanders, especially those people with low literacy. There were some researches made in other countries that agreed with these results. Written clinical information was poorly written so the informed consent forms were not working helping patients to recall information nor helping patients to become a part in the shared decision making about their health. The use of readability formulas represented a simple way to discriminate those informed consent forms that had normal readability scores from those that should be adapted. (shrink)

The task of rhetorical role labeling is to assign labels (such as Fact, Argument, Final Judgement, etc.) to sentences of a court case document. Rhetorical role labeling is an important problem in the field of Legal Analytics, since it can aid in various downstream tasks as well as enhances the readability of lengthy case documents. The task is challenging as case documents are highly various in structure and the rhetorical labels are often subjective. Previous works for automatic rhetorical (...) role identification (i) mainly used Conditional Random Fields over manually handcrafted features, and (ii) focused on certain law domains only (e.g., Immigration cases, Rent law), and a particular jurisdiction/country (e.g., US, Canada, India). In this work, we improve upon the prior works on rhetorical role identification by proposing novel Deep Learning models for automatically identifying rhetorical roles, which substantially outperform the prior methods. Additionally, we show the effectiveness of the proposed models over documents from five different law domains, and from two different jurisdictions—the Supreme Court of India and the Supreme Court of the UK. Through extensive experiments over different variations of the Deep Learning models, including Transformer models based on BERT and LegalBERT, we show the robustness of the methods for the task. We also perform an extensive inter-annotator study and analyse the agreement of the predictions of the proposed model with the annotations by domain experts. We find that some rhetorical labels are inherently hard/subjective and both law experts and neural models frequently get confused in predicting them correctly. (shrink)

The article focuses on the analysis of curriculum documents from Taiwan to investigate how benchmarks for learning nature of science are positioned in different versions of the science curricula. Following a review of different approaches to the conceptualization of NOS and the role of NOS in promoting scientific literacy, an empirical study is reported to illustrate how the science curriculum documents represent different aspects of NOS. The article uses the family resemblance approach as the account of NOS and (...) adapts it for analysis of the curriculum documents. The FRA defines NOS as cognitive-epistemic and social-institutional systems that serve as constructs of knowledge categories with a high level of interconnectedness. The FRA was used as an analytical tool for investigating two sets of Taiwanese curriculum guidelines published 10 years apart, providing an opportunity to discuss how NOS is addressed in the curriculum reforms. The findings show a shift away from the excessive centralization of the cognitive-epistemic system to a consideration of the social-institutional system. Modifications to the benchmarks are proposed in order to achieve a more holistic and progressive approach to NOS. The article contributes to studies on NOS in science education by illustrating how the FRA can act as a tool for exploring interconnectedness of NOS ideas in the curriculum. (shrink)

There is an internal connection between ecclesiology, the teaching about the Church that we call academic ecclesiology, and mission, which is the inner heart of the Church and becomes visible through different practices. For the Orthodox Church involved in the ecumenical movement, there is a struggle to balance ecclesiology (theology) with ecumenical mission and dialogue (practice) in a divided Christian world. Nevertheless, the recent Synod of Crete (June 2016) addressed some important elements of this struggle. I have in mind, for (...) example, the act to accept the historical name of other non-Orthodox Christian Churches and Confessions that are not in communion with it. Also, this is the first Synod of the Orthodox Churches in modern times at which ecumenical dialogue, especially in the World Council of Churches, is officially affirmed. Because of mission dialogue has to continue, “if we wish never to ‘put an obstacle in the way of the gospel of Christ’ (1 Cor 9:12).” The present paper highlights those statements of the Holy and Great Council which have direct relevance for discussing the relation of ecclesiology and mission. I assert that we should understand firstly the document Relations of the Orthodox Church with the Rest of the of the Christian World and only then reflect upon The Mission of the Orthodox Church in Today’s World (MOCT). Furthermore, I will make some references to the other texts which were central for this conference: The Cape Town Commitment (CTC), Together Towards Life (TTL) and Apostolic Exhortation Evangelii Gaudium (EG). I conclude by exposing briefly my reflections after reading these mission documents and by formulating some agenda points for further work in theology of mission. (shrink)
