In 1964, the American Medical Association invited liberal theologian Abraham Joshua Heschel to address its annual meeting in a program entitled “The Patient as a Person” [1]. Unsurprisingly, in light of Heschel’s reputation for outspokenness, he launched a jeremiad against physicians, claiming: “The admiration for medical science is increasing, the respect for its practitioners is decreasing. The depreciation of the image of the doctor is bound to disseminate disenchantment and to affect the state of medicine itself” [1, p. 35]. Heschel’s (...) reference to “disenchantment” suggests that he may have been familiar with the work, or at least the outlook, of sociologist Max Weber, whose 1917 address “Science as a Vocation” portrays the modern world as disenchanted by the progress of rationalism. Heschel’s life’s vocation had been to uncover the inner meaning of religious faith and to translate that faith into principled action. Heschel saw disenchantment not as an inescapable aspect of modern life but rather as the byproduct of physicians’ conscious choices to seek worldly success and material comfort. Yet, because of their privileged position as witnesses to human vulnerability, physicians possess an obligation to develop their own personhood, to re-enchant medicine, and through medicine to spark a positive transformation in all of modern life. As Heschel says, “The doctor must realize the supreme nobility of his vocation, to cultivate a taste for the pleasures of the soul. … The doctor is a major source of moral energy affecting the spiritual texture and substance of the entire society” [1, pp. 34, 38]. While Heschel’s conception of the physician’s role is romanticized and idealized, changes in the organization and practice of medicine have validated his concerns. (shrink)

There I followed the traditional view whereby is translated as ‘thwarts’’, is taken to describe thwarts passing from one gunwale to the other in such a way that each end was placed ‘on top of the gunwale, and the sentence is understood to refer to caulking with papyrus. J. S. Morrison has in recent years on several (...) occasions offered a radically different translation under the influence of the Fourth-Dynasty boats interred beside the Great Pyramid of Gîza . The problematic nature of the relation between a politicized historical rhetoric and the presumed authority of brute fact was starkly outlined in the irreconcilable interpretations of the purge trials that tore apart the political Left in the 1930s. The conclusions of the Commission, headed by John Dewey, on the mock trial of Leon Trotsky in Mexico City in April 1937 rested on the evidence of the factual fabrications of key confessions. The critical contemporary responses were more or less predictable in (...) light of political partis pris. They either disparaged the entire procedure as a Trotskyite "court," where the driving purpose was to acquit Trotsky of guilt, deftly disposed of the key factual allegations, or saw the trial as attacking the Soviet system of justice itself, thus making irrelevant Trotsky's actual guilt or innocence. We now find the Commission's conclusions more persuasive than those of William Z. Foster, Malcolm Cowley, or F. L. Schuman not because of their superior tropological strategies, nor because of a skillful parade of rhetorical figures, nor because of the hermeneutic fusing of historical horizons, but because they satisfy familiar criteria of empirical inference and rational discourse. We discuss Aristotle's "Categories" as an answer to Plato's One-over-Many argument. For Plato, F-ness is something "over against" particular F things; to predicate "F" of these things is to assert that they all stand in a certain relation to F-ness. Aristotle answers that predication is classification; and there being a classification of a certain sort is a fact correlative with there being things classifiable in the way the classification in question would classify them.

European animal disease policy seems to find its justification in a “harm to other” principle. Limiting the freedom of animal keepers—e.g., by culling their animals—is justified by the aim to prevent harm, i.e., the spreading of the disease. The picture, however, is more complicated. Both during the control of outbreaks and in the prevention of notifiable, animal diseases the government is confronted with conflicting claims of stakeholders who anticipate running a risk to be harmed by each other, and who ask (...) for government intervention. In this paper, we first argue that in a policy that aims to prevent animal diseases, the focus shifts from limiting “harm” to weighing conflicting claims with respect to “risks of harm.” Therefore, we claim that the harm principle is no longer a sufficient justification for governmental intervention in animal disease prevention. A policy that has to deal with and distribute conflicting risks of harm needs additional value assumptions that guide this process of assessment and distribution. We show that currently, policies are based on assumptions that are mainly economic considerations. In order to show the limitations of these considerations, we use the interests and position of keepers of backyard animals as an example. Based on the problems they faced during and after the recent outbreaks, we defend the thesis that in order to develop a sustainable animal disease policy other than economic assumptions need to be taken into account. We present a counter-example and then suggest that Kenny may have been misled by the fact that wanting expresses itself in goal-directed behavior. From the truism that one's behavior cannot be directed toward a goal that one knows one has already attained, Kenny may have been led to suppose that behavior directed toward an as yet unattained goal cannot express one's desire for what one (...) has and knows one has. Majumder (bio)Human pluripotent stem cell research, meaning research into cells that can multiply indefinitely and differentiate into almost all the cells of the body, has become a minefield in which science, ethics, and politics have collided over the last decade in the United States. President Barack Obama entered this highly (...) charged territory when he indicated during his campaign that once in office he would issue an executive order expanding federally funded human embryonic stem cell (hESC) research and introduce rigorous oversight of it (Obama 2008a & b). Candidate Obama stated that he would require that the hESC lines involved were derived with donor consent from early embryos that otherwise would be discarded following in vitro fertilization (IVF) treatment. However, in contrast with the policy of President George W. Bush, he would do so without regard to the date of their derivation. He added that he would call upon the director of the National Institutes of Health (NIH) to develop guidelines for federally funded hESC and other pluripotent stem cell research that would draw from the guidelines developed in 2005 by the National Academies of Science (NAS) for privately funded research (National Research Council 2005).A similar policy was written into the 2008 version of the Stem Cell Research Enhancement Act, which reiterates the policy enunciated in earlier versions of this bill, passed twice by the Congress but vetoed by President Bush each time (House of Representatives, 110th Congress 2008).1 Depending on how one reads the 2008 version of the act, it could also apply in certain respects to hESC research that is not federally funded. We proceed on the assumption that the act applies at least to federally funded stem cell research. Therefore, it appears that the president or the Congress, or both, will approve of an expanded policy of federal funding of hESC research, as well as other forms of human pluripotent stem cell research. [End Page 79]This policy would make the guidelines developed by a committee appointed by NAS, a prestigious private body of American scientists and related experts, the primary basis for the development of new federal guidelines for oversight of hESC research in the United States. This would have certain advantages in that those familiar with the relevant scientific issues are likely to address them accurately and stem cell investigators are apt to accept restrictions on their research written by fellow scientists and ethics and policy experts whom they perceive as strong supporters of stem cell research. However, it also would have certain disadvantages. Chief among these is that the NAS committee appointed to write guidelines for this research, in its concern to see stem cell science move forward after a period in which many scientists and others maintained that it had been unduly restricted, might have overlooked or deferred consideration of some pressing ethical and policy issues. We maintain that this is the case—although we also maintain that the NAS guidelines provide a responsible foundation for developing NIH guidelines for stem cell research. Consequently, we propose that an NIH task force charged by the director of NIH with writing new guidelines for hESC and other stem cell research should revise and expand the NAS guidelines in ways that we propose below, as well as others that it considers necessary, and make it obligatory for those seeking federal funding of such research to follow these new guidelines.We highlight certain areas in which an ethical case can be made for strengthening the existing NAS guidelines and certain areas in which more fundamental ethical reflection—and building on that, additional guideline/policy development—seems warranted. In lieu of an abstract, here is a brief excerpt of the content:270 HISTORY OF PHILOSOPHY The Prophets of Paris. By Frank E. Manuel. (Cambridge: Harvard University Press, 1962.) This perceptive and sophisticated contribution to the history of ideas is organized around the intellectual biographies of Turgot, Condorcet, Saint-Simon, the Saint-Simoniarts, Charles Fourier, and Auguste Comte. Professor Manuel's prophets were all Frenchmen and all, he believes, can be placed in a common tradition marked by their conviction that Paris was the (...) mount from which the new gospel had to be delivered, that love was the key to social organization, and that social and religious relationships were more significant than political forms. He presents them as prophets in the Old Testament sense--as unsparing moral critics, teachers and the "revealers of a divine historical design." They were philosophers of an age of crisis, convinced that theirs was the instant of a great human divide and therefore victims "of the anguish of futurity." The future they so confidently foretold to anyone who cared to listen, and to many who did not, has found many of their prophetic visions to be poor predictions, but for Manuel they cannot be dismissed as utopian cranks or frustrated totalitarians. Many of the issues they raised and problems they sensed have yet to be adequately confronted, and it is this prescience, particularly with regard to the psychological conditions of social existence, that Manuel wishes to emphasize. This treatment, as its author admits, is a "frank attempt at rehabilitation, to right the balance of historical judgement and bestow new worth upon thinkers who have often been treated with superficiality" (pp. 1-10). Manuel's approach to the history of ideas lends itself quite effectively to this purpose. He admits to a "romantic view of history-writing" which entails an effort to establish an intimacy with his subjects through an immersion in their manuscripts, in the "scribbled brouillons, the casual notes, the personal letters," as well as in the identity presented through their published works. His writing of history is romantic not only in this regard but much more profoundly in his historicism, which attempts an immediate empathetic confrontation with the total organic complex of his subject's life, ideas, and environment. Manuel's evident sympathy occasionally tempts him into apologetics, but essentially he is not arguing a brief for the defense but trying to understand what it was that made these men see so far, and yet with such myopic arrogance, and what it was they saw. It seemed to me that his approach is most successful with Fourier, and least so with Turgot. Charles Fourier, the self-taught travelling salesman from Besan~on, is often summarily dismissed as a cosmic crank with easy reference to his fantastic aberrations --his seas of lemonade and the copulation of the planets. Manuel helps us to understand not only the aberrations but the prescient insights by establishing the relationship between Fourier's personality and his ideas, as well as by tracing the connections between apparently contradictory conceptions. He does not misuse this technique of intellectual biography by patronizing or justifying a system of thought with reference to its psychological antecedents, but rather helps to illuminate a philosophy by examining the reasons for its expression. This works particularly well with Fourier, an obsessed and deprived personality, whose great contribution, according to Manuel, was the assimilation into a social doctrine of the fundamental needs and drives of mankind--its "manifold wants, its secret desires, and its obstinate fixations" (p. 203). Both Fourier and the SaintSimonians believe that it was pointless to tinker with the social environment without regard for permanent psychological realities, but the latter hoped to sublimate human passions through a social organization that redefined them, while Fourier wanted a social system that would provide for their total gratification (p. 226). Occasionally Manuel rather triumphantly unearths striking parallels with our present BOOK REVIEWS 271 concerns that do not demonstrate the vision of his seers into the future so much as his discovery of analogues in the past. We examine whether a taxpayer’s decision to choose a taxpayer-favorable characterization of income is associated with contextual and individual dimensions of that decision. Using a 2 × 2 factorial experimental design, we manipulate the prevailing social norm on whether there is a general belief that a specific form of income should be characterized as a capital gain or as ordinary income, and the group affiliation on whether the individual is making a tax characterization decision as a sole proprietor or as (...) a member of a group practice. Moreover, we measure participants’ fairness perception of characterizing the income as capital gains versus ordinary. We study the decisions of 180 graduate business and accounting students from two US business schools to explore these dimensions using a tax-ambiguous income situation. Results indicate that both contextual and individual dimensions impact taxpayer decisions. Specifically, the social norm and fairness perception of characterizing income as capital gains affects the likelihood of choosing such a characterization. Being a sole proprietor or a member of a group practice does not have any significant main effect. However, relative to all other conditions, taxpayers are most likely to characterize income as capital gains when both the social norms are for capital gains characterization and when the taxpayer is a member of a group practice. Results remain largely robust to a variety of alternative explanations. We conclude the paper with a discussion of our findings and their implications for tax policy, enforcement, and research. Persons with serious and disabling medical conditions have traveled abroad in search of stem cell treatments in recent years. However, weak or nonexistent oversight systems in some countries provide insufficient patient protections against unproven stem cell treatments, raising concerns about exposure to harm and exploitation. The present article, the first of two, describes and analyzes stem cell tourism in Russia and India and addresses several scientific/medical, ethical, and policy issues raised by the provision of unproven stem cell-based treatments within them. (...) The distinction between treatment based on proven clinical research and "innovative treatment" is addressed and the authors conclude that the innovations at issue constitute neither. Regulatory measures need to be developed or strengthened in accord with internationally accepted standards in such countries to protect those seeking stem cell treatments. (shrink)

We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

Clinics and hospitals around the globe are offering stem cell treatments to persons with serious conditions for whom no effective therapies are available in their home countries. Many of these treatments, which are touted as cures for such conditions as Parkinson's and Alzheimer's Diseases, multiple sclerosis, and spinal cord injuries, have not gone through clinical trials that establish their safety and efficacy. Indeed, it is unclear whether some of them even utilize stem cells. State regulation of these therapies tends to (...) be weak or nonexistent in some of the countries in which they are offered. On the 50th anniversary of the Willowbrook experiment's inception, in which Dr. Saul Krugman intentionally infected cognitively disabled children with hepatitis, it is worth reflecting on how our attitude toward research ethics of the past informs our current practices. In examining ethical violations in postwar medicine, we frequently turn to examples that shock and appall, thereby offering concomitant comfort as we measure their safe distance from our own medical context. And yet, which modern medical student has not heard a variation (...) of the phrase "This study would never have passed an ethics committee today" in reference to a classic experiment or a professor's very own work?
