Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) It is well known that Niklas Luhmann’s theory of social systems is grounded in Spencer-Brown’s seminal Laws of Form (LoF) or ‘calculus of indications’. It is also known that the reception of the latter has been rather problematic. This article attempts to describe the construction of LoF, and confront it with Niklas Luhmann’s ontological and epistemological premises. I show how LoF must be considered a protologic, or research into the fundamentals of logical systems. The clue to its understanding is to (...) be found in its profoundly topological conception of common mathematics and (Boolean) algebra. Both are explained as direct offspring of their planar orientation. Self-reference is a justified instance of an extended, more intricate topological arrangement. Its consequences for ontology (non-identity) and epistemology (autology), I argue, have been adopted correctly by Niklas Luhmann. Separate sections are devoted to how Spencer-Brown’s notion of re-entry relates to Luhmann’s definition of system/environment, and to a comparison between Luhmann’s and Parsons’ functionalism. The philosophical import of the chariot images found in the Katha Upanishad and the Phaedrus is considered here. It is claimed that the resemblance in the accounts provided in these disparate texts is not merely incidental. Rather, each chariot-image should be read as contributing to a careful answer to the same thorny philosophical problem: the identification and justification of the best life for the individual. It is argued that each serves to illuminate an internal and complex account of the self, (...) which grounds and supports an effective rejection of the life spent in pursuit of the satisfaction of bodily desires in favor of the life spent in pursuit of wisdom. Medical care of critically ill and injured infants and children globally should be based on best research evidence to ensure safe, efficacious treatment. In South Africa and other low and middle-income countries, research is needed to optimise care and ensure rational, equitable allocation of scare paediatric critical care resources.

The Volksunie, partly from the opposition and partly from its participation in cabinet/coalitions made an important contribution to the processes of state reforms that remodeled Belgium in the 80's and 90's into a federal state. The party strongly introduced the federalist ideas in the political arena. In the seventies it played a pro-active role in the negociations with the French interlocuteurs. Although these negociations did not succeed, the solutions advocated in that period went on as possible outcomes for later negociations (...) and played a catalyst role. When taking part in the cabinets either the national and for the Flemish cabinets in the 80's and the 90's, its minister advocated and carried on a maximalizing federalist policy. Inside and outside the party, it was not easy to perform this policy. Even the electorate did not reward the party that much for its achievements, which can be summarized as an undeniable contribution to the federal state reform of Belgium. (shrink)

BackgroundSocial media has globalised compassion enabling requests for donations to spread beyond geographical boundaries. The use of social media for medical crowdfunding links people with unmet healthcare needs to charitable donors. There is no doubt that fundraising campaigns using such platforms facilitates access to financial resources to the benefit of patients and their caregivers.Main textThis paper reports on a critical review of the published literature and information from other online resources discussing medical crowdfunding and the related ethical questions. The review (...) highlighted the benefits of crowdfunding as well as the under-exploration of the risk of having patients’ desires and human rights undermined during online fundraising campaigns. Majority of these campaigns get initiated on behalf of the patients, especially the very sick and dependant. The ethical questions raised relate to the voluntariness of informed consent and the possibility of patients being used as a means to an end. Vulnerability of patients may expose them to coercion, undue influence, manipulation, and violation of their human rights. The success of these campaigns is influenced by the digital skills, pre-existing social networks and, the emotional potency. Healthcare is a public good, and online market forces should not determine access to essential health services. The benefits of crowdfunding cannot be subverted, but it can perpetuate unintended injustices, especially those arising from socio-economic factors.ConclusionsPolicymakers ought to monitor the utilisation of crowdfunding sites to identify policy failures and unmet essential health care needs responsible for driving individuals to use these platforms. The upholding of human rights and the fundamental respect of the individual’s wishes is a moral imperative. The need for an ethics framework to guide different stakeholders during medical crowdfunding needs further examination. (shrink)

The dominant discourse in chronic disease management centres on the ideal of person-centred healthcare, with an empowered patient taking an active role in decision-making with their healthcare provider. Despite these encouraging developments toward healthcare democracy, many person-centred conceptions of healthcare and programming continue to focus on the healthcare institution’s perspective and priorities. In these debates, the patient’s voice has largely been absent. This article takes the example of patient empowerment to show how the concept has been influenced by a variety (...) of competing and shifting influences that have led to conceptualisations and programming designed for the patient, but developed without the patient. The framework of epistemic injustice is proposed to unravel the complexity of these omissions. The concept can be defined as a wrong done to someone specifically in their capacity as a knower. It occurs when a person is ignored or not believed due to a prejudice of some kind. It has been applied to healthcare in order to better understand barriers for patient participation and will be used to better understand the problems with current empowerment definitions and implementation strategies. The article will end by proposing some methodologies to facilitate patient-developed concepts of empowerment. (shrink)

This paper proposes a dynamic theory of embodiment that aims to get beyond the absent moving body in embodied social theory. The first somatic revolution, inspired by Merleau Ponty, provided theories based on the feeling and experience of the body. The theory of dynamic embodiment focuses instead on the doing itself as embodied social action, in which the embodied person is fore-grounded as a complex resource for meaning making. This represents a theoretical enrichment of the earlier turn to the body (...) in social theory, which tended to separate the semiotic, as necessarily representational and/or linguistic, from the somatic as a wide range of corporeal processes and practices assumed to be separated from mind, language and/or conscious thought. We argue that overcoming this persistent Cartesianism requires a New Realist approach to the proper location of human agency as a causal power, one that promotes a bio-psycho-social concept of personhood. Part one of the paper presents a general framework for this perspective, while part two applies this paradigm ethnographically to illustrate how bringing semiosis and somatics together requires a robust conception of multi-sensory modalities. This article inquires whether and to which degree some fundamental traits of the World Wide Web may encourage us to revise traditional conceptions of what constitutes scientific information and knowledge. Turning to arguments for `open access' in scientific publishing and its derivatives (open content, open archives, etc.), contemporary tendencies in `social software' and knowledge sharing, the authors project a new look on knowledge, dissociated with linear notions of cumulation, progression, and hierarchy (e.g. of scientific argument), but related to circularity, heterarchy, (...) and evolution. Arguing from a medium theoretical perspective, they illustrate their ideas with developments in library science, current debates in epistemology and theories about information architecture, with a particular focus on `unsystematic' folksonomies. This essay evaluates Charles Taylor's defence of a politics of recognition in light of his broader account of modern identity and the self. I argue that his call for a politics of recognition betrays what is most ethically promising in his own account of modern subjectivity – namely, its emphasis on and affirmation of inner multiplicity. The first part of the paper identifies the ways in which his account of the self affirms inner multiplicity. The second part of the paper (...) outlines how a politics of recognition circumscribes this inner plurality by rendering core aspects of personal identity rigid and by promoting attitudes that inhibit attentiveness to multiplicity within the self. By outlining the ways in which it circumscribes inner multiplicity, I show that Taylor's preferred form of politics undermines two of his own central goals: that of securing the conditions in which authentic identity can be realized and that of promoting mutually receptive relations among diverse selves. A form of liberalism that strives for neutrality with respect to cultural symbols and practices more effectively facilitates the realization of these goals. (shrink)

She maintains that the traditional family is fragmenting in Western societies, causing serious social problems. She urges that we reconsider our attitudes to sex and reproduction in order to strengthen our most important social institution, the family.

This comparative case analysis contrasts two nations – Viet Nam and The United States of America (U.S.) – in terms of processes each employed and results each achieved in respective response to the COVID-19 pandemic. We use a general theory of teaching to contrast the countries in terms of their approaches to COVID public health education. Viet Nam followed the recommendations of the theory. The U.S. did not. While our analysis does not and cannot prove educational theory acted as the (...) sole causal factor in realization of the disparate results in the countries, our case study does illustrate that the different approaches to public health education used by the countries may be counted among factors contributing to wide differences in the contrasting cases. The argument proceeds by 1) describing differences in relevant statistics between Viet Nam and the U.S., 2) outlining the theory of teaching we use to analyze differences in public health education in the two contexts, and 3) discussing successful implementation of the theory in Viet Nam and failure to implement in the U.S. Finally, we 4) dismiss competing explanations of differences between the countries and 5) offer considerations about how the U.S. may educate citizens away from turning the pandemic into a pan(en)demic. Despite a growing body of research by management scholars to understand and explain failures in ethical decision making (EDM), misconduct prevails. Scholars have identified character, founded in virtue ethics, as an important perspective that can help to address the gap in organizational misconduct. While character has been offered as a valid perspective in EDM, current theorizing on how it applies to EDM has not been well developed. We thus integrate character, founded in virtue ethics, into Rest’s (1986) EDM model to (...) reveal how shifting attention to the nature of the moral agent provides critical insights into decision making more broadly and EDM specifically. Virtue ethics provides a perspective on EDM that acknowledges and anticipates uncertainties, considers its contextual constraints, and contemplates the development of the moral agent. We thus answer the call by many scholars to integrate character in EDM in order to advance the understanding of the field and suggest propositions for how to move forward. We conclude with implications of a character-infused approach to EDM for future research. (shrink)

This article focuses on the experiences of social care workers during the first wave of the Covid pandemic. The method involved analyzing diaries kept by 65 professionals in 8 French regions during the first lockdown in France in the spring of 2020. As a form of non-binding, narrative expression, keeping diaries breaks with traditional models of reporting common in social care structures and allowed professionals to reflect on the experience as it was lived. In the diaries, professionals explored how the (...) crisis disrupted and challenged their personal and professional values but also allowed innovation in care practices for vulnerable populations that will continue beyond the pandemic period. Five care values were put to forefront by professionals: (1) spontaneity/flexibility; (2) respect for persons; (3) team reflexivity; (4) innovation; (5) solidarity. Mobilizing philosopher Paul Ricoeur’s ideas on recognition, Payet and Laforgue’s analysis of weak actors, as well as research on moral distress, we discuss how these values were tested during the crisis and what effect they had on professionals’ and users’ vulnerabilities. We will also elaborate the interest of keeping account of social care work through narrative methods. (shrink)

High blood pressure is a disease of unknown cause. Family history of the disease indicates higher risk, but it is not known which genes are involved or how they interact with environmental influences to produce the disorder. Molecular biology offers an approach to problems that have not so far been solved by classical physiology or biochemistry. By analysing polymorphic variation in chromosome markers such as minisatellite sequences, or by restriction fragment polymorphism analysis of candidate genes, attempts are being made to (...) link genetic variations with hypertension. In genetically hypertensive rats, hypertension is associated with a polymorphism of the renin gene and with other loci on chromosomes 10 and 18. The role of these loci in human hypertension remains to be determined. Other genes such as sodium‐lithium countertransport may be involved. Environmental factors such as stress or salt intake could influence the rate or timing of expression of certain genes and thus result in hypertension. (shrink)

The present study explored a multi‐construct model of moral development. Variables commonly seen in the moral development literature, such as family interactions, spiritual life, ascription to various sources of moral authority, empathy, shame, guilt and moral judgement competence, were investigated. Results from the current study support previous research that the three moral emotions of empathy, shame and guilt interrelate. Further, it was found that the relationship one has with a higher power (spirituality) involves empathy and guilt. Implications for moral education (...) are discussed. This is an important collection of works, from an international team of authors, on corporate power and its justification and authority. It highlights the growing importance of corporate governance issues, an area which now has unprecedented coverage by the media in the commercial sector and is increasingly important in business schools.

In seeking for an understanding of ethical practices in health care situations, our challenge is always both to recognize and respond to the call of individuals in need. In attuning ourselves to the call of the vulnerable other an ethical moment arises. Asking ‘how are you?’ in health care practice is our very first possibility to learn how a particular person finds herself or himself in this particular situation. Here, ‘how are you?’ shows itself as an ethical question that opens (...) up a relational space that calls forth a response. It is a way to understand the situated moments in which we are already that enables us to act respectfully. Our ethical frameworks assist us in trying to decide what is the right thing to do given a set of circumstances. Yet there is a prior step that already calls us to ethical attention; this is when we ask ‘how are you?’, which transforms a seemingly small interaction into an ethical moment. ‘How are you?’ is a question that turns us back to who we are as health care professionals and calls us to be more deeply attentive to the moment. When we sincerely ask ‘how are you?’ we enact our ethical commitments to one another. (shrink)

This article articulates a range of possible pedagogical goals for courses in comparative philosophy, and discusses a number of methods and strategies for teaching courses intended to achieve those ends. Ultimately, it argues that the assignment to teach comparative philosophy represents an opportunity to design a course with remarkable freedom and tremendous potential. Comparative philosophy courses can engage students in unique ways that not only increase their understanding of the fundamental assumptions and beliefs of non-Western traditions, but also facilitate the (...) development of the skills and dispositions that enable them to become better philosophers. This commentary explores the sometimes uncomfortable ambivalence that colors most people’s experience of disability, either as an aspect of a person’s own identity, or as an aspect of a person’s interactions with a person with a disability. Disabilities are experienced by many as both a positive and a negative aspect of a person’s identity. The commentary describes the work of two disability scholars who have recently explored how this ambivalence affects both legal schemes and parenting decisions, and argue for a (...) ‘destigmatizing’ of this ambivalence. The framework provided by these scholars illuminates ways in which ambivalence about the experience of disability is revealed by many of the contributors to this collection of essays, and suggests that an open confrontation with this ambivalence may facilitate more satisfactory relationships between people with and people without disabilities. "Space," William James confessed, "is [both] a direfully difficult subject [and the] driest of subjects.'" Nonetheless, convinced that most previous accounts of space were either incoherent or mythological, he set out to describe space as it is actually experienced. His first effort, "The Spatial Quale," appeared in The Journal of Speculative Philosophy in 1879. 2 This article is historically important; as Ralph Barton Perry notes, "his peculiar view of the amplitude and eonnectedness of experience seems to have begun with the (...) application to space. ''3 But, despite this fact, it is seldom read today. It was not reprinted in James's Collected Essays and Reviews because the editor found "no important difference" between the content of this article and that of the chapter in The Principles of Psychology dealing with the same topic. 4 And it has not been included in more recent anthologies of James's writings. James would undoubtedly have concurred with the reasoning behind these editorial decisions. In the preface to the Psychology he wrote: Chapter 20, on Space-perception, is a terrible thing, which, unless written with all that detail, could not be fairly treated at all. In the Phaedrus, Plato asserts that divine erotic mania is not an "invariable evil," but enables the philosopher to ascend to the forms and attain "true knowledge," On this view of the best life, this mania has value---it is even "superior" to sophrosume. This dissertation argues that this Phaedrus account should be read as a work in moral psychology. ;To this end, this dissertation considers the development of the ways of thinking about the individual, behavior, and ethics in Greek thought (...) before Plato, and argues that Homer, Aeschylus, and Euripides display a movement from an externalist to an internalist view. This movement, then, continues in the Charmides, Protagoras, and Gorgias, as Plato develops an increasingly complex moral psychology. Further, this internalist movement is revealed in a consideration of the concepts of sophrosune and mania, and in the development of a view of mania as an intensification of desire. ;Next, this dissertation argues that the failure of the Gorgias response to Callicles issues in the Republic's complex moral psychology---in an internalist view and justification of the best life. The Republic , account, however, results in a view on which excessive desires for the pleasures of wisdom may result in mania. Finally, then, the Symposium and the Phaedrus are read as attempts to construct a moral psychology which is both accurate and able to avoid this wisdom/mania difficulty. ;The Phaedrus, then, represents the result of the development and refinements of the internalist approach in Plato's thought. Plato provides a revised, complex psychology, which issues in a view on which the soul's proper goal---the apprehension of the forms---requires both the direction of reason and the motivational energy of the irrational elements. On this account, divine erotic mania---eros-doubled, as both the reason and desire are engaged---represents the method for attaining this knowledge. ;Thus, this dissertation concludes that the Phaedrus may be read as the culmination of the internalist movement toward moral psychology; that the dialogue extraordinary assertions about mania and sophrosune are part of a new view and justification of the best life.
