Recent Case Developments in Health Law.Brett Hartman, Faina Shalts & Caitlyn Ross - 2009 - Journal of Law, Medicine and Ethics 37 (2):380-388.
In January 2009, the California Court of Appeal for the Fifth District held that an individual suffering from paranoid schizophrenia could be forcefed and medicated despite his refusal of consent. The patient was a prison inmate, who engaged in a hunger strike to protest imagined abuses by prison guards. The court, reconciling conflicting provisions of California law, upheld the appointment of a conservator to make treatment decisions because the patient could not participate in those decisions “by means of a rational (...)

New but for whom? Discourses of innovation in precision agriculture.Emily Duncan, Alesandros Glaros, Dennis Z. Ross & Eric Nost - 2021 - Agriculture and Human Values 38 (4):1181-1199.
We describe how the set of tools, practices, and social relations known as “precision agriculture” is defined, promoted, and debated. To do so, we perform a critical discourse analysis of popular and trade press websites. Promoters of precision agriculture champion how big data analytics, automated equipment, and decision-support software will optimize yields in the face of narrow margins and public concern about farming’s environmental impacts. At its core, however, the idea of farmers leveraging digital infrastructure in their operations is not (...)

    The Anthropocene as a Figure of Neoliberal Hegemony.Ross Abbinnett - 2019 - Social Epistemology 33 (4):367-379.
The idea of the Anthropocene postulates that, epistemically and ontologically, we must consider the climatic, geological, and biological systems of the Earth as essentially bound up with the technological systems that have been developed by human beings. This idea has been aesthetically configured through images of ‘Spaceship Earth’ and in the orbital pictures of light patterns emitted by human settlements across the globe. I will argue that this shift towards the idea of the Anthropocene is complicit with a certain kind (...)

Walter Benjamin’s Concept of the Image.Alison Ross - 2014 - New York: Routledge.
In this book, Alison Ross engages in a detailed study of Walter Benjamin’s concept of the image, exploring the significant shifts in Benjamin’s approach to the topic over the course of his career. Using Kant’s treatment of the topic of sensuous form in his aesthetics as a comparative reference, Ross argues that Benjamin’s thinking on the image undergoes a major shift between his 1924 essay on ‘Goethe’s Elective Affinities ,’ and his work on The Arcades Project from 1927 (...)

In this article, we investigate how state-to-state differences in U.S. childcare costs and gender norms are associated with maternal employment. Although an abundance of research has examined factors that influence mothers’ employment, few studies explore the interrelationship between maternal employment and culture, policy, and individual resources across U.S. states. Using a representative sample of women in the 2017 American Community Survey along with state-level measures of childcare costs and gender norms, we examine the relationship between these state conditions and mothers’ (...)

Do the folk actually hold folk-economic beliefs?Ben M. Tappin, Robert Ross & Ryan T. McKay - 2018 - Behavioral and Brain Sciences 41.
Boyer & Petersen argue that folk-economic beliefs are widespread – shaped by evolved cognitive systems – and they offer exemplar beliefs to illustrate their thesis. In this commentary, we highlight evidence of substantial variation in one of these exemplars: beliefs about immigration. Contra claims by B&P, we argue that the balance of this evidence suggests the “folk” may actually holdpositivebeliefs about the economic impact of immigration.

How We Found Consensus on Pediatric Decision-Making and Why It Matters.Erica K. Salter, Lainie Friedman Ross & D. Micah Hester - 2024 - Perspectives in Biology and Medicine 67 (2):186-196.
This article describes the process engaged by 17 expert scholars in the development of a set of six consensus recommendations about the normative foundations of pediatric decision-making. The process began with a robust pre-reading assignment, followed by three days of in-person symposium discussions that resulted in a publication in _Pediatrics_ entitled “Pediatric Decision-Making: Consensus Recommendations” (Salter et al. 2023). This article next compares the six recommendations to existing statements about pediatric decision-making (specifically those developed by the American Academy of Pediatrics), (...)

Pastoral ethics: moral formation as life in the trinity.W. Ross Hastings - 2022 - Bellingham,WA: Lexham Academic.
Ethics is freedom in Christ to pursue the good, true, and beautiful. Pastors regularly face concrete ethical questions. And they, too, pursue a moral life. In the busyness of ministry, it can be tempting to think pragmatically or derive one's ethics from the latest cultural concerns. But standard approaches to ethics, whether deontological, utilitarian, or virtue-ethical, all fall short of being distinctly Christian. Ethics ought to be grounded in the gospel and in our triune God. In Pastoral Ethics, W. (...) Hastings provides pastors an evangelical and trinitarian framework for moral formation and ethical discernment. For Hastings, ethics must be reclaimed as theological. Theology without ethics becomes gnosticism. Ethics without theology leads to legalism and death. Christian ethics participates in God's life and God's work. This communion with God leads to obedience to his commands as summed up in the Decalogue, and over several chapters Hastings provides a rich exposition for pastoral formation. Pastors find their identity in God, and this inspires right thinking and acting with regard to authority, life and death, sexuality, work and rest, speech, and desires. An approach to ethics that prompts faith, hope, and love, Pastoral Ethics is an essential guide for Christians in all ministry contexts. (shrink)

This timely Research Handbook highlights these critical issues and suggests both legal and policy changes are necessary to better protect patients' safety. Multidisciplinary in nature, this Research Handbook features contributions from eminent academics, policy makers and medical practitioners from the Global North and South, discussing the essential facets concerning patient safety and the law. It highlights how the role (...)

At this crucial time, on the centenary of major reforms, we invite all concerned stakeholders to join us in much needed rethinking for reforms of professional education in the 21st century. . . . All health professionals in all countries should be educated to mobilise knowledge and to engage in critical reasoning and ethical conduct so that they are competent to participate in patient and population-centred health systems as members of locally responsive and globally connected teams. Introduction to Monique David-Ménard on Kant and madness.Alison Ross - 2000 - Hypatia 15 (4):77-81.
: Ross examines the relation between thought and madness within the practical and theoretical wings of Kant's critical philosophy. She argues that the notion of critique is formulated as a guard against the tendency of thought to madness. She locates the significance of David-Ménard's essay on Kant's pre-critical works in the idea that Kant's own tendency to madness functions in these early works as a motivational principle for the mature, critical system.

Bargaining for Truth and Reconciliation in South Africa: A Game-Theoretic Analysis.Jerrob Duffy & Don Ross - 2001 - South African Journal of Philosophy 20 (1):66-89.
As regimes move from illiberal to liberal, post-transition justice methodology has been employed to engender truth and reconciliation. These normative concepts have evolved into a policy of creating truth and reconciliation commissions that trade civil and criminal amnesty with applicants in exchange for information. This bargained-for exchange can be analyzed as an imperfect information game, where the commission attempts to maximize information while the applicant seeks amnesty for the lowest possible price. Using game-theoretic analysis, the authors model the truth-amnesty game (...)

This first chapter of Ross's book is devoted to an inquiry into the meaning of right. The interest throughout is ethical, with value only being discussed as far as it seems relevant. The first aspect addressed is the ambiguity inherent in any definition of the meaning of right. G. E. Moore's three definitions of a horse are discussed: these may be designated the arbitrary verbal definition, the verbal definition proper, and the definition that involves the sense of being reduced (...)

Pregnancy involves puzzling aversions to nutritious foods. Although studies generally support the hypotheses that such aversions are evolved mechanisms to protect the fetus from toxins and/or pathogens, other factors, such as resource scarcity and psychological distress, have not been investigated as often. In addition, many studies have focused on populations with high-quality diets and low infectious disease burden, conditions that diverge from the putative evolutionary environment favoring fetal protection mechanisms. This study tests the fetal protection, resource scarcity, and psychological distress (...)

What makes a multimillion-dollar, transnational intimate industry possible when most people see it as exploitative? Using the newly emergent case of commercial surrogacy in India, this article extends the literature on stratified reproduction and intimate industries by examining how surrogacy persists and thrives despite its common portrayal as the “rent-a-womb industry” and “baby factory.” Using interview data with eight infertility specialists, 20 intended parents, and 70 Indian surrogate mothers, as well as blogs and media stories, we demonstrate how market actors (...)

Fasting during pregnancy is an enigma: why would a woman restrict her food intake during a period of increased nutritional need? Relative to the costs to healthy individuals who are not pregnant, the physiological costs of fasting in pregnancy are amplified, with intrauterine death being one possible outcome. Given these physiological costs, the question arises as to the socioecological factors that give rise to fasting during pregnancy. There has been little formal research regarding the emic perceptions and socioecological factors associated (...)

In order to reduce stigma and improve the lives of vulnerable populations, researchers have recognized a need to integrate different types of support at various levels. To better inform HIV interventions, the current study draws on social-ecological and evolutionary theories of reproduction to predict stigma and fear of contracting HIV among pregnant women in South India. The question of why music evolved has been contemplated and debated for centuries across multiple disciplines. While many theories have been posited, they still do not fully answer the question of why humans began making music. Adding to the effort to solve this mystery, we propose the socio-affective fiction (SAF) hypothesis. Humans have a unique biological need for emotion regulation strengthening. Simulated emotional situations, like dreams, can help address that need. Immersion is key for such simulations to successfully exercise people's (...)
