Este artigo tem por objetivo investigar a filiação filosófica dos denominados direitos da natureza. A questão central deste texto é saber se é procedente afirmar que a concepção da natureza enquanto titular de direitos significa rompimento com a ética Antropocêntrica e, entre as correntes da ética Ambiental, qual delas está alinhada com tal perspectiva. Apesar de ser comum a tese de que os direitos da natureza denotam uma posição biocêntrica, este artigo conclui que a posição filosófica que realmente identifica esta (...) formulação é a da ética Ecocêntrica, o que não significa, a rigor, afastamento ou superação do antropocentrismo. investigam-se autores referenciais para a problemática, bem como a legislação constitucional do Equador e da Bolívia. indaga-se também a fundamentação que justificaria reconhecer direitos à natureza, mas não reconhecer direitos aos animais. A metodologia adotada implica análise da bibliografia basilar acerca do tema, que é basicamente de origem estrangeira: europeia, estadunidense e sul-americana. A importância do tema está no exame jusfilosófico da virada paradigmática proposta pela ética Ambiental, notadamente pela ética Animal. Atribuir direitos à natureza significa rever essencialmente os critérios tradicionalmente empregados pelo Direito para o reconhecimento de direitos subjetivos. (shrink)

O artigo se propõe a pensar o retorno dos adolescentes às escolas após a pandemia fazendo a articulação entre conceitos psicanalíticos e a importância da escola na transição que a adolescência representa para a constituição psíquica do sujeito. A partir de uma experiência de pesquisa-extensão em uma escola com estudantes do Ensino Médio, pensamos sobre como o laço social contemporâneo impacta os modos de subjetivação e a educação, relacionando-o ao mal-estar nos estudantes adolescentes nos contextos educativos brasileiros. Além disso, a (...) dimensão da temporalidade tanto a própria da adolescência, quanto da escola e da pandemia que lhe atravessam foram tomadas como direcionamentos sendo o artigo dividido três partes: tempo na pandemia, tempo da escola e o tempo da adolescência. A partir do século XVIII, a imposição do controle das principais instituições políticas e sociais à população passa a ocorrer precipuamente por meio de estratégias urbanísticas. A arquitetura revela o objetivo de disciplinamento dos corpos de modo a prepará-los para a inserção na incipiente sociedade capitalista, seja na forma das escolas, fábricas ou prisões. Objetivamos num primeiro momento refletir, por meio da trajetória histórica e arquitetônica da Biblioteca Pública Municipal de Marília, se a biblioteca antiga tem preponderância de uma instituição (...) disciplinar; para, em um segundo momento, apresentar a arquitetura no novo prédio, verificando se o novo modelo de biblioteca pode evidenciar a transição do modelo disciplinar ao de controle. Metodologicamente, trata-se de uma pesquisa de natureza qualitativa, documental e bibliográfica, na qual utilizamos o método Análise de Conteúdo da Bardin para analisarmos categorias de entrevista. Para tanto, nos valemos um pouco do pensamento de Foucault e Deleuze acerca do tema, bem como o histórico, arquitetura e um pouco da organização das coleções da biblioteca em questão, nos espaços e tempos diferentes. Concluímos que a nova biblioteca não é melhor do que a anterior. Ela apenas se adequa melhor aos ditames dos novos tempos, com novas perspectivas sociais e tecnológicas. A antiga biblioteca teve uma função muito importante na história da cidade e dos seus usuários. Somente não estava mais apropriada ao século XXI, necessitando de novo aspecto e sentido. (shrink)

Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. O objetivo do presente artigo é defender as seguintes teses. Em primeiro lugar, as teorias da justiça de Habermas e Rawls devem ser vistas como duas versões do construtivismo kantiano, entendido como abordagem metaética que pretende reunir anti-realismo e cognitivismo forte. Em segundo lugar, o contraste com o “construtivismo reconstrutivista” de Habermas ajuda a esclarecer de que modo a teoria de Rawls atende à pretensão de universalidade própria do cognitivismo forte. Ao realçar o fato de que o construtivismo de Rawls (...) está baseado no trabalho reflexivo da consciência individual, o contraste com Habermas permite compreender em que sentido os conceitos de equilíbrio reflexivo e consenso sobreposto designam um ideal com pretensão de validade universal, o que desmente o particularismo implicado nas interpretações coerentistas e relativistas destes conceitos. It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. The concept of indiscernibility in a structure is analysed with the aim of emphasizing that in asserting that two objects are indiscernible, it is useful to consider these objects as members of (the domain of) a structure. A case for this usefulness is presented by examining the consequences of this view to the philosophical discussion on identity and indiscernibility in quantum theory.

Este presente artigo visa buscar os pressupostos da dupla reflexão de Climacus para melhor compreender a sua crítica ao pensamento dialético-especulativo. É tendo em mente que a dupla reflexão retoma os conceitos do trágico e do cômico, da seriedade e do gracejo – ainda que sobre uma nova perspectiva– que compreenderemos a importância dessa comunicação para a linguagem indireta, que tem por objetivo comunicar uma contradição absoluta.

Cognitive representations are typically analysed in terms of content, vehicle and format. While current work on formats appeals to intuitions about external representations, such as words and maps, in this paper we develop a computational view of formats that does not rely on intuitions. In our view, formats are individuated by the computational profiles of vehicles, i.e., the set of constraints that fix the computational transformations vehicles can undergo. The resulting picture is strongly pluralistic, it makes space for a variety (...) of different formats, and is intimately tied to the computational approach to cognition in cognitive science and artificial intelligence. This paper proposes an alternative view of the connection between knowledge and truth. Truth is traditionally seen as a semantic notion, i.e. a relation between what we say about the world and the world itself. Epistemologists and philosophers of science are therefore apt to resort to correspondence theories of truth in order to deal with the question whether our theories and beliefs are true. Correspondence theories try to define truth, but, in order to do so, they must choose a truth (...) bearer, i.e. something capable of being true, for instance, propositions, sentences or statements. According to the analysis here proposed, none of these truth bearers can be defined without reference to the others. The pragmatic, alternative view here presented, in its turn, is unaffected by this kind of conceptual difficulty. According to this view, one must focus on the use of truth terms – such as ‘true’, ‘false’, ‘correct’, ‘appropriate’, etc. – and the methodological role such terms play in the investigative practices and research programs to be found both in the sciences and in other, everyday investigative activities, such as forensic and journalistic investigations. The concept of natural kind is center stage in the debates about scientific realism. Champions of scientific realism such as Richard Boyd hold that our most developed scientific theories allow us to “cut the world at its joints” (Boyd, 1981, 1984, 1991). In the long run we can disclose natural kinds as nature made them, though as science progresses improvements in theory allow us to revise the extension of natural kind terms.

An influential view in cognitive science is that computation in cognitive systems is semantic, conceptually depending on representation: to compute is to manipulate representations. I argue that accepting the non-semantic teleomechanistic view of computation lays the ground for a promising alternative strategy, in which computation helps to explain and naturalise representation, rather than the other way around. I show that this computation-based approach to representation presents six decisive advantages over the semantic view. I claim that it can improve the two (...) most influential current theories of representation, teleosemantics and structural representation, by providing them with precious tools to tackle some of their main shortcomings. In addition, the computation-based approach opens up interesting new theoretical paths for the project of naturalising representation, in which teleology plays a role in individuating computations, but not representations. O texto defende que afetos tais como orgulho, vaidade, inveja, busca de honra e glória, são estruturantes para a argumentação hobbesiana. Sustenta-se que sem tais afetos o estado de natureza não seria um estado de guerra, mas um estado de paz e concórdia, como defendido por Locke. Ademais, sem a consideração de tais afetos, o design do Leviatã seria fundamentalmente diferente, visto que as leis naturais que devem configurá-lo, só são compreensíveis em seu conteúdo se se pressupuser a autoconservação de (...) seres orgulhosos, vaidosos, invejosos e que buscam honra e glória. Sem tal consideração, o Estado não só se mostraria ineficaz enquanto dispositivo de segurança para os humanos, como seria instável. Portanto, pressupor e conter tais traços afetivos é fundamental para a viabilidade e a estabilidade do Leviatã. Por fim, o texto desenha uma hipótese a respeito dos fundamentos a partir dos quais o ser humano apresenta tais traços afetivos, bem como a respeito do modo de conhecê-los. (shrink)

The pessimistic hypothesis is the hypothesis that life is bad for us, in the sense that we are worse off for having come into existence. Suppose this hypothesis turns out to be correct — existence turns out to be more of a burden than a gift. A natural next thought is that we should stop having children. But I contend that this is a mistake; procreation would often be permissible even if the pessimistic hypothesis turned out to be correct. Roughly, (...) this is because we are often in a position to know that future people will approve of having been created, and their approval will not be inappropriate even if they are worse off for having been created. No Tratado político, Espinosa, ao primeiro movimento do texto, faz dura crítica àqueles que criaram utopias ao tratarem da política. Tais filósofos, afirma, por tomarem os homens não pelo que são, mas pelo que gostariam que fossem, conceberam uma forma de política que nunca pôde ser posta em aplicação. Tese muito próxima à de Maquiavel, presente em O Príncipe, segundo a qual, para escrever coisa útil neste campo, deve-se ir direto alla verità effettuale della cosa che alla immaginazione di essa. (...) Não casualmente, portanto, no Capítulo V do Tratado político, último parágrafo, Espinosa usa os termos ‘agudíssimo’ e ‘prudentíssimo’ ao se referir ao florentino. Há mais Maquiavel em Espinosa para além das citações elogiosas? O artigo procurará tratar desta questão ao mostrar alguns traços comuns às respectivas filosofias políticas. Ao que indicam as fontes primárias e alguns comentadores, Espinosa teria se apropriado, e reconceitualizado, à sua maneira, teses-chave do florentino para escrever suas obras, em particular o Tratado político. No primeiro movimento o artigo analisa, em panorama, a ontologia espinosana. Após, mostra como, do interior dos conceitos presentes na ontologia, derivam os de homem, desejo, alegria e tristeza, esperança e medo, segurança e desespero, ação e paixão. Da relação entre ontologia, homens e desejo – bem como dos demais afetos –, são extraídas, em breves considerações, algumas teses políticas de Espinosa. Levanta-se, neste movimento argumentativo, a hipótese de que as teses políticas espinosanas derivam de sua ontologia e de sua (...) concepção de homem como desejo e variação de potência. O conceito de desejo é analisado à luz da variação de potência e do tema do direito natural, o qual, em Espinosa, se identifica a potência. Quando das breves derivações à política, algumas teses hobbesianas – relacionadas aos temas da multidão, povo, representação, direito natural, estado civil, etc. – são trazidas à argumentação para que se mostre, por contraste, o peso das inovações espinosanas. Este artigo investe na ideia de que a infância é um dispositivo histórico do poder. Tem-se como referência analítica Michel Foucault, que concebe a noção de dispositivo em suas discussões a respeito da sexualidade. A hipótese geradora é a de que, a partir do momento em que a criança se torna um dos grupos estratégicos do dispositivo da sexualidade, produz-se sobre ela um conjunto heterogêneo de regimes de verdades e práticas que configura uma maneira de ser e ter uma infância, (...) influindo significativamente nas perspectivas pedagógicas modernas. Dialogando com Deleuze, Agamben e Veyne, considera-se que todo dispositivo possui: linhas de visibilidade e de enunciação que são, respectivamente, máquinas de “fazer ver” e de “fazer falar” ; linhas de força, que sustentam os campos de visibilidade e os regimes de enunciabilidade; e linhas de subjetivação que são, segundo Deleuze a dimensão do “si próprio” e que configuram o sujeito infantil. Apresenta-se três grupos de práticas articuladas às estas características do dispositivo: as práticas pedagógicas, as práticas divisórias e identitárias de gênero e de sexualidade e as práticas médicas. Observa-se que, para Foucault, o dispositivo da sexualidade disciplina os corpos, regula e normatiza a população, regulamenta o prazer e os saberes sobre o sexo, e, além disso, ocupa-se, por meio desse regime sobre o sexo, da preservação da espécie humana. A infância como dispositivo, na perspectiva ora apresentada neste artigo, também regulamenta a criança, constituindo-a em “sujeito infantil”, estabelecendo uma pedagogia e uma ciência que compuseram o pensamento pedagógico moderno sobre e para infância, ocupando-se também da preservação e da manutenção dessa espécie outra, a criança. uma das teses fundamentais de Habermas no que diz respeito à relação entre direito e moral é que o direito alivia três exigências que são feitas à moral, quais sejam, exigência cognitivas, motivacionais e organizacionais. Os defensores de uma relação forte entre direito e moral, como por exemplo Dworkin, sustentam que a moral deve ser chamada para resolver os casos difíceis do direito. Ora, Habermas parece afirmar justamente o contrário, a saber, que é o direito que é chamado a suprir (...) um déficit cognitivo da moral. O texto explora as consequências dessa afirmação para a teoria discursiva do direito de Habermas, em relação a uma das teses fundamentais do positivismo jurídico, qual seja, a de que a moral não pode ser um fundamento para o direito justamente por causa de sua indeterminação cognitiva, razão pela qual os positivistas jurídicos afirmam o elemento de decisão última da autoridade do direito, sem que, para tal, o conteúdo seja o ponto determinante. O texto coteja o quanto a teoria discursiva do direito de Habermas se aproxima ou se afasta dessa tese fundamental do positivismo jurídico. (shrink)

This book seeks to bring together the pragmatic theory of 'meaning as use' with the traditional semantic approach that considers meaning in terms of truth conditions. Daniel Gutzmann's new approach captures the entire meaning of complex expressions and overcomes the empirical gaps and conceptual problems associated with previous analyses.

Simon May has argued that the notion of a principled compromise is incoherent. Reasons to compromise are always in his view strategic: though we think that the position we defend is still the right one, we compromise on this view in order to avoid the undesirable consequences that might flow from not compromising. I argue against May that there are indeed often principled reasons to compromise, and that these reasons are in fact multiple. First, compromises evince respect for persons that (...) we have reason to think of as our epistemic peers, and acknowledgement of our own finitudes as moral reasoners. Second, compromises are often made morally necessary by the shortfalls that unavoidably separate democratic institutions from democratic ideals. Third, compromises express a desirable form of democratic community. And fourth, compromises are often justified from a consequentialist point of view, in that they allow for the realization of values that would not be realized as well by the failure to compromise. I analyze a tension at the core of the mechanistic view of computation generated by its joint commitment to the medium independence of computational vehicles and to computational systems possessing teleological functions to compute. While computation is individuated in medium-independent terms, teleology is sensitive to the constitutive physical properties of vehicles. This tension spells trouble for the mechanistic view, suggesting that there can be no teleological functions to compute. I argue that, once considerations about the relevant function-bestowing factors for computational (...) systems are brought to bear, the tension dissolves: physical systems can have the teleological function to compute.
