E-Z Reader achieves an impressive fit of empirical eye movement data by simulating core processes of reading in a computational approach that includes serial word processing, shifts of attention, and temporal overlap in the programming of saccades. However, when common assumptions for the time requirements of these processes are taken into account, severe constraints on the time line within which these elements can be combined become obvious. We argue that it appears difficult to accommodate these processes within a largely sequential (...) modeling framework such as E-Z Reader. (shrink)

In ‘The Choice Theory of Contracts’, we advance a claim about the centrality of autonomy to contract. Since publishing Choice Theory, we have engaged dozens of reviews and responses; here, we reply to Robert Stevens, Arthur Ripstein, and Brian Bix. All this rigorous debate confirms for us one core point: contract’s ultimate value must be autonomy, properly understood and refined. Autonomy is the telos of contract and its grounding principle. In Choice Theory, we stressed the proactive facilitation component of autonomy, (...) in particular, the state’s obligation regarding contract types. Here, we highlight two additional, necessary implications of autonomy for contract: regard for future selves and relational justice. These three aspects of autonomy shape the range, limit, and floor, respectively, for the legitimate use of contract. They provide a principled and constrained path for law reform. (shrink)

Der Band gibt einen Überblick über die Probleme der Moralphilosophie und die Antworten der Ethik auf die Frage nach dem Wesen, den Funktionen und den Inhalten der Moral. Ein besonderer Akzent liegt auf der Unterscheidung der Ebenen, auf denen moralische und ethische Diskurse geführt werden. Geeignet ist die Einführung auch für Leser ohne besondere Vorkenntnisse.

The focus of this book is on conceptual and philosophical issues of perception including the classic notion of unconscious inferences in perception. The book consists of contributions from a group of internationally renowned researchers who spent a year together as distinguised fellows at the German Centre for Advanced Study.

Is causal analysis an appropriate method to discover causal laws? Some prerequisites for any successful application of mathematical causal models are worked out and discussed. It can be shown that these prerequisites cannot be fulfilled by present models and there are strong reasons to assume that they cannot be satisfied by any model. Therefore causal analysis will probably be of no importance for the discovery of causal laws in sociology.

Thesis Eleven is honoured to be able to publish this text by our late friend and mentor Agnes Heller. It was secured in the period before her recent death, and is published now posthumously in her memory. Echoing her earlier text written as an Imaginary Preface to Arendt’s Totalitarianism, it responds to themes in the later text, The Life of the Mind. These were among the most eminent of the minds referred to later as Women in Dark Times. Their (...) connection was not only institutional, via the New School, but represented a deep and ongoing affinity and critical engagement in political and philosophical terms. The imaginary letter arcs around issues and questions indicated by Cicero, Kant, Heidegger and Wittgenstein, including matters of republicanism, rhetoric and the question of thinking. Best of all, it shows Agnes Heller at work, at her best: it shows her thinking. Like Arendt, she offers inspiration, provocation, through thinking. (shrink)

Ethics in the 21st century is threatened by a split between practical philosophy as a full-blown academic discipline and applied ethics as pragmatic problem-solving inside the political process. The place of the professional philosopher sitting on medical and other 'ethics committees' as an 'ethical expert' is somewhere in between. But where exactly? How is his role defined? Is the expertise he brings to bear on practical decisions of a purely technical or of a substantially moral kind? These issues are discussed (...) both 'from the outside' and 'from the inside'. First, some of the theoretical controversies surrounding 'ethical expertise' are discussed on the background of a rapidly growing literature in the field. These are then related to the realities of commission work as they confront the academic ethicist in practice. (shrink)

The relation between ethics and social science is often conceived as complementary, both disciplines cooperating in the solution of concrete moral problems. Against this, the paper argues that not only applied ethics but even certain parts of general ethics have to incorporate sociological and psychological data and theories from the start. Applied ethics depends on social science in order to asses the impact of its own principles on the concrete realities which these principles are to regulate as well as in (...) order to propose practice rules suited to adapt these principles to their respective contexts of application. Examples from medical ethics (embryo research) and ecological ethics (Leopold's land ethic) illustrate both the contingence of practice rules in relation to their underlying basic principles and the corresponding need for a co-operation between philosophy and empirical disciplines in judging their functional merits and demerits. In conclusion, the relevance of empirical hypotheses even for some of the perennial problems of ethics is shown by clarifying the role played by empirical theories in the controversies about the ethical differentiation between positive and negative responsibility and the relation between utility maximisation and (seemingly) independent criteria of distributive justice in the context of social distributions. The Rest of Language When Aristotle, at the opening of his treatise on interpretation, defines the nature and function of language, he does so by referring "the things in the voice [ta en tei phonei]" to impressions on the soul (pathe¯mata), which, in turn, he refers to "things [pragmata]" [De interpretatione 16a4 ff.]. Aristotle's text establishes, in this way, that vocal utterances are signs of things. The philosophical significance of this gesture could not be more decisive. Once De interpretatione determines the canonical form of the statement as a "meaningful sentence [logos se¯mantikos]" and, more precisely, as a "proposition [logos apophantikos]" bearing truth or falsity, and once it asserts that truth and falsity reside in the composition (synthesis) of elements [16a10-15], 1 the consequence is inevitable: the paradigmatic form of true speech must be that of the "statement of one thing concerning another thing [legein ti kata tinos]" [17a25]. 2 Here it matters little whether the relation of speech to things is grasped as one of imitation or constitution, reproduction or production; it matters little, moreover, whether the things at issue--that which language means--are understood as sensible objects or supersensuous entities, material beings or logical idealities. In every utterance, speech, by virtue of its very form, is necessarily capable of being dissolved into those things of which it speaks. Indeed, the Aristotelian principle of analysis (literally, "loosening up") demands this [End Page 22] dissolution as the end toward which all speech, insofar as it is both assertive and predicative, ultimately tends. Language is thus posited only in order to be effaced; its specific constituents are identified only to be returned, in the end, to the world of things. When Augustine writes, in a lapidary formula at the start of his De doctrina christiana, that "things are learned by signs [res per signa discuntur]" [1.2.2.20], he simply summarizes what is already stated in the Aristotelian locus classicus: words, the elements of language, function in the service of things; when words show what exists, their task is accomplished.Werner Hamacher's works constitute perhaps the most powerful contemporary attempt to delineate and interrogate this aporetic structure, by which language, in its classical philosophical and theoretical elaboration, is simultaneously constructed and effaced, identified as such and destituted of all propriety. The implications of this structure, which are both logical and metaphysical, extend not only to the Aristotelian, but even to the most modern theories of language and its operation. "At the end of every semantic theory of language and its truth," Hamacher thus writes in Premises: Essays on Philosophy and Literature from Kant to Celan, "stands the aporetic verdict: language does not speak; it has nothing to say" [P 338; EV 325]. When language is determined by its "semantic and referential functions," we read, it follows that at "the end and thus the site of its destination, it no longer means anything and no longer refers to anything" [P 338; EV 325]. If Hamacher's texts often take as their point of departure contemporary doctrines of literary production and language, it is because, in the field of literary studies, the invocation of the semantic determination of language thus leads thought to eliminate the very element that might have been its subject of examination: language. The one discipline that might have resisted the apophantic dissolution of language proves itself not to be, as the German term has it, a "science of literature [Literaturwissenschaft]" but, rather, "more or less clandestinely a science against literature" [P... The force of [Heinrich von] Kleist's story "On the Marionette Theatre" . . . derives from roots deeply sunk into the soil of the past. It is a novel variation on a theme the first author of which may well be Plato. For according to Plato the human mind has been in the dark ever since it lost its place in the community of Truth, in the realm, that is, of the Ideas, the eternal and eternally perfect forms, those now (...) unattainable models which man in his exile is able to see and recognize only as shadows or imperfect copies. And this Platonic parable of the damage suffered by man's soul and consciousness is not unlike the Fall as it is narrated in Genesis. The Fall was the consequence and punishment of man's free will that for the first time had asserted itself against the universal God and rejoiced in a consciousness and pleasure entirely its own—tragically its own; for man had to forsake the indwelling in the supreme Intelligence and thus the harmony between himself and Being as such. The reward for this betrayal was the embarrassment and shame of self-consciousness, the hard labor of maintaining himself in his state of separation, and, soon to follow, the murderous misdeeds of the self-will named Cain. Better to have no mind than a mind thus deprived and impoverished and cruel. Adapting a terminology introduced by Brian Barry, I make a distinction between want-regarding and ideal-regarding principles and apply it to the norms and criteria put forward in environmental ethics. I argue that priority should be given to want-regarding principles over ideal-regarding ones because the former are universalizable while the latter are not, universalizable being understood in the sense ofappealing to value premises for which universal assent can be secured. This sense is different both from R. M. Hare's metaethical concept of (...) universalizability and J. L. Mackie’s “three stages of universalisation.”. (shrink)

David Hume is quoted in Binmore’s book Natural Justice more than any other author, past or present, and throughout with a markedly positive attitude. It is argued that this affinity is reflected in many characteristic features of Binmore’s approach to fairness and social justice and especially in the central role motivational issues are made to play in his theory. It is further argued that Binmore shares with Hume not only important strengths but also certain weaknesses, among them a tendency to (...) derive from the limited evidence of past history far-reaching statements on human nature and the conditions thereby imposed on social morality. ZusammenfassungDer schnelle Fortschritt der Biomedizin fördert fortwährend neue bioethische Problemstellungen zutage und erfordert Anpassungen überlieferter Normbestände an neue Gegebenheiten. Für viele neue Verfahren stellen sich jedoch Fragen nicht nur der moralischen Bewertung, sondern auch der begrifflichen Einordnung. Diese besagt dann häufig etwas über das Gewicht, das einerseits sachlichen, andererseits normativen Kontinuitäten und Diskontinuitäten beigelegt wird. Der Beitrag illustriert die in diesem Zusammenhang auftretenden Konflikte am Beispiel des Gene editing bei Nutzpflanzen, der mitochondrial replacement therapy, des aktiven Behandlungsabbruchs bei Schwerkranken und (...) dem freiwilligen Verzicht auf Nahrung und Flüssigkeit zur Lebensbeendigung (Sterbefasten). Besonderes Augenmerk gilt den Dilemmata, die sich ergeben, wenn sich diese Konflikte angesichts verhärteter normativer Fronten diskursiv nicht auflösen lassen. (shrink)

Aus mehr als einem Grund ist Biodiversität für die Umweltethik ein hard case. Es ist schwierig, Biodiversität zu definieren und darauf aufbauend zu begründen, warum Biodiversität ein Wert ist und warum es uns ein Anliegen sein sollte, sie zu schützen und zu erhalten. Ein weiteres Problem, das mit Biodiversität als Wertbegriff einhergeht, ist das sogenannte „Substitutionsproblem“. Es besteht darin, dass im Prinzip jede natürliche Entität durch eine andere ersetzt werden kann, so lange sie dieselben Werteigenschaften aufweist. Wie und zu welchem (...) theoretischen Preis lassen sich nun Intuitionen verteidigen, die der ökologischen Ersetzbarkeit widersprechen? Ist Substitution grundsätzlich problematisch oder nur unter besonderen Bedingungen? Gibt es Werte, die, prinzipiell oder faktisch, einen Ersatz ausschließen? Und wie überzeugend sind diese Werte im Kontext des Biodiversitätsschutzes? Meine Schlussfolgerung ist, dass keiner der Werte, die Substitution einschränken, unmittelbar zu den wesentlichen Wert- Dimensionen von Biodiversität beiträgt, sodass sogar im Rahmen eines streng verstandenen Biodiversitätsschutzes (zumindest prinzipiell) breiter Spielraum für anthropogene Ersetzungen besteht. It is evident that the problem of global climate change is closely bound up with questions of distributional justice, both intra- and intergenerational. Questions of justice are raised by two kinds of burdens: reductions in the emission of greenhouse gases, and the financial and knowledge transfers necessary to enable the poorest countries to compensate the harms suffered by the ongoing process. Both burdens involve considerable costs and opportunity costs. On the backdrop of a prioritarian version of utilitarianism, it is argued (...) that the answer should be a split strategy. While reduction of emissions should be based on the polluter-pays principle, obligations of compensation should be based on the criteria of overall economic strength. (shrink)

Supporting the rational suicide of a patient with a terminal disease is opposed by a majority of German doctors, whereas assistance in such patients’ hastening their death by voluntarily stopping eating and drinking is predominantly judged to be acceptable. Are these two positions compatible? It is argued that the normative differentiation cannot be justified by the fact that the assistance in active suicide is itself active, whereas assistance in VSED is merely passive. Even in "letting die" a patient from hastening (...) death by refusing nutrition and hydration there is an active element in the doctor's/the palliative care team's assurance that they will provide palliative support in case of need. Nor can the difference in evaluation be justified by relevant differences in the causal situation. Enabling a patient to perform VSED and assisting a patient's active suicide under the same circumstances are, as far as causal relevance is concerned, on a par. This holds, at least, on a condition view of causality in the tradition of John Stuart Mill. Finally, the paper discusses whether there are other morally relevant dimensions by which actively and passively supporting a patient suicide under the relevant circumstances differ, again with a negative result. Schopenhauers »Preisschrift über die Freiheit des Willens« ist eine der wenigen Einsendungen zu einem Wettbewerb, die nachhaltige Berühmtheit erlangt haben. Die Norwegische Sozietät der Wissenschaften in Trondheim hatte 1839 die Preisfrage gestellt »Lässt sich die Freiheit des menschlichen Willens aus dem Selbstbewusstsein beweisen?«, und Schopenhauers anonym eingesandte Abhandlung – die einzige – bekam den Preis zugesprochen.

Vielen Menschen ist es wichtig, über einen Notausgang aus dem Leben zu verfügen, sollten sie dieses einmal als unerträglich erleben. Eine bedingungslose moralische Verpflichtung zur Erhaltung des eigenen Lebens wird heute nur noch von wenigen akzeptiert. Nietzsche, auf den der Terminus „Freitod“ zurückgeht, hat allerdings den Suizid nicht nur – wie viele Schwerkranke, die wissen, dass ihnen dieser Ausweg offensteht – als psychologische Stütze der Leidenstoleranz rehabilitiert, sondern auch unzulässig normativiert. Das Bestehen auf der „Freiheit zum Tode“ als integralem Teil (...) der Freiheit der Lebensgestaltung rechtfertigt keine Abwertung des Lebenswillens derer, die trotz stark reduzierter Lebensqualität am Leben hängen. Unter den Bedingungen der modernen Mittel zur Lebenserhaltung selbst bei schwerstem Leiden bekommt das von der Aufklärung erkämpfte, allerdings durch Pflichten gegenüber Nahestehenden eingeschränkte Recht auf Suizid eine neue Brisanz. Es verdient, auch vom Rechtssystem als Recht anerkannt zu werden. (shrink)

Zusammenfassung Angesichts des fortgesetzten Rückgangs des Organspendeaufkommens in Deutschland werden Forderungen nach Einführung der Widerspruchsregelung bei der Organübertragung post mortem seit längerem nicht mehr nur von der Ärzteschaft, sondern verstärkt auch von politischer Seite erhoben. Gegenstand des Beitrags ist die Prüfung der Vereinbarkeit der gegenwärtig diskutierten Vorschläge zu einer Erhöhung des Organaufkommens mit dem individuellen Selbstbestimmungsrecht, ohne damit eine gesamthafte ethische Nutzen-Kosten-Bilanz dieser Strategien zu präjudizieren. Der Beitrag geht davon aus, dass hauptsächlich drei Faktoren für die Beurteilung relevant sind: 1. (...) ob der Eingriff in die körperliche Integrität zu Lebzeiten oder post mortem erfolgt; 2. die Intensität des Wunsches, nach dem Tod vor solchen Eingriffen geschützt zu sein; 3. das Ausmaß des sozialen Drucks, einen solchen Eingriff zuzulassen. Es ergibt sich, dass eine Widerspruchsregelung unter dem Gesichtspunkt des Selbstbestimmungsrechts einerseits nicht optimal, andererseits aber auch nicht schlechthin inakzeptabel und jedenfalls der Alternative einer Zwangserklärungsregelung vorzuziehen ist. The moral dilemma of nuclear deterrence arises from two conflicting facts: the fact that in a world of conflicting superpowers with nuclear arsenals preserving peace must have an overriding moral priority; and that a policy of mutual nuclear deterrence, which seems well suited to achieve this aim, faces grave moral difficulties on its own, the main difficulty being the moral indefensibility of the act of retaliation threatened in case of attack. It is argued that a consequentialist approach to the moral (...) assessment of nuclear deterrence is in principle able to provide a solution to this dilemma by reducing the moral dilemma to a non-moral dilemma which can in turn be solved by a comparison of risks. In this connection, a theory of the ‘functional’ assessment of intentions is developed in order to subject even threats involving a conditional intention to retaliate to consequentialist reasoning.
