In the framework of judgment aggregation, we assume that some formulas of the agenda are singled out as premisses, and that both Independence (formula-wise aggregation) and Unanimity Preservation hold for them. Whether premiss-based aggregation thus defined is compatible with conclusion-based aggregation, as defined by Unanimity Preservation on the non-premisses, depends on how the premisses are logically connected, both among themselves and with other formulas. We state necessary and sufficient conditions under which the combination of both approaches leads to dictatorship (resp. (...) oligarchy), either just on the premisses or on the whole agenda. This framework is inspired by the doctrinal paradox of legal theory and arguably relevant to this field as well as political science and political economy. When the set of premisses coincides with the whole agenda, a limiting case of our assumptions, we obtain several existing results in judgment aggregation theory. (shrink)

Against the background of the Second World War and post-war cultural change in Australia, this review article discusses the establishment of the profession of art history and art curatorial scholarship in Australia in the 1940s and 1950s. The key figures in this transformation were Franz Philipp and Ursula Hoff (European ‘savant’ refugees from Nazism and anti-Semitism), and the British scholar Joseph Burke (appointed as Herald Professor of Fine Arts at Melbourne University). These figures played pivotal roles in Sir (...) Keith Murdoch's ‘civilizing mission’ to reform Australian culture – a mission centred on Melbourne University and the National Gallery of Victoria under its new director, Daryl Lindsay. Within the context of the ‘culture wars’ dividing the Australian art world at this time, these reformers and pioneering scholars found themselves opposed by a radical art avant-garde under the leadership of the art patron John Reed. The work of key modernist Australian artists, above all Sidney Nolan and Russell Drysdale, became touchstones for radical and conservative positions in this conflict. (shrink)

After outlining the life and works of interpreter Yoshio Gonnosuke, this paper introduces the manuscript witnesses of his hitherto unstudied comparative Dutch–Japanese syntax written in the mid‐1820s, which was modelled on Pieter Weiland's Nederduitsche spraakkunst (1805). This is followed by a closer look at the process of compilation and publication of Philipp Franz von Siebold's “Epitome linguae japonicae,” of which only the first part was published in 1826. How ethical have recent banking practices been? We answer this question via an economic analysis. We assess the two dominant practices of the modern banking system – fractional reserves and maturity transformation – by gauging the respective rights of the relevant parties. By distinguishing the legal and economic differences between deposit and loan contracts, we determine that the practice of maturity transformation (in its various guises) is not only ethical but also serves a positive social function. The foundation of the (...) modern banking system – the holding of fractional reserves against deposits – is, however, problematic from economic, legal and ethical perspectives. Starting from a microanalysis of money's function, a reassessment of the current laws concerning the practice is encouraged, with the aim not only to rectify economic irregularities but also to realign depositors' rights with the obligations of the banking sector. Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects. The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. This paper shows that the law, in subtle ways, may set hitherto unrecognized incentives for the adoption of explainable machine learning applications. In doing so, we make two novel contributions. First, on the legal side, we show that to avoid liability, professional actors, such as doctors and managers, may soon be legally compelled to use explainable ML models. We argue that the importance of explainability reaches far beyond data protection law, and crucially influences questions of contractual and tort liability for (...) the use of ML models. To this effect, we conduct two legal case studies, in medical and corporate merger applications of ML. As a second contribution, we discuss the trade-off between accuracy and explainability and demonstrate the effect in a technical case study in the context of spam classification. (shrink)

In current debates, many philosophers of science have sympathies for the project of introducing a new approach to the scientific realism debate that forges a middle way between traditional forms of scientific realism and anti-realism. One promising approach is perspectivism. Although different proponents of perspectivism differ in their respective characterizations of perspectivism, the common idea is that scientific knowledge is necessarily partial and incomplete. Perspectivism is a new position in current debates but it does have its forerunners. Figures that are (...) typically mentioned in this context include Dewey, Feyerabend, Leibniz, Kant, Kuhn, and Putnam. Interestingly, to my knowledge, there exists no work that discusses similarities to the phenomenological tradition. This is surprising because here one can find systematically similar ideas and even a very similar terminology. It is startling because early modern physics was noticeably influenced by phenomenological ideas. And it is unfortunate because the analysis of perspectival approaches in the phenomenological tradition can help us to achieve a more nuanced understanding of different forms of perspectivism. The main objective of this paper is to show that in the phenomenological tradition one finds a well-elaborated philosophy of science that shares important similarities with current versions of perspectivism. Engaging with the phenomenological tradition is also of systematic value since it helps us to gain a better understanding of the distinctive claims of perspectivism and to distinguish various grades of perspectivism. ‘India’s founding moment’ a moment of breath-taking political imagination and it is one of the great achievements of Madhav Khosla. to unpack important parts of its pre-history and emergence. This article will look at two questions—one about alternatives and the other about contexts. Regarding alternatives, I am interested in the paths not taken and an understanding of possibilities. I try to get a sense of possible alternative futures or modernities that the founding generation pondered, in the best case allowing us (...) to wonder what we can learn from the choices made as well as from the paths rejected. The other question I raise is the question of the intellectual contexts, in which the founding took place. Coming from a non-Indian perspective, I am interested in the entanglements, the contexts and potentially migrating ideas that emerge. (shrink)

Saskia Sassen today and Jane Adams more than 100 years ago are both social scientists and public philosophers of reconstruction. Both offer defining contributions to a philosophical tradition that will be identified here as “radical pragmatism”. Sassen’s theoretical stance “before method” serves as a key to understand Addams’s locally embedded urban activist projects as a form of social scientific inquiry. Sassen introduces the concept of “territory making” as a spark of hope against rampant and destructive global trends of “expulsions”, which (...) her approach reveals. In this article this concept of “territory making” will be explored in various contexts and with particular attention to Addams’s Hull house project. It will be shown how a pragmatist brand of human imagination is critical in “territory making”. This leads to reconsidering the role of art in social transformation projects. (shrink)

As a corollary we obtain that RC implies Semistationary Reflection and, i.e. the statement that all forcings that preserve the stationarity of subsets of ω1 are semiproper.

The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. Foundationalism and coherentism are two fundamentally opposed basic epistemological views about the structure of justification. Interestingly enough, there is no consensus on how to interpret Husserl. While interpreting Husserl as a foundationalist was the standard view in early Husserl scholarship, things have changed considerably as prominent commentators like Christian Beyer, John Drummond, Dagfinn Føllesdal, and Dan Zahavi have challenged this foundationalist interpretation. These anti-foundationalist interpretations have again been challenged, for instance, by Walter Hopp and Christian Erhard. One might suspect that (...) inconsistencies in Husserl’s writings are the simple reason for this disagreement. I shall argue, however, that the real question is not so much how to read Husserl, but how to define foundationalism and that there is overwhelming textual evidence that Husserl championed the most tenable version of foundationalism: a moderate foundationalism that allows for incorporating coherentist elements. This paper sets out to evaluate the claim that Aristotle’s Assertoric Syllogistic is a relevance logic or shows significant similarities with it. I prepare the grounds for a meaningful comparison by extracting the notion of relevance employed in the most influential work on modern relevance logic, Anderson and Belnap’s Entailment. This notion is characterized by two conditions imposed on the concept of validity: first, that some meaning content is shared between the premises and the conclusion, and second, that the premises (...) of a proof are actually used to derive the conclusion. Turning to Aristotle’s Prior Analytics, I argue that there is evidence that Aristotle’s Assertoric Syllogistic satisfies both conditions. Moreover, Aristotle at one point explicitly addresses the potential harmfulness of syllogisms with unused premises. Here, I argue that Aristotle’s analysis allows for a rejection of such syllogisms on formal grounds established in the foregoing parts of the Prior Analytics. In a final section I consider the view that Aristotle distinguished between validity on the one hand and syllogistic validity on the other. Following this line of reasoning, Aristotle’s logic might not be a relevance logic, since relevance is part of syllogistic validity and not, as modern relevance logic demands, of general validity. I argue that the reasons to reject this view are more compelling than the reasons to accept it and that we can, cautiously, uphold the result that Aristotle’s logic is a relevance logic. (shrink)

Recent interest in phenomena of simulation, pretense, and play has given rise to new philosophical debates on the basic structure of human action and action planning. Some philosophers sought to transform Hume's desire-belief-action model by sophisticating its basic structure. For example, they introduced “hypothetical world boxes” or imaginary “i-desires” and “i-beliefs” into the standard model, in order to account for the representational and motivational structures of imaginary scripts. Others used phenomena of behavior driven by imagination to attempt a more fundamental (...) critique of the Humean tradition. This article aims to show how the pragmatist tradition could be used as a resource in reframing current debates on imagination, pretense, and simulation in the cognitive sciences. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

Polysemous concepts with multiple related meanings pervade natural languages, yet some philosophers argue that we should eliminate them to avoid miscommunication and pointless debates in scientific discourse. This paper defends the legitimacy of polysemous concepts in science against this eliminativist challenge. My approach analyses such concepts as patchworks with multiple scale-dependent, technique-involving, domain-specific and property-targeting uses (patches). I demonstrate the generality of my approach by applying it to "hardness" in materials science, "homology" in evolutionary biology, "gold" in chemistry and "cortical (...) column" in neuroscience. Such patchwork concepts are legitimate if the techniques used to apply them produce reliable results, the domains to which they are applied are homogenous, and the properties they refer to are significant to describe, classify or explain the behavior of entities in the extension of the concept. By following these normative constraints, researchers can avoid miscommunication and pointless debates without having to eliminate polysemous patchwork concepts in scientific discourse. (shrink)

The aim of this paper is to establish a phenomenological mathematical intuitionism that is based on fundamental phenomenological-epistemological principles. According to this intuitionism, mathematical intuitions are sui generis mental states, namely experiences that exhibit a distinctive phenomenal character. The focus is on two questions: what does it mean to undergo a mathematical intuition and what role do mathematical intuitions play in mathematical reasoning? While I crucially draw on Husserlian principles and adopt ideas we find in phenomenologically minded mathematicians such as (...) Hermann Weyl and Kurt Gödel, the overall objective is systematic in nature: to offer a plausible approach towards mathematics. (shrink)

Motivated by results of Bagaria, Magidor and Väänänen, we study characterizations of large cardinal properties through reflection principles for classes of structures. More specifically, we aim to characterize notions from the lower end of the large cardinal hierarchy through the principle [math] introduced by Bagaria and Väänänen. Our results isolate a narrow interval in the large cardinal hierarchy that is bounded from below by total indescribability and from above by subtleness, (...) and contains all large cardinals that can be characterized through the validity of the principle [math] for all classes of structures defined by formulas in a fixed level of the Lévy hierarchy. Moreover, it turns out that no property that can be characterized through this principle can provably imply strong inaccessibility. The proofs of these results rely heavily on the notion of shrewd cardinals, introduced by Rathjen in a proof-theoretic context, and embedding characterizations of these cardinals that resembles Magidor’s classical characterization of supercompactness. In addition, we show that several important weak large cardinal properties, like weak inaccessibility, weak Mahloness or weak [math]-indescribability, can be canonically characterized through localized versions of the principle [math]. Finally, the techniques developed in the proofs of these characterizations also allow us to show that Hamkin’s weakly compact embedding property is equivalent to Lévy’s notion of weak [math]-indescribability. Can phenomenologists allow for the existence of unobservable entities such as atoms, electrons, and quarks? Can we justifiably believe in the existence of entities that are in principle unobservable? This paper addresses the relationship between Husserlian transcendental phenomenology and scientific realism. More precisely, the focus is on the question of whether there are basic epistemological principles phenomenologists are committed to that have anti-realist consequences with respect to unobservable entities. This question is relevant since Husserl’s basic epistemological principles, such as the (...) “principle of all principles,” seem to suggest that epistemic justification is limited to what can be originally given in the sense that if an object cannot be given in an originary presentive intuition, then one cannot be justified in believing that this object exists. It is the main aim of this paper to show (i) that interpretative reasons exist for not reading Husserl in such a way and (ii) that systematic reasons exist as to why phenomenologists should not subscribe to this criterion. I shall put forward a different criterion of justification that satisfies the spirit of Husserlian transcendental phenomenology and allows for justifiably believing in the existence of unobservable scientific entities. The contemporary theory of epistemic democracy often draws on the Condorcet Jury Theorem to formally justify the ‘wisdom of crowds’. But this theorem is inapplicable in its current form, since one of its premises – voter independence – is notoriously violated. This premise carries responsibility for the theorem's misleading conclusion that ‘large crowds are infallible’. We prove a more useful jury theorem: under defensible premises, ‘large crowds are fallible but better than small groups’. This theorem rehabilitates the importance of deliberation (...) and education, which appear inessential in the classical jury framework. Our theorem is related to Ladha's (1993) seminal jury theorem for interchangeable (‘indistinguishable’) voters based on de Finetti's Theorem. Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. I support this view by proposing common normative (...) principles that specify when exploratory concept formation and tool development succeed to initiate scientific change. (shrink)
