Information on the risks and benefits related to surgical procedures is essential for patients in order to obtain their informed consent. Some disciplines, such as sociolinguistics, offer insights that are helpful for patient—professional communication in both written and oral consent. Communication difficulties become more acute when patients make decisions through an informed consent document because they may sign this with a lack of understanding and information, and consequently feel deprived of their freedom to make their choice about different treatments or (...) surgery. This article discusses findings from documentary analysis using the sociolinguistic SPEAKING model, which was applied to the general and specific informed consent documents required for laparoscopic surgery of the bile duct at Torrecárdenas Hospital, Almería, Spain. The objective of this procedure was to identify flaws when information was provided, together with its readability, its voluntary basis, and patients’ consent. The results suggest potential linguistic communication difficulties, different languages being used, cultural clashes, asymmetry of communication between professionals and patients, assignment of rights on the part of patients, and overprotection of professionals and institutions. Preserving dignity during the dying process requires reviewing the roles of those involved in the treatment, care methods and decision-making. This article examines the participation and responsibility assigned to nurses regarding decision-making in the final stages of life, as laid out in the Rights to and Guarantee of Dignity for the Individual During the Process of Death Act. This text has been analysed on the levels of socio-cultural practice and discourse practice, using the critical discourse analysis methodology. El método empleado presupone un análisis dialéctico de la realidad, sustentado en una perspectiva crítica que permite interpretar y enriquecer la concepción sobre los hechos y procesos históricos. Desde una visión holística (...) del pensamiento filosófico cubano se revela la complejidad de un fenómeno multifactorial, la cubanía, como construcción cultural, a partir de la articulación de la concepción martiana y marxista de la cultura y los valores, lo que constituye un acierto del quehacer teórico - práctico marinelliano. El conocimiento de esta perspectiva enriquece los estudios sobre la obra de este intelectual y contribuye a dilucidar el devenir ideo-artístico y cultural cubano. The result of the research focuses on one of the priorities of the territorial and national scientific pole line: the need to recover the role of Cuban intellectuals during the Republic. The role of culture and Cubanism in Juan Marinello's philosophical world view is analyzed. The method used presupposes a dialectical analysis of reality, based on a critical perspective which allows to interpret and enrich the understanding of events and historical processes. From a holistic point of view of the Cuban philosophical thinking, Cubanism, a complex multifactorial phenomenon, is revealed as a cultural construction, starting from the articulation of Marti's and Marx's conception of culture and values, which is a good result of Marinello's theoretical-practical work. The knowledge of this perspective enriches the studies on the work of this intellectual and contributes to the clarification of the Cuban ideo-artistic and cultural evolution. (shrink)

When viewed as the most comprehensive theory of collections, set theory leaves no room for classes. But the vocabulary of classes, it is argued, provides us with compact and, sometimes, irreplaceable formulations of largecardinal hypotheses that are prominent in much very important and very interesting work in set theory. Fortunately, George Boolos has persuasively argued that plural quantification over the universe of all sets need not commit us to classes. Because humans cannot know one another’s minds directly, every form of communication is a solution to the same basic problem: how can privately held information be made publicly accessible through manipulations of the physical environment? Language is by far the best studied response to this challenge. But there are a diversity of non-linguistic strategies for representation with external signs as well, from facial expressions and fog horns to chronological graphs and architectural renderings. The general thesis of this dissertation is that (...) there is an impressively wide spectrum of conventional systems of representation, corresponding to the many ways that the problem of communication can be solved, and that these systems can be described and explained using the tools of contemporary mathematical semantics. As a partial corrective to the countervailing norm, this work concentrates on the class of systems arguably most different from language— those governing the interpretation of pictorial images. Such representations dominate practical communication: witness the proliferation of maps, road signs, newspaper photographs, scientific illustrations, television shows, engineering drawings, and even the fleeting imagery of manual gesture. I argue that systems of depiction and languages embody a parallel technologies of communication. Both are based on semantics: systematic and conventional mappings from signs to representational content. But I also provide evidence that these semantics are profoundly divergent. Whereas the semantics of languages are based on arbitrary associations of signs and denotations, the semantics of systems of depiction are based on rules of geometrical transformation. Drawing on recent research in computer graphics and computational vision, I go on to develop a precise theory of pictorial semantics. This in turn facilitates a detailed comparison of iconic, image-based representation, and symbolic, language-based representation. A consequence of these conclusions is that the traditional, language-centric conception of semantics must be overhauled to allow for a more general semantic theory, one which countenances the wide variety of interpretive mechanisms actually at work in human communication. We criticize attempts to define hope in terms of other psychological states and argue that hope is a primitive mental state whose nature can be illuminated by specifying key aspects of its functional profile.

This essay argues for a model of pictorial representation which aims to explain the relationship between pictorial content and pictorial accuracy. Focusing on cases where pictures are intended to convey accurate information, the model distinguishes between two fundamental representational relations: on one hand, a picture expresses a content; on the other, it aims at a target scene. Such a picture is accurate when the content it expresses fits the target scene it aims at. In addition, the model follows the traditional (...) division of content into two aspects: singular content specifies the particular individuals which a picture is of, and attributive content specifies the properties and relations which the picture ascribes to those individuals. For a picture to be accurate, both aspects must be matched in the target. I call this the Three-Part Model because it distinguishes between the triad of factors, singular content, attributive content, and target, which together determine pictorial accuracy. Though previous work on depiction has not recognized the distinctive role played by target, I will argue that it is essential in order to make sense of accuracy judgements across a range of central cases. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

Several philosophers have argued recently that semantic properties do play a causal role. 1 It is our view that none of these arguments are satisfactory. Our aim is to reveal some of the deficiencies of these arguments, and to reassess the question in our own way. In section 1, we shall explain in more detail what is involved in the pretheoretical idea of a causally efficacious property and so provide a fuller sense of the issue. In section 2 we shall (...) discuss Fodor's and Kim's arguments that the semantic properties of mental events are causally efficacious. Their tactic is to articulate sufficient conditions for the causal efficacy of a property, and then apply these conditions to the psychological properties under consideration. We shall show that both formulations are inadequate. However, each account can remedy some of the defects of the other. We shall argue that by putting the two together, and modifying this combined account in certain ways, we can arrive at something that might just pass as a general sufficient condition for causal efficacy. We believe that the question of causal efficacy of content is best approached as a question in the philosophy of science. If one wants to know whether a given species of property is efficacious, the most productive strategy is to find a science that investigates the properties and examine the role they are assigned. In keeping with this attitude we shall restrict our discussion to the notion of content deployed within cognitive science. In section 3 we examine the role of content in cognitive science and discuss whether this role suits content to the conditions on efficacy articulated in section two. Our conclusion will be conditional and hedged: on certain views of cognitive science, content will meet the sufficient condition for efficacy. If other views are correct, the question remains open. The paper is concerned with the bad company problem as an instance of a more general difficulty in the philosophy of mathematics. The paper focuses on the prospects of stability as a necessary condition on acceptability. However, the conclusion of the paper is largely negative. As a solution to the bad company problem, stability would undermine the prospects of a neo-Fregean foundation for set theory, and, as a solution to the more general difficulty, it would impose an unreasonable constraint on (...) mathematical practice. We give examples of calculi that extend Gentzen’s sequent calculusLKby unsound quantifier inferences in such a way that derivations lead only to true sequents, and proofs therein are nonelementarily shorter thanLK-proofs.

We shall introduce in this paper a language whose formulas will be interpreted by games of imperfect information. Such games will be defined in the same way as the games for first-order formulas except that the players do not have complete information of the earlier course of the game. Some simple logical properties of these games will be stated together with the relation of such games of imperfect information to higher-order logic. Finally, a set of applications will be outlined.

To make the case for non-conceptualism, Heck draws on an apparent dichotomy between linguistic and iconic representations. According to Heck, whereas linguistic representations have conceptual content, the content of iconic representations is non-conceptual. Based on the case of cartographic systems, the authors criticize Heck’s dichotomous distinction. They argue that maps are composed of semantically arbitrary elements that play different syntactic roles. Based on this, they claim that maps have a predicative structure and convey conceptual content. Finally, the authors argue that, (...) despite their differences, maps and sentences can logically interact with each other through heterogeneous inferences. These considerations not only challenge the view that conceptual content and inferential processes necessarily involve linguistic representations; furthermore, they provide a new perspective for thinking about maps, their semantics and syntax, and their interaction with linguistic systems. The advent of prenatal genetic diagnosis has sparked debates among ethicists and philosophers regarding parental responsibility towards potential offspring. Some have attempted to place moral obligations on parents to not bring about children with certain diseases in order to prevent harm to such children. There has been no rigorous evaluation of cystic fibrosis in this context. This paper will demonstrate cystic fibrosis to have unique properties that make it difficult to categorise among other diseases with the goal of promulgating a (...) reproductive rule. Once this is established, it will be demonstrated that procreative rules that appeal to future health are inadequate in the era of advancing genetic knowledge. Utilising a specification of Joel Feinberg's ‘open future’ concept outlined by Matteo Mameli, it will offer an analysis of parental obligation that does not constrain parents of potential children with cystic fibrosis with a moral obligation not to bring them about. This paper appeals to the phenomenon of dreaming to provide a novel defense against arguments from evil. The thrust of the argument is as follows: when we wake up after a nightmare we are often filled entirely with relief, and do not consider ourselves to have actually suffered very much at all; and since it is epistemically possible that this whole life is simply a dream, it follows that it is epistemically possible that in reality there is very little suffering. The article proposes to analyse whether the current configuration of national migration legislation from Arendt's perspective on the universalization of human rights and Agamben's reflections on bare life and the state of exception demonstrates its capacity to protect the human rights of people undergoing forced migration. To this end, a literature review of a bibliographical nature was used, using the historical procedure method. In order to interpret the effectiveness of the current configuration of the human rights of this vulnerable group, (...) an analysis of international and national legislation on migration was carried out, focusing mainly on the case of the New Brazilian Migration Law. To this end, a theoretical discussion was built to understand how human rights are framed considering the situation of migration and statelessness in the face of an increasingly prevalent state of exception. It was noted that the constitutive fragility of forced migrants is a perennial situation, aggravated by the political inaction of nation states. It has also been noted that there is a need for states and international organizations to adopt new practices to promote the human dignity of forced migrants. (shrink)

Since Tolman’s paper in 1948, psychologists and neuroscientists have argued that cartographic representations play an important role in cognition. These empirical findings align with some theoretical works developed by philosophers who promote a pluralist view of representational vehicles, stating that cognitive processes involve representations with different formats. However, the inferential relations between maps and representations with different formats have not been sufficiently explored. Thus, this paper is focused on the inferential relations between cartographic and linguistic representations. To that effect, we (...) appeal to heterogeneous inference with ordinary maps and sentences. In doing so, we aim to build a model to bridge the gap between cartographic and linguistic thought. It is often assumed that the capability to make inferences requires language. Against this assumption, I claim that inferential abilities do not necessarily require a language. On the contrary, certain cartographic systems could be used to explain some forms of inferences, and they are capable of warranting rational relations between contents they represent. By arguing that certain maps, as well as sentences, are adequate for inferential processes, I do not mean to neglect that there are important differences between maps and (...) sentences. Instead, the purpose of this paper is to highlight interesting distinctions that might affect the way that cartographic thinking works. (shrink)

The topic of this paper is the semantic structure of belief reports of the form 'a believes that p'. it is argued that no existing theory of these sentences satisfactorily accounts for anaphoric relations linking expressions within the embedded complement sentence to expressions outside. a new account of belief reports is proposed which assigns to embedded expressions their normal semantic values but which also exploits frege's idea of using senses to explain the apparent failures of extensionality in the reports.

Corruption poisons corporations in America and around the world, and has devastating consequences for the entire social fabric. In this article, we focus on organizational corruption, described as the abuse of authority for personal benefit, and draw on Weber’s three ideal-types of legitimate authority to develop a theoretical model to better understand the antecedents of different types of organizational corruption. Specifically, we examine the types of business misconduct that organizational leaders are likely to engage in, contingent on their legitimate authority, (...) motives, and justifications. We conclude by suggesting managerial implications of our theoretical model and propose directions for future research. (shrink)

We analyze the geometric foundations of classical Yang-Mills theory by studying the relationships between internal relativity, locality, global/local invariance, and background independence. We argue that internal relativity and background independence are the two independent defining principles of Yang-Mills theory. We show that local gauge invariance -heuristically implemented by means of the gauge argument- is a direct consequence of internal relativity. Finally, we analyze the conceptual meaning of BRST symmetry in terms of the invariance of the gauge fixed theory under general (...) local gauge transformations. (shrink)

Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. We prove a number of results on the determinacy of σ-projective sets of reals, i.e., those belonging to the smallest pointclass containing the open sets and closed under complements, countable unions, and projections. We first prove the equivalence between σ-projective determinacy and the determinacy of certain classes of games of variable length <ω^2 (Theorem 2.4). We then give an elementary proof of the determinacy of σ-projective sets from optimal large-cardinal hypotheses (Theorem 4.4). Finally, we show how to generalize the proof (...) to obtain proofs of the determinacy of σ-projective games of a given countable length and of games with payoff in the smallest σ-algebra containing the projective sets, from corresponding assumptions (Theorem 5.1, Theorem 5.4). Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

No presente artigo analisarei as três principais objeções comumente empregadas para rejeitar o uso de violência em defesa de animais não-humanos. Existe a ideia de que a violência é inerentemente errada e sempre deveria ser repudiada – eu chamo isso de ‘Objeção do Pacifista Absoluto’. Há também a perspectiva de que a utilização de violência por ativistas interespécies acaba alienando o grande público do movimento pelos direitos dos animais não-humanos como um todo – eu me refiro a esse argumento como (...) ‘Objeção da Hostilidade Pública’. Por último, encontra-se na literatura dos estudos interespécies o argumento de que lançar mão de violência pró-não-humanos é contraproducente, pois táticas violentas seriam responsáveis pela criação de leis que protegem aqueles que exploram os animais não-humanos e criminalizam as ações de ativistas interespécies – essa é a ‘Objeção do Impacto Contraproducente Visível’. Após apresentar cada uma dessas objeções explicarei por que nenhuma delas é capaz de oferecer um argumento definitivo contra o uso de estratégias violentas em favor dos membros de outras espécies animais sencientes. We propose a conceptual framework for understanding the relationship between observables and operators in mechanics. To do so, we introduce a postulate that establishes a correspondence between the objective properties permitting to identify physical states and the symmetry transformations that modify their gauge dependant properties. We show that the uncertainty principle results from a faithful—or equivariant—realization of this correspondence. It is a consequence of the proposed postulate that the quantum notion of objective physical states is not incomplete, but rather that (...) the classical notion is overdetermined. (shrink)

Given a structure [math] and a stably embedded [math]-definable set [math], we prove tameness preservation results when enriching the induced structure on [math] by some further structure [math]. In particular, we show that if [math] and [math] are stable (respectively, superstable, [math]-stable), then so is the theory [math] of the enrichment of [math] by [math]. Assuming simplicity of [math], elimination of hyperimaginaries and a further condition on [math] related to the behavior of algebraic (...) closure, we also show that simplicity and NSOP1 pass from [math] to [math]. We then prove several applications for tame expansions of weakly minimal structures and, in particular, the group of integers. For example, we construct the first known examples of strictly stable expansions of [math]. More generally, we show that any stable (respectively, superstable, simple, NIP, NTP2, NSOP1) countable graph can be defined in a stable (respectively, superstable, simple, NIP, NTP2, NSOP1) expansion of [math] by some unary predicate [math]. We show from an abstract comparison principle that the Mitchell order is linear on sufficiently strong ultrafilters: normal ultrafilters, Dodd solid ultrafilters, and assuming GCH, generalized normal ultrafilters. This gives a conditional answer to the well-known question of whether a [Formula: see text]-supercompact cardinal [Formula: see text] must carry more than one normal measure of order 0. Conditioned on a very plausible iteration hypothesis, the answer is no, since the Ultrapower Axiom holds in the canonical inner models at the finite (...) levels of supercompactness. (shrink)

We estimate the expressive power of various partially ordered connectives and use methods like Ehrenfeucht games and infinitary logic to get various undefinability results.

Right after the presentation of Hyginus’s fable in §42 of Being and Time comes a note in which Heidegger affirms that the orientation about care as the being of Dasein (§41) arose in the context of the interpretation of Augustinian anthropology and the foundations obtained by the analysis of Aristotelian ontology. Why such a mention and why is it placed precisely after proving the pre-ontological origin of care as the being of Dasein? Assuming such problem, this paper does not aim (...) only at offering a reading key that justifies such note, but at presenting the importance of the factical and pre-ontological aspects presented, respectively, in Book X of The Confessions of Augustine and in the fable of Hyginus for Heidegger's elaboration of care as an ontological category. For this purpose, three lecture courses will be assumed, especially: Augustine and Neo-Platonism (1921), which will make it possible to perceive the always factical aspect of care, thus evidencing the historical enactment perspective of the hermeneutics of facticity; Phenomenological Interpretations of Aristotle (1921/1922), which will make it possible to understand the idea of “ontological category” as a first formulation of what, in Being and Time, will be the existentials; and History of the concept of time: prolegomena (1925), which will allow us to realize that care is about being and not having, therefore, that it is not a possession of Dasein, but a condition of its existence. Finally, after justifying the importance of different aspects for care as an ontological category, it will be understood why the ontological interpretation differs from both others. (shrink)

The absence of grammatical subject and object in Parmenides' "it is/it is not" allows the reading of the verbal forms not as copulas but as names, with no implicit subject nor elided predicate. Once there are two only alternatives, contrary and excluding each other, sustaining that a 'no-name' does not grant knowledge implies identifying its opposite – "it is" – as the only name conducive to knowledge in itself, denouncing the 'inconceivability of a knowledge that does not know. If "it (...) is" is the only [name] "which can be thought/known", and "what is" is the way in which 'thought/knowledge' can be accomplished, there is no need to postulate the existence of 'anything' that is, nor of anything that can be said of "what is". Being the only name which "can be thought of/known", the unifying synthesis of "knowledge, knowing and known" in one infallible cognitive state, it is unthinkable that "what is" does not exist.
