Este artículo identifica los principales antecedentes legislativos y jurisprudenciales de la evidencia digital en Colombia, con miras a detallar su tratamiento en el proceso judicial; así mismo, pretende evidenciar cómo opera la cláusula de exclusión, y de qué manera se protege el derecho a la intimidad, en la obtención de evidencia digital, desde distintos medios de almacenamiento. La metodología es cualitativa y se utilizó la técnica de la revisión documental y la entrevista a expertos, para mostrar una realidad respecto a (...) una problemática de valoración de las pruebas tecnológicas, en los casos de ilicitud, y brindar aportes para mejorar la comprensión y la dimensión de su práctica en el proceso judicial. La principal conclusión es que no se le puede negar eficacia y validez probatoria por estar en forma de bytes, siempre y cuando se pueda establecer la autenticidad del contenido y la correspondencia con el autor. This paper presents a critical reflection on insights into the ongoing endeavours for community engagement by Ayara and MAL; two urban grassroot organisations in Bogota, Colombia, where a long history of internal conflicts has resulted in diverse human right violations. The paper presents examples of the grassroots organisations’ unique methods of engagement that promotes building collective intelligence from the bottom–up through creative collaboration and design processes, leading to rebuilding social fabrics that support the common good for the people of Bogota.

En este artículo se pretende, a partir de la lectura de los textos literarios de Gabriel García Márquez, reconocer los elementos poéticos que se encuentran presentes de una manera peculiar y hondamente bella en su obra: la extrañeza, el pensamiento poético, la intensidad de sus imágenes, la exploración profunda de la vida, que son condiciones inherentes a la poesía, y que no solo están presentes en los distintos textos de múltiples escritores del realismo mágico Latinoamericano en general, sino de una (...) manera particular y “maravillosa” en los relatos de García Márquez. Tal vez por ello sean tan inolvidables en la memoria del cuerpo y de la inteligencia de sus lectores. (shrink)

El presente artículo pretende hacer una presentación de la filosofía de Peirce definida por él como idealismo objetivo, la puerta de entrada a esta definición de su filosofía está inscrita en la comprensión y funcionamiento de las tres categorías configuradoras de la realidad se hará un exposición de las tres categorías, haciendo un énfasis especial en la de terceridad, punto de quiebre de la definición del idealismo objetivo como un realismo escolástico.

How are biases encoded in our representations of social categories? Philosophical and empirical discussions of implicit bias overwhelmingly focus on salient or statistical associations between target features and representations of social categories. These are the sorts of associations probed by the Implicit Association Test and various priming tasks. In this paper, we argue that these discussions systematically overlook an alternative way in which biases are encoded, that is, in the dependency networks that are part of our representations of social categories. (...) Dependency networks encode information about how features in a conceptual representation depend on each other. This information determines the degree of centrality of a feature for a conceptual representation. Importantly, centrally encoded biases systematically disassociate from those encoded in salient-statistical associations. Furthermore, the degree of centrality of a feature determines its cross-contextual stability: in general, the more central a feature is for a concept, the more likely it is to survive into a wide array of cognitive tasks involving that concept. Accordingly, implicit biases that are encoded in the central features of concepts are predicted to be more resilient across different tasks and contexts. As a result, the distinction between centrally encoded and salient-statistical biases has important theoretical and practical implications. (shrink)

We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. The meaning that expressions take on particular occasions often depends on the context in ways which seem to transcend its direct effect on context-sensitive parameters. ‘Truth-conditional pragmatics’ is the project of trying to model such semantic flexibility within a compositional truth-conditional framework. Most proposals proceed by radically ‘freeing up’ the compositional operations of language. I argue, however, that the resulting theories are too unconstrained, and predict flexibility in cases where it is not observed. These accounts fall into this position because (...) they rarely, if ever, take advantage of the rich information made available by lexical items. I hold, instead, that lexical items encode both extension and non-extension determining information. Under certain conditions, the non-extension determining information of an expression e can enter into the compositional processes that determine the meaning of more complex expressions which contain e. This paper presents and motivates a set of type-driven compositional operations that can access non-extension determining information and introduce bits of it into the meaning of complex expressions. The resulting multidimensional semantics has the tools to deal with key cases of semantic flexibility in appropriately constrained ways, making it a promising framework to pursue the project of truth-conditional pragmatics. This hypothesis, called the `logicality of language', accounts for many acceptability patterns, including systematic restrictions on the distribution of quantifiers. To deal with apparent counter-examples consisting of acceptable tautologies and contradictions, the logicality of language is often paired (...) with an additional assumption according to which logical forms are radically underspecified: i.e., the language system can see functional terms but is `blind' to open class terms to the extent that different tokens of the same term are treated as if independent. This conception of logical form has profound implications: it suggests an extreme version of the modularity of language, and can only be paired with non-classical---indeed quite exotic---kinds of deductive systems. The aim of this paper is to show that we can pair the logicality of language with a different and ultimately more traditional account of logical form. This framework accounts for the basic acceptability patterns which motivated the logicality of language, can explain why some tautologies and contradictions are acceptable, and makes better predictions in key cases. As a result, we can pursue versions of the logicality of language in frameworks compatible with the view that the language system is not radically modular vis-a-vis its open class terms and employs a deductive system that is basically classical. The logicality of language is the hypothesis that the language system has access to a ‘natural’ logic that can identify and filter out as unacceptable expressions that have trivial meanings—that is, that are true/false in all possible worlds or situations in which they are defined. This hypothesis helps explain otherwise puzzling patterns concerning the distribution of various functional terms and phrases. Despite its promise, logicality vastly over-generates unacceptability assignments. Most solutions to this problem rest on specific stipulations about the properties (...) of logical form—roughly, the level of linguistic representation which feeds into the interpretation procedures—and have substantial implications for traditional philosophical disputes about the nature of language. Specifically, contextualism and semantic minimalism, construed as competing hypotheses about the nature and degree of context-sensitivity at the level of logical form, suggest different approaches to the over-generation problem. In this paper, I explore the implications of pairing logicality with various forms of contextualism and semantic minimalism. I argue that to adequately solve the over-generation problem, logicality should be implemented in a constrained contextualist framework. (shrink)

Frege's semantics of sense and reference and two husserlian alternatives are discussed. it is shown that husserl neither took his semantics of sense and reference from frege nor abandoned psychologism under his influence. frege's arguments on behalf of his choice of truth values as the reference of statements and of concepts as the reference of conceptual words are submitted to criticism. some algebraic considerations are sketched in the last part of the article.

Este trabajo pretende preguntarse si, a pesar del “silencio” de Heidegger ante la teoría de los géneros poéticos de Hölderlin, no es esta misma teoría, y especialmente el poema lírico que caracteriza a la modernidad, la cuestión en la cual se apoya Heidegger para fundamentar su “historia del ser”, de modo que la noción fuerte de _historia _que se maneja en su obra y finalmente el término marcado _das Ereignis _estaría en sintonía con los “trayectos poéticos” que Hölderlin teoriza.

The goal of this study was to introduce a model explaining how managers' attitudes, subjective norms, attributions, and the individualism-collectivism cultural dimension affect the way managers' deal with employee bribery in organizations. Twenty-six internal and external attributions related to bribery were identified through a series of structured interviews with 65 subject matter experts. These attributions, together with the other variables in the model, were evaluated by 354 Ecuadorian managers. Hierarchical regression analyses indicated that attitudes and external attributions significantly predicted managers' (...) intentions to discipline employees who accepted a bribe. In addition, external attributions mediated the relationship between individualism-collectivism and intent to discipline corrupt employees. Implications for the management of bribery in Latin American organizations are discussed. (shrink)

Mathematical chemistry is often thought to be a 20th-century subdiscipline of chemistry, but in this paper we discuss several early chemical ideas and some landmarks of chemistry as instances of the mathematical way of thinking; many of them before 1900. By the mathematical way of thinking, we follow Weyl's description of it in terms of functional thinking, i.e. setting up variables, symbolizing them, and seeking for functions relating them. The cases we discuss are Plato's triangles, Geoffroy's affinity table, Lavoisier's classification (...) of substances and their relationships, Mendeleev's periodic table, Cayley's enumeration of alkanes, Sylvester's association of algebra and chemistry, and Wiener's relationship between molecular structure and boiling points. These examples show that mathematical chemistry has much more than a century of history. (shrink)

This book presents a new explanation of the rise, development and demise of social movements and cycles of protest in autocracies; the conditions under which protest becomes rebellion; and the impact of protest and rebellion on democratization. Focusing on poor indigenous villages in Mexico's authoritarian regime, the book shows that the spread of US Protestant missionaries and the competition for indigenous souls motivated the Catholic Church to become a major promoter of indigenous movements for land redistribution and indigenous rights. The (...) book explains why the outbreak of local rebellions, the transformation of indigenous claims for land into demands for ethnic autonomy and self-determination, and the threat of a generalized social uprising motivated national elites to democratize. Drawing on an original dataset of indigenous collective action and on extensive fieldwork, the empirical analysis of the book combines quantitative evidence with case studies and life histories. The classification of ageing as a disease is fundamental to developing new pharmacological strategies that can target said phenomenon. The European Medicines Agency does not do this and maintains a questionable perspective based on the traditional naturalistic argument and the value-free ideal. An alternative is proposed which, inspired by consequentialism, is committed to considering ageing as a disease in European regulatory contexts as long as the ethical consequences are desirable. Within a realistic framework, I show that making this decision would (...) have moderate positive effects such as increased knowledge about antiageing pharmacology or potential greater chances of completing vital projects. Furthermore, we will see that the main arguments used by critics to show that the negative effects outweigh the positive ones are not sound. Therefore, I conclude that it would be beneficial for the European Medicines Agency to change its position on ageing. (shrink)

According to Kratzer’s influential account of epistemic must and might, these operators involve quantification over domains of possibilities determined by a modal base and an ordering source. Recently, this account has been challenged by invoking contexts of ‘epistemic tension’: i.e., cases in which an assertion that must\ is conjoined with the possibility that \, and cases in which speakers try to downplay a previous assertion that must\, after finding out that \. Epistemic tensions have been invoked from two directions. Von (...) Fintel and Gillies :351–383, 2010) propose a return to a simpler modal logic-inspired account: must and might still involve universal and existential quantification, but the domains of possibilities are determined solely by realistic modal bases. In contrast, Lassiter :117–163, 2016), following Swanson, proposes a more revisionary account which treats must and might as probabilistic operators. In this paper, we present a series of experiments to obtain reliable data on the degree of acceptability of various contexts of epistemic tension. Our experiments include novel variations that, we argue, are required to make progress in this debate. We show that restricted quantificational accounts à la Kratzer fit the overall pattern of results better than either of their recent competitors. In addition, our results help us identify the key components of restricted quantificational accounts, and on that basis propose some refinements and general constraints that should be satisfied by any account of the modal auxiliaries. : In this paper I will examine two conceptions of philosophy that were defended in Latin America during the last century. I believe that both models have to be put away and that we must build a new one, recovering elements of both of them. At the end of my paper I will consider very briefly what can we learn from this in order to construct a genuine philosophical dialogue between the United States and Latin America.

En el presente trabajo de homenaje al Profesor Julio De Zan, me concentro en su crítica al realismo moral. En su libro, La ética, los derechos y la justicia, Julio De Zan niega que existan en el ámbito moral propiedades naturales o metafísicas. Para comprender su crítica, propongo una reconstrucción conceptual de los presupuestos filosóficos que existen para su rechazo del realismo moral. Con este propósito, mi propuesta de reconstrucción conceptual consiste en complementar la ética del discurso defendida por Julio (...) De Zan, relacionando su propuesta con dos complementos filosóficos: por un lado, con el rechazo hacia el realismo moral realizado por Ronald Dworkin en su libro Justicia para erizos; por otro lado, con el rechazo hacia el realismo moral dirigido por Christine Korsgaard en su libro Las Fuentes de la Normatividad. Aunque los tres filósofos mantienen diferencias relevantes, mantienen también un rechazo al realismo moral basado en ciertos parecidos de familia. (shrink)

The author discusses the rational argumentation of the values from a proposal defended by the legal philosopher Robert Alexy. The paper shows that discourse for Alexy is essentially a regulated activity. A model of certain rules ensure the rationality and correctness of practical discourse oriented towards resolving conflicts of value. Firstly, the types of rules responsible for the rationality of practical argumentation are described. Secondly, some open problems relating to the claim to correctness of reasoned practical discourse are posed, namely (...) problems derived from the idea of consensus and that of a single correct answer to certain practical issues that include conflicts of values and raise basic disagreements. El artículo ofrece una propuesta de reconstrucción del “orden de las razones” del pensamiento ético de Kant y pretende con ello contribuir a las discusiones sobre su arquitectura interna y sobre el lugar que ocupa en el conjunto de la reflexión moral moderna. En particular, el artículo discute el extendido hábito de situar la exigencia de universalidad como primer principio de la ética kantiana, y trata de mostrar que dicha exigencia no es lo primero en el orden efectivo de las (...) razones. Dicho orden –esta es la tesis que el artículo defiende– comienza antes y en un estrato más originario, y ello repercute directamente en el sentido y el lugar que deben atribuirse al proyecto de una “ética autónoma”. Por ese motivo, en la última parte del trabajo se discuten, a partir de la perspectiva alcanzada, algunas interpretaciones importantes y ya clásicas (Tugendhat, Prauss) acerca del sentido y el lugar que corresponden a tal proyecto dentro de la época moderna. El propósito es explicar cómo la crisis de la institución familiar lleva implícita una crisis en el sujeto humano, que desde la auto­nomía y la libertad se proponía como proyecto de vida conformar una familia. El modelo de análisis está centrado en esa configu­ración de las nuevas formas de familia, mediadas por el influjo de las tecnologías, especialmente, las fotografías digitales o las selfies como formas de expresión cotidiana donde ya no está presente la narración ni la historia, aunque sí (...) está la imagen. La metodología de investigación utilizada en este análisis es la hermenéutica feno­menológica a partir de manifestaciones relacionales mediadas por un generador de significado como es la selfie que se pone presente en este espacio conjunto de realidad y virtualidad. La tarea desde la educación es ser propositivos construyendo con los jóvenes nuevos sentidos de esperanza para que esas nuevas formas de familia sean espacios de amor. (shrink)

Despite recognizing the importance of impact investing in combating complex societal challenges, researchers have yet to examine the capacity of the field to address systemic inequality. While impact investments are intended to benefit vulnerable stakeholders, the voices of those stakeholders are generally overlooked in the design and implementation of such investments. To resolve this oversight, we theorize how the fields’ design—through its tools, organizations, and field-level bodies—influences its capacity to address inequality by focusing on the concept of giving voice, which (...) we define as the inclusive participation of vulnerable stakeholders in decision-making processes. We build from stakeholder engagement research to show how the design of impact investing can address inequality using three illustrative cases: social impact bonds, impact investing funds, and national advisory boards. We conclude with a discussion of how the ethical decision of giving voice to vulnerable stakeholders will determine the capacity of the field to address inequality, as well as provide implications for future research and practice. Este artículo tiene el objetivo de delimitar el componente epistemológico en la indagación reflexiva de las teorías procedimentales de la justicia, específicamente, describiendo el modo en el que se exacerban en un modus operandi que se denomina como cartesianismo político, es decir, como la búsqueda cognitiva de ideas claras y distintas que normativizan la administración de la vida; posteriormente, se propondrá, en antagonismo al cartesianismo político, la posibilidad de regular la indagación en torno a los procedimientos para lograr una estructura (...) básica de justicia social a partir del principio de interlocución lógica, como garantía del primer principio de una teoría procedimental de la justicia: la imparcialidad. En esta dirección, se expondrá el carácter cultural y epistémico de la imparcialidad, tratando de relaborar un marco de comprensión que, en vez de prescindir de las mentalidades culturales, las incluya como elemento dinamizador de la interacción en los procedimientos de elección de estructuras básicas de justicia. When people join him to help him search, they ask where it was that he thinks he might have let them fall; with a frustrated look on his face, he then points into the dark distance and says, by way of explanation, “I am looking under the lamppost because this is where the light is!” This story, introduced (...) by Janice Ross, provides us with a metaphorical description of an ongoing situation in arts education advocacy1: Certainly, I can only look for the arts in education where there is something about them that can be seen. This paper argues, contrary to Fodor’s well-known position, that the iconic and discursive modes of representation are not mutually exclusive categories. It is argued that there exists at least a third kind of representation which blends the semantic properties of icons and the syntactic properties of discourses. We reason that this iconic-discursive genus behaves differently from other representational formats, such as distributed representations or maps, previously put forward as challenging Fodor’s basic distinction. A reflection follows about how this kind of (...) representation impacts on the Fodorian issues for which the original dual distinction was argumentatively instrumental, namely, the kinds of codes and possible inter-code relations accessible to the representational mind. The suggestion is put forward that iconic-discursive representations may facilitate trade-offs between the world and the representational mind, as well as between the differently complex levels of representation that mediate between percepts and concepts. We conclude that such aspects of the computational mind, which until now appeared to be stubbornly resistant with respect to a conciliation of Hume’s empiricism and Fodor’s computationalism, may be more easily accessed and understood taking advantage of the biosemiotics perspective and acknowledging the richness of the biosemiotics codes accessible to cognition.
