La oposición a una estricta separación entre las dimensiones dialéctica y retórica de la actividad argumentativa es una de las aportaciones más destacadas y peculiares de la denominada escuela holandesa sobre argumentación. Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). Sobre este tema siguieron investigando para presentar un análisis de la perspectiva dialéctica inherente al caso de Guillermo I de Orange en un congreso de la Japan Debate Association en Tokio (van Eemeren y Houtlosser, 2000). Agustín Serrano de Haro edita y presenta en el volumen colectivo Cuerpo vivido una selección de textos memorables en torno a lo que en 1925 fue denominado programáticamente por Ortega y Gasset una “topografía de nuestra intimidad”. La reflexión fenomenológica acerca del intracuerpo fue un tema que ha preocupado y preocupa de manera notoria a los filósofos cuyos trabajos reúne este colectivo: Ortega y Gasset, José Gaos, Joaquín Xirau, Leopoldo-Eulogio Palacios y Agustín Serrano de Haro. Pese a ello, tal (...) vez no sea tan conocido de todos nosotros el hecho de que las investigaciones filosóficas acerca del cuerpo humano (siempre sentido por uno mismo y reconocido por otros de modo intransferible) resultaron ser contribuciones pioneras y anticipaciones preclaras del tema actual del cuerpo y la corporalidad. The purpose of this paper is to introduce everyday aesthetics in education. First, it presents everyday aesthetics as a subdiscipline within philosophical aesthetics, that revisits sensory perception as the backdrop of all experience, claims ordinary life is a proper venue for aesthetic inquiry, and problematizes the impact aesthetic preferences have on habitual decisions. Second, the paper argues that among the diverse matters students learn in school, they learn—explicitly or implicitly—what and how to perceive, as well as the pedagogical purposes of (...) daily perception. School models the relationships that students will develop between what they perceive, what they think about it, and how they act accordingly. Next, the paper elaborates on the notions of “school aesthetic matrixes” and “space and place in school”. School aesthetic matrixes refer to perceptual patterns that allow characterizing relationships between daily perception and the pedagogical project of a school. They manifest through expressions such as prison school, home school, mall school, etc. Space and place in school allude to concomitant experiences, of corporeal basis, that allow describing how we inhabit the world. What distinguishes them is the approach each one gives to the senses and the body. The paper concludes by calling attention to the comprehension and role of perception in education, urging to mind the aesthetic-pedagogical character that students develop throughout 12 years of schooling. Ultimately, the key relationships we develop with ourselves, others, and the world, entail a basic perceptual dimension that can be educated to become more purposefully and integrally present in life. The field of Philosophy and Education seems to be experiencing a renewed interest in the work of Aristotle. As recently reviewed by Curren (Oxf Rev Educ 36(5):543–559, 2010), most of this attention aligns with the virtue ethics movement where themes like moral development in education, and the inquiry on human flourishing as the aim of education are prevalent. For sources, this scholarship relies heavily and extensively on the Nicomachean Ethics and Politics’ Book VIII where Aristotle develops his single, clearly defined (...) account of education. Among the short list of scholars who include Poetics in their research, their work seems to return to issues of morality and education (Carr in J Aesthet Educ 44(3):1–15, 2010; Gupta in J Aesthet Educ 44(4):60–80, 2010). This paper is an attempt to rediscover Aristotle’s insights on the peculiar type of learning that the arts seem to favor. In order to carry on this investigation, I will first guide my argument towards Aristotle’s remarks on poiesis. Then, I will focus on what constitutes the heart of poiesis, that is, mimesis. I will pay special attention to Aristotle’s consideration of both poiesis and mimesis as ultimately dealing with what he calls “possibility.” I will argue that learning in the arts entails the coming together of these three qualities. This would be a way of learning characterized by seeing human likenesses emerge as such in our interactions with artworks. (shrink)

This Element offers an overview of some of the most important debates in philosophy and physics around the topics of emergence and reduction and proposes a compatibilist view of emergence and reduction. In particular, it suggests that specific notions of emergence, which the author calls 'few-many emergence' and 'coarse-grained emergence', are compatible with 'intertheoretic reduction'. Some further issues that will be addressed concern the comparison between parts-whole emergence and few-many emergence, the emergence of effective theories, the use of infinite limits, (...) the notion of intertheoretic reduction and the explanation of universal and cooperative behavior. Although the focus will be principally on classical phase transitions and other examples from condensed matter physics, the main aim is to draw some general conclusions on the topics of emergence and reduction that can help us understand a variety of case-studies ranging from high-energy physics to astrophysics. When people join him to help him search, they ask where it was that he thinks he might have let them fall; with a frustrated look on his face, he then points into the dark distance and says, by way of explanation, “I am looking under the lamppost because this is where the light is!” This story, introduced (...) by Janice Ross, provides us with a metaphorical description of an ongoing situation in arts education advocacy1: Certainly, I can only look for the arts in education where there is something about them that can be seen. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. I analyze the extent to which classical phase transitions, both first order and continuous, pose a challenge for intertheoretic reduction. My contention is that phase transitions are compatible with a notion of reduction that combines Nagelian reduction and what Thomas Nickles called Reduction2. I also argue that, even if the same approach to reduction applies to both types of phase transitions, there is a crucial difference in their physical treatment: in addition to the thermodynamic limit, in continuous phase transitions there (...) is a second infinite limit involved, which marks an important difference in the reduction of first-order and continuous phase transitions. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

This paper examines whether there are moral differences between the mitochondrial replacement techniques that have been recently developed in order to help women afflicted by mitochondrial DNA diseases to have genetically related children absent such conditions: maternal spindle transfer and pronuclear transfer. Firstly, it examines whether there is a moral difference between MST and PNT in terms of the divide between somatic interventions and germline interventions. Secondly, it considers whether PNT and MST are morally distinct under a therapy/creation optic. Finally, (...) it investigates whether there is a moral difference between MST and PNT from a human embryo destruction point of view. I conclude, contra recent arguments, that regarding the first two points there is no moral differences between PNT and MST; and that regarding the third one MST is morally preferable to PNT, but only if we hold a gradualist account of the moral value of human embryos where zygotes have slight moral value. Several objections against the morality of researching or employing mitochondrial replacement techniques have been advanced recently. In this paper, I examine three of these objections and show that they are found wanting. First I examine whether mitochondrial replacement techniques, research and clinical practice, should not be carried out because of possible harms to egg donors. Next I assess whether mitochondrial replacement techniques should be banned because they could affect the study of genealogical ancestry. Finally, I examine the claim that mitochondrial (...) replacement techniques are not transferring mitochondrial DNA but nuclear DNA, and that this should be prohibited on ethical grounds. (shrink)

Some Comments on de Melo-Martin and Harris.

It has been commonplace to equate Foucault’s 1979 series of lectures at the Collège de France with the claim that for neoliberalism, unlike for classical liberalism, the market needs to be artificially constructed. The article expands this claim to its full expression, taking it beyond what otherwise would be a simple divulgation of a basic neoliberal tenet. It zeroes in on Foucault’s own insight: that neoliberal constructivism is not directed at the market as such, but, in principle, at society, arguing (...) that the value of this insight goes beyond the critique of a neoliberal present. The neoliberal rationale rather helps him to reveal a unique historical architecture, a latent approach to the social dissimilar to the one that has long predominated in the human sciences. The inversion of homo œconomicus in neoliberal theory amounted to the unearthing of a ‘social subject of interest’ within civil society. Such a subject, barely recognized by neoliberals who simply instrumentalize it for the sake of the market, demonstrates that the social is not necessarily the natural product of ethical subjects; that society may also need to be constructed. According to robust versions of virtue epistemology, the reason why knowledge is incompatible with certain kinds of luck is that justified true beliefs must be achieved by the agent . In a recent set of papers, Pritchard has challenged these sorts of views, advancing different arguments against them. I confront one of them here, which is constructed upon scenarios affected by environmental luck, such as the fake barn cases. My objection to Pritchard differs from those offered until now by Carter (...) , Jarvis or Littlejohn in that it is based on the claim that cognitive performances may not be properly considered as achievements beyond the scope of the agent’s intentional action—an idea that confers more explanatory power on my argument, and contributes to stregthening links between knowledge and agency. Children created through mitochondrial replacement techniques (MRTs) are commonly presented as possessing 50% of their mother’s nuclear DNA, 50% of their father’s nuclear DNA and the mitochondrial DNA of an egg donor. This lab-engineered genetic composition has prompted two questions: Do children who are the product of an MRT procedure have threegeneticparents? And, do MRT egg donors have parental responsibilities for the children created? In this paper, I address the second question and in doing so I also address the first (...) one. First, I present a brief account of mitochondrial diseases and MRTs. Second, I examine how MRTs affect the numerical identity of eggs and zygotes. Third, I investigate two genetic accounts of parenthood and MRT egg donation. Fourth, I explore three causal accounts of parenthood and MRT egg donation. My conclusion is that, under the appropriate circumstances, MRT egg donors are parentally responsible for the children created under genetic accounts of parenthood and under causal accounts of parenthood. This paper advances new theses about the relationship between luck and risk, using recent work by Duncan Pritchard (2014, 2015, 2016) as its foil. Once Pritchard’s views are introduced in section 1, the rest of the paper completes two different tasks, one critical and one constructive. By focussing on some epistemological cases that Pritchard’s model would fail to identify, section 2 shows that it relies on a difference that is in fact inessential: the one between the occurrence and the non‐occurrence (...) of an event. Section 3 sketches and defends an alternative account of the luck/risk distinction, based on the consideration of situations (instead of events) from different temporal perspectives: luck assessments track a situation’s past, considering it the actual outcome of some previous event, whereas risk assessments look at the situation’s future, regarding it as the initial condition of some unsettled event. In this paper, I analyze the extent to which classical phase transitions, especially continuous phase transitions, impose a challenge for reduction- ism. My main contention is that classical phase transitions are compatible with reduction, at least with the notion of limiting reduction, which re- lates the behavior of physical quantities in different theories under certain limiting conditions. I argue that this conclusion follows even after rec- ognizing the existence of two infinite limits involved in the treatment of continuous phase transitions.

Abstract:: This essay addresses the notion of public order from the point of view of biopolitics. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) Finally, in dialogue with Sarah Ahmed and Mary Douglas, it explores the role of the biopolitics of public order in the constitution and policing of the moral and physical, internal and external borders separating the political community from its various others. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

Algorithmic biases, or algorithmic unfairness, have been a topic of public and scientific scrutiny for the past years, as increasing evidence suggests the pervasive assimilation of human cognitive biases and stereotypes in such systems. This research is specifically concerned with analyzing the presence of discursive biases in the text generated by GPT-3, an NLPM which has been praised in recent years for resembling human language so closely that it is becoming difficult to differentiate between the human and the algorithm. The (...) pertinence of this research object is substantiated by the identification of race, gender and religious biases in the model’s completions in recent research, suggesting that the model is indeed heavily influenced by human cognitive biases. To this end, this research inquires: How does the Natural Language Processing Model GPT-3 replicate existing social biases?. This question is addressed through the scrutiny of GPT-3’s completions using Critical Discourse Analysis (CDA), a method which has been deemed as amply valuable for this research as it is aimed at uncovering power asymmetries in language. As such, the analysis is specifically centered around the analysis of gender and race biases in the model’s generated text. Research findings suggest that GPT-3’s language generation model significantly exacerbates existing social biases while replicating dangerous ideologies akin to white supremacy and hegemonic masculinity as factual knowledge. In his influential paper Legal Reasons, Sources and Gaps' reprinted in The Authority of Law (Oxford: Oxford University Press, 1979), Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the (...) claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principle of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show ‐ with the aid of a sophisticated analytical tool, i.e. von Wright's Truth Logic ‐ that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth‐values. For this reason, Raz's paper can still be regarded as a good starting‐point for analyzing the relationships among norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

It is generally accepted that, around the turn of the century, GIBBS and EINSTEIN independently developed two equivalent formulations of statistical mechanics. GIBBS version is taken as genuine and rigorous, while EINSTEINs, despite some features which are characteristic of him, is usually considered a not totally satisfactory attempt.It will be shown in the present work that such a picture is oversimplified and requires further nuancing. In fact, there are significant differences, with important implications which have not been sufficiently examined, between (...) the two formulations. In 2015 the United Kingdom (UK) became the first nation to legalize egg and zygotic nuclear transfer procedures using mitochondrial replacement techniques (MRTs) to prevent the maternal transmission of serious mitochondrial DNA diseases to offspring. These techniques are a form of human germline genetic modification and can happen intentionally if female embryos are selected during the MRT clinical process, either through sperm selection or preimplantation genetic diagnosis (PGD). In the same year, an MRT was performed by a United States (U.S.)-based (...) physician team. This experiment involved a cross-border effort: the MRT procedure per se was carried out in the US, and the embryo transfer in Mexico. The authors examine the ethics of MRTs from the standpoint of genetic relatedness and gender implications, in places that lack adequate laws and regulation regarding assisted reproduction. Then, we briefly examine whether MRTs can be justified as a reproductive option in the US and Mexico, after reassessing their legalization in the UK. We contend that morally inadequate and ineffective regulations regarding egg donation, PGD, and germline genetic modifications jeopardize the ethical acceptability of the implementation of MRTs, suggesting that MRTs are currently difficult to justify in the US and Mexico. In addition to relevant regulation, the initiation and appropriate use of MRTs in a country require a child-centered follow-up policy and more evidence for its safety. (shrink)

Historical accounts of the work of J. J. Thomson find a contradiction in his work. On the one hand, he is presented as a Maxwellian theoretical physicist dealing with a typically Victorian entity, the ether. On the other hand, the analysis of his experimental work at the Cavendish seems to have little connection with his mathematical work. In this paper, I discuss the metaphysical views of J. J. Thomson, and argue that his deep belief in the ultimate continuity of matter (...) can be seen to give a framework to both his theoretical and his experimental work. His metaphysical beliefs were not in the least shaken by the discovery of discrete phenomena and entities, not even by his suggestion of the existence of corpuscles later known as electrons. His formation in Cambridge, together with some ideas that he acquired in his youth at Owens College, Manchester, are the key to understanding his metaphysics and the role it plays in his scientific work. Clinical photography is an important tool for medical practice, training and research. While in the past clinical pictures were confined to the stringent controls of surgeries and hospitals technological advances have made possible to take pictures and share them through the internet with only a few clicks. Confronted with this possibility I explore if a case could be made for using clinical photography in tandem with social media. In order to do this I explore: if patient’s informed consent is required (...) for the publication of any clinical images that depicts her, irrespective of whether the patient can be identified from the image or not, if social media is an adequate place for clinical images to be displayed, and finally if there are special considerations that should be taken into account when publishing clinical images on social media. A continuación, examinamos las soluciones principales que propone para una mejor distribución de la riqueza y el aumento de la justicia fiscal, así como ciertos aspectos problemáticos de su enfoque.
