Dr. Heimo Hofmeister is the Chair of Philosophy in the Protestant Theology Faculty at the University of Heidgelberg, and has twice served as the Dean of that faculty. One of the most significant figures in contemporary German philosophy and ethics, he has recently published landmark works in medical ethics and the nature of warfare. A Russian translation of this book has already been published in 2000 and a second edition in German came out at the same time, and is (...) almost sold out. In this book, Andy Mueller examines the ways in which epistemic and practical rationality are intertwined. In the first part, he presents an overview of the contemporary debates about epistemic norms for practical reasoning, and defends the thesis that epistemic rationality can make one practically irrational. Mueller proposes a contextualist account of epistemic norms for practical reasoning and introduces novel epistemic norms pertaining to ends and hope. In the second part Mueller considers current approaches to pragmatic encroachment in epistemology, ultimately (...) arguing in favor of a new principle-based argument for pragmatic encroachment. While the book defends tenets of the knowledge-first programme, one of its main conclusions is thoroughly pragmatist: in an important sense, the practical has primacy over the epistemic. (shrink)

Over the past two decades scholars in the fields of political and social philosophy have devoted much time to the subject of recognition. But what is recognition, exactly? Who (or what) can (or should) be recognized? What role does it play for individuals and society? This volume discusses these and other central questions from historical and systematic perspectives. In doing so, it helps define the framework of the discussion and advance recognition studies.

I will argue for a novel variant of the knowledge norm for practical reasoning. In Sect. 2, I will look at current variations of a knowledge norm for practical reasoning and I will provide reasons to doubt these proposals. In Sects. 3 and 4, I develop my own proposal according to which knowledge is the norm of apt practical reasoning. Section 5 considers objections. Finally, Sect. 6 concerns the normativity of my proposed knowledge norm and its significance.

Recognition is one of the most debated concepts in contemporary social and political thought. Its proponents, such as Axel Honneth, hold that to be recognized by others is a basic human need that is central to forming an identity, and the denial of recognition deprives individuals and communities of something essential for their flourishing. Yet critics including Judith Butler have questioned whether recognition is implicated in structures of domination, arguing that the desire to be recognized can motivative individuals to accept (...) their assigned place in the social order by conforming to oppressive norms or obeying repressive institutions. Is there a way to break this impasse? -/- Recognition and Ambivalence brings together leading scholars in social and political philosophy to develop new perspectives on recognition and its role in social life. It begins with a debate between Honneth and Butler, the first sustained engagement between these two major thinkers on this subject. Contributions from both proponents and critics of theories of recognition further reflect upon and clarify the problems and challenges involved in theorizing the concept and its normative desirability. Together, they explore different routes toward a critical theory of recognition, departing from wholly positive or negative views to ask whether it is an essentially ambivalent phenomenon. The basic hypothesis of this book is that linguistic reference to kinds should be seen as reference to sortal concepts, i.e. cognitive categories for identifying and classifying objects. Viewed that way, kinds serve as the interface between the conceptual system and the grammatical system. Kind-level predicates differ as to whether they presuppose (e.g. to be extinct) or entail (e.g. to invent) the existence of objects, with crucial consequences for the interpretation of indefinite argument noun phrases. Moreover, object reference always involves (...) underlying kind reference, but kind reference does not always involve object reference. This asymmetry, once recognized, proves useful in solving otherwise puzzling problems in semantic composition. (shrink)

This essay presents a novel approach to specifying the meaning of the concept of populism, on the political position it occupies and on the nature of populism. Employing analytic techniques of concept clarification and recent analytic ideology critique, it develops populism as a political kind in three steps. First, it descriptively specifies the stereotype of populist platforms as identified in extant research and thereby delimits the peculiar political position populism occupies in representative democracies as neither inclusionary nor fascist. Second, it (...) specifies on this basis analytically–normatively the particular stance towards liberal representative democracy (in particular towards popular sovereignty and democratic legitimacy) that unifies populism’s political position and explains how populist politics can be compelling for democratic citizens. The normative core (populist ideology) turns out to require no more than two general principles of legitimizing political authority by elections. Surprisingly, it does not need a separate anti-pluralist or exclusionary commitment: it entails it. Third, this normative model allows a response to a contested question in the theoretical discussion, namely, whether populism (properly specified) can be democracy-enhancing. The article defends the negative answer in virtue of the normative core alone and does so as much vis-à-vis a minimal (purely electoral) as vis-à-vis a normatively ambitious (liberal) conception of democracy. The reconstruction of the normative core of populist ideology enables a novel argument to show that populism is incompatible with the continued democratic legitimation of political authority even in the normatively most austere conception of ‘electoral democracy’, not just with ‘liberal democracy’. Assuming a normatively more ambitious concept of democratic legitimation in terms of political autonomy, the model also produces an extremely direct argument showing that populists cannot fulfil their promise of ‘taking back control’ over political decision-making to the population. The case describes the developments of an ethics code observed in the local government of Suffolk County, New York, USA. In Suffolk County, there is now a dedicated Board of Ethics Agency (“Board”) within the local government to ensure that business operations and government operations run as ethically compliant as possible. This Board was created in 2012 in order to follow compliance with a law that established a replacement for the Ethics Commission (previously existing within Suffolk County) because this Ethics (...) Commission had been involved in a serious controversy. The former County Executive, Steve Levy, was found guilty of compromising the “integrity of an ethics commission”. Suffolk County government prescribed various measures in order to ensure that the citizens of Suffolk County were protected from business ethical violations. The Board also preemptively created laws that discouraged businesses from acting unethically. (shrink)

Increasingly, companies implement social and environmental standards as instruments towards corporate social responsibility (CSR) in supply chains. This is based on the assumption that such standards increase legitimacy among stakeholders. Yet, a wide variety of standards with different requirement levels exist and companies might tend to introduce the ones with low exigencies, using them as a legitimacy front. This strategy jeopardizes the reputation of social and environmental standards among stakeholders and their long-term trust in these instruments of CSR, meaning that (...) all expenses for their implementation are of no avail for the companies. Therefore, this paper highlights which criteria are important for the selection, implementation and improvement in order to achieve a company's aim, but also to strengthen the legitimacy of social and environmental standards. This research is based on conceptual thought and some existing empirical research, comparing four different social and environmental standards, revealing weaknesses and strengths. It exposes the basic conditions for the success of such standards among stakeholders and identifies the need for more empirical data. (shrink)

The point of the controversy is the interpretation of kant's article, "on a supposed right to lie from altruistic motives." my paper maintains: (1) that kant's interpreters, including w. schwarz, so far have failed to recognize the essential distinction kant makes between truth and truthfulness; (2) that apart from the historical context the disregard of this distinction has a demoralizing effect on man because it has penetrated and underlies all moral decisions as illustrated by two contemporary political situations.

International human rights law and international humanitarian law (IHL) contain few obligations for rebel groups, yet those groups are nonetheless under pressure to comply with their foundational international norms. This case study of the Kosovo Liberation Army (KLA) analyzes the evolution of its discourse and behavior related to human rights and IHL. It then compares changes in the group’s discourse to evidence of changes in behavior. The study finds that the KLA does significantly change its language, gradually incorporating such language (...) over time, but it also demonstrates that this change is not accompanied by improvements in human rights and IHL adherence in its behavior. The study considers whether greater adoption of these norms is better explained by a constructivist or a rationalist approach and, in particular, looks at the role of legitimacy. In addition, it offers insight into how groups may respond to future pressure to follow these norms. (shrink)

We report core stratigraphy and chronology that explains the diachronic history of the surface in a prehispanic wetland agricultural complex of planting platforms and canals at Mandinga, central Veracruz, Mexico. Using recognizable stratigraphic horizons, elevations of prehistoric surfaces were measured for the wetland prior to the construction of platforms and canals, immediately following construction, at the time of abandonment, and of the present-day surface. Significant topographic and hydrological changes are evident. We discuss our results in the light of prehispanic water (...) management and cultivation and postulate water storage within the wetland, a patchy management of water and cultivation, and variable productivity. The paper ends with a discussion of the lessons that can be learned when contemplating contemporary cultivation of wetlands. In addition to the environmental concerns, we emphasize the need to consider the physical, socio-economic, and political contexts in which contemporary wetland agriculture would have to operate. In this article, we expand on the models available for defining various different business logics relevant to video game development, especially those concerning free-to-play games. We use the models to analyse those business logics from an Aristotelian virtue ethics perspective. We argue that if an individual wishes to follow the Aristotelian virtue ethics code in order to develop the virtues inherent in his or her own character, how he or she chooses to try and generate revenue from the fruits of (...) his or her labour is not irrelevant. Moreover, we argue that some of these methods are in fact vices, which are damaging to the character of the developer, and should therefore be avoided. (shrink)

It is a popular thought that emotions play an important epistemic role. Thus, a considerable number of philosophers find it compelling to suppose that emotions apprehend the value of objects and events in our surroundings. I refer to this view as the Epistemic View of emotion. In this paper, my concern is with a rivaling picture of emotion, which has so far received much less attention. On this account, emotions do not constitute a form of epistemic access to specific axiological (...) aspects of their objects. Instead it proposes that they are ways of taking a stand or position on the world. I refer to this as the Position-Taking View of emotion. Whilst some authors seem sympathetic to this view, this it has so far not been systematically motivated and elaborated. In this paper, I fill this gap and propose a more adequate account of our emotional engagement with the world than the predominant epistemic paradigm. I start by highlighting the specific way in which emotions are directed at something, which I contrast with the intentionality of perception and other forms of apprehension. I then go on to offer a specific account of the valence of emotion and show how this account and the directedness of emotions makes them intelligible as a way of taking a position on something. Several lines of evidence suggest that children born via Cesarean section are at greater risk for adverse health outcomes including allergies, asthma and obesity. Vaginal seeding is a medical procedure in which infants born by C-section are swabbed immediately after birth with vaginal secretions from the mother. This procedure has been proposed as a way to transfer the mother's vaginal microbiome to the child, thereby restoring the natural exposure that occurs during vaginal birth that is interrupted in the case of (...) babies born via C-section. Preliminary evidence indicates partial restoration of microbes. However, there is insufficient evidence to determine the health benefits of the procedure. Several studies, including trial, are currently underway. At the same time, in the clinic setting, doctors are increasingly being asked to by expectant mothers to have their babies seeded. This article reports on the current research on this procedure and the issues it raises for regulators, researchers, physicians, and patients. (shrink)

This contribution focuses on three aspects of Nietzsche’s art of living that have become relevant today especially in the United States (but not only here): first, regarding some facets of the economic-political conditions of any contemporary art of living; second, the widespread adoption of Nietzsche’s notion of self-overcoming and artistic self-design in entrepreneurship and individual’s lives; and third, how his notion of ‘incorporation’ has been further developed in current approaches to habit design. Anthony Robbins that some notions of Nietzsche’s art of living have become most popular outside of academia, namely in the commercial industries of what has been called ‘self-growth’ or ‘self-development.’. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. Goethe's objections to Newton's theory of light and colours are better than often acknowledged. You can accept the most important elements of these objections without disagreeing with Newton about light and colours. As I will argue, Goethe exposed a crucial weakness of Newton's methodological self-assessment. Newton believed that with the help of his prism experiments, he could prove that sunlight was composed of variously coloured rays of light. Goethe showed that this step from observation to theory is more problematic than (...) Newton wanted to admit. By insisting that the step to theory is not forced upon us by the phenomena, Goethe revealed our own free, creative contribution to theory construction. And Goethe's insight is surprisingly significant, because he correctly claimed that all of the results of Newton's prism experiments fit a theoretical alternative equally well. The importance of self-interest at both the micro and macro levels of politics becomes clear once one looks not simply at the ?inputs? of a democracy but at its ?outputs? as well. The prevalence of interest (...) groups, the dysfunction of the United States tax code, the lobbying by unions for their members? self-interest, the earmarks in the Patriot Act, the numerous cases of corruption in Western democracies, and the dissatisfaction of citizens with their governments? failings all point to the importance of self-interest in politics. Nietzsche and Shaw are famous and infamous: famous for their innovative and influential forms of writing, but infamous for their apparent support of totalitarianism and Nazism. However, while it has long been shown that Nietzsche’s provocative language about “breeding” and “masters and slaves” was intended to enhance culture through competition, it is still an open question how and when Shaw supported biological eugenics. Via Nietzsche’s “philosophical breeding,” this article presents a new reading of Shaw’s Man and Superman: on the one (...) hand, it contrasts Nietzsche’s philosophical Übermensch with Shaw’s eugenic Superman; and on the other hand, it connects Nietzsche’s agonistic enhancement of culture with Shaw’s philosophical reflections in “Don Juan in Hell.” In contrast to Tanner’s support of eugenic breeding in his Revolutionist’s Handbook, Shaw’s Don Juan remarkably resembles Nietzsche’s notion of “philosophical breeding” toward a more competent, truthful, and autonomous orientation that is needed in increasingly complex global politics. PurposeThe purpose of this paper is to show that most, if not all RFID/biometric passports have clear technical and social problems in their intended use and that there are clear problems with the databases into which biometric data are being collected, due to use of this data for other, non‐intended uses.Design/methodology/approachThe approach of this paper is both a meta‐study of the flaws in the technological specifications as well as the social implementation of RFID/biometric passports. Finland is used as a case, (...) but the results extend beyond Finland in most, if not all the topics presented – not necessarily all results to all implementations, but all to some others.FindingsThe current implementations of RFID/biometric passports are lacking in both technical and social implementations and pose clear risks to their use, both due to lax implementation of the technology itself but specifically due to the social changes brought about. These problems cause both erosion of privacy and trust.Research limitations/implicationsFurther research into other potential social implications on a national level is required. The authors fear that the cases presented do not necessarily reflect all the potential problems, but just the most evident ones.Practical implicationsThe problems with the technological implications can be averted by using the best technological solutions, and thus the best technological solutions should be used instead of the ones proven to be lacking.Social implicationsThe social implications should at least be brought forth for public discourse and acknowledged, which currently does not seem to happen.Originality/valueThe paper contributes to the understanding of problems with current RFID/biometric passport implementations as well as inherent social problems that are hard, if not impossible to avoid.
