At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). Sie führen zu einigen wichtigen Einsichten über die Natur, die Materie, die Zeit, die Bewegungs- und Zweckursache u.a. und erheben ihre aktuelle Bedeutung für die gegenwärtigen interdisziplinären Diskussionen zwischen Naturphilosophie, Physik, Biologie, Psychologie und Anthropologie.

This book opposes the position that meanings can be explained by way of intralinguistic relations, as in structural linguistics and its successors, and rejects definitional descriptions of meaning as well as naturalistic accounts. The idea that we are able to live by strings of mere signifiers is shown to rest on a misconception. Ruthrof also attempts an explanation of why arguments grounded in a post-Saussurean view of language, as for instance certain feminist theories, find it so difficult to show how (...) precisely the body can be reclaimed as an integral part of linguistic signs. In reinstating the body in language, Ruthrof draws on Peirce, Husserl, Heidegger, Wittgenstein and Derrida, cognitive linguistics and rhetoric, as well as on the writings of Helen Keller. (shrink)

Fifty years ago Hartman studied the barrier transmission time of wave packets (J Appl Phys 33:3427–3433, 1962). He was inspired by the tunneling experiments across thin insulating layers at that time. For opaque barriers he calculated faster than light propagation and a transmission time independent of barrier length, which is called the Hartman effect. A faster than light (FTL or superluminal) wave packet velocity was deduced in analog tunneling experiments with microwaves and with infrared light thirty years later. Recently, the (...) conjectured zero time of electron tunneling was claimed to have been observed in ionizing helium inside the barrier. The calculated and measured short tunneling time arises at the barrier front. This tunneling time was found to be universal for elastic fields as well as for electromagnetic fields. Remarkable is that the delay time is the same for the reflected and the transmitted waves in the case of symmetric barriers. Several theoretical physicists predicted this strange nature of the tunneling process. However, even with this background many members of the physics community do not accept a FTL signal velocity interpretation of the experimental tunneling results. Instead a luminal front velocity was calculated to explain the FTL experimental results frequently. However, Brillouin stated in his book on wave propagation and group velocity that the front velocity is given by the group velocity of wave packets in the case of physical signals, which have only finite frequency bandwidths. Some studies assumed barriers to be cavities and the observed tunneling time does represent the cavity lifetime. We are going to discus these continuing misleading interpretations, which are found in journals and in textbooks till today. (shrink)

Wilhelm Windelband (1848-1915) war Ordinarius der Philosophie im Deutschen Kaiserreich, Haupt der südwestdeutschen Schule des Neukantianismus und einflussreicher Kathederfürst. Dem Neukantianismus wird Gegnerschaft zur Psychologie nachgesagt, und Windelband gilt in der Wissenschaftsgeschichte als jemand, der eine ausgeprägte Abneigung gegen die Psychologie hegte und diese polemisch von sich gab. Die hier erstmalig untersuchte Wirklichkeit sah anders aus. Er setzte sich frühzeitig für die Selbständigkeit der Psychologie ein, arbeitete an einem Buch zur Psychologie und hielt mehr als zwanzig Hauptvorlesungen zur Psychologie. Institutionelle (...) Hintergründe des problematischen Verhältnisses zwischen Philosophie und Psychologie werden untersucht und gezeigt, weshalb Windelband kein Einzelfall in der Geschichte des Faches Philosophie war. English summary: This volume contains controversial views and discussions on the purpose, function, analysis and justification of value judgments and norms in the social sciences and humanities.

Sein und Bewußtsein, zwei Kernbegriffe der modernen Bewußtseinsphilosophien, vor allem seit Kant, werden von diesen immer im Gegensatz zur traditionellen Metaphysik bestimmt, obwohl sie ihr der Sache nach entstammen. Die vorliegende Untersuchung beabsichtigt, in einer Gegenüberstellung von Aristoteles und Kant neben dem Verschiedenen auch das Gemeinsame zwischen den traditionellen und den modernen Auffassungen der beiden Begriffe herauszustellen und zu erörtern. Im Ergebnis finden sich Gesichtspunkte, wonach sich die beiden Auffassungen gwissermaßen ergänzen könnten: Die modernen gehen mit dem Bewußtsein auf eine (...) subjektive Erkenntnisbedingung, die traditionellen mit dem Sein der Dinge auf eine objektive reale Erkenntnisvoraussetzung. Die Untersuchung berücksichtigt auch nachkantianische Bewußtseinstheorien (Reinhold, Brentano, Husserl) sowie gegenwärtige Spezialliteratur, in der Absicht, etwas zur Klärung der beiden Begriffe Sein und Bewußtsein beizutragen: Sie erweisen sich als unlösbar aufeinander bezogen. The article outlines the Multiple-Field-Approach ("Mehr-Felder-Ansatz") in Gestalt Theoretical Psychotherapy and in psychotherapy in general. This Gestalt theory based approach deals 1) with the conditions under which a secondary phenomenal field (containing a secondary phenomenal ego and a secondary phenomenal environment) segregates within the primary phenomenal field, 2) with the dynamic field interaction between primary and secondary field and their role in psychotherapy, 3) with psychotherapeutic techniques favouring the segregation and favouring the dissolution of a secondary field . Some of (...) these phenomena have been discussed as mind-wandering, daydreaming, or - in a pathological context - as dissociation. But it seems that the Gestalt psychological approach presented in this paper has to offer a more promising framework for these phenomena and their dynamics. (shrink)

Aufgrund sorgfältiger Untersuchung in phänomenologischer Erkenntnishaltung können die Struktur des Lysis, die künstlerisch-ideelle Gedankenbewegung und damit die Einheit von philosophisch-künstlerischer Gestalt und philosophischem Gehalt des Dialoges in einer strengeren Weise erfasst werden als bisher. Dadurch werden ganz neue Beziehungen zu Gestalt und Gehalt der Politeia sichtbar. Sie erlauben im Verein mit grundsätzlichen Überlegungen zur Methode der datierenden Sprachstatistik und weiteren Beobachtungen, den Lysis chronologisch nach der Politeia anzusetzen - in der Trilogie Phaidros - Lysis - Euthydemos. So können die interpretatorischen (...) Einschränkungen durch das Vorurteil, der Lysis sei ein Frühdialog, überwunden werden. Die positive Interpretation des Dialoges und ihre Vertiefung durch die platonische Prinzipienlehre werden damit auf ungewohnte Weise stärker begründet. (shrink)

This accessible and highly readable book is the first full-length biography of Hegel to be published since the largely outdated treatments of the nineteenth century. Althaus draws on new historical material and scholarly sources about the life and times of this most enigmatic and influential of modern philosophers. Someone acts in a morally worthy way when they deserve credit for doing the morally right thing. But when and why do agents deserve credit for the success involved in doing the right thing? It is tempting to seek an answer to that question by drawing an analogy with creditworthy success in other domains of human agency, especially in sports, arts, and crafts. Accordingly, some authors have recently argued that, just like creditworthy success in, say, chess, playing the piano, or (...) archery, creditworthy moral success is a matter of getting things right by way of manifesting a relevant skill. My main aim in this paper is to bring out an important structural difference between moral creditworthiness and creditworthiness in sports, arts, and craft, undermining attempts to use examples of the latter as a model for understanding the former. As an alternative, I propose an account of morally creditworthy action, according to which such action is a matter of manifesting virtue, not skill—a claim that's based on an important, but underappreciated, difference between the sorts of excellences constituting virtues and skills. The paper thus contributes to a more nuanced picture of normative achievements across different domains of human agency, highlighting largely overlooked structural dissimilarities among them. The paper presents basic Gestalt psychological concepts of ego and self. They differ from other concepts in the way that they do not comprehend ego and self as fixed entities or as central controlling instances of the psyche, but as one specific organized unit in a psychological field in dynamic interrelation with the other organized units—the environment units—of this field. On this theme, well-known representatives of Gestalt theory have presented some general and special theories since the early days of this (...) approach that could partly be substantiated experimentally. They illuminate the relationship between ego and world in everyday life as well as in the case of mental disorders. Not only the spatial extension of the phenomenal ego is subject to situational changes, but also its place in the world, its functional fitting in this world, its internal differentiation, its permeability to the environment, and much more. The German Gestalt psychologist Wolfgang Metzger emphasizes the significant functional role that this dynamic plasticity of the phenomenal world and its continuously changing segregation of ego and environment have for human life by designating the phenomenal world as a “Central Steering Mechanism.” In this article, ego and self as part of this field in their interrelation with the total psychological field will be illuminated from the perspective of the thinking of the Gestalt psychologists Max Wertheimer, Kurt Koffka, Wolfgang Köhler, Kurt Lewin, Wolfgang Metzger, Mary Henle, Edwin Rausch, and Giuseppe Galli. We discuss several ontological properties of explicit mathematics and operational set theory: global choice, decidable classes, totality and extensionality of operations, function spaces, class and set formation via formulas that contain the definedness predicate and applications.

An important finding of the game theoretic research on signaling games is the insight that under many circumstances, a signal obtains credibility by incurring costs to the sender. Therefore it seems questionable whether or not cheap talk—signals that are not payoff relevant—can serve to transmit information among rational agents. This issue is non-trivial in strategic interactions where the preferences of the players are not aligned. Researchers like Crawford & Sobel, Rabin, and Farrell demonstrated, however, that even in the case of (...) partially divergent interests, cheap talk may be informative. They assume that signals have an exogenously given meaning that is common knowledge between the players, and they explore the conditions under which such a signal is credible. This discussion has obvious relevance to the program of Gricean pragmatics in linguistics. According to Grice’s "Cooperative Principle”, this research tradition only considers scenarios where the interests of the players are aligned. Nevertheless, the assumption of differential signaling costs introduces an element of non-aligned interests. The present paper proposes a framework that combines these two research strands. Using an inference protocol of iterated best response, it gives a recipe for how the interlocutors derive rationalizable strategies from exogeneously given "literal” meanings of signals. No special assumptions about the alignment of interests or signaling costs are made. After introducing the formal model, the paper sketches several applications of this model to problems in linguistic pragmatics, like scalar implicatures, the division of pragmatic labor, and the interpretation of measure terms. Robert Stalnaker has argued that mathematical information is information about the sentences and expressions of mathematics. I argue that this metalinguistic account is open to a variant of Alonzo Church's translation objection and that Stalnaker's attempt to get around this objection is not successful. If correct, this tells not only against Stalnaker's account of mathematical truths, but against any metalinguistic account of truths that are both necessary and informative.

Seit dem byzantinischen Bilderstreit und dem Bildersturm der Reformation ist nicht mehr in solcher Intensität über Bilder nachgedacht worden wie in den letzten Jahrzehnten. Neben der Archäologie und der Kunstgeschichte haben sich zahlreiche weitere Fächer an Fragestellungen rund um das Bild geradezu festgebissen. Angesichts dessen geht einer der bedeutendsten Kunsthistoriker der Gegenwart der Frage nach, warum Begriff und Geltung sowie Macht und Ohnmacht von Bildern so hartnäckig verfolgte Themen unserer Tage geworden sind.

“Analytical construct. The Culture as construct and the constitution of the social – fallowing Max Weber”. The key of this paper is the chalange to determinate theplace of the cultural sociology in the context of the general sociology and of the other cultural sciences, like cultural anthropology and ethnology. For doing that it is necessary to analize Max Weber’s concept: Gedankenbild.

During a conference entitled “_Un logicien consciencieux. La philosophie de Evert Willem Beth_,” held in Nancy in 1998 and published in this journal, volume 3, cahier 4 [Barth, Heinzmann _et al._ 1998-1999], the participants regretted that a reasoned biography of Beth was not available. In view of the efforts made since then in this direction, in particular by Paul van Ulsen in his PhD thesis in Dutch [2000], this article attempts to provide an overview of Beth’s work for a broader (...) community of philosophers of science. However, my focus is not so much on Beth’s widely discussed and important contributions to mathematical logic, where his most creative merits reside. My aim is to emphasize Beth’s philosophical and cultural background. Both are also discussed in the first two chapters of Ulsen’s thesis, which globally focuses on Beth’s work in logic. Although Walter Benjamin's writings are considered to be among the most powerful theoretical enterprises of the twentieth century, his ideas are resistant to cooptation by the doctrines of various critical programs. These essays engage this resistance by examining the ghostly in Benjamin's work. The contributors show that the haunting truths Benjamin offers point towards new forms of responsibility. These truths reside in a figurative elsewhere, a ghostly space that his texts delimit but never fully inhabit, and these essays seek to (...) do justice to the ghosts of Benjamin. Issues explored include: the status of the image in Benjamin's literary reflections and in his meditations on cinema and visual culture; abiding Benjaminian notions of messianism, aura, reproducibility, semblance, and melancholy; Benjamin's relation to Freud; his innovative rethinking of history, virtuality, and translation; and his reflections on tragedy and prophecy, the geometrical dimensions of writing, and the relation between eros and language.
