Benardete paradoxes involve a beginningless set each member of which satisfies some predicate just in case no earlier member satisfies it. Such paradoxes have been wielded on behalf of arguments for the impossibility of an infinite past. These arguments often deploy patchwork principles in support of their key linking premise. Here I argue that patchwork principles fail to justify this key premise.

What does it mean to assert or deny the existence of a legal system? How can one determine whether a given law belongs to a certain legal system? What kind of structure do these systems have, that is--what necessary relations obtain between their laws? The examination of these problems in this volume leads to a new approach to traditional jurisprudential question, though the conclusions are based on a critical appraisal, particularly those of Bentham, Austin, Kelsen, and Hart.

In the economic literature on the firm, especially in the transaction–cost tradition, a sharp distinction is drawn between so-called “market transactions” and “administered transactions.” This distinction is of enormous importance for business ethics, since market transactions are governed by the competitive logic of the market, whereas administered transactions are subject to the cooperative norms that govern collective action in a bureaucracy. The widespread failure to distinguish between these two types of transactions, and thus to distinguish between adversarial and non-adversarial relations, (...) has led many business ethicists to develop a “uniform” moral code. Yet in market transactions, the checks and balances built into the system of commercial exchange are such as to permit more instrumental forms of behavior. In administered transactions, by contrast, these checks and balances are absent, and thus the institutional context calls for much greater exercise of moral restraint. In this paper, I begin the task of developing an adversarial ethic for business. According to this view, the competitive environment licenses a greater range of “self-interested” behavior, but also imposes its own constraints on the strategies that firms may adopt in the pursuit of their interests. One of the most influential ideas in the field of business ethics has been the suggestion that ethical conduct in a business contextshould be analyzed in terms of a set of fiduciary obligations toward various “stakeholder” groups. Moral problems, according to this view, involve reconciling such obligations in cases where stakeholder groups have conflicting interests. The question posed in this paper is whether the stakeholder paradigm represents the most fruitful way of articulating the moral problems that arise in business. By (...) way of contrast, I outline two other possible approaches to business ethics: one, a more minimal conception, anchored in the notion of a fiduciary obligation toward shareholders; and the other, a broader conception, focused on the concept of market failure. My dissertation consists of two main parts. In the first part, I begin by assuming the plausibility of the libertarian thesis that agents sometimes could have done otherwise than they did given the very same history of the world. In light of this assumption, I undertake to develop a model of agency which does not employ the concept of agent-causation. My agency theory is developed in three main stages: I suggest that any agency theory must satisfy four desiderata: It must (...) adequately account for the freedom and responsibility of human agents. It must provide an adequate answer to the question of what distinguishes human actions from mere happenings. It must adequately account for the epistemological fact that human agents have an immediate and nonobservational awareness of their actions. It should have the support of a respectable philosophical tradition. I argue that agent-causation provides a theory of agency which fails adequately to satisfy these four desiderata. I claim both that human actions are uncaused exercisings by agents of their powers and that human agents typically act for reasons. I maintain that the central issue dividing agency theorists and nonagency theorists is whether reasons for performing actions cause the latter. I maintain that the sense of 'because' in 'I did x because...' is not causal in nature, but teleological. ;Having developed my model of agency, in the second part of my dissertation I investigate what are some of the paradigmatic actions human agents perform. I claim that bodily actions, such as moving an arm, are psychological in nature. Essential to my argument is the concept of a body-image. A normal agent 'feels' as if she is present in her physical arm. The way a normal agent feels is revealed in the case of a phantom limb. The subject of a phantom arm feels as if her amputated physical arm is still there and she can move while feeling armishly. I maintain that the bodily action of moving an arm is the agent's movement as a psychological arm-image of her physical arm, whether the physical arm is present or not. (shrink)

We examine two competing solutions to Benardete paradoxes: causal finitism, according to which nothing can have infinitely many causes, and the unsatisfiable pair diagnosis (UPD), according to which such paradoxes are logically impossible and no metaphysical thesis need be adopted to avoid them. We argue that the UPD enjoys notable theoretical advantages over causal finitism. Causal finitists, however, have levelled two main objections to the UPD. First, they urge that the UPD requires positing a ‘mysterious force’ that prevents paradoxes from (...) arising. Since such a force is implausible, the UPD is in trouble. Second, they employ recombination or patchwork principles to argue that paradoxical situations would be possible if causal finitism were false. Since such situations are not possible, causal finitism is true, and so a substantive metaphysical thesis is needed to avoid the paradoxes. A prominent objection to the MOA is that it suffers from a symmetry problem: an exactly parallel modal ontological argument can be given for God's non-existence. Several attempts have been made to break the symmetry between the arguments. In this paper, I develop a noncausal view of agency. I defend the thesis that choices are uncaused mental actions and maintain, contrary to causal theorists of action, that choices differ intrinsically or inherently from nonactions. I explain how they do by placing them in an ontology favored by causal agency theorists (agent-causationists). This ontology is one of powers and liabilities.After explicating how a choice is an uncaused event, I explain how an adequate account of freedom involves the concept of (...) choosing for a reason. Biomedical engineering technologies such as brain–machine interfaces and neuroprosthetics are advancements which assist human beings in varied ways. There are exciting yet speculative visions of how the neurosciences and bioengineering may influence human nature. However, these could be preparing a possible pathway towards an enhanced and even posthuman future. This article seeks to investigate several ethical themes and wider questions of enhancement, transhumanism and posthumanism. Four themes of interest are: autonomy, identity, futures, and community. Three larger questions can be asked: (...) will everyone be enhanced? Will we be “human” if we are not, one day, transhuman? Should we be enhanced or not? The article proceeds by concentrating on a widespread and sometimes controversial application: the cochlear implant, an auditory prosthesis implanted into Deaf patients. Cochlear implantation and its reception in both the deaf and hearing communities have a distinctive moral discourse, which can offer surprising insights. The paper begins with several points about the enhancement of human beings, transhumanism’s reach beyond the human, and posthuman aspirations. Next it focuses on cochlear implants on two sides. Firstly, a shorter consideration of what technologies may do to humans in a transhumanist world. Secondly, a deeper analysis of cochlear implantation’s unique socio-political movement, its ethical explanations and cultural experiences linked with pediatric cochlear implantation—and how those wary of being thrust towards posthumanism could marshal such ideas by analogy. As transhumanism approaches, the issues and questions merit continuing intense analysis. (shrink)

While William Hasker and I for the most part broadly agree in our opposition to much of the contemporary philosophical community concerning issues in the philosophy of mind that he discusses in his book, there are nevertheless seemingly some domestic disputes between him and me about certain matters concerning the nature of events involving the self. In this paper, I will focus on two of these disagreements. The first disagreement concerns Hasker’s treatment of what is widely known today as the (...) argument from reason and whether the events involved in our reasoning are essentially causal or teleological in nature. The second disagreement is about Hasker’s account of libertarian freedom, and whether agent causation is required to explain our free choices. (shrink)

The loss of C with bilateral thalmic lesions involving the intralaminar nuclei contrasts with retention of C after large cortical ablations depriving C of specific contents. A role of ILN in the perception of primitive sensations is suggested by their afference of directly ascending pathways. A role for ILN in awareness of cortical (...) activity is suggested by their widespread afference from cortex, a property shared with striatum. A role for ILN in volition is suggested by their heavy projection to striatum. Unlike striatum, ILN also project widely to almost all neocortex, enabling an effect on ideation; this last property is in common with other structures but none of them has the same direct cortical afference. And passage through the reticular nucleus of ILN efferents to cortex could impact the attention-selective action of nRt. It is suggested that the quickest route to a better understanding of C involves more intensive study of ILN. No other structure seems, in the light of our current knowledge, a more likely site for Mc. (shrink)

If we have libertarian free will, then it is plausible to believe that the occurrences of certain physical events have irreducible and ineliminable mental explanations. According to a strong version of naturalism, everything in the physical world is in principle explicable in nonmental terms. Therefore, the truth of naturalism implies that libertarian choices cannot explain the occurrences of any physical events. In this paper, I example a methodological argument for the truth of naturalism and conclude that the argument fails. I (...) then consider additional concerns raised against the reality of libertarian freedom. First, I examine the claim that if a physical event E is not causally determined to occur by another physical event, then there is no way to account for the difference between E’s occurring randomly and E’s being causally determined to occur by a mental event. Second, I consider the assertion that the affirmation of libertarianism is a mind-of-the-gaps version of the God-of-the-gaps objection to a divine explanation of a physical event. Third, I take up the question of whether the inability of libertarians to pinpoint precisely where the initial physical effects of libertarian choices occur is a good reason for rejecting libertarianism. Fourth, I examine the claim that belief in the existence of the soul or immaterial mind is the result of an explanatory hypothesis to account for how libertarian free choices can causally produce physical effects. Fifth, I look at the traditional objection to substance dualism from the impossibility of causal interaction between a soul and its body. (shrink)

David Widerker has forcefully argued that a libertarian is on firm ground in believing that the principle of alternative possibilities (PAP) is true. Eleonore Stump has argued that not all libertarians need accept PAP, and that its acceptance is not required for a rejection of compatibilism.This paper is a defense of Widerker against Stump. In this paper, I assume that if we have libertarian freedom, it is located in the power to choose and its exercise. Given this assumption, I then further assume a version of the Principle of Alternative Possibilities which states that an agent is morally responsible for his choice only if he could have chosen otherwise. With these assumptions in place, I examine three recent attempts to construct Frankfurt‐style counterexamples to PAP. I argue that all fail to undermine the intuitive plausibility (...) of PAP. Rape of women by men might be generated either by a specialized rape adaptation or as a by-product of other psychological adaptations. Although increasing number of sexual partners is a proposed benefit of rape according to the “rape as an adaptation” and the “rape as a by-product” hypotheses, neither hypothesis addresses directly why some men rape their long-term partners, to whom they already have sexual access. In two studies we tested specific hypotheses derived from the general hypothesis that sexual coercion (...) in the context of an intimate relationship may function as a sperm competition tactic. We hypothesized that men’s sexual coercion in the context of an intimate relationship is related positively to his partner’s perceived infidelities and that men’s sexual coercion is related positively to their mate retention behaviors (behaviors designed to prevent a partner’s infidelity). The results from Study 1 (self-reports from 246 men) and Study 2 (partner-reports from 276 women) supported the hypotheses. The Discussion section addresses limitations of this research and highlights future directions for research on sexual coercion in intimate relationships. (shrink)

Wright, anyone who is a Christian should at least think twice before he or she speaks about the soul, especially as an entity that is distinct from its physical body and can survive death in a disembodied intermediate state until the resurrection and reembodiment. In Wright’s mind, talk of the soul is talk about soul-body substance dualism (dualism, for short), which is the villain in Christian anthropological thought. Ecology and sustainability are current narratives about the behavior of humans toward themselves and the environment. Ecology is defined as a science, and a philosophy of ecology has become a recognized domain of the philosophy of science. For some, sustainability is an accepted, important moral goal. In 2013, a Special Issue of the journal Sustainability dealt with many of the relevant issues. Unfortunately, the economic, ideological, and psychological barriers to ethical behavior and corresponding social action remain great as well as (...) obvious. In this paper, I propose that a new, non-standard and non-propositional logic of real processes, Logic in Reality (LIR) grounded in physics applies to the science and philosophy of these narratives and helps to explicate them. Given the ecological role of organizations and institutions, reference is often made to organizational or institutional logics as guides to ecological practice. This paper suggests that these logics are either too abstract or too informal to have an impact in a conflictual world. Recognition of the suggested new, transdisciplinary logical dimension of ecological processes may provide credibility and support to new initiatives in ecology and its philosophy. (shrink)
