Drowning has been the cause of over 2.5 million preventable deaths in the past decade. Despite the fact that the majority of drownings occur in open water, assessment of water safety competency typically occurs in swimming pools. The assessment of water safety competency in open water environments brings with it a few difficulties, but also promises tremendous benefits. The aim of this position paper is to discuss the benefits and caveats of conducting assessments in open water environments as opposed to (...) closed and controlled environments, and to provide recommendations for evidence-based practice. The first theoretical section discusses the effects of the environment and key variables on various factors of assessment. These discussions are linked to the two perspectives of representative learning design and information processing theory. The second section presents two pilot studies of relevance and provides practical implications for assessment of water safety competency. It seems that a combination of pool-based practice and open water education may be ideal in assessing aquatic skills competency. Assessment in open water presents clear benefits regarding validity, but often poses seemingly unsurmountable barriers, which providers may have reservations about in the absence of clear evidence. Hence this article provides a robust discussion about competency assessment and signals the practical importance of faithfully reproducing the environment in which skilled behavior is most relevant. Kane also defends a traditional libertarian or incompatibilist view of free will, employing arguments that are both new to philosophy and that respond to contemporary developments in physics and biology, neuro science, and the cognitive and behavioral sciences.

Conversation-as-material is a language-based artistic research practice for attempting to speak from within the experience of collaborative artistic exploration, a linguistic practice attentive to the lived experience of aesthetic co-creation. The practice of conversation-as-material, which forms the basis of this article, has evolved through tentative exploration of the questions: How can the shared act of conversation bring into reflective awareness the live and lived, yet often hidden or undisclosed, experience of artistic practice and process, especially within collaboration? How can the (...) event of conversation be developed as an artistic research practice for attempting to give tangibility, whilst also remaining in fidelity, to the pre-reflective aspects of this lived experience? Considered less as a means for talking about, conversation-as-material may be understood as a practice for inviting immanent, inter-subjective modes of verbal-linguistic sense-making emerging through different voices enmeshed in live exchange. Conversation — from con- meaning ‘with, together’ and versare, ‘to turn, bend’; or else, from conversare — ‘to turn about, to turn about with’. Conversation-as-material has emerged as a practice of collaborative writing, which unfolds through the interplay of different voices ‘turning about’ together in conversation. In this sense, the practice can be differentiated from that of interview — for in the practice of conversation-as-material there is no researcher/researched dichotomy. Within the practice, an attempt is made to develop an approach to writing that finds expression first through verbal conversation, which is then subsequently distilled, even densified, towards poetic text. Conversation-as-material involves the gradual revelation of an artistic-poetic, perhaps even phenomenological, mode of emergent writing for speaking from the experience of collaborative co-creation, where linguistic content is not already known in advance, but rather emerges in and through the lived working-with of language. The practice of conversation-as-material thus comprises a quadripartite process of conversation, transcription, distillation, and presentation, where each part involves the activation of a particular aesthetic or poetic mode of attention, perhaps even a specific phenomenological attitude or disposition. There are many different interpretations of what the family should be – its desired member composition, its primary purpose, and its cultural significance – and many different examples of what families actually look like across the globe. I examine the most paradigmatic conceptions of the family that are based upon the supposed primary purpose that the family serves for its members and for the state. I then suggest that we ought to reconceptualize how we understand and define the family in (...) an effort to move away from these paradigmatic conceptions. This approach requires that we examine the way(s) in which the family has been defined descriptively – that is, how families have been defined historically – in an effort to determine what a normative theory of the family might look like. The goal of this inquiry is to define a family in terms of what it ought to be – a goal that moves our understanding of the family to a new conceptual landscape. I then present my own account of familial relations that aims to capture a normative understanding of the unique primary purpose that the family serves for its members. (shrink)

When Ron Giere introduced perspectivism into philosophy of science, he provided a perspectivist analysis of both scientific instruments and scientific theorizing. Today, there is a burgeoning literature that extends Giere’s analysis of theorizing, with many philosophers examining the perspectivist approach to aspects of theorizing such as models, laws, explanations, and so on. However, relatively little attention has been paid to Giere’s analysis of instruments. In this article, I hope to fill this gap. I argue that the perspectivist analysis of instruments (...) should be rejected. First, I give a general account of the kind of instrumentation relevant to instrumental perspectivism, drawing on Cartwright’s notion of nomological machines, which forms the basis of my criticism of Giere’s argument for instrumental perspectivism. Next, I present the case against instrumental perspectivism. I argue that instrumental perspectivism is dependent on theoretical perspectivism in a way that robs it of philosophical significance, and that it introduces new puzzles while adding little to our understanding of instruments. According to constructive empiricists, accepting a scientific theory involves belief only that it is true of the observable world, where observability is defined in terms of what is detectable by the unaided senses. On this view, scientific instruments are machines that generate new observable data, but this data need not be interpreted as providing access to a realm of phenomena beyond what is revealed by the senses. A recent challenge to the constructive empiricist account of instruments appeals to the extended (...) mind thesis, according to which cognitive processes are sometimes constituted not just by brain activity, but can extend into the rest of the body and the surrounding environment. If this is right, scientific instruments may, in the right circumstances, literally become part of our perceptual processes. In this article, I examine this extended perception argument, and I find that it fails for the vast majority of scientific instruments. Even if the extended mind thesis is accepted, the constructive empiricist can draw a line between observables and unobservables that makes very few concessions to the realist. (shrink)

In a recent paper in this journal, “How should libertarians conceive of the location and role of indeterminism?” Christopher Evan Franklin critically examines my libertarian view of free will and attempts to improve upon it. He says that while Kane's influential [view] offers many important advances in the development of a defensible libertarian theory of free will and moral responsibility … [he made] “two crucial mistakes in formulating libertarianism” – one about the location of indeterminism, the other about its (...) role – “both of which have helped fan the flame of the luck argument”. In this paper, I respond to Franklin's criticisms, arguing that, so far from making it significantly more difficult to answer objections about luck and control, as he claims, giving indeterminism the location and role I do makes it possible to answer such objections and many other related objections to libertarian free will. The present essay is about this problem of the intelligibility of incompatibilist freedom. I do not think Kant, Nagel and Strawson are right in thinking that incompatibilist theories cannot be made intelligible to theoretical reason, nor are those many others right who think that incompatibilist accounts of freedom must be essentially mysterious or terminally obscure. I doubt if I can say enough in one short paper to convince anyone of these claims who is not already persuaded. But I hope to (...) persuade some readers that new ways of thinking about the problem are necessary and, more to the point, that new ways of thinking about the problem are possible. As Nagel says, "nothing approaching the truth has yet been said on this subject." Parts V and VI of this paper present one new way of thinking about the problem. How can we register the participation of a range of elements, extending beyond the human subject, in the production of HIV events? In the context of proposals around biomedical prevention, there is a growing awareness of the need to find ways of responding to complexity, as everywhere new combinations of treatment, behavior, drugs, norms, meanings and devices are coming into encounter with one another, or are set to come into encounter with one another, with a range of unpredictable effects. In (...) this paper I consider the operation of various framing devices that attribute responsibility and causation with regard to HIV events. I propose that we need to sharpen our analytic focus on what these devices do, their performativity—that is, their full range of worldly implications and effects. My primary examples are the criminal law and the randomized control trial. I argue that these institutions operate as framing devices: They attribute responsibility for HIV events and externalize other elements and effects in the process. Drawing on recent work in science and technology studies as well as queer theory, I set out an analytic frame that marks out a new role for HIV social research. Attentiveness to the performative effects of these devices is crucial, I suggest, if we want better to address the global HIV epidemic. (shrink)

R. Jay Wallace’s Responsibility and the Moral Sentiments develops an original compatibilist approach to issues about moral responsibility and freedom that cannot be ignored by anyone working on these topics. Wallace’s theory is “Strawsonian” in the sense that it is heavily indebted to P. F. Strawson’s influential work on reactive attitudes. But we would seriously underestimate the originality of Wallace’s accomplishment if we said that his theory was merely an extension of Strawson’s. It includes new twists that Strawson did not (...) envisage and removes some weaknesses in Strawson’s position that are clearly there. The Strawsonian approach is one of several new compatibilist approaches to responsibility and freedom that have changed the face of debates about these topics over the past four decades; and Wallace’s book is the most developed and challenging Strawsonian view available. I have reservations about some of Wallace’s conclusions, but I have nothing but admiration for the book. It develops an original position and is written with critical acumen and in a lucid style that could be shown to graduate students as a model of what good philosophical writing can be. (shrink)

This article examines how the formation of markets in bottled water has relied on assembling a particular subject: the subject of hydration. The discourse of hydration is a conspicuous feature of efforts to market bottled water, allowing companies to appeal to scientifically framed principles and ideas of health in order to position the product as an essential component in self-health and healthy lifestyles. Alongside related principles, such as the ‘8 × 8 rule’, hydration has done much to establish new practices (...) of water drinking and consumption in which the consumer appears to be always at risk of dehydration and must engage in practices of ‘frequent sipping’. This article traces the emergence of the concept of hydration from its origins in exercise science and explores its circulation, contemporary uses and purchase. I argue that the appeal to biomedical languages and concepts found in the discourse of hydration connects with much broader ways of conceiving and acting upon the self that have become prevalent in contemporary society – what Rose and Novas call ‘biological citizenship’ – indicating how the ensemble of hydration participates in wider-ranging transformations in forms of rule. The story of hydration reveals how biomedical techniques of the self can be made to double up as ‘market devices’ by offering specific procedures for assessing the self and calculating the body’s needs. In order to grasp these developments, I position the health sciences, and health and fitness in particular, as a potent site of popular culture in which bodies learn to be affected by the procedures of scientific experiment. A critical grasp of this context is best enabled, I argue, by situating the producers and consumers of scientific principles and commercial products as embodied and looking at their interconnection in processes of emergence. Through these means, we can begin to develop a fully materialized account of the question: how have we become so thirsty? (shrink)

This paper responds to three critical essays on my book, The Significance of Free Will(Oxford, 1996) by Randolph Clarke, Istiyaque Haji and Alfred Mele (which essays appear in this issue and an earlier issue of this journal). This response first explains crucial features of the theory of free will of the book, including the notion of ultimate responsibility.The paper then answers objections of Haji and Mele that the occurrence of undetermined choices would be matters of luck or chance, and so (...) could not be responsible actions. It then responds to concerns of Clarke that indeterminism provides no greater degree of control for defenders of incompatibilist free will and to concerns Clarke has about the notions of "effort" and "willing" in the book. Finally, the paper addresses objections of Haji concerning Frankfurt type-examples and the relation of moral responsibility to the power to act otherwise, and it addresses a concern of Mele's about why we should want a free will that is incompatible with determinism. Prominent accounts of collective intentional activity explain the nature of social groups by virtue of a specific criterion: goal-directedness. In doing so, these accounts offer little in the way of determining whether there are any differences among social groups. In this paper, I propose a refined framework of collective intentional activity that can distinguish among social groups better than alternative accounts, and which has revisionary but nevertheless plausible implications for the nature of the family: specifically, that certain friendship relationships may (...) count as genuinely familial, and that we ought to count them as such. I argue that social groups are distinguished by what we can expect from one another within different kinds of social groups; specifically, that there is an important difference between reciprocity that is equivalent in performance and reciprocity that is equivalent in intention; familial groups are specifically guided by this latter kind of reciprocity. This more inclusive definition of familial groups may have important implications for how such groups are supported within a given society – for instance, by recognizing certain caring relations as essential for well-being and supporting them accordingly. The principal concern of this paper is to track the first wave of criticism directed against Deleuze's relation to Hegelianism as it has appeared in the English-speaking world. To this end, we assess the criticisms offered by Stephen Houlgate, Judith Butler, and Catherine Malabou, each of whom, in their respective ways, accuse Deleuze of misreading Hegel, claiming that his rejection of Hegelianism merely reinforces a secret or unacknowledged Hegelianism inherent in his own critique. Despite the brisk treatment Houlgate grants Deleuze, (...) his charges are by far the most serious, and hence it is to these that much of the discussion is dedicated; but the aim is to show how each of these claims concerning Deleuze's misreading of Hegel themselves involve a misreading of Deleuze. The popularity of Deleuze and Guattari is an undeniable precedent in current theoretical exchanges, and it could be stated without much contention that one's theoretical positioning must at some point deal with the salient conceptual offerings of Deleuze and Guattari, especially their double-opus, Anti-Oedipus and A Thousand Plateaus wherein a wealth of critique abounds. However, the significant trends concerning Deleuze and Guattari ‘scholarship’ may be jeopardised by the use of certain conceptual themes and methods in their work that are distorted (...) and employed by big business looking to secure their legacies of power by means of a control mechanism that looks to subjugate an entire world by means of ‘globalitarianism’. Our aim here will be to use McDonald's Corporation as an example of how the theoretical offerings of Deleuze and Guattari have been indirectly and hastily deployed for corporate ends, how these attempts are counter-Deleuzian, and to answer at least one of Žižek's criticisms against Deleuze. The problem of how to access and deploy the explanatory power of culture in historical accounts has long remained vexing. A recent approach, combining and transcending the "culture as structure"/ "culture as practice" divide among social historians, puts explanatory focus on the recursivity of meaning, agency, and structure in historical transformation. This article argues that meaning construction is at the nexus of culture, social structure, and social action, and must be the explicit target of investigation into the cultural dimension of (...) historical explanation. Through an empirical analysis of political alliance during the Irish Land War, 1879–1882, I demonstrate that historians can uncover meaning construction by analyzing the symbolic structures and practices of narrative discourse.
