This text discusses aspects of Human-Machine Interaction from the perspectives of an engineer and a philosopher. Machines are viewed not so much as tools, but more as complex socio-technical systems. On this basis, the relation between production and use of such systems and its influence on the interaction between human and machine is examined. The concept of intentionality serves as a common thread, and its close connection with the concepts of usefulness, purpose, and functionality as well as the more socio-culturally (...) shaped concept of destination is shown. We also discuss the connection of these considerations to current philosophical debates around Floridi’s “Onlife Manifesto”. The core of our argumentation is the significance of the unintended in the interplay between justified expectations, the intended, and experienced results of real-world cooperative action. We extend the meaning of this term up to the negatively intended as harmful effect in order to highlight the prominent position of problem solving in the socio-cultural development of humankind. We focus on information processes in that Human-Machine Interaction and the concept of unintended information. With the advancing digital transformation and the growing possibilities of digital monitoring, the importance of information processes as forms of description is growing, too. We show how the concept of non-intended information is linked to such concepts of control of development, in which the non-intended is marginalised and thus an essential driver of socio-cultural development is deactivated. We compare this with Floridi’s reflections on “fears and risks in a hyperconnected era”. (shrink)

This is a peer reviewed chapter in the book The Persistence of Taste: Art, Museums and Everyday Life After Bourdieu, an interdisciplinary analysis of taste in the wake of Pierre Bourdieu’s sociology. The chapter, ‘The configurational encounter and the problematic of beholding’, is in Part I of the book, entitled ‘Taste and Art’. Engaging the aesthetics of reception as its field of inquiry, the chapter draws upon the literary theorist Wolfgang Iser’s notion of the ‘blank’ as a staged suspension (...) of connectivity, arguing for a reassignment of the aesthetic in terms of a ‘configurational encounter’ that problematizes the work/beholder relation. This constitutes a rare attempt to apply reception aesthetics to contemporary art, a ‘gap’ first highlighted by the art historian Michael Ann Holly in her 2002 article ‘Reciprocity and Reception Theory’, published in A Companion to Art Theory. Utilising concrete examples of practice, the chapter asks whether the shift towards inter- or transmedia art practices, characterising postconceptual art, renders Bourdieu’s characterisation of the ‘autonomous’ artwork superfluous to the contemporary situation, and whether the kinds of judgments of taste associated with the acquisition of cultural capital are no longer relevant. The chapter argues that in revealing material processes, rules, instructions or appropriations – and/or its situated reception and apparatus of display – the configurational encounter problematizes the beholder’s bodily and ideological orientation toward an artwork, revealing our embodied dispositions or ‘habitus’. This counters philosopher Peter Osborne’s suggestion that a change in art’s ‘ontology’ post 1960s renders questions of aesthetics obsolete and reconceives the aesthetic as emerging from the oscillation of spatial and ideational perspective switches resulting from a calculated problematizing of the beholder’s position-taking. According to an intuitive picture of relevant entailment, an entailment is relevant if all the formulas it contains contribute to its validity. In this paper, we provide a ground-theoretic analysis of this notion of contribution, and as a result of relevant entailment. We build a system of bilateral logical grounding within which we can derive classical entailment and analyze the contribution of premises and conclusions, in terms of a certain type of connection between their respective logical grounds. The resulting framework (...) is shown to have a strong unifying and explanatory power by bringing together the notions of grounding and relevance and explaining the commonalities and differences between alternative contribution-based accounts of relevance. : Any precise version of H-D needs to handle various problems, most notably, the problem of selective confirmation: Precise formulations of H-D should not have the consequence that where S confirms T, for any T', S confirms T&T'. It is the perceived failure of H-D to solve such problems that has lead John Earman to recently conclude that H-D is "very nearly a dead horse". This suggests the following state of play: H-D is an intuitively plausible idea that breaks down (...) in the attempt to give it a precise formulation. Indeed I think that fairly captures the view among specialists in the field of confirmation theory. Here I argue that the truth about H-D is largely the reverse: H-D can be given a precise formulation that avoids the longstanding technical problems, however, it relies on a fundamentally unsound philosophical intuition. The bulk of this paper involves reviewing the problems affecting previous attempts at giving precise formulations of H-D and displaying some recent versions that can handle these problems. It then briefly explains why the basic intuition behind H-D is itself unsound, namely, because H-D involves a tacit assumption of inductive scepticism. Finally, the historical relation between H-D and the positivists' quest for a criterion of empirical significance will be reconsidered with the surprising result that having glossed H-D as fundamentally unsound it is concluded that a sound version of the criterion of empirical significance is now available. The demarcation criterion, the positivists' philosopher's stone that serves to separate claims with empirical significance from claims lacking empirical significance having finally been found, it is argued that we should regard empirical significance as just one among a variety of virtues and not follow the positivists in taking it to be a sin qua non for all meaningful statements. At the time of this writing, a widely publicized, waived-consent trial is underway. Sponsored by Northfield Laboratories, Inc. (Evanston, IL) the trial is intended to evaluate the emergency use of PolyHeme®, an oxygen-carrying resuscitative fluid that might prevent deaths from uncontrolled bleeding. The protocol allows patients in hemorrhagic shock to be randomized between PolyHeme® and saline in the field and, still without consent, randomized between PolyHeme® and blood after arrival at an emergency department. The Federal regulations that govern the waiver (...) of consent restrict its applicability to circumstances where proven, satisfactory treatments are unavailable. Blood - the standard treatment for hemorrhagic shock - is not available in ambulances but is available in hospitals. The authors argue that the in-hospital stage of the study fails to meet ethical and regulatory standards. (shrink)

This paper demonstrates an empirical analysis of the visual order of membership categories in a way consistent with both an early ethnomethodological research interest and recent arguments in membership categorization analysis. Early ethnomethodological studies have highlighted that we can infer and understand the membership categories of observed people about whom we have no information in advance, even without talking to them. Recent membership categorization analysts have argued the methodological importance of using video data. Given this, fictional films serve as video (...) data to advance the investigation into the visual order of membership categories since audiences do not know the fictional characters’ information in advance and cannot talk to them. We analyze how potential audiences understand fictional characters’ membership categories and how production crew members organize the visual and conversational order of membership categories. The analysis illustrates that our practical inferences of fictional characters’ membership categories are based on conversations among characters and visually available information. Such visually available information includes environments and lighting, as well as characters’ clothes, body orientations, facial expressions, and physical distance from each other. In other words, production crew members of fictional films design the visual and conversational order for remote audiences by arranging visually available information and fictional characters’ conversations. The findings provide insights into the “possible correctness” and “defeasibility” of membership categorization practices. Particularly regarding fictional characters’ membership categories, production crew members can employ the “possible correctness” and “defeasibility” of categorization practices to mislead audiences. I show to be unsuccessful several attempts to demonstrate the possibility of time without change. Consideration of the most prominent of these arguments (by Sydney Shoemaker) then leads to the formulation of a general argument: evidence which justifies a claim that a certain amount of time has elapsed also justifies a claim that continuous change has occurred during the period. Hence there is a sound basis for the relationist claim that there is no time without events.

This volume explores from multiple perspectives the subtle and interesting relationship between the theory of rational choice and Darwinian evolution. In rational choice theory, agents are assumed to make choices that maximize their utility; in evolution, natural selection 'chooses' between phenotypes according to the criterion of fitness maximization. So there is a parallel between utility in rational choice theory and fitness in Darwinian theory. This conceptual link between fitness and utility is mirrored by the interesting parallels between formal models of (...) evolution and rational choice. The essays in this volume, by leading philosophers, economists, biologists and psychologists, explore the connection between evolution and rational choice in a number of different contexts, including choice under uncertainty, strategic decision making and pro-social behaviour. Using a case of intended but failed doping, the author seeks to answer the question of if an agent cheated when they intended to but failed in the case of doping due to inert, counterfeit drugs. The examination looks at the case using the concept of cheating and concludes by dividing the results of cheating into primary and secondary effects.

What is one who takes normativity seriously to do if normativity can neither be discovered lurking out there in the world independently of us nor can it be sufficiently grasped from a merely explanatory perspective? One option is to accept that the normative challenge cannot be met and to retreat to some form of moral skepticism. Another possibility has recently been proposed by Christine Korsgaard in The Sources of Normativity where she aims to develop an account of normativity which is (...) grounded in autonomy. Furthermore, she argues that on her account reasons are "essentially public" and that this captures how it is that we can obligate one another. In this paper I argue that there is a serious tension between her account of normativity and the publicity of reasons-namely, that if reasons are essentially public, then it is not possible for individuals to legislate laws for themselves. However, I then argue that if we revise her conception of normativity such that it is understood to involve collective rather than individual legislation that it may then be possible to account for interpersonal reasons. Libertarians like Robert Kane believe that indeterminism is necessaryfor free will. They think this in part because they hold both (1) thatmy being the ultimate cause of at least part of myself is necessary forfree will and (2) that indeterminism is necessary for this ``ultimateself-causation''. But seductive and intuitive as this ``USCLibertarianism'' may sound, it is untenable. In the end, nometaphysically coherent (not to mention empirically valid) conception ofultimate self-causation is available. This paper is a comparative analysis of egalitarianism and utilitarianism from a naturalistic perspective that offers some insight into the manner in which we come to make interpersonal comparisons of welfare.

Field's claim that we have a notion of consistency which is neither model-theoretic nor proof-theoretic but primitive, is examined and criticized. His argument is compared to similar examinations by Kreisel and Etchemendy, and Etchemendy's distinction between interpretational and representational semantics is employed to reveal the flaw in Field's argument.

I interpret Mill?s view on logic as the instrumentalist view that logical inferences, complex statements, and logical operators are not necessary for reasoning itself, but are useful only for our remembering and communicating the results of the reasoning. To defend this view, I first show that we can transform all the complex statements in the language of classical first-order logic into what I call material inference rules and reduce logical inferences to inferences which involve only atomic statements and the material (...) inference rules. Then I explain why we introduce logical operators and logical inference rules into a system of the latter kind. In the end I determine what kind of negation is justified from this point of view. It is now 110 years since the first reported medical use of donor insemination. Despite its somewhat doubtful beginnings and its chequered history, especially up until the 1970s, DI has become a well accepted and utilised part of most infertility treatment services. An American survey in 1988 reported that approximately 80,000 women a year undergo the procedure, and that over 30,000 children are born each year. The only figures from the United Kingdom cover a 5-month period between August 1 and (...) December 31, 1991, and show that 4,260 patients were treated with DI during this period. This paper describes the situation of philosophy in Japan with respect to the question of internationalism. For more than a hundred years, Japan took Western culture as its model and European philosophy as the authentic philosophy. This tendency was paradoxically strengthened by the post‐war humanism. It gave us Japanese philosophers a clear discipline to work in but cut us off from our own native culture, history, and philosophical traditions. In wishing to recover this loss, I argue that it is necessary (...) to distinguish between two forms of internationalism: humanistic and merely fashionable. In American, the terms “schism,” “heresy,” “sect,” and “cult” have been used to describe splinter groups as they distinguish themselves from the majority religion. The term cult has been used in two different senses. Within the Roman Catholic Church a group’s devotion to a particular saint may earn them the title “Cult of” that particular saint. However, among contemporary American Protestants the term cult has come to be applied to religious groups that split from mainstream Christianity with regard to their (...) beliefs and behavior to the degree that the groups are considered dangerous to themselves and society. When it comes to defining what a cult is, only about ten percent of the attention is placed on a cult’s beliefs and ninety percent is placed on a cult’s behavior. In fact, there seems to be a general squeamishness about using the term cult in the first place. There are several reasons for this malaise toward the term, but this article will argue that the term cult can and should be used in general and scholarly contexts. (shrink)

ABSTRACT Coase's now famous paper, ‘The Problem of Social Cost’, argues that social harms caused by industry are best addressed through a policy which would be optimal in terms of market efficiency. I argue that this narrowly based policy represents a classic example of the failure of many welfare economists to consider adequately the ethical implications of their recommendations. I also indicate the manner in which Coase's recommendations conflict with intuitively well‐established ethical principles. I conclude that only an approach that (...) considers many more features than market efficiency can produce an optimal policy for dealing with the social costs of production. (shrink)

In recent years, the constitutional freedom of association has assumed a relatively low profile. Today, the most extended discussions of the right consider it as a second-order countervailing claim in civil rights cases involving questions of identity and the right to exclude. This article provides a brief overview of the right at a time when it was one of the most widely discussed, first-order constitutional rights, and when those discussions centered not on the right to exclude but on the question (...) of “guilt by association.” The article provides a sampling of the way that right was considered in the immediate post-World War Two years in the writings of some of the era's most prominent civil libertarian thinkers – Leo Pfeffer, Milton Konvitz, Robert Cushman, Henry Steele Commager, Zechariah Chafee, Jr., and Sidney Hook. These writings demonstrate that doctrinal development concerning the right was driven by its implication in two of the major political issues of the day: domestic security at the height of the Cold War and civil rights. The article concludes by arguing that, in the aftermath of the September 11 attacks and the ongoing fight against terrorism, free association questions are likely to assume renewed prominence. It argues further that, in a contemporary context, those thinking about the most pressing freedom of association questions would profit by looking less to the more recent discussions of the right as a matter of the right to exclude, and more to the highly-relevant discussions of “guilt by association” by the currently less well known mid-century civil libertarians. One of the central debates amongst U. S. constitutional theorists for more than a generation has been between (conservative) ‘originalists’ arguing that, in interpreting and applying the Constitution, judges are duty bound to adhere to the original understandings at the time of the Constitution’s adoption and (liberal/progressive) ‘living constitutionalists’ arguing rather that, when appropriate, judges should read the Constitution in light of contemporary needs and moral aspirations. While acknowledging the significance and legitimacy of the originalist call for fidelity to history (...) and newly incorporating elements of their arguments into his theory, Fleming, in Fidelity to Our Imperfect Constitution, re-affirms moral aspirationalism as the ultimate foundation of the interpretive project. I argue here, as against Fleming, that the opposition that he (and other American constitutional theorists) have drawn between originalism’s historicism and living constitutionalism’s moral aspirationalism is a false binary – the contingent product of a developmental succession of political battles between American conservatives and progressive/liberals over the course of the twentieth century. I argue here, contra Fleming, that in both theory and practice, in the U. S. at least, history and moral aspiration are and have always been inextricably intertwined —inseparable— and that, going forward, U. S. constitutional historians and theorists would do better by forthrightly acknowledging and accounting for this fact, and dynamic. (shrink)
