The comorbidity of chronic pain and opioid addiction is a serious problem that has been growing with the practice of prescribing opioids for chronic pain. Neuroimaging research has shown that chronic pain and opioid dependence both affect brain structure and function, but this is the first study to evaluate the neurophysiological alterations in patients with comorbid chronic pain and addiction. Eighteen participants with chronic low back pain and opioid addiction were compared with eighteen age- and sex-matched healthy individuals in a (...) pain-induction fMRI task. Unified structural equation modeling (SEM) with Lagrange multiplier (LM) testing yielded a network model of pain processing for patient and control groups based on 19 a priori defined regions. Tests of differences between groups on specific regression parameters were determined on a path-by-path basis using z-tests corrected for the number of comparisons. Patients with the chronic pain and addiction comorbidity had increased connection strengths; many of these connections were interhemispheric and spanned regions involved in sensory, affective, and cognitive processes. The affected regions included those that are commonly altered in chronic pain or addiction alone, indicating that this comorbidity manifests with neurological symptoms of both disorders. Understanding the neural mechanisms involved in the comorbidity is crucial to finding a comprehensive treatment, rather than treating the symptoms individually. (shrink)

The financial system is currently undergoing a revolution brought about by e-finance, digital convergence, new market entrants and government-encouraged competition. New market entrants such as Apple, Alibaba, Facebook and Google come from industries such as IT, retail, social media and telecoms, and, therefore, do not fit comfortably within traditional financial institutional structures. A functional perspective might provide more practical insights into this revolution; however, the functional perspective has had a limited impact. This paper will investigate the benefits and limitations of (...) financial functional analysis; probe the underpinning principles of sociology’s structural functional analysis; revisit Merton and Bodie’s six core financial functions in relation to new entrants in the financial landscape; and, finally, argue that in the new financial environment, functional analysis provides a more coherent and explanatory framework of the financial system for students and practitioners alike. According to axiological retributivism, people can deserve what is bad for them and an outcome in which someone gets what she deserves, even if it is bad for her, can thereby have intrinsic positive value. A question seldom asked is how axiological retributivism should deal with comparisons of outcomes that differ with respect to the number and identities of deserving agents. Attempting to answer this question exposes a problem for axiological retributivism that parallels a well-known problem in population axiology introduced (...) by John Broome. The problem for axiological retributivism is that it supports the existence of a range of negative wellbeing levels such that if a deserving person comes into existence at any of these levels, the resulting outcome is neither better nor worse with respect to desert. However, the existence of such a range is inconsistent with a set of very plausible axiological claims. I call this the desert neutrality paradox. After introducing the paradox, I consider several possible responses to it. I suggest that one reasonable response, though perhaps not the only one, is to reject axiological retributivism. (shrink)

The conversation with Jill H. Casid and Anna Campbell is a reconceptualization of several themes to develop an aesthetic that incorporates notions of the necropolitical and redefines the concept of the Anthropocene as the Necrocene. The Necrocene implies an era marked by death, decay, and the consequences of human impact on the environment, as well as a critical reflection on the choices individuals and societies make that contribute to the transition from the Anthropocene to the Necrocene. Christopher Kutz has written an excellent book: part metaphysics, part ethical theory, and part legal philosophy. The aim of the book, as is clear from the title, is to examine and defend the idea of complicity, that is, the responsibility of individuals for their participation in collective harms. While there has not been a lot of philosophical work on this topic, there has been some good work, and Kutz is responsive to most of it. But basically, this book strikes out (...) on its own, building a conception of complicity from an analysis of collective action and individual intention. The cornerstone of the analysis is the idea that individuals should be responsible for what they participate in, regardless of whether the participation makes a causal difference for the outcome. This anthology presents recent philosophical analyses of the moral, political, and legal responsibility of groups and their members. Motivated by reflection on such events as the Holocaust, the exploding Ford Pintos, the May Lai massacre, and apartheid in South Africa, the essays consider two questions - what collective efforts could have prevented these large-scale social harms? and is some group to blame and, if so, how is blame to be apportioned? We prove that every convexly ordered valuation ring has a unique completion as a uniform space, which furthermore is a convexly ordered valuation ring. In addition, we give a model theoretic characterisation of complete convexly ordered valuation rings, and give a necessary and sufficient condition for the completion of a convexly ordered valuation ring to be a real closed ring.

We recall the characterisation of positive definite polynomial functions over a real closed ring due to Dickmann, and give a new proof of this result, based upon ideas of Abraham Robinson. In addition we isolate the class of convexly ordered valuation rings for which this characterisation holds.

DURBIN University of Delaware Newark, Delaware I N 1986 I published a survey of some then-recent works in academic philosophy of science, primarily in the United States (The Thomist 50/4 (Oct. 1986): 689-700). My theme was continuity amid change, with a secondary focus on the diversity of philosophers' discussions of science-a diversity much greater than many academic philosophers of science were (...) then admitting. In my earlier survey, I conceded that one recent contribution, by Ronald Giere, represents something genuinely novel in philosophy of science. I was concentrating there on an early adumbration, in article form, of Giere's new approach, which-following W. V. Quine-he has dubbed "naturalized philosophy of science." Giere soon produced a book length version of this approach, Explaining Science: A Cognitive Approach (1988), and it is with that book that I want to begin my survey here. Giere says that from the beginning of his graduate studies in philosophy he had been " troubled... because philosophical discussions of induction seemed so remote from scientific practice as [he] had known it (Explaining Science, p. xv). But, twentyfive years later, his skepticism had increased markedly: From this skepticism, and some fortuitous encounters with work in cognitive science, Giere quickly went on to perceive the I began to lose my faith in the general program.... My skepticism progressed to the point that I now believe there are no special philosophical foundations to any science. There is only deep theory, which, however, is part of science itself (p. xvi). 655 656 PAUL T. DURBIN outlines of his new naturalized philosophy of science. This involves the view that, in general, " cognitive agents... develop representations of the world and make judgments about both the world and their representations of it." And, in particular in Giere's view, "scientists [are] cognitive agents and... scientific models [are] a special type of representation" (pp. xvi-xvii). Philosophy of science is not exactly expendable, but its task becomes one of understanding what scientists do, not of providing rational foundations for it. Later, Giere is even more explicit about the rejections this naturalized approach entails. It means, he says, giving up philosophical definitions of rationality, where he explicitly mentions Karl Popper and Larry Laudan-with their conflicting definitions of rationality-as examples (p. 8). And Giere equally forcefully repudiates other alleged philosophical foundations, whether empiricist, positivist, Kantian, etc. (p. 15). What Giere includes in his approach is an evolutionary naturalism (with debts to Donald Campbell and George Gale, among others), openness to social influences on cognitive resources, and close parallels with " traditional [internalist] historians of science " (p. 19). However, Giere goes on, "evolutionary models of scientific development recommend some changes in the way the history of science is conceived," moving it in the direction that "social historians" have moved for other reasons: "To see the processes of variation and selection at work, one must look at many members of a research community, including those who are unsuccessful" (p. 19).1 Despite Giere's repudiation of "over fifty years [of] philosophy of science " in which its practitioners " have labored to·elucidate the nature of scientific theories and the [rational] criteria for choosing one theory over others " (Explaining Science, 1 An approach very similar to Giere's (in my opinion) has been provided in David Hull's Science as a Process: An Evolutionary Account of the Social and Conceptual Development of Science (1988)-though Hull makes no use of cognitive science models, and his examples are from the history of biological research communities. The just war tradition began life, primarily in the writings of Augustine and other Church Fathers, as a reaction to pacifism. In my view, contemporary just war adherents should also see pacifism as their main rival. The key question of the just war tradition is how to justify war, given that war involves intentionally attacking or killing innocent people. And this justificatory enterprise is not an easy one. Today some theorists argue that some, but not all, soldiers are liable to (...) be attacked, especially those who fight in an unjust war. In this view, some of those who fight and kill in unjust wars should not be excused for following orders or even for their ignorance. Yet, it is often hard to tell if one is fighting in an unjust war, or whether military orders are unjust. I will argue that, especially in light of new work by just war adherents, the moral risks of participating in war are so high that pacifism, at least in its contingent form, should be seen as a reasonable option. The new versions of the just war doctrine bring us much closer to pacifism than their adherents would admit. (shrink)

The fifteen essays collected here explore America's distinctive form of agrarianism: where individualism, democracy, and a seemingly endless frontier transcended European quarrels over "commons" versus "containment." These values also helped forge our indigenous philosophy—pragmatism—and it is the confluence of these two distinctive American forms that intrigues each of these authors.The essays fall roughly into three groups: 1) historical queries whose connection to pragmatism is marginal, 2) expositions of the agrarian roots of pragmatism, and 3) estimates of the influence of classical pragmatism on the recent rise of neoagrarianism. The first category offers sparkling essays by Charles Taliaferro, James Campbell, Paul B. Thompson, Robert S. Corrington, and Douglas R. Anderson. Together these scholars sketch a history from colonial times to the mid-twentieth century—from Jefferson's "noble agrarian" to the agony of reconstruction, which hastened the split between Northern transcendentalists and Southern romantics. There are some surprises: Franklin outshines even Jefferson with his balanced vision of self-improvement and community weal, and Jefferson's correspondent Crèvecoueur emerges as a visionary who foresaw farming as a wholesome and integrated way of life a century before Emerson and Thoreau. Thomas C. Hilde finds an engagingly pragmatic notion of community in Josiah Royce, and Richard E. Hart discovers Dewey's sense of concrete experience in the novels of John Steinbeck. The contributions of neglected figures such as Francois Quesnay, Liberty Hyde Bailey, John Brewster, and A Whitney Griswold are also recovered.Turning to the second group, though obviously an irresistible title the notion that classical pragmatism is robustly "rooted" in agrarianism is slightly disingenuous. Peirce and James have no direct ties to agrarianism. And though Dewey's themes of innovation, social intelligence, community, and a conception of experience broadly inclusive of organisms and environments reflect obvious affinities, they do not show that pragmatism grew directly from or is a variant of agrarianism. Happily, the pieces on Dewey contributed by Larry A. Where traditional agrarianism was polarized between the domination of nature and its romantic beatification, the movement pioneered by Wendell Berry in the 1970s portrays the farmer as a nurturer whose goal is to seek an optimal harmony in the health of the land, the family, the community, and the country. In this James A. Montmarquet finds a Deweyan respect for an encompassing "situation," a unity of fact and value in stark opposition to the "corporate" mentality of specialization and success measured in economic gain alone. For Jeffrey Burkhardt, land grant universities must renew their original commitment to the family farm by distancing themselves from the forces of positivism and scientism—the technocrats and bio-chemical engineers who have imperiled both the land and the communities who depend upon it. Neither Montmarquette nor Burkhardt are looking for handouts, or for a return to the "idyllic" life of the one-horse plow. They emphasize moral training and a combination of practices designed to support the sustainability of the smaller farm in a competitive marketplace.One author compares the mention of agrarianism in philosophical discourse to committing a rude act in public. Clearly, however, mere "respectability" is not enough. If the contributors to this volume are correct, agrarianism is a lantern that may illuminate our ongoing search for wholeness and integrity. In the last two decades there has been a meteoric rise of international criminal tribunals and courts and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity (...) crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals. During the influx of neurological research into France from across Europe that took place rapidly in the late 19th century, the philosophy course in lycées was mobilized by education reformers as a means of promulgating the emergent brain sciences and simultaneously steering their cultural resonance. I contend that these linked prongs of philosophy’s public mission under the Third Republic reconciled contradictory pressures to advance the nation’s scientific prowess following its defeat in the Franco-Prussian war of 1870 without dropping France’s distinct (...) tradition of 19th-century spiritualism, which extended from Maine de Biran’s philosophical psychology to Victor Cousin’s official eclectic spiritualism. Between 1874 and 1902, the French Ministry of Public Instruction transformed philosophy into a national project designed to guide the reception of experimental psychology generally and neurology in particular. This article features original archival research on philosophy textbooks and students’ course notes that illuminate the cultural and intellectual impact of these sciences in the fin de siècle from inside the classroom. I argue that the scientific turn in the psychology section of the lycée philosophy course reflected and brought about a distinct philosophical movement that I call ‘scientific spiritualism’. While historians have analysed philosophy instruction as a mechanism used by the Third Republic to secularize students, this article sheds new light on lycée philosophy professors’ campaign to promote scientific spiritualism as a means to advance incipient brain research and pare its reductionist implications. The Rwandan genocide of 1994 occurred due to widespread complicity. I will argue that complicity can be the basis for legal liability, even for criminal liability, if two conditions are met. First, the person’s actions or inactions must be causally efficacious at least in the sense that had the person not committed these actions or inactions the harm would have been made significantly less likely to occur. Second, the person must know that her actions or inactions risk contributing to a (...) harmful enterprise, and must intend that these actions or inactions risk making this contribution. But it is not part of this analysis that the defendant must intend the harmful result. I explore the boundaries between legal and moral complicity and end with a discussion of how the analysis defended in the paper affects such questions as how many people in Rwanda should be prosecuted for the genocide which occurred due to widespread complicity. The categories of "civilian" or "soldier,” “combatant" or “noncombatant,” are thought to be stable. Yet, the case of the naked soldier taking a bath challenges such stability in a way that illustrates the serious conceptual and normative problems with identifying such social groups.

The first section examines how jus in bello necessity was understood in the work of the sixteenth and seventeenth century philosophers. In the second section we show how a revised understanding of necessity fits into the kind of considerations that are involved in the principle of humanitarian treatment. Based on that analysis, the chapter concludes that the principle of necessity creates a very small class of cases that may be treated in an exceptional way. In the third section we discuss (...) the problem that occurs when considerations of jus in bello necessity seem to involve the irrelevant factor of luck. The fourth section relates necessity to the philosophical concept of practical necessity. The final section spells out how the principles of necessity and proportionality relate to each other: proportionality puts a restraint on the principle of necessity, so the two must be understood in tandem. Transitional justice and jus post bellum share in common many concepts that will be explored in this volume. In both transitional justice and jus post bellum, retribution is crucial. In some contexts criminal trials will need to be held, and in others truth commissions and other (...) hybrid trials will be considered more appropriate means for securing some form of retribution. But there is a difference between how jus post bellum is conceptualized, where the key is securing peace, and transitional justice, where the key is often greater democratization.
