The implementation of pre-exposure prophylaxis (PrEP) as a new tool for prevention against HIV raised particular ethical concerns regarding the individuals’ and the collective's best interests in France. It was questioned whether the beneficence of taking or prescribing PrEP regarding its high efficacy to protect people from HIV is always more important than the maleficence represented by the risks involved, such as healthy people taking a pill with side effects, the growth of sexually transmitted infections or the potential generalization of (...) risk-taking sexual behaviour. The main objective of this study was to explore patients’ and health professionals’ ethical questioning on PrEP. Sixty-nine qualitative interviews were conducted with 45 users and 24 healthcare professionals. Overall, this study shows that those primarily concerned by PrEP tend to dismiss ethical questions regarding PrEP itself in the name of its efficacy and the empowerment it allows, but they would rather stress the impact PrEP can have on individuals’ sexual behaviour and how it can affect their autonomy if it is prescribed blindly without taking into consideration the specific living context and life history of each PrEP user. As has been widely observed, histories of feminism have often been conceived via notions of generation where feminism is positioned as a kind of familial property, a form of inheritance and legacy which is transmitted through generations. Thus feminism and its history have been imagined as following a familial mode of social reproduction. Despite the dominance of this model, it has nonetheless been subject to critique, not least because of its reliance on teleological and progressive notions of history. Judith Roof, (...) for example, has called for new conceptualizations of temporality in an attempt to decouple histories of feminism from a generational model. This need to move away from a generational model is also underscored by what commentators such as Angela McRobbie have identified as a dispersal of feminism – a broad-scale circulation of feminist values in popular culture – as well as by the emergence of a certain kind of reflexivity whereby past and current feminist practices are increasingly subject to critique. For McRobbie such developments are understood as part of the articulation of a post-feminism in which feminism can no longer be passed on as it is positioned as having already passed away. However, in this article via an exploration of recent accounts of the passing of feminism it is suggested that what allows for a declaration of this passing is an attachment to feminism as a particular way of knowing as well as to a particular arrangement of the social. Indeed, it will be suggested that recent histories of feminism and commentaries on the state of contemporary feminism are driven not only by generational logics but also by these attachments – attachments which lose and fix both feminism and women in time. This article engages the crisis of measure currently being articulated within social and cultural theory and the associated claim that this crisis should compel an embrace of methods which seek to know the heterogeneous, the multiple, the complex and the vague. Taking the rise of immaterial forms of labour and value as paradigmatic of the crisis of measure, it questions the use of the figure of a domestically labouring woman who lacks ownership of her labour to illuminate this crisis, as (...) well as the structural equivalence currently being forced between ‘women’s work’ (especially the work of social reproduction) and productive activities. It does so with reference to the changing relationship between women and social reproduction, a changing relationship which suggests that at the heart of the crisis of measure is a restructuring of time. This article therefore adds fuel to the view that the relations of temporality are now a key ground for feminist theory. (shrink)

The attempt to critique the profession of clinical ethics consultation by establishing the impossibility of ethics expertise has been a red herring. Decisions made in clinical ethics cases are almost never based purely on moral judgments. Instead, they are all-things-considered judgments that involve determining how to balance other values as well. A standard of justified decision-making in this context would enable us to identify experts who could achieve these standards more often than others, and thus provide a basis for expertise (...) in clinical ethics consultation. Questions about the relevance and value of various liberal concepts are at the heart of important debates among feminist philosophers and social theorists. Although many feminists invoke concepts such as rights, equality, autonomy, and freedom in arguments for liberation, some attempt to avoid them, noting that they can also reinforce and perpetuate oppressive social structures. In Challenging Liberalism Schwartzman explores the reasons why concepts such as rights and equality can sometimes reinforce oppression. She argues that certain forms of abstraction and (...) individualism are central to liberal methodology and that these give rise to a number of problems. Drawing on the work of feminist moral, political, and legal theorists, she constructs an approach that employs these concepts, while viewing them from within a critique of social relations of power. In many Western capitalist economies, private indebtedness is pervasive, but it has received little attention from political philosophers. Economic theory emphasizes the liberating potential of debt contracts, but its picture is based on assumptions that do not always hold, especially when there is a background of structural injustice. Private debt contracts are likely to miss their liberating potential if there is deception or lack of information, if there is insufficient access to (regular forms of) credit, or if credit is overly (...) expensive. Markets for private debt can be mechanisms of structural injustice: rather than playing a neutral role, they reinforce injustices, because the failures of debt to be liberating disproportionately hit individuals in disadvantaged positions. By individualizing what are in fact structural problems, private debt can contribute to stigmatization, social exclusion and oppression. What is at stake, from a perspective of structural justice, is not only the distribution of income, but also the distribution of risk. The problems of private debt markets therefore require political attention. In addition to fighting the structural injustices that form the background condititions of private debt, it is also worth addressing private debt markets themselves. (shrink)

In recent social theory, there has been an emphasis on the emergence of non-market, non-cash nexus or what are sometimes referred to as `traditional' forms of organization in the economic sphere. These are sometimes represented as vital to innovation and as constituting the cutting edge of socioeconomic change. In this article, my concern is to interrogate these new modes of organization. Its main argument is that such traditional forms may go hand in hand with a retraditionalization of gender in terms (...) of employment. Within the social sciences the widespread impact of the social capital concept has prompted strong critique on the part of feminists, for it is a concept which appears to reinstate a version of social worlds which for the past thirty years or more feminist social scientists have sought to problematize and move beyond. Yet do these critiques go beyond the social capital paradigm? It is the contention of this article that they do not and in particular that such critiques fail (...) to problematize the association of women with collective social goods found in the social capital literature. It will be suggested further that this association relates to the use of a dualism of instrumentality versus freedom, whereby women are overwhelmingly associated with the latter. This article therefore delineates a gendered subtext operative within the social capital debates. Recognition of this subtext should lead feminists to disengage with the social capital concept, for this is a concept whose use will always trap women in the social-historical time of industrial society. What can money do? Can it be put to work to address deepening forms of social and economic inequality associated with the financial crisis, ongoing recession and still unfolding politics of austerity? Can we have faith in money as an injustice-remedying substance in a crisis-ridden and (still thoroughly) financialised reality? While the latter scenario is implied in recent feminist calls to redistribute resources to redress widening socio-economic inequalities under austerity, in this article I suggest that such a redistributive logic fails (...) to account for the shifting capacities of resources, including the capacities of money. To track these shifting capacities, I revisit the demands of the 1970s women's liberation movement and especially the assumptions at play in these demands that money both measure and distribute justice. While these assumptions were arguably politically efficacious in that moment, in the contemporary present, pervasive financialisation has involved a material transformation to the capacities of money, a transformation that, I will suggest, leaves its justice-distributing potential in doubt. This article therefore not only calls for careful exploration of the capacities of resources in analyses of crisis, recession and austerity, but also for feminist theory to rethink redistributive justice in the light of such transformations. This article focuses on the new economy. While a number of recent analyses have considered how new economic arrangements rework a range of material relations, this article suggests that such considerations have tended to stop short of considering how material relations may be reconstituting vis-à-vis the people who are working in the new economy. This is so, it will be argued, because there is a pervasive assumption of what is termed a social contract model of personhood, where people are assumed (...) to own or at least to strive to accumulate skills, capacities and abilities as forms of property in the person. However, what this article underscores is that the relations between people and their labour in the new economy are being reworked. In particular, it highlights how qualities previously associated with people are being disentangled and are becoming the object of processes of qualification and re-qualification. However, such qualities do not take the form of property in the person as claims towards the ‘ownership’ of this labour lie in the domain of audience effects - that is, in relations external to the person. This shift, it is argued further, locates labour in the new economy firmly in the domain of the production and circulation of cultural value. Indeed, more broadly this article suggests that the now commonplace idea that economy and culture are de-differentiating involves a previously unrecognized restructuring of the relations between people and property and even the end of the modern notion of personhood. This article analyses a hitherto neglected problem at the transition from ideal to non‐ideal theory: the problem of knowledge. Ideal theories often make idealising assumptions about the availability of knowledge, for example knowledge of social scientific facts. This can lead to problems when this knowledge turns out not to be available at the non‐ideal level. Knowledge can be unavailable in a number of ways: in principle, for practical reasons, or because there are normative reasons not to use it. This can (...) make it necessary to revise ideal theories, because the principle of ‘ought implies can’ rules out certain theories, at least insofar as they are understood as action‐guiding. I discuss a number of examples and argue that there are two tendencies that will increase the relevance of this problem in the future: the availability of large amounts of sensitive data whose use is problematic from a normative point of view, and the increasing complexity of an interrelated world that makes it harder to predict the effects of institutional changes. To address these issues, philosophers need to cooperate with social scientists and philosophers of the social sciences. Normative theorising can then be understood as one step in a long process that includes thinkers from different disciplines. Ideal theory can respond to many of the charges raised against it if it is understood along these lines and if it takes the problem of knowledge and its implications seriously. (shrink)

Within the ethics and science literature surrounding uterus transplantation (UTx), emphasis is often placed on the extent to which UTx might improve upon, or offer additional benefits when compared to, existing ‘treatment options’ for women with absolute uterine factor infertility, such as adoption and gestational surrogacy. Within this literature UTx is often positioned as superior to surrogacy because it can deliver things that surrogacy cannot (such as the experience of gestation). Yet, in addition to claims that UTx is superior in (...) the aforementioned sense it is also often assumed (either implicitly or explicitly) that UTx is less fraught with ethical difficulties and thus should be considered a less morally problematic option. This article seeks to examine this assumption. Given that much UTx research has been performed in Sweden, a country where surrogacy is effectively although not currently explicitly forbidden, we do this through an analysis of the arguments underpinning a 2016 Swedish white paper which considered amending existing policy such that altruistic surrogacy arrangements would be permitted. By applying the white paper’s arguments for a restrictive position on altruistic surrogacy to the case of UTx using living altruistic donors we find that such arguments, if they hold in the case of surrogacy, apply similarly to UTx. We thus suggest that, for reasons of consistency, a similar stance should be taken towards the moral and legal permissibility of these two practices. (shrink)

The concept of bodily health is problematic for mechanists like Descartes, as it seems that they need to appeal to something extrinsic to a machine, i.e., its purpose, to determine whether the machine is working well or badly, and so healthy or unhealthy. I take issue with this claim. By drawing on the history of medicine, I suggest that in the seventeenth century there was space for a non-teleological account of health. I further argue that mechanists can and did (...) appeal to structural integrity, as a non-teleological notion of form, to ground the norms required for ascriptions of health. (shrink)

A critically revised Aristotelian-based virtue ethics has something potentially useful to offer to those engaged in analyzing oppression and creating liberatory projects. A critical virtue ethics can help clarify one of the ways in which oppression interferes with flourishing; specifically, it helps clarify an aspect of oppression that can be called "moral damage.".

This paper questions the prevailing historical understanding that scientific racism “retreated” in the 1950s when anthropology adopted the concepts and methods of population genetics and race was recognized to be a social construct and replaced by the concept of population. More accurately, a “populational” concept of race was substituted for a “typological one”—this is demonstrated by looking at the work of Theodosius Dobzhansky circa 1950. The potential for contemporary research in human population genetics to contribute to racism needs to be (...) considered with respect to the ability of the typological-population distinction to arbitrate boundaries between racist society and nonracist, even anti-racist, science. In the last few decades, religious and secular thinkers have tackled the world's escalating environmental crisis by attempting to develop an ecological ethic that is both scientifically accurate and free of human-centered preconceptions. This groundbreaking study shows that many of these environmental ethicists continue to model their positions on romantic, pre-Darwinian concepts that disregard the predatory and cruelly competitive realities of the natural world. A survey was administered during fall 2013 to 163 self-identified adult ethical vegans and/or ethical vegetarians in the United States to determine whether the respondents+ beliefs meet the definition of religion according to U.S. federal law. The data demonstrate that a majority of the surveyed group possesses beliefs concordant with the definition of "religion" according to federal statutes, federal judicial tests, and regulatory law. Since religion is a protected characteristic in U.S. law, and ethical veganism meets various definitions for religion, (...) then ethical veganism should be recognized as a religion and a protected characteristic under U.S. law. For many, the word 'pleasure' conjures associations with hedonism, indulgence, and escape from the life of the mind. However little we talk about it, though, pleasure also plays an integral role in cognitive life, in both our sensory perception of the world and our intellectual understanding. This previously important but now neglected philosophical understanding of pleasure is the focus of the essays in this volume, which challenges received views that pleasure is principally motivating of action, unanalyzable, and caused, rather than (...) responsive to reason. Like other books in the Oxford Philosophical Concepts series, it traces the development of the focal idea from ancient times through the 20th century. The essays highlight points of departure for new lines of inquiry rather than attempting to provide a full picture of how the idea of pleasure has been explored in philosophy. The volume begins by showing how Plato, Aristotle, early Islamic philosophers, and philosophers in the Medieval Latin tradition, such as Aquinas, honed in on the challenge of unifying the variety of pleasures so that they fall under one concept. In the early modern period, philosophers shifted from understanding the logic of pleasure to treating pleasure as a mental state. As the studies of Malebranche, Berkeley and Kant show, the central problem becomes understanding the relation of pleasure to other sensory experiences, and the role of pleasure in human cognition and knowledge. Short interdisciplinary reflections interspersed between essays focus on art of 16th and 17th century textbooks and the difficult music of composers like Bach, which demonstrate translation of these concerns to cultural production in the period. As the essay on Mill shows, the 19th century development of scientific psychology narrowed the definition of pleasure, and so its philosophical focus. Contemporary accounts of pleasure, however, in both philosophy and psychology, are now recognizing the limitations of this narrow focus, and are once again recognizing the complexity of pleasure and its role in human life. Analysing ten interviews with women diagnosed with and treated for congenital absence of the vagina, this article theorises the notion of ideal (hetero)relational normality. It explores how women in my case study negotiate, relate to and challenge this notion and examines the normative and bodily work for which it calls. The article specifically underscores the corporeal dimension of (hetero)relational normality. I argue that this notion of normality shapes the bodies of the women through medical interventions, while concurrently being reinforced through (...) the corporeal shapings that the women undergo. These corporeal shapings consolidate enacted norms concerning heterosexuality and form understandings of female and male bodies. The analysis also reveals how these women nevertheless find ways to re-negotiate and question the notion of ideal (hetero)relational normality and its intertwinement with medical practice. The article contributes both to the critical examination of genital surgery and to feminist discussions of how to critically examine heterosexuality without rejecting it. Furthermore, it provides a deeper understanding of how medical interventions designed to create a vagina, or dilate a vagina considered ‘too small’, are made meaningful by the women affected. Recent social and cultural theory has emphasized that in risk culture the achievement of a reflexive self-identity is a key resource, for example, in terms of employment, citizenship and intimacy. Commentators on shifts in the organization of health have also stressed the significance of achieving a self-reflexive identity. So, for example, knowing, self-monitoring subjects have emerged as optimal citizens in relation to health. While there is certainly some critical commentary on these kinds of moves, nevertheless reflexive sexual subjects in relation (...) to health have received less critical attention. In this article, through an analysis of HIV antibody testing and, in particular, by looking at the making of reflexivity through the practice of testing, I consider the emergence of a heterosexuality defined in terms of reflexivity. In so doing I suggest that reflexivity should not be understood - as many commentators suggest - as an effect but rather as constitutive of risk culture. (shrink)

In the modern Middle East, the public institutions associated with the internationally recognized states of the region are rarely viewed as trustworthy or reliable. Born in the demise of the Ottoman Empire, midwifed by European imperial powers who paid lip service to the development of the inhabitants, and nurtured in the cold war by superpowers largely indifferent to the well-being of the peoples of the region, the existing states came to be associated with expectations of welfare provision and structures of (...) accountability that privileged external actors over local interests. In the absence of public institutions that responded to and represented local interests, people organized around those still vibrant alternative forms of community that existed – the exchange networks of informal economies or the kinship systems of extended families and the ethnic and religious communities of language, sect and confession – and sometimes they reorganized and reinterpreted these identities to supplement and ultimately supplant the failing states in which they found themselves. In explicating this trope, he refers to a biblical passage in which Moses is like a "wet nurse" bearing Others whom he has "neither conceived nor given birth to" (Num. 11:12). A close reading of this passage raises questions about ethics, maternity, and sexual difference, for both the concept of ethical substitution and the material practice of mothering.

Anschließend wird vorgeschlagen, Einbettung im moralischen Sinn als die Forderung nach der Vermeidung verschiedener Formen von (...) Schädigungen zu verstehen, und diese nach dem systematischen Ort der Schädigung und anhand der Kategorien materiell versus immateriell zu kategorisieren. Anschließend werden Hindernisse für die vorgeschlagene Konzeptualisierung und deren praktische Umsetzung diskutiert, nämlich die Frage nach den relevanten Vergleichsmaßstäben und das Problem der Dynamik unbeabsichtigter Folgen, das eine entsprechende Dynamik auch in den Reaktionen auf diese Folgen nötig macht.
