Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

Constitutive instrumentalism is the view that responsibility practices arise from and are justified by our being prosocial creatures who need responsibility practices to secure specific kinds of social goods. In particular, responsibility practices shape agency in ways that disposes adherence to norms that enable goods of shared cooperative life. The mechanics of everyday responsibility practices operate, in part, via costly signaling about the suitability of agents for coordination and cooperation under conditions of shared cooperative life. So, there are a range (...) of identifiable conditions where the ordinary operation of responsibility practices—and thus, the usual normative force of the practices—is disrupted. Even so, these conditions are not so widespread as to favor a more thoroughgoing abandonment of responsibility practices. (shrink)

In mid-twentieth-century Mexican philosophy, there was a peculiar nationalist existentialist project focused on the cultural conditions of agency. This article revisits some of those ideas, including the idea that there is an important but underappreciated experience of one's relationship to norms and social meanings. This experience—something called accidentality—casts new light on various forms of social subordination and socially scaffolded agency, including cultural alienation, biculturality, and double consciousness.

Through modern driver assistant systems, algorithmic decisions already have a significant impact on the behavior of vehicles in everyday traffic. This will become even more prominent in the near future considering the development of autonomous driving functionality. The need to consider ethical principles in the design of such systems is generally acknowledged. However, scope, principles and strategies for their implementations are not yet clear. Most of the current discussions concentrate on situations of unavoidable crashes in which the life of human (...) beings is existentially affected. In this paper, we argue that ethical considerations should be mandatory for any algorithmic decision of autonomous vehicles, instead of a limitation to hazard situations. Such an ethically aligned behavior is relevant because autonomous vehicles, like any other traffic participants, operate in a shared public space, where every behavioral decision impacts the operational possibilities of others. These possibilities concern the fulfillment of a road-user’s safety, utility and comfort needs. We propose that, to operate ethically in such space, an autonomous vehicle will have to take its behavior decisions according to a just distribution of operational possibilities among all traffic participants. Using an application on a partially-autonomous prototype vehicle, we describe how to apply and implement concepts of distributive justice to the driving environment and demonstrate the impact on its behavior in comparison to an advanced but egoistic decision maker. Retirement is often viewed as a reward for a working life. While many have reason to want a work-free retirement, not everyone does. Should working retirees have to give up their retirement pension and, consequently, their status as retirees? The answer, I argue, boils down to whether we conceive of retirement as free time (need-free) or as leisure (work-free). In this article, I put forward a liberal case in favour of free time, despite whether our liberalism leans towards perfectionism or (...) neutralism, with social primary goods being a case in point. Applying this case for free time to retirement yields two significant policy implications. First, it demands “free synchronic combination” – that retirees may use their retirement pensions however they see fit, including to work. Second, it also yields “free diachronic combination” – that, within limits, individuals have discretionary control over how to combine retirement and work across time – thus challenging the idea that retirement should be available only in old age and not earlier in life. So far, the literature on free time focused only on narrow temporal units, such as hours and days, but there is much to gain by extending the concept into retirement. (shrink)

Explicitly fictional armchair reconstructions of the past are sometimes taken to be informative about philosophical issues. What appeal a counterfactual genealogy has depends on its speculative accuracy, that is, its accuracy in identifying relevant causal, functional, or explanatory particulars. However, even when speculatively accurate, counterfactual genealogies rarely secure more than proofs of possibility. For more ambitious deployments of genealogy – for example, efforts to show what properties the target concept in fact predicates – genealogies are hamstrung by the possibility of (...) predicative drift, or changes over time in what the concept predicates. Still, even when counterfactual genealogies fail to tell us about our current practices or concepts, they may identify appealing successors. Pettit's (2018 Pettit, Philip. 2018. The Birth of Ethics: Reconstructing the Role and Nature of Morality. New York, NY: Oxford University Press.[Crossref], [Google Scholar]) innovative defense of moral realism and his employment of a counterfactual genealogy provides an illuminating instance of the promise and challenges facing accounts employing counterfactual genealogies. I argue that Plato was right in claiming that justice is more profitable, more rational, and more intrinsically valuable than injustice, and that this is particularly true for business organizations. The research on prisoners’ dilemmas and social dilemmas shows that ethical behavior is more profitable and more rational than unethical behavior in terms of both the negative sanctions on unethical behavior when interactions with stakeholders are iterated, and the positive rewards of habitually ethical behavior when stakeholders can identify those who (...) are predisposed to be ethical. In addition, the psychological research on justice shows that justice is intrinsically valued, both from an outcome and from a process perspective, and so crucial for business organizations, particularly in terms of organizational effectiveness. The present chapter is concerned with revisionism about free will. It begins by offering a new characterization of revisionist accounts and the way such accounts fit (or do not) in the familiar framework of compatibilism and incompatibilism. It then traces some of the recent history of the development of revisionist accounts, and concludes by remarking on some challenges for them.

Of all the risks we face in life, ranging from unemployment to old age, early death is among the most tragic and yet most neglected by modern states. Liberal egalitarians might find it easy to dismiss social insurance against early death, but I argue they should not. Early in this paper, I explain why social insurance should include the risk of premature death by replying to four common criticisms. What follows is a case for a novel form of insurance that (...) is more liberal and egalitarian across ages than the status quo. More specifically, I show that granting storable pensions in all life stages - youth, middle and old age - promotes liberty and reduces lifetime inequality. Writers on age group and longevity justice often overlook the extent to which liberal lifetime equality can supply insightful arguments against inequality across ages. These call for a policy that gives each age group the freedom to draw a storable pension. I call that policy "freetirement". (shrink)

Political egalitarians tend to defend equal distributions of voting power at specific times, as in ‘one election, one vote’. Appealing as it is, the principle seems incompatible with distributing power proportionally to the stakes voters have at different elections, as in ‘one stake, one vote’. This article argues that the tension above stems from the temporal scope ascribed to political equality, as at specific moments of democratic decision-making instead of over entire lives. More specifically, ascribing a lifetime view to political (...) equality renders equality compatible with proportionality at different elections. I first show that storable votes differ from standard votes in their distinctive commitment to lifetime political equality. I then argue that storable voting schemes are compatible with three key reasons to value political equality: equal consideration of interests, relational equality, and non-domination. Finally, storable votes are also consistent with proportionality at specific times. I conclude that the neglected idea of lifetime political equality can, through storable votes, deliver proportionality without inequality. (shrink)

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. This chapter discusses what maximin egalitarians should think about two types of age-sensitive taxation. One is a form of cumulative income taxation, which taxes yearly incomes taking into account all earlier income years instead of only the last one. The second is age-differentiated taxation, which taxes yearly incomes adjusting the rate to the taxpayer’s age. The chapter first presents the main reasons supporting cumulative income taxation and then proceeds to look at how it affects fiscal obligations across life. Then it (...) argues that egalitarians should aim at a fiscal reform that benefits the young and the elderly but not the middle-aged. Finally, it questions whether cumulative income taxes can deliver this without resorting to age-differentiated taxes. According to a common belief concerning the Mach-Boltzmann debate on atoms, the new experiments performed in microphysics at the turn of the 19th and 20th centuries confirmed Boltzmann’s atomic hypothesis and disproved Mach’s anti-atomic view. This paper intends to show that this belief is partially unjustified. Mach’s view on atoms consists in fact of different kinds of arguments. While the new experiments in microphysics refute indeed his scientific arguments against the atomic hypothesis, his epistemological arguments are unaffected. In this regard, (...) Mach’s epistemological approach remains relevant for today’s discussion on the status of the notion of atom. (shrink)

Examino Acerca del cielo (De caelo) I 2 con el fin de mostrar allí la presencia de la demostración científica. Este desarrollo pretende aportar nueva evidencia en favor de la no discrepancia entre teoría y praxis científica en Aristóteles (Barnes, 1969) y de relativizar la interpretación de que el método real y únicamente usado es la dialéctica (cuyo antecedente se remonta a Owen, 1980). Además, siguiendo la propuesta hermenéutica de Gotthelf (1987) y Detel (1993 y 1997), mostraré de qué modo (...) se utiliza la demostración científica en la prueba de la existencia del cuerpo simple o éter. Ofreceré también una reconstrucción de las pruebas mediante la elaboración de un esquema que abarque el conjunto de las deducciones. Estos últimos desarrollos constituyen el aporte más novedoso del presente artículo. I examine On the Heavens (DC) 12 in order to show there the presence of scientific demonstration. This development tries to contribute new evidence in favor of the not discrepancy between theory and scientific practice in Aristotle (Barnes, 1969) and to make the interpretation that method real and solely used is dialectic relative (whose precedent goes back to Owen, 1980). In addition, following the hermeneutic proposal of Gotthelf (1987) and Detel (1993 and 1997), I will show how scientific demonstration is used in the proof of simple body (ether) existence. I will offer also a reconstruction of the proof by means of the elaboration of a scheme that includes the set of deductions. The latter developments constitute the most new contribution of the present paper. (shrink)

This article explores how citizen participation was methodologically devised and materially articulated in the postdisaster reconstruction of Constitución, one of the most affected cities after the earthquake and tsunami that battered south central Chile in 2010. I argue that the techniques deployed to engineer the participation were arranged as a policy experiment where a particular type of public was provoked—one characterized by its emotional detachment, political engagement, and social tolerance. The case of Constitución, however, also shows that this public ran (...) parallel to other forms of being a public not aligned with the experiment’s assumptions. More broadly, the article argues that while disaster studies need to acknowledge the generative capacities of public participation, science and technology studies should include disasters as a particular setting for participatory experiments. This paper provides new elements for reconstructing Heinrich Hertz's conversion from an electrodynamic concept to a concept of field theory, a process that took place between September 1887 and February 1888. First of all, it is argued that, contrary to what one could deduce from Hertz's own presentation in his Untersuchungen (or Electric Waves), paper N∘ 5 was actually written after the first publication of papers N∘ 6 and N∘ 7; this fact is illuminated by Hertz's unpublished correspondence (Section 1). (...) Following this reordering, an approximative process of Hertz's conversion based only on his published papers is described (Section 2). Second, by complementing Hertz's published Erinnerungen (or Memoirs, Letters, Diaries) with his unpublished Versuchsprotokolle (Laboratory notes), a much finer description of this conversion process is discussed (Section 3). It is finally concluded that Hertz's idea of “air waves” belongs at the very end of this process, and was mainly attained through experimental hints found within Helmholtz's theoretical framework. A dialogical version of (modal) epistemic logic is outlined, with an intuitionistic variant. Another version of dialogical epistemic logic is then provided by means of the S4 mapping of intuitionistic logic. Both systems cast new light on the relationship between intuitionism, modal logic and dialogical games.

This article examines the Kantian thesis of the a priori nature of our knowledge of space. Because it makes the representation of objects possible as external to us and all others, and consequently, as distinct and individualized, space (whatever its structure may be) claims the status as necessary condition and as apriori possibility of all knowledge. However, in the light of various physical, psychological and philosophical considerations, it seems that the particular structure allocated by Kant to space (i.e. uniqueness, infinity, (...) continuity, homogeneity, isotropy, Euclidean character and three-dimensional character) is neither necessary nor a priori but is rather contingent and dependent on experience. For this reason a pragmatist relativization of the transcendental approach appears to be necessary: the structure of space which makes knowledge possible is not apriori in an absolute sense, but rather, it is determined within the context of a certain practice, which is characterized by a certain mode of interaction with the environment and reveals particular empirical constraints to which this spatial structure must fit. There have recently been proposed cases where, supposedly, mathematics would play a genuinely explanatory role in science. These have been divided into those situations where the explanatory role would be played by mathematical operations, and those where it would be played by mathematical entities. In this article, I analyze some of these purported cases and argue that claims that mathematics can be genuinely explanatory are unfounded. Throughout my discussion, I (...) emphasize the representational role of mathematics, as opposed to its supposed explanatory role: the role of mathematics, even in the cases that I discuss, is to represent physical facts and help draw inferences about those facts. En la conquista, colonización y evangelización de las Indias se dio una estrecha colaboración y alianza Iglesia-Estado, amalgama que reforzaba a ambas instituciones, aunque siempre bajo el control estatal, supervisada y coordinada por el Consejo de Indias. Las relaciones Iglesia-Estado en América pasaron por diversas modalidades: Patronato, Vicariato y Regalismo. En el siglo XVI rige el Patronato, basado en las concesiones Pontificias que ponía en manos de la Corona española el ‘cuidado’ sobre la Iglesia americana. Desde fines del XVI, religiosos (...) y juristas españoles elaboraron la teoría del Vicariato, según la cual los reyes, en virtud de la donación papal, eran Vicarios de la Santa Sede en las Indias y adquirían competencias en materia de disciplina eclesiástica. En el siglo XVIII el Regalismo asume ambas posiciones y las convierte en jurisdicción civil al considerar que los derechos esenciales del Patronato y el Vicariato no se basan en concesiones papales sino que son prerrogativas inherentes a la Corona, regalías o atributos del poder real. La premisa que guía nuestra investigación es que Poética es un tratado científico, i. e., que la investigación desarrollada en dicha obra se corresponde con el examen de una téchne. Defendemos que el método utilizado se corresponde con el método general de investigación denominado “salvar las apariencias”. Tal método es expuesto con más detalle en otras obras del corpus pero lo presuponemos utilizado en Poética. Si bien el método presupone la recolección de datos, no se limita a eso puesto que (...) el paso ulterior consiste en la caracterización de las diferencias y la exposición de las cuatro causas del fenómeno. De este modo, expondremos por un lado la base fenoménica de Poética y, por otro, sus cuatro causas. (shrink)

In this paper I will examine the relationship between constitutionalism and democracy as the alleged tensions between them appear in diagnoses about the crisis of liberal democracy. The issue is approached through the arguments of the German jurist Martin Kriele, who holds the thesis that there can be no sovereign in the constitutional State. I will begin by explaining this thesis as well as the justification offered by Kriele. According to him, the guarantee of rights and freedoms is only possible (...) within the framework of the constitutional State. Hence, he advances a second related thesis, that democracy can only be developed in the constitutional State, that is, as constitutional democracy. However, this second thesis seems in contradiction with the first if the democratic principle implies popular sovereignty. To resolve this apparent antinomy, I will distinguish with Kriele two rival conceptions of democracy in order to point out the danger of misinterpreting the meaning of constitutional democracy. -/- En este trabajo examino la relación entre constitucionalismo y democracia, puesto que las supuestas tensiones entre ambos aparecen en los diagnósticos sobre la crisis de la democracia liberal. La cuestión se aborda a través de los argumentos del jurista alemán Martin Kriele, quien defiende la tesis de que no puede haber soberano en el Estado constitucional. Empezaré por explicar dicha tesis así como la justificación de ella que ofrece Kriele, para quien la garantía de los derechos y libertades sólo es posible en el marco del Estado constitucional. De ahí que avance una segunda tesis relacionada, cuando sostiene que la democracia sólo puede desarrollarse en dicho Estado constitucional, esto es, como democracia constitucional. Sin embargo, esta segunda tesis parece contradictoria con la primera si identificamos el principio democrático con la soberanía popular. Para resolver esa aparente antinomia, se distinguiré con Kriele dos concepciones rivales de la democracia, a fin de señalar el peligro de malinterpretar el sentido de la democracia constitucional.
