Der Vortrag zum Thema "Schmerzen", den der 100-jährige Hans-Georg Gadamer anläßlich des von der Orthopädischen Universitätsklinik Heidelberg am 11. November 2000 organisierten Symposions abhielt, war der letzte öffentliche Auftritt des großen Heidelberger Philosophen. In ihm formulierte Gadamer eine für das medizinische Kollegium ungeheure Provokation, indem er den Schmerz als eine lebenslange Aufgabe beschrieb, die, weit entfernt ein Makel oder gar Deformation des leidenden Individuums zu sein, sich vielmehr dem strukturell annähert, was Gadamer zeitlebens beschäftigt hat: der Hermeneutik. Der Akt des (...) Verstehens prägt auch das anschließende Gespräch zwischen Gadamer und dem Fachpublikum, in dem sich beide Seiten zögernd aufeinander zu bewegen. Das vorliegende Bändchen trägt dem in zweierlei Hinsicht Rechnung: Es gibt die freie, lebendige Rede Gadamers möglichst unverstellt wieder und flankiert die Anregungen Gadamers mit Überlegungen zum Phänomen "Schmerz" aus medizinischer und therapeutischer Sicht. Biometric facial recognition is an artificial intelligence technology involving the automated comparison of facial features, used by law enforcement to identify unknown suspects from photographs and closed circuit television. Its capability is expanding rapidly in association with artificial intelligence and has great potential to solve crime. However, it also carries significant privacy and other ethical implications that require law and regulation. This article examines the rise of biometric facial recognition, current applications and legal developments, and conducts an ethical analysis of (...) the issues that arise. Ethical principles are applied to mediate the potential conflicts in relation to this information technology that arise between security, on the one hand, and individual privacy and autonomy, and democratic accountability, on the other. These can be used to support appropriate law and regulation for the technology as it continues to develop. (shrink)

The effect of violent video games is among the most widely discussed topics in media studies, and for good reason. These games are immensely popular, but many seem morally objectionable. Critics attack them for a number of reasons ranging from their capacity to teach players weapons skills to their ability to directly cause violent actions. This essay shows that many of these criticisms are misguided. Theoretical and empirical arguments against violent video games often suffer from a number of significant shortcomings (...) that make them ineffective. This essay argues that video games are defensible from the perspective of Kantian, Aristotelian, and utilitarian moral theories. (shrink)

How homogenous are the sources of human motivation? Textbook Humeans hold that every human action is motivated by desire, thus any heterogeneity derives from differing objects of desire. Textbook Kantians hold that although some human actions are motivated by desire, others are motivated by reason. One question in this vicinity concerns whether there are states such that to be in one is at once take the world to be a certain way and to be motivated to act: the state-question. My (...) question here is different: whether passion and reason constitute distinct sources of human motivation: the source question. In this essay, I defend an affirmative answer to the source-question while remaining neutral on the state-question. I distinguish between what I call orectic desires, which are associated with the appetites, and anorectic desires, which are associated with judgments of the good. I argue that the two sorts of desires constitute distinct sources of motivation initially on the basis of their differing epistemological profiles. Specifically, self-attributions of anorectic desires are governed by the transparency condition, self-attributions of orectic desires are not. It emerges from this discussion that the motivation for performing an action arises in very different ways from each sort of desire. This difference, in turn, is explained by their differing relations to the will. Roughly, an orectic desire influences the will, but an anorectic desire is the will. The motivation to perform some of our actions derives simply from the determination that they are to-be-done—from reason. (shrink)

Dagegen wird hier die These vertreten, dass über Sinn und Unsinn des Einsatzes empirischer Methoden zunächst eine moralphilosophische Diskussion erforderlich ist. Medizinethiker müssen ausweisen können, welche empirischen Forschungsresultate zur Beantwortung normativer Fragen erforderlich sind. Ein solcher Ausweis beruht seinerseits jedoch auf normativen Annahmen, die ihrerseits moralphilosophischer Legitimation bedürfen. Der Beitrag untersucht (...) daher den Einsatz empirischer Methoden in der Medizinethik im Hinblick auf Verhältnis von ethischem Grundlagendiskurs und Methodologie der angewandten Ethik. Though ‘evil’ is often used loosely as merely the generic opposite of ‘morally good’, used precisely it is the worst possible term of opprobrium available. In this essay it is taken as applying primarily to persons, secondarily to conduct; evil deeds must flow from the volition to do something evil. An evil action is one so horrendously bad that no ordinary decent human being can conceive of doing it, and an evil person is one who knowingly wills or orders such (...) actions. Malignant evil—doing evil because it is evil—is not just possible but real, and is one of several kinds of evil delineated. There are incidental discussions of cruelty, Rosenbaum on Explaining Hitler, Baumeister on Evil, and Benn on wickedness. Although most styles of military ethics are hybrids that draw on multiple ethical theories, they are usually based primarily on the model of Aristotelian virtue ethics. Virtue ethics is well-suited for regulating the conduct of soldiers who have to make quick decisions on the battlefield, but its applicability to military personnel is threatened by the growing use of unmanned weapon systems. These weapons disrupt virtue ethics’ institutional and cultural basis by changing what it means to display virtue and transforming the (...) roles soldiers perform and the nature of the military profession itself. I argue that in light of these challenges to virtue ethics, at least as it is traditionally understood within the armed forces, soldiers operating unmanned weapons require a more heavily rule-based approach to military ethics. This essay analyzes the use of military robots in terms of the jus in bello concepts of discrimination and proportionality. It argues that while robots may make mistakes, they do not suffer from most of the impairments that interfere with human judgment on the battlefield. Although robots are imperfect weapons, they can exercise as much restraint as human soldiers, if not more. Robots can be used in a way that is consistent with just war theory when they are programmed to (...) avoid using force against all but the most clearly hostile targets. However, the essay also cautions against using robots for counterinsurgency because they may alienate people in the contested area and lead to an escalation of hostilities. (shrink)

Research on preference reversals has demonstrated a disproportionate influence of outcome probability on choices between monetary gambles. The aim was to investigate the hypothesis that this is a prominence effect originally demonstrated for riskless choice. Another aim was to test the structure compatibility hypothesis as an explanation of the effect. The hypothesis implies that probability should be the prominent attribute when compared with value attributes both in a choice and a preference rating procedure. In Experiment 1, two groups of undergraduates (...) were presented with medical treatments described by two value attributes (effectiveness and pain-relief). All participants performed both a matching task and made preference ratings. In the latter task, outcome probabilities were added to the descriptions of the medical treatments for one of the groups. In line with the hypothesis, this reduced the prominence effect on the preference ratings observed for effectiveness. In Experiment 2, a matching task was used to demonstrate that probability was considered more important by a group of participating undergraduates than the value attributes. Furthermore, in both choices and preference ratings the expected prominence effect was found for probability. (shrink)

The primary purpose of this randomized controlled trial (RCT) was to evaluate the efficacy of an unguided, two-week internet-based training program to overcome procrastination, called ON.TOP. Because adherence is a typical problem among individuals who tend to procrastinate, especially with internet-based interventions, the secondary purpose of the present study was to investigate whether adding SMS support increases subjects’ frequency of engagement in training. In a three-armed RCT (N = 161), the effects of the intervention alone and intervention with daily SMS-support (...) were compared to a waiting list control condition in a sample of students. The primary outcome of interest was procrastination. The secondary outcome of interest was the extent of training behavior. Baseline (T0), immediate post-treatment (T1) and 8-week post-treatment (T2) assessments were conducted. Results indicated that procrastination decreased significantly only with intervention group with daily SMS support, relative to control. Moreover, incorporating SMS support also may enhance extent of training behavior. (shrink)

The set of minimal indices of a Gödel numbering $\varphi$ is defined as ${\rm MIN}_{\varphi} = \{e: (\forall i < e)[\varphi_i \neq \varphi_e]\}$ . It has been known since 1972 that ${\rm MIN}_{\varphi} \equiv_{\mathrm{T}} \emptyset^{\prime \prime }$ , but beyond this ${\rm MIN}_{\varphi}$ has remained mostly uninvestigated. This paper collects the scarce results on ${\rm MIN}_{\varphi}$ from the literature and adds some new observations including that ${\rm MIN}_{\varphi}$ is autoreducible, but neither regressive nor (1,2)-computable. We also study several variants of (...) ${\rm MIN}_{\varphi}$ that have been defined in the literature like size-minimal indices, shortest descriptions, and minimal indices of decision tables. Philosophy students often struggle to master the complex skills needed to succeed in their work, especially in writing thesis-driven essays. Research over the past forty years on instructional scaffolding, both generally and as applied in philosophy, has helped teachers to refine both instruction and assignment design to improve students’ performance on complex philosophical tasks. This essay reviews the fundamentals of scaffolding in order to motivate and support some innovative in-class exercises and writing assignments that can help students develop even finer-grained (...) skills. These skills are useful both intrinsically and for their transfer to longer-form essays, to other philosophical work, and to the general academic and intellectual development of our students. The access problem for mathematics arises from the supposition that the referents of mathematical terms inhabit a realm separate from us. Quine’s approach in the philosophy of mathematics dissolves the access problem, though his solution sometimes goes unrecognized, even by those who rely on his framework. This paper highlights both Quine’s position and its neglect. I argue that Michael Resnik’s structuralist, for example, has no access problem for the so-called mathematical objects he posits, despite recent criticism, since he relies on (...) an indispensability argument. Still, Resnik’s structuralist does not provide an account of our access to traditional mathematical objects, and this may be seen as a problem. (shrink)

Crisis prevention plans are usually evaluated based on their effects in terms of preventing or limiting organizational crisis. In this survey-based study, the focus was instead on how such plans influence employees’ reactions in terms of risk perception and well-being. Five different organizations were addressed in the study. Hypothesis 1 tested the assumption that leadership crisis preparation would lead to lower perceived risk among the employees. Hypothesis 2 tested the conjecture that it would also lead to a higher degree of (...) well-being. Both hypotheses were supported. The results and their implications are discussed. (shrink)

In der deutschen medizinethischen Debatte spielen Verweise auf Menschenbilder eine große Rolle. Dabei haben diese Verweise ganz unterschiedliche argumentative Funktionen: Bisweilen sollen mit Bezug auf ein Menschenbild direkt moralische Normen begründet werden, aber Verweise auf Menschenbilder können auch andere Funktionen haben. Problematisch erweist sich jedoch, dass der Verweis auf ein „Bild“ vom Menschen voraussetzt, dass in einem einzigen Bild alle Aspekte, die für das Verständnis des Menschen wesentlich sind, erfasst werden können und damit die Vermittlung zwischen deskriptiven und normativen Dimensionen (...) als unproblematisch angesehen wird. Eine normative Begründungsfunktion des Menschenbildes ist jedoch aus verschiedenen moralphilosophischen Erwägungen heraus problematisch. Dagegen könnte eine Thematisierung eines umfassenden Verständnisses vom Menschen uns in der Tat helfen, metaphysische und ontologische Voraussetzungen moralischer Diskurse sichtbar und diskutierbar zu machen, die Bedingungen des menschlichen Handlungsraumes zu verstehen und das Moralische in einem weiteren Kontext praktischen Selbstverständnisses zu interpretieren. Die Mehrdimensionalität des Begriffs „Menschenbild“ lässt es fraglich erscheinen, ob der Begriff geeignet ist, medizinethische Fragen adäquat zu verstehen; zur Begründung von Handlungsnormen sind Menschenbilder eher ungeeignet. Our aim is to propose several itineraries which follow the scenario having as a first step Euclid’s Fifth Postulate; as a second step the Bolyai–Lobachevsky’s non-Euclidean geometries and as a third step Einstein’s relativity theory. The role of Euclid’s fifth postulate is successively assumed by Archimedes’ axiom; Zermelo’s choice axiom; Cantor’s continuum hypothesis; von Neumann’s foundation axiom for set theory; Church–Turing thesis and Turing’s computability; the validity of classical logic under the form of the principles of identity, non-contradiction and excluded (...) middle; the macroscopic universe assumed as form of existence, including the fact that humans are macroscopic beings; human language and semiosis assumed as the unique way to approach understanding and communication; the old Greek ideal of order, symmetry and harmony, adopted for representation of the world in Art and Poetry. The common denominator of these starting steps is the fact that they all correspond to the sensorial-empirical perception of the world. We point out the strong interaction among the steps corresponding, in these different itineraries, to Einstein’s relativity theory. We infer in this way the need of a transdisciplinary approach. This chapter examines an apparent tension created by recent research on neurological development and genetics on the one hand and cognitive development on the other. It considers what it might mean for intrinsic signals to guide the initial establishment of functional architecture. It argues that an understanding of the mechanisms by which the body develops can inform our understanding of the mechanisms by which the brain develops. It cites the view of developmental neurobiologists Fukuchi-Shimogori and Grove, that the patterning of (...) the part of the brain responsible for our higher functions is coordinated by the same basic mechanisms and signaling protein families used to generate patterning in other embryonic organs. Thus, what's good enough for the body, is good enough for the brain. (shrink)

The very title of Sidgwick’s great work is fascinating: the methods of ethics. We hear much—and persons a hundred years ago heard much—of the methods of science. But we hear very little of the methods of ethics. Is ethics a science? No, and Sidgwick never thought that it was. But he did think that the methods, or something of the spirit, of scientific investigation could be imported into ethical studies, with results which, though they would not necessarily be dramatic and (...) would certainly not be edifying, would nevertheless be worthwhile. Sidgwick himself characterized his work as “essentially an attempt to introduce precision of thought into a subject usually treated in a too loose and popular way”. “I have thought that the predominance in the minds of moralists of a desire to edify has impeded the real progress of ethical science; and that this would be benefited by an application to it of the same disinterested curiosity to which we chiefly owe the great discoveries of physics”. This paper describes a number of the most important recent changes in the character of ethics, Such as the revival of applied ethics and the effect this is having on ethical theory. In the process discusses some recent work of note and the new role in ethics of the notion of rights, And speculates on the possibility of ethics becoming a discipline separate from philosophy while at the same time remaining moral philosophy.

Forensic genomics now enables law enforcement agencies to undertake rapid and detailed analysis of suspect samples using a technique known as massively parallel sequencing (MPS), including information such as physical traits, biological ancestry, and medical conditions. This article discusses the implications of MPS and provides ethical analysis, drawing on the concept of joint rights applicable to genomic data, and the concept of collective moral responsibility (understood as joint moral responsibility) that are applicable to law enforcement investigations that utilize genomic data. The widespread and unconstrained use of this technology without appropriate legal protections of individual moral rights and associated accountability mechanisms, could potentially not only involve violations of individual moral rights but also lead to an unacceptable shift in the balance of power between governments and the citizenry. We argue that in light of the rights of victims and the security benefits for society, there is a collective moral responsibility for individuals to submit their DNA to law enforcement and for MPS to be used where other, less invasive techniques are not effective. However, this application should be limited by legislation, including that any data obtained should be directly relevant to the investigation and should be destroyed at the conclusion of the investigation. Er legt die Gedanken, die ihn selbst bewegen, in den Mund bewunderter Personlichkeiten Roms. Die Texte gelten als Hohepunkte seines philosophischen Gesamtwerks nicht zuletzt ihrer vollendeten Sprache wegen.".

Nach dem Vorbild Platons fasste Cicero den Plan, seiner Schrift "De re publica" eine Abhandlung ber die Gesetze folgen zu lassen. Der Dialog "De legibus" wird von Marcus Cicero, Atticus und Quintus Cicero, dem Bruder des Politikers, in heiter-entspannter Atmosph re auf seinem Landgut in Arpinum gef hrt. Es handelt sich um drei B cher ber rechtsphilosophische Grundfragen, die in einer kommentierenden Darstellung der Sakralgesetzgebung und des Zivilrechts veranschaulicht werden. Die 52/52 v. Chr. entstandene Schrift beweist Ciceros F higkeit, (...) ein schwieriges und auf den ersten Blick spr des Thema faszinierend darzustellen. Das gilt auch f r die "Paradoxa Stoicorum", die Cicero Anfang 46 v. Chr. verfasst und seinem Freund Brutus gewidmet hat. Mit Hilfe geschichtlicher und biographischer Beispiele ist es dem Autor gelungen, seine Leser auf anregende Weise f r die Dogmen der stoischen Ethik zu interessieren. (shrink)

cicero, als der unbestrittene Meister der romischen Beredsamkeit in Theorie und Praxis, hat sich in mehreren Werken mit der Theorie der Rhetorik befasst. In seinen "Partitiones oratoriae" stellt er die Rhetorik als System dar. Der literarischen Form nach handelt es sich um einen Dialog oder einen Katechismus in Frage und Antwort: Sohn Marcus darf seinen Vater im Urlaub anhand einer griechischen Vorlage examinieren. Uber die Datierung des Werks besteht keine Ubereinstimmung: Einiges spricht fur seine Entstehung im Jahre 56 v. (...) Chr., vieles dafur, dass es erst zehn Jahre spater niedergeschrieben wurde. Das straff gegliederte Werk gibt einen ausgezeichneten Einblick in die vielfaltigen Anforderungen, denen ein Redner gerecht werden musste und auch heute noch genugen muss.". (shrink)

In THE NATURE OF THE GODS, the eminent Roman statesman and philosopher Marcus Tullius Cicero (106-43 B.C.E.) analyzes the positions of the Stoic, Epicurean, and Academic schools on the existence and nature of the gods, and whether they act in the interests of humankind. In the dialogue of ON DIVINATION, Cicero and his brother Quintus examine various sorts of divination against Stoic principles.

This paper explores the relevance of Kant's categorical imperative to military ethics and the solution it suggests for improving the treatment of women in the military. The second formulation of the categorical imperative makes universal respect for humanity a moral requirement by asserting that one must always treat other people as means in themselves and never as merely means to an end. This principle is a promising guide for military ethics and can be reconciled with the acts of violence required (...) by war. This paper argues that it can also regulate soldiers? relations to each other and that it may contribute to reorienting military culture in a way that overcomes the biases against female military personnel.
