If Kant's account of rights had continued the "early modern Natural Law tradition", basing rights on some notion of human flourishing, there would be no difficulty about including socio-economic rights for the needy in his theory. However, his division of moral philosophy into Rechtslehre and Tugendlehre limits Rechtspflichten to duties that a moral agent can be coerced to fulfill. If a state is to give the needy statutory rights, the justification for using coercion on its citizens cannot be that they (...) have a duty of virtue to assist the needy. In order to determine whether such a justification can be found, the one innate socio-economic right Kant admits, a child's right to be cared for and educated, is examined and found to be a right against its parents, not against the state. Kant does, however, hold that a state should establish institutions to provide for abandoned children and for the poor in general. His justification for a state's use of coercion with regard to such statutory rights is considered and a criterion is suggested for the possible consent of its non-virtuous citizens to proposed measures for assistance to the needy. It is suggested that if advocates of aid to the needy cannot justify their proposals by such a criterion they will have to provide a very different account of rights than Kant gives in his Rechtslehre , which is concerned with the moral permissibility of using coercion. Um festzustellen, ob sich staatlicher Zwang in bezug auf solche Hilfspflichten überhaupt rechtfertigen läßt, erörtert der Beitrag das Recht des Kindes auf Fürsorge und Ausbildung als das eine und einzige angeborene sozio-ökonomische Recht, das Kant akzeptiert. Freilich ist das Recht des Kindes ein Recht gegen seine Eltern und nicht gegen den Staat. Gleichwohl nimmt Kant an, daß der Staat Einrichtungen schaffen sollte, die für verlassene Kinder und für die Armen im allgemeinen zu sorgen haben. Der Beitrag untersucht die Rechtfertigung, die Kant für die Anwendung von staatlichem Zwang zur Durchsetzung solcher positiv-gesetzlicher Rechte gibt, und arbeitet die Gründe dafür heraus, warum der nicht tugendhafte Staatsbürger in die vorgesehenen Hilfsmaßnahmen für die Bedürftigen einwilligen könnte. Wenn sich die Verfechter von Hilfsmaßnahmen für die Bedürftigen außerstande sehen, ihre Vorschläge auf Gründe dieser Art zu stützen, dann werden sie mit einem Konzept von subjektivem Recht aufwarten müssen, das sich von dem Konzept Kants von Recht und Rechtslehre , bei dem es allein um die moralische Erlaubtheit von Zwangsmaßnahmen geht, ganz erheblich unterscheidet. This book offers a defence of mathematical fictionalism, according to which we have no reason to believe that there are any mathematical objects. Perhaps the most pressing challenge to mathematical fictionalism is the indispensability argument for the truth of our mathematical theories (and therefore for the existence of the mathematical objects posited by those theories). According to this argument, if we have reason to believe anything, we have reason to believe that the claims of our best empirical theories are (at (...) least approximately) true. But since claims whose truth would require the existence of mathematical objects are indispensable in formulating our best empirical theories, it follows that we have good reason to believe in the mathematical objects posited by those mathematical theories used in empirical science, and therefore to believe that the mathematical theories utilized in empirical science are true. Previous responses to the indispensability argument have focused on arguing that mathematical assumptions can be dispensed with in formulating our empirical theories. This book, by contrast, offers an account of the role of mathematics in empirical science according to which the successful use of mathematics in formulating our empirical theories need not rely on the truth of the mathematics utilized. Renowned philosopher Mary Midgley explores the remarkable gap that has opened up between our own understanding of our sense of our self and today's scientific orthodoxy that claims the self to be nothing more than an elaborate illusion. Bringing her formidable acuity and analytic skills to bear, she exposes some very odd claims and muddled thinking on the part of cognitive scientists and psychologists when it comes to talk about the self. It is no more sensible to give a physical answer to a moral problem than it is to give political answers to physical ones. 'Are you an Illusion?' is an impassioned defence of the importance of our own experiences - the subjective sources of thought - which are every bit as necessary for the world as the objective ones such as brain cells. For many philosophers not automatically inclined to Platonism, the indispensability argument for the existence of mathematical objectshas provided the best (and perhaps only) evidence for mathematicalrealism. Recently, however, this argument has been subject to attack, most notably by Penelope Maddy (1992, 1997),on the grounds that its conclusions do not sit well with mathematical practice. I offer a diagnosis of what has gone wrong with the indispensability argument (I claim that mathematics is indispensable in the wrong way), and, taking my cue (...) from Mark Colyvan''s (1998) attempt to provide a Quinean account of unapplied mathematics as `recreational'', suggest that, if one approaches the problem from a Quinean naturalist starting point, one must conclude that all mathematics is recreational in this way. Preservationism is a dominant account of the justification of beliefs formed on the basis of memory. According to preservationism, a memory belief is justified only if that belief was justified when it was initially held. However, we now know that much of what we remember is not explicitly stored, but instead reconstructed when we attempt to recall it. Since reconstructive memory beliefs may not have been continuously held by the agent, or never held before at all, a purely preservationist account (...) of memory does not allow for justified reconstructed memory beliefs. In this essay, I show how a process reliabilist account can maintain preservationism about reproductive memory beliefs while accommodating the justification of reconstructive memory beliefs. I argue that reconstructive memory is an inferential process, and that therefore the beliefs it produces are justified in the same way that other inferential beliefs are justified. Accordingly, my process reliabilist account combines a preservationist account of reproductive memory with an inferential account of reconstructive memory. Background:Clinical investigation is a growing field employing increasing numbers of nurses. This has created a new specialty practice defined by aspects unique to nursing in a clinical research context: the objectives, setting, and nature of the nurse–participant relationship. The clinical research nurse role may give rise to feelings of ethical conflict between aspects of protocol implementation and the duty of patient advocacy, a primary nursing responsibility. Little is known about whether research nurses experience unique ethical challenges distinct from those experienced (...) by nurses in traditional patient-care settings.Research objectives:The purpose of the study was to describe the nature of ethical challenges experienced by clinical research nurses within the context of their practice.Research design:The study utilized a qualitative descriptive design with individual interviews.Participants and research context:Participating nurses self-identified as having experienced ethical challenges during screening. The majority were Caucasian, female, and worked in outpatient settings. Approximately 50% had > 10 years of research experience.Ethical considerations:The human subjects review board approved the study. Written informed consent was obtained.Findings:Predominant themes were revealed: the inability to provide a probable good, or/do no harm, and dual obligations. The following patterns and subthemes emerged: conflicted allegiances between protocol implementation, needs of the participant, desire to advance science, and tension between the nurse–patient therapeutic relationship versus the research relationship.Discussion:Participants described ethical challenges specific to the research role. The issues are central to the nurse–participant relationship, patient advocacy, the nurse’s role in implementing protocols, and/or advancing science.Conclusion:Ethical challenges related to the specialized role of clinical research nurses were identified. More research is warranted to fully understand their nature and frequency and to identify support systems for resolution. (shrink)

This is the first critically evaluative study of Gaston Bachelard's philosophy of science to be written in English. Bachelard's professional reputation was based on his philosophy of science, though that aspect of his thought has tended to be neglected by his English-speaking readers. Dr Tiles concentrates here on Bachelard's critique of scientific knowledge. Bachelard emphasised discontinuities in the history of science; in particular he stressed the ways of thinking about and investigating the world to be found in modern science. This, (...) as the author shows, is paralleled by those debates among English-speaking philosophers about the rationality of science and the 'incommensurability' of different theories. To these problems Bachelard might be taken as offering an original solution: rather than see discontinuities as a threat to the objectivity of science, see them as products of the rational advancement of scientific knowledge. Dr Tiles sets out Bachelard's views and critically assesses them, reflecting also on the wider question of how one might assess potentially incommensurable positions in the philosophy of science as well as in science itself. Conscientious objection has become a divisive topic in recent bioethics publications. Discussion has tended to frame the issue in terms of the rights of the healthcare professional versus the rights of the patient. However, a rights-based approach neglects the relational nature of conscience, and the impact that violating one’s conscience has on the care one provides. Using medical assistance in dying as a case study, we suggest that what has been lacking in the discussion of conscientious objection thus far is (...) a recognition and prioritising of the relational nature of ethical decision-making in healthcare and the negative consequences of moral distress that occur when healthcare professionals find themselves in situations in which they feel they cannot provide what they consider to be excellent care. We propose that policies that respect the relational conscience could benefit our healthcare institutions by minimising the negative impact of moral distress, improving communication among team members and fostering a culture of ethical awareness. Constructive responses to moral distress including relational cultivation of moral resilience are urged. (shrink)

A phenomenological approach to mathematical practice is sketched out, and some problems with this sort of approach are considered. The approach outlined takes mathematical practices as its data, and seeks to provide an empirically adequate philosophy of mathematics based on observation of these practices. Some observations are presented, based on two case studies of some research into the classification of C*-algebras. It is suggested that an anti-realist account of mathematics could be developed on the basis of these and other studies, (...) locating the substance of mathematics in the various informal argument methods used by mathematicians. Anticipation plays a role in language comprehension. In this article, we explore the extent to which verb sense influences expectations about upcoming structure. We focus on change of state verbs like shatter, which have different senses that are expressed in either transitive or intransitive structures, depending on the sense that is used. In two experiments we influence the interpretation of verb sense by manipulating the thematic fit of the grammatical subject as cause or affected entity for the verb, and test (...) whether readers’ expectations for a transitive or intransitive structure change as a result. This sense‐biasing context influenced reading times in the postverbal regions. Reading times for transitive sentences were faster following good‐cause than good‐theme subjects, but the opposite pattern was found for intransitive sentences. We conclude that readers use sense‐contingent subcategorization preferences during on‐line comprehension. (shrink)

This paper seeks to examine the plausibility of the concept of ‘Civic Friendship’ as a philosophical model for a conceptualisation of ‘belonging’. Such a concept, would hold enormous interest for educators in enabling the identification of particular virtues, attitudes and values that would need to be taught and nurtured to enable the civic relationship to be passed on from generation to generation. I consider both of the standard arguments for civic friendship: that it can be understood within the Aristotelian typology (...) as either a form of utility friendship or as a form of virtue friendship. I argue that civic friendship may not be the most appropriate model and that attempts to resolve the problems through looking on it as a political metaphor leave it unable to fulfil the function for which it was originally designed in Ancient Greece. Finally, I emphasize the need to carefully consider which particular metaphors we choose for civic relationships and how we subsequently use them. (shrink)

This article revisits the account of magnanimity offered by Thomas Aquinas, in his Commentary on the Nicomachean Ethics of Aristotle and especially in his Summa Theologiae. Recent scholarship has viewed Aquinas' magnanimity as essentially Aristotle's, complemented by the addition of charity and humility to the classical moral horizon. By contrast, I read Aquinas as offering a subtle yet far-reaching critique of important aspects of Aristotelian magnanimity, a critique with roots in Aquinas' theology, yet also comprising a significant philosophic reappraisal of (...) Aristotle's account of human excellence. Against contentions that Aquinas' ethical revisionism is antithetical to civic common sense, the requirements of statesmanship, and the rational foundations of social science, I argue that Aquinas' theory is politically salutary and theoretically enlightening. Moreover, I suggest that recent dissident reflection on twentieth-century totalitarian experience underscores both the humanity and the nobility of a humility-informed magnanimity, such as that advocated by Thomas Aquinas. The Metaphysics of Morals is Kant's major work in applied moral philosophy in which he deals with the basic principles of rights and of virtues. It comprises two parts: the 'Doctrine of Right', which deals with the rights which people have or can acquire, and the 'Doctrine of Virtue', which deals with the virtues they ought to acquire. Mary Gregor's translation, revised for publication in the Cambridge Texts in the History of Philosophy series, is the only complete translation of (...) the whole text, and includes extensive annotation on Kant's difficult and sometimes unfamiliar vocabulary. A new introduction by Roger Sullivan sets the work in its historical and philosophical context. This volume will be of wide interest to students of ethics and of legal and political philosophy. According to Ernst Gombrich, cartoons provide us the chance to “study the use of symbols in a circumscribed context [and] find out what role the image may play in the household of our mind” (Gombrich 1973, 190). This paper looks at some underexplored implications and outcomes of Ernst Gombrich’s conceptual schemata when such a schemata is applied to cartoons. While we might easily avoid defamatory reference when picking out a subject in writing or speech, cartoon depictions, especially those unaccompanied by (...) speech bubbles or captions, often rely on a visual symbolism typified by the warping of some features the removal of others, and the manifestation of some visual trope or other, more easily lend themselves to defamatory reference. While harms to the referent are many in cases of defamatory cartoons, this paper focuses on the harms to the viewers of such cartoons by the depicter’s message and mode of representation, unique to the cartoon form. I will focus on the harms of misinformation of the viewer by the visual schemata (Gombrich 1960) present in certain cartoons, and the way this misinformative visual schemata (Ibid) may also restrict the possibility of conceptual revisions in its viewership. Harms of this kind come out uniquely in cartoons via norms of cartooning (as a particularly stylized and symbolic mode of visual representation) and the norms of interaction employed in the act of viewing a cartoon. As we’ll see in our case study of the infamous Jyllands Posten cartoons of Muhammad the Prophet, even in cases where a cartoon representation bears no visual similarity to its referent, viewers can easily and reliably pick out the referent by calling to mind, in our focal case, the defamatory stereotypes, stock figures and icons inextricably linked with the referent. I argue that the damage to viewers of these sorts of depictions lies not in the fact that the viewer manages to pick out the intended referent of the depiction but what tools they use to pick out the referent and how such tools of reference (mis)inform their understanding of the referent they’ve picked out. After we die, our persona may live on in the minds of the people we know well. Two essential elements of this process are mourning and acts of commemoration. These behaviors extend well beyond grief and must be cultivated deliberately by the survivors of the deceased individual. Those who are left behind have many ways of maintaining connections with their deceased, such as burials in places where the living are likely to return and visit. In this way, culturally defined places (...) often serve as metaphors of social association and shared experience. Humans are the only kind of animal that buries their dead, and this gesture is preserved in Paleolithic sites as early as 120,000 years ago. Though not the only method of honoring the dead in human cultures, the emergence of burial traditions in the Middle Paleolithic implies that both Neandertals and early anatomically modern humans had already begun to conceive of the individual as unique and irreplaceable. Claims of primitive mortuary behavior in earlier periods than the Middle Paleolithic fall short in that they lack any signs of positive social-spatial associations between the deceased and survivors. The archaeological evidence for burial behavior in the Middle Paleolithic provides the first clear translation of mourning into a stereotypical action. These burials therefore may represent the first ritualized bridge between the living and the deceased in human evolutionary history. (shrink)

"Charming, interesting, thought-provoking and a great read." Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by (...) Nazi Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today.
