Proportionality in Action presents an empirical and comparative exploration of the proportionality doctrine, based on detailed accounts of the application of the framework by apex courts in six jurisdictions: Germany, Canada, South Africa, Israel, Poland and India. The analysis of each country is written and contextualized by a constitutional scholar from the relevant jurisdiction. Each country analysis draws upon a large sample of case law and employs a mixed methodological approach: an expansive coding scheme allows for quantitative analysis providing comparable (...) and quantifiable measurements, which is enriched by qualitative analysis that engages with the substance of the decisions and captures nuance, contextualizing the data and providing it with meaning. The book concludes with a comparative chapter that synthesizes some of the most interesting findings. Focusing on deviations of the practice of proportionality from theory, the authors conclude their argument in support of an integrated approach to the application of proportionality. (shrink)

The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. The article presents and evaluates the Judgment, particularly the relation between the substantive moral questions involved and the aspect of authorization. (shrink)

Mordechai Rotenberg, who is well known for his work on the pessimistic impact of Protestant ethics on the Western social sciences, presents here a systematic study derived from, and based on, Judeo-Hasidic ethics. Proceeding from the cabalistic-Hasidic concept of contraction (tzimtsum), according to which God's voluntary withdrawal into Himself to evacuate space for the world serves as a model for human behavior, Professor Rotenberg shows that it is not personal-social construction, but self- and social contraction, that explains how the (...) The Calvinist view that man is predestined to be among the elect or the damned has profoundly influenced not only our views of criminals and deviants, but also the theoretical basis of correctional methods and psychotherapeutic techniques. Abstract:This essay explores with the help of the discipline of philosophy of education the educational implications of the practice of canceling individuals or ideas. In particular, it investigates what gets lost or undermined when we cancel various opinions, words, and practices. To advance my argument, I first introduce some basic definitions while analyzing the problem with the notion of cancel culture. Then, I briefly review various historical examples of canceling going back to Socrates. The next part of this paper presents (...) some of the philosophical arguments against canceling and restricting speech made by John Stuart Mill. After presenting Mill’s contentions in favor of liberty of expression, I revisit John Dewey’s conception of democratic association in order to show that the practice of canceling people and ideas is antithetical to Dewey’s dynamic view of democracy. Based on the insights of Mill and Dewey, in the final part I attempt to make an educational case against the practice of canceling. (shrink)

Hegelian‐Marxian doctrines of dialectic progress through war and conflict are traced to Christian theosophy of historical necessity and “imperialistic missionarism.” Jewish fossilized existence is traced to its antiproselytizing “kibbutz” ideology of dialogic coexistence. Tolerance is possible either through an ideological balance of terror between equal opposing powers or through mutual volitionary space evacuating Cabalic style contraction. According to the Biblical definition of covenant, brit, a coexisting shalom (peace) is possible only through separating and rebinding which comprises the shalem (complete). Japanese (...) Makuya Christianity is presented as an anti‐imperialistic model for mutual contraction facilitating the coexisting shalom‐shalem between equals who are different but not indifferent to each other. Yet, the conversations taking place on this issue have been largely uninformed, lacking intellectual rigor, and devoid of the historical and cultural context that could help make the contested debates more enlightening. The author investigates the phenomenon of cancelling historically as well as how it (...) became an issue recently. The book presents some compelling philosophical arguments against the practice of cancelling and highlights various educational dangers and risks that emerge from this practice and deserve our attention. In this essay, Mordechai Gordon interprets Martin Buber's ideas on dialogue, presence, and especially his notion of embracing in an attempt to shed some light on Buber's understanding of listening. Gordon argues that in order to understand Buber's conception of listening, one needs to examine this concept in the context of his philosophy of dialogue. More specifically, his contention is that closely examining Buber's notion of embracing the other is critical to making sense of his conception of listening. Gordon's (...) analysis suggests that, in Buber's model, listening involves a kind of active attentiveness to another's words or actions, engaging them as though they are directed specifically at us. Gordon's discussion of dialogue and listening also indicates that the relation between speaking and listening is one of reciprocity and mutual dependence and that listening plays an essential role in initiating many dialogues by creating a space in which two people can embrace each other as complete individuals.
