This is a selection of essays on moral responsibility that represent the major components of John Martin Fischer's overall approach to freedom of the will and moral responsibility. The collection exhibits the overall structure of Fischer's view and shows how the various elements fit together to form a comprehensive framework for analyzing free will and moral responsibility. The topics include deliberation and practical reasoning, freedom of the will, freedom of action, various notions of control, and moral accountability. The (...) essays seek to provide a foundation for our practices of holding each other (and ourselves) morally and legally accountable for our behavior. A crucial move is the distinction between two kinds of control. According to Fischer, "regulative control" involves freedom to choose and do otherwise ("alternative possibilities"), whereas "guidance control" does not. Fischer contends that guidance control is all the freedom we need to be morally responsible agents. Further, he contends that such control is fully compatible with causal determinism. Additionally, Fischer argues that we do not need genuine access to alternative possibilities in order for there to be a legitimate point to practical reasoning. Fischer's overall framework contains an argument for the contention that guidance control, and not regulative control, is associated with moral responsibility, a sketch of a comprehensive theory of moral responsibility (that ties together responsibility for actions, omissions, consequences, and character), and an account of the value of moral responsibility. On this account, the value of exhibiting freedom (of the relevant sort) and thus being morally responsible for one's behavior is a species of the value of artistic self-expression. (shrink)

Content- relativism is a semantic theory that states that the content of an uttered sentence can vary according to some feature of an assessment context. This paper has two objectives. The first is to determine which features a motivational case for content- relativism would display – what would a good case for content- relativism look like? The second is to consider cases that appear to have the required features and evaluate their prospects as motivational cases. I identify two varieties of (...) motivational case for content- relativism : content interpretation and content enhancement. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. The author also notes a number of gender-egalitarian trends that have stalled. (shrink)

A major obstacle for materialist theories of the mind is the problem of sensory consciousness. How could a physical brain produce conscious sensory states that exhibit the rich and luxurious qualities of red velvet, a Mozart concerto or fresh-brewed coffee? Caging the Beast: A Theory of Sensory Consciousness offers to explain what these conscious sensory states have in common, by virtue of being conscious as opposed to unconscious states. After arguing against accounts of consciousness in terms of higher-order representation of (...) mental states, the theory claims that sensory consciousness is a special way we have of representing the world. The book also introduces a way of thinking about subjectivity as separate and more fundamental than consciousness, and considers how this foundational notion can be developed into more elaborate varieties. An appendix reviews the connection between consciousness and attention with an eye toward providing a neuropsychological instantiation of the proposed theory. (shrink)

Stigma taints individuals with a spoiled identity and loss of status or discrimination. This article is the first to examine the stigma attached to abortion and surrogacy and consider how law may stigmatize women for failing to conform to social expectations about maternal roles. Courts should consider evidence of stigma when evaluating laws regulating abortion or surrogacy to determine whether these laws are based on impermissible gender stereotyping.

There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. While Aristotle's account of the happy life continues to receive attention, many of his claims about virtue of character seem so puzzling that modern philosophers have often discarded them, or have reworked them to fit more familiar theories that do not make virtue of character central. Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. The very reasons leading theorists of testimony have for thinking that assertion can be testimony are equally reasons (...) for thinking semantic presupposition can be testimony. (shrink)

There are many introductions to the animal ethics literature. There aren't many introductions to the practice of doing animal ethics. Bob Fischer's Animal Ethics: A Contemporary Introduction fills that gap, offering an accessible model of how animal ethics can be done today. The book takes up classic issues, such as the ethics of eating meat and experimenting on animals, but tackles them in an empirically informed and nuanced way. It also covers a range of relatively neglected issues in animal (...) ethics, such as the possibility of insect sentience and the ethics of dealing with pests. Finally, the book doesn't assess every current practice using standard ethical theories, but tries to evaluate some of them using the moral frameworks endorsed by those involved. So, for instance, there is a chapter on the way that animal care and use committees try to justify some of the educational uses of animals, and the chapter on zoos considers the way that international zoological societies justify compromising animal welfare. The book wraps up with a discussion of the future of animal ethics. Forgiveness as a positive response to wrongdoing is a widespread phenomenon that plays a role in the moral lives of most persons. Surprisingly, Kant has very little to say on the matter. Although Kant dedicates considerable space to discussing punishment, wrongdoing and grace, he addresses the issues of human forgiveness directly only in some short passages in the Lectures on Ethics and in one passage of the Metaphysics of Morals. As noted by Sussman, the TL passage, however, betrays some ambivalence. (...) Kant establishes a duty of virtue to be forgiving (TL, 6:460), yet he immediately warns against its excess: meek toleration of recurrent wrongs could manifest a lack of self-respect and a violation of a duty to oneself (TL, 6:461). Sussman claims that this ambivalence ultimately arises from the fact that forgiveness sits uncomfortably in Kant’s moral thought. First, forgiveness has an ‘ineluctably elective aspect’ that makes it, to a certain extent, arbitrary and dependent on particular features of the forgiver’s psychology and, as such, in tension with Kant’s central claims that human beings are autonomous agents capable of determining their own moral status. Second, according to Sussman, Kant’s moral retributivism, i.e. ‘the particular moral position that every moral wrong against another deserves punishment of the wrongdoer’ seems to be in tension with the possibility of a ‘truly redemptive forgiveness’. Moreover, forgiveness also seems to be in tension with a passage of the Religion in which Kant argues that the moral guilt from our original evil disposition cannot be understood as a debt or liability that can be compensated, erased, transferred or otherwise wiped out by others (Rel, 6:72). Thus, to the extent that forgiveness might be thought to involve the forgoing of moral guilt, it seems incompatible with Kant’s views on culpability and punishment. This chapter seeks to clarify Kant’s views on forgiveness in order to show that, although not often appreciated, personal forgiveness plays an important role in the lives of ordinary human agents as understood by Kant. In particular, I aim to show there is a conception of forgiveness available to Kant that is not incompatible with Kant’s views of punishment and culpability. In Section 1, I argue that, for Kant, far from being merely ‘elective,’ forgiveness is, under certain conditions, morally required. I provide a brief summary of an interpretation of Kant’s theory of forgiveness that I have defended in recently published work , in order to argue that Kant’s duty to be forgiving should be understood as an imperfect duty of virtue which is conditional on repentance. Kant is not ambivalent about this duty because he maintains that when the relevant conditions are not met, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. The TL passage thus identifies two different duties. In Section 2, I show that forgiveness, as conceptualised by Kant, does not require the forgoing of punishment or the overcoming of moral guilt and that this could, in fact, be seen as an attractive feature of Kant’s position. In this paper I explore in a preliminary way the interconnections among narrative explanation, narrative value, free will, an immortality. I build on the fascinating an suggestive work of David Velleman. I offer the hypothesis that our acting freely is what gives our lives a distinctive kind of value - narrative value. Free Will, then, is connected to the capacity to lead a meaningful life in a quite specific way: it is the ingredient which, when aded to others, enows us (...) with a meaning over an above the cumulative value erived from ading together levels of momentary welfare. In acting freely, we are writing a sentence in the story of our lives, and the value of acting freely is thus a species of the value of artistic creativity or self-expression (understood appropriately). Finally, I contend that the fact that our lives are stories need not entail that they have endings, or that immortality would necessarily be unimaginable or essentially different from ordinary, finite human life. Yes, a certain sort of narrative understanding of our lives as a whole would be impossible in the context of immortality; but much of what we care about, and value, in our stories might remain. Inspired by discussions with a number of nurse philosophers at the 2008 Knowledge Conference in Boston, two of the original Manifesto authors and two colleagues discussed the need to explicate emancipatory knowing as it emerged from the Manifesto . This paper adds to what is already known on this topic, as there is not an explicit contribution to the literature of this specific Manifesto , its significance, and utility for the discipline. While each of us have written on emancipatory knowing and social justice in a variety of works, it is in this article that we identify, as a unit of knowledge production and as a direction towards praxis, a set of critical values that arose from the emancipatory conscience-ness and intention seen in the framework of the Nursing Manifesto. Stanley Cavell's work is distinctive not only in its importance to philosophy but also for its remarkable interdisciplinary range. Cavell is read avidly by students of film, photography, painting, and music, but especially by students of literature, for whom Cavell offers major readings of Thoreau, Emerson, Shakespeare, and others. In this first book-length study of Cavell's writings, Michael Fischer examines Cavell's relevance to the controversies surrounding poststructuralist literary theory, particularly works by Jacques Derrida, J. Hillis Miller, Paul de Man, (...) and Stanley Fish. Throughout his study, Fischer focuses on skepticism, a central concern of Cavell's multifaceted work. Cavell, following J. L. Austin and Wittgenstein, does not refute the radical epistemological questioning of Descartes, Hume, and others, but rather characterizes skepticism as a significant human possibility or temptation. As presented by Fischer, Cavell's accounts of both external-world and other-minds skepticism share significant affinities with deconstruction, a connection overlooked by contemporary literary theorists. Fischer follows Cavell's lead in examining how different genres address the problems raised by skepticism and goes on to show how Cavell draws on American and English romanticism in fashioning a response to it. He concludes by analyzing Cavell's remarks about current critical theory, focusing on Cavell's uneasiness with some of the conclusions reached by its practitioners. Fischer shows that Cavell's insights, grounded in powerful analyses of Descartes, Hume, and Wittgenstein, permit a fresh view of Derrida, Miller, de Man, and Fish. The result is not only a revealing characterization of deconstruction but a much-needed and insightful introduction to Cavell's rich but difficult oeuvre. (shrink)

We extend meet-combination of logics for capturing the consequences that are common to both logics. With this purpose in mind we define meet-combination of consequence systems. This notion has the advantage of accommodating different ways of presenting the semantics and the deductive calculi. We consider consequence systems generated by a matrix semantics and consequence systems generated by Hilbert calculi. The meet-combination of consequence systems generated by matrix semantics is the consequence system generated by their product. On the other hand, the (...) meet-combination of consequence systems generated by Hilbert calculi is the consequence system generated by their interconnection. We investigate preservation of several properties. Capitalizing on these results we show that interconnection provides an axiomatization for the product. Illustrations are given for intuitionistic and modal logics, Łukasiewicz logic and some paraconsistent logics. (shrink)

In this essay, Paula McAvoy critiques a commonly held view that teaching young people to be good choice makers should be a central aim of sex education. Specifically, she argues against David Archard's recommendation that sex educators ought to focus on the development of autonomy and teaching young people that “choice should be accorded the central role in the legitimation of sexual conduct.” Instead, McAvoy argues that under conditions of gender inequality this view advantages boys and disadvantages girls. Juxtaposing (...) a case of a culturally arranged marriage with a spring break scene from Ariel Levy's Female Chauvinist Pigs: Women and the Rise of Raunch Culture, McAvoy shows that focusing on sexual choice making obscures and reifies the unequal social conditions that young people navigate. She concludes by suggesting an alternative that is in line with Sharon Lamb's argument in “Just the Facts? The Separation of Sex Education from Moral Education” that intimate encounters are better governed by attending to our ethical obligations to others. (shrink)

I am going to argue that it is a cost of libertarianism that it holds our status as agents hostage to theoretical physics, but that claim has met with disagreement. Some libertarians regard it as the cost of doing business, not a philosophical liability. By contrast, Peter van Inwagen has addressed the worry head on. He says that if he were to become convinced that causal determinism were true, he would not change his view that humans are free and morally (...) responsible. Rather, he would give up at least one of the formerly-thought-to-be a priori truths that are elements in his argument for the incompatibility of causal determinism and the relevant sort of freedom. Thus, according to van Inwagen, our status as free and morally responsible agents would not be held hostage to the physicists or hang on a thread I think that van Inwagen’s strategy for securing our freedom and responsibility is unattractive. Somewhat tendentiously, I have called the rejection of an a priori ingredient in the incompatibilist’s argument, contingent upon learning that causal determinism is true, ‘metaphysical fip-flopping.’ -/- And it does seem that van Inwagen’s approach is implausible insofar as he is open to such metaphysical fip-fopping. That he is open to it—that he would fip-fop if he became convinced of the truth of causal determinism—is a problem for his actual philosophical position. Or so I will argue. (shrink)

In his recent book on the problem of evil, Peter van Inwagen argues that both the global and local arguments from evil are failures. In this paper, we engagevan Inwagen’s book at two main points. First, we consider his understanding of what it takes for a philosophical argument to succeed. We argue that while his criterion for success is interesting and helpful, there is good reason to think it is too stringent. Second, we consider his responses to the global and (...) local arguments from evil. We argue that although van Inwagen may have adequately responded to each of these arguments, his discussion points us toa third argument from evil to which he has yet to provide a response. (shrink)

Brain functions are stochastic processes without intentionality whereas mind emerges from brain functions as a Hegelian “change from quantity”, that is, on the order of 1012 profusely interconnected neurons, “into a new quality”: the collective phenomenon of the brain's self-experience. This self-referential and self-observing quality we have in mind is capable of (recursively) observing its self-observations, i.e., interpreting change that is meaningful in relation to itself. The notion of self-interpretation embodies the idea of a “hermeneutic circle”, that is, (in interpretation (...) theory) the treatment of the whole in relation to its parts. (shrink)

According to the authors of Populism and Civil Society, ‘populism is situated within the democratic imaginary’ but its logic is authoritarian. This article agrees with the first but challenges the second argument by focussing on the question of representation. In the case of ‘populism as government’ the tensions between bottom-up and top-down articulations seem to be more or less resolved by the repression of bottom-up organization, but in so doing, so the argument of this article, populism is mutating into something (...) else. Furthermore, ‘populist dictatorship’ seems to be closer to a dictatorship strategically using populist tools than to an intrinsic populist logic. While I agree with the authors on the authoritarian cases of populism in government, my argument diverges from the book when it comes to populism as government and introduces a discussion about the nature of populism. To this purpose, I first propose a complex definition of populism which understands populism not as the essence, but as one component of hybrid authoritarian formations, thus enabling the disentanglement of populism, authoritarianism, and totalitarianism. Second, I examine two components of populism that Arato and Cohen lay out in the book: the specific representation pars pro toto and embodiment. Building on Lefort, I argue that these components are not populist but totalitarian and that the empirical manifestations of populism are always hybrid, mixing populist and authoritarian or even totalitarian components. Experimental philosophy’s much-discussed ‘restrictionist’ program seeks to delineate the extent to which philosophers may legitimately rely on intuitions about possible cases. The present paper shows that this program can be (i) put to the service of diagnostic problem-resolution (in the wake of J.L. Austin) and (ii) pursued by constructing and experimentally testing psycholinguistic explanations of intuitions which expose their lack of evidentiary value: The paper develops a psycholinguistic explanation of paradoxical intuitions that are prompted by verbal case-descriptions, and presents two (...) experiments that support the explanation. A full answer to this question requires two different sorts of theory. The first sort considers what all these conscious sensory states have in common, by virtue of being conscious as opposed to unconscious states. The second sort (...) considers what distinguishes conscious sensory-states from each other, for example, how the qualities in a conscious sensory state of red velvet differ from those of a Mozart concerto. I propose a theory of the first sort, that is, an explanation of the distinction between conscious and unconscious sensory states. ;According to the second sense theory, conscious sensory states are coordinated sensory representations of the present moment produced by a second sense. Three elements are necessary and jointly sufficient for sensory consciousness. Sensory representations must be coordinated toward action in the world. The representations included in the content of a conscious sensory state are those that will aid the creature in assessing current environmental conditions according to the task at hand. Conscious sensory states represent states of affairs as occurring at the present moment. In other words, sensory consciousness is constituted by the coordination of sensory representations into a representation of what is happening 'now.' The mechanism responsible for coordinating sensory representations into conscious sensory states is the second sense. A second sense mechanism explains how some sensory representations become coordinated into a conscious sensory state while others remain unconscious. ;In addition to providing an explanation of sensory consciousness, the second sense theory is nicely suited to a Gibsonian account of subjectivity, whereby information about the subject is specified simultaneously in perception with information about the object. I argue that the subject, at its most bare, is the locus of an egocentric map, the zero point of a coordinate system which specifies objects according to here. (shrink)

Does neuroscience show that free will is an illusion? No, it shows that unconscious mental states are causally effective in action. Because free will includes initiation by both conscious and unconscious states, the self as free agent should be characterized in terms of more than her conscious deliberations to range over unconscious beliefs, memories and feelings. Further, the ways social relations influence action and the ways actions influence the social environment are relevant to a full account of free will. Given (...) this broader perspective, it is clear that recent neuroscientific studies only show that the conscious feeling of volition does not play the agential role it seems to play. Consciousness is nonetheless causally effective in planning and monitoring actions to ensure they conform to goals. This causal process unfolds over a span of time and encompasses a wide array of factors. (shrink)

In this collection of essays on the metaphysical issues pertaining to death, the meaning of life, and freedom of the will, John Martin Fischer argues that death can be a bad thing for the individual who dies. He defends the claim that something can be a bad thing--a misfortune--for an individual, even if he never experiences it as bad. Fischer also defends the commonsense asymmetry in our attitudes toward death and prenatal nonexistence: we are indifferent to the time (...) before we are born, but we regret that we do not live longer. Further, Fischer argues, that immortal life could be desirable, and shows how the defense of the badness of death and the goodness of immortality exhibit a similar structure; on Fischer's view, the badness of death and the goodness of life can be represented on spectra that display certain continuities. Building on Fischer's previous book, My Way a major aim of this volume is to show important connections between issues relating to life and death and issues relating to free will. More specifically, Fischer argues that we endow our lives with a certain distinctive kind of meaning--an irreducible narrative dimension of value--by exhibiting free will. There are two perspectives from which formal theories can be viewed. On the one hand, one can take a theory to be about some privileged models. On the other hand, one can take all models of a theory to be on a par. In contrast with what is usually done in philosophical debates, we adopt the latter viewpoint. Suppose that from this perspective we want to add an adequate truth predicate to a background theory. Then on the one hand the (...) truth theory ought to be semantically conservative over the background theory. At the same time, it is generally recognised that the central function of a truth predicate is an expressive one. A truth predicate ought to allow us to express propositions that we could not express before. In this article we argue that there are indeed natural truth theories which satisfy both the demand of semantical conservativeness and the demand of adequately extending the expressive power of our language.
