An important part of responsible business practices is compliance with the law. This article details what actually happens when the laws of the host country fail to ensure adequate protection. The focus here is on land dispossession and loss of livelihood in relation to a gold mine project in central Ghana. How is it that a well‐known international company—Newmont—with its own corporate social responsibility (CSR) statements sets up a project in the year 2003 that displaces subsistence farmers from their land (...) without compensating in cash or with replacement land? The analysis identifies the factors that lead the company to not compensate farmers for their lost land: cost‐cutting, strict adherence to the law, CSR commitment that was new and not internalized, complexities of the Ghanaian land tenure system, peer pressure to preserve the status quo, selection of an “old‐school” CSR manager, and the inadequacy of Ghanaian mining law to account for relatively novel, “open‐pit” mining techniques. However, the specter of famine raised by civil society activism, the involvement of the International Financial Corporation, and a better qualified CSR team constitute another set of factors that lead to a comprehensive package of livelihood improvement measures. There is a contrast between the complexity, long‐term, and advanced type of assistance Newmont currently envisages and the backward, short‐term, formalism, and brutality of denying compensation for land back in 2003. Leading invasion biologists sometimes dismiss critics and criticisms of their field by invoking “the straw man” fallacy. Critics of invasion biology are also labelled as a small group of “naysayers” or “contrarians”, who are sometimes engaging in “science denialism”. Such unfortunate labels can be seen as a way to possibly suppress legitimate debates and dismiss or minimize reasonable concerns about some aspects of invasion biology, including the uncertainties about the geographic origins and complex environmental impacts of species, and the control (...) programs against species perceived as “invasive”. In assessing the quality of the debate in this area, we examine the validity of the use of various strategies, including the “straw man” concept, and explore a range of potential logical fallacies present in some recent prominent discussions about invasion biology and so-called “invasive” species. The goal is to add some clarity to the concepts involved, point out some problematic issues, and improve the quality of the debates as the discussions move forward. (shrink)

In this paper I focus on Proclus’ concept of the instrumental cause in his commentary on the Timaeus (In Tim.). Unlike earlier Neoplatonists who do not make much use of this type of causality, Proclus relates the instrumental cause to the hypostasis of nature (φύσις). The Demiurge uses nature as an instrument in his ordering and creation of the cosmos. How does Proclus arrive at this understanding of nature? I argue that the definition of nature as an instrumental cause is (...) in part based on his critical reception of Aristotle who identifies nature with the formal, efficient, and/or final cause. That is, Proclus did not develop his views on the causality of nature only by looking at the Timaeus (and other Platonic sources), but also by engaging with Aristotle’s rich – and, to a certain extent, authoritative – reflections on this issue. The theme of this essay is rather simple, though its demonstration is not. It is that humans think reflexively or metamentally because -- and often in the forms in which -- they interpret each other. In this essay ‘metamental’ means ‘about mental’ and ‘reflexive mind’ means ‘a mind thinking about its own thoughts.’ To think reflexively or metamentally is to think about thoughts deliberately and explicitly, as in thinking that my current thoughts about metamentation are right. Thinking about thoughts requires (...) understanding thoughts as thoughts, as mental structures that represent; it also requires an ability to relate thoughts to other thoughts and to recognize such inter-thought relations. Since metamentation is essential to and uniquely distinctive of human minds, the idea that it originates in interpreting other minds can be encapsulated in the slogan that minds are minded because minds mind minds. This word play translates as: minds evolve into reflexive minds because they mind other minds -- where ‘minding other minds’ means interacting and bonding with other minds, being concerned or curious about them, representing their relations to the world, manipulating and using these relations for some purpose, and the like. All of this amounts (in my terminology) to interpreting other minds in social contexts of cooperation, communication, education, politics, and so on. It follows that intermental relations among individuals, handled by a distinct competence for interpretation, are essential to the evolution of abilities to represent intramental relations among thoughts, typical of a reflexive mind. I take ‘interpretation’ to be a convenient, short, and grammatically flexible label for what is known in philosophy as commonsense or folk psychology and in psychology as theory of mind, mindreading, or naive psychology. Interpretation is a cognitive rapport between an interpreter (she, in this book) and a subject (he), whereby she represents his mind-world relations, from the simplest, such as seeing.... (shrink)

The article presents the preliminary results of the author’s study of the unedited homily De transfiguratione et eleemosyna, ascribed to John Chrysostom. The question of the manuscript tradition is first discussed. The article shows that Maurice Sachot is right when he indicates only the manuscript Romanus Angelicus gr. 125 as a manuscript witness of this homily and that the other two witnesses indicated by Pinakes are erroneous. Then, the descriptions of the folios that preserve the homily are analysed in the (...) light of a new examination of them. This re-examination shows that hitherto several sources that inspired the compiler have gone unnoticed. This is followed by a brief summary of the contents of the homily and an analysis of the passages in which almsgiving is mentioned.Contribution: The article offers a re-examination of the folios 353v–361 from the manuscript Romanus Angelicus gr. 125, the first presentation of the content of the homily De transfiguratione et eleemosyna, and tries to shed light on the association of the theme of the Transfiguration with almsgiving. This paper aims to address the manner in which the protester’s opposition, or what I consider as the protester’s being-there-against, “profiles” itself in the no-man’s-land between non-violence and violence. My focus is therefore to unfold some of its constitutive layers, relying on the conceptual tools prominently provided by Ricoeur’s hermeneutical phenomenology. The first constitutive layer concerns the protester’s bodily presence, seized first of all as a specific “here” and “there,” and then as an expressive body that is communicating through gestures. Within the interpretation of one of these gestures—the fist raised in the air—I highlight the anamnestic nature of the protester’s being-there-against as it appears in the relationship with a state whose legitimacy comes from taking over the monopoly on violence. The second constitutive layer is related to the linguistic dimension of the protester’s presence: here special attention is paid to the way language and violence connect, having as background an analysis devoted to the surplus and the deficit of meaning attached to the slogans chanted by the protesters. Cyber risk has become one of the greatest threats to firms in recent years. Accordingly, boards of directors must be continually vigilant about this danger. They have a duty to ensure that the companies adopt appropriate cybersecurity measures to manage the risk of cyber fraud. Boards should also ensure that the firm disclose material cyber risk and breaches. We examine how the board’s gender composition can influence the extent of such disclosure, based on a sample of the companies listed on (...) the S&P/TSX 60 Index over the period 2014–2018. Results show evidence of a positive association between the presence and level of cybersecurity disclosure and board gender diversity. However, the board must boast a critical mass of at least three women before this positive impact can be observed. Our findings contribute to the debate on the importance of gender diversity by adding the concept of the positive influence of heterogeneity on cyber disclosure. We also augment the literature on the critical mass of women in boardrooms by providing empirical evidence that three or more women constitute the threshold for better governance. Our study has important implications for investors, stakeholders and regulators. If investors wish to increase cybersecurity disclosure, they should ask for more diversified boards. Our findings support regulators in their efforts to increase women’s representation on boards by providing empirical evidence of better outcomes with this type of board composition. (shrink)

Information is the fuel of cognition. At its most basic level, information is a matter of structures interacting under laws. The notion of information thus reflects the (relational) fact that a structure is created by the impact of another structure. The impacted structure is an encoding, in some concrete form, of the interaction with the impacting structure. Information is, essentially, the structural trace in some system of an interaction with another system; it is also, as a consequence, the structural fuel (...) which drives the impacted system's subsequent processes and behavior. Information takes various forms because the world has many levels of compositional and functional complexity, under different constraints. The key constraints that matter in the understanding of information are natural patterns of organization, or types, and systematic correlations among types, or laws. These level- sensitive constraints, in the form of types and laws, shape the very form in which information is tokened in some structure, that is, the very form in which it is encoded. As a result, the information-producing interactions bring about different sorts of structures, with various sorts of causal effects and functions, whence so many ways in which information is coded and utilized. Eliminativism assumes that commonsense psychology describes and explains the mind in terms of the internal design and operation of the mind. If this assumption is invalidated, so is eliminativism. The same conditional is true of intentional realism. Elsewhere (Bogdan 1991) I have argued against this 'folk- theory-theory' assumption by showing that commonsense psychology is not an empirical prototheory of the mind but a biosocially motivated practice of coding, utilizing, and sharing information from and about conspecifics. Here, without presupposing a specific (...) analysis of commonsense psychology, I want to challenge a key implication of the 'folk-theory-theory' assumption to the effect that commonsense psychology is committed to a definite architecture of the mind. The contributors to this volume examine recent controversies about the importance of common sense psychology for our understanding of the human mind. Common sense provides a familiar and friendly psychological scheme by which to talk about the mind. Its categories tend to portray the mind as quite different from the rest of nature, and thus irreducible to physical matters and its laws. In this volume a variety of positions on common sense psychology from critical to supportive, from exegetical to speculative, (...) are represented. Among the questions posed are: Is common sense psychology an empirical theory, a body of analytic knowledge, a practice or a strategy? If it is a legitimate enterprise can it be naturalized or not? If it is not legitimate can it be eliminated? Is its fate tied to our understanding of consciousness? In this paper, I argue that Plato conceives self-motion as non-spatial in Laws X. I demonstrate this by focusing on the textual evidence and by refuting interpretations according to which self-motion either is a specific type of spatial motion or is said to require space as a necessary condition for its occurrence. Moreover, I show that this non-spatial understanding differs from the identification of the soul’s motion with locomotion in the Timaeus. Consequently, I provide an explanation for this difference between (...) the Timaeus and Laws X by considering developmentalist and contextualist viewpoints. (shrink)

Through the efforts of the Institut de Recherche et d’Histoire des Textes (IRHT), a list of manuscripts is available that preserves homilies on the healing of the paralytic. Included in this list is the codex Athonensis, Lauras A 112 (Eustratiadis 112), which, according to those who provided its second description, preserves in the last four folios ‘a homily on the paralytic by John Chrysostom’. After a brief presentation of what is known about this codex, this article offers a detailed examination (...) of the codex’s last four folios, revealing that the description of them by Spyridon Lauriotis and Sophronios Eustratiadis is inaccurate. Contribution: This article provides the first thorough examination of the last four folios of the codex Athonensis, Lauras A 112 (Eustratiadis 112), demonstrating that they do not contain ‘a homily on the paralytic by John Chrysostom’ but rather several fragments of homilies on Thomas, Mid-Pentecost and the Ascension. Thus, the article contributes to the description of the codex and to the identification of a previously unknown manuscript witness to several homilies. (shrink)

In his inventory of the manuscript tradition of the homilies on the Transfiguration, Maurice Sachot stated that folios 46r-55r of the codex Parisinus graecus 1611 contain the homily In transfigurationem Domini (BHGn 1980a). He also stated that this text is unedited and that it is most probably a recension of the homily In transfigurationem Domini (CPG 5807; BHG 1980) attributed to Proclus of Constantinople. To date, however, this homily has remained unpublished and unstudied. After a brief presentation of the codex (...) Parisinus graecus 1611, this article brings to light a surprise that emerges from examining folios 46r-55r of the Parisian manuscript. CONTRIBUTION: The article proves that the homily In transfigurationem Domini (BHGn 1980a) is not a recension of the homily on the Transfiguration (CPG 5807; BHG 1980), but a compilation for which the beginning of the homily on the Transfiguration attributed to Proclus of Constantinople was used. In this article, I would like to highlight Ricoeur’s manner of rethinking the humanities, by focusing on a particular case, namely his hermeneutical reading of the question of trace. Taking into consideration two different contexts: historiography and the cognitive sciences, I will show that the very notion of trace is the limit-notion that induces a hermeneutical crisis at the core of the historiography as well as at the centre of the cognitive science.

This article aims to address, by means of a two-step analysis, the foundations of the relationship between history and psychoanalysis as “disciplinary practices” that deal with the past. In the first step, I examine the different relationships between history and psychoanalysis but also the uses of psychoanalysis in historical approaches. My goal here is to situate the context and the guiding questions. As a second step, I try to show that Ricœur puts forward, in his book Memory, History, Forgetting, a (...) major thesis regarding the foundations of the relationship between psychoanalysis and the hermeneutics of history. By means of the phenomenology of wounded memory, he identifies a fundamental structure of collective existence that provides the basis of this relationship. Finally, I seek to determine the scope of this structure, which takes the form of an originary trauma affecting the collective existence, by drawing an analogy with the psychoanalytic concept of afterwardsness. The relationship between memory and history, which has preoccupied historiography and the philosophy of history since the middle of the nineteenth century, took a particular course in France at the end of the millennium. The forms this relationship took in this particular context have been the subject of heated debate around whether the reconstruction of the past should bear the sign of a moral imperative or, on the contrary, it should be kept away from any moral conditioning. To address this (...) question and underline its particular relevance to the present, I will revisit a significant debate, based around Paul Ricoeur’s interpretation of the duty of memory developed in his book Memory, History, Forgetting. I will do this by means of a three-step approach. First, a short introduction will provide several guidelines for understanding the issues at stake in the debate in which Ricoeur was caught and explanations regarding the significance of the main notions around which the discussions took place, i.e., the duty and work of memory. Second, I will identify how historical debates, political decisions and civic concerns about the past gradually coagulated into two different “camps” in France during the 1980s and 1990s, i.e., the advocates of memory against those of history, foreshadowing the emergence of a historiographical crisis, the stakes of which I will analyse in detail. Finally, I will show how Ricoeur’s solution to this debate, i.e., an incomplete dialectic between the duty and the work of memory, developed on the horizon of justice, continues to have relevance for the present, being an innovative form of “defatalizing” the past. "In the perspective of biocultural homogenization and the increasingly prominent use of technology, environmental ethics faces new challenges. Development policies, governance, and economic factors impose new ways of understanding and managing coexistence. Phenomena such as pandemics, global warming, migratory phenomena, the expansion of urban and rural areas, and the development of large-scale monocultures show us that human agency, resources, the environment, and surroundings are increasingly intertwined, both physically and metaphysically, in an increasingly encompassing organism where the dissociation between the local (...) and the global becomes difficult to achieve. With a wide range of actions and relationships, environmental psychology and ethics have the task of rethinking the relationship between cultural elements and the biosphere, in order to achieve a balance between sensibility, responsibility, and responsivity. In this article, I aim to illustrate that a biocultural ethical framework emphasizing socio-environmental justice, applied to geoengineering, not only promotes global socio-environmental sustainability but also recognizes the crucial significance of local ecosystems in climate regulation and biodiversity conservation. To do so, I will briefly present some theoretical elements related to the importance of environmental psychology in understanding the connection between individuals and the surrounding environment. Then, I will succinctly present the concept of the ”3Hs” and its implication on biocultural ethics, and subsequently integrate specific elements of biocultural ethics into the analysis of geoengineering ethics to illustrate the need for a perspective that takes this into account. Through this endeavor, I intend to emphasize the vital role of a holistic, multidimensional perspective that guides individual values and community policies towards sustainable practices, ensuring social cohesion and dialogue, respecting the coexistence of life forms, and protecting their habitats. Some of the topics presented in this volume of original essays on contemporary approaches to belief include the problem of misrepresentation and false belief, conscious versus unconscious belief, explicit versus tacit belief, and the durable versus ephemeral question of the nature of belief. The contributors, Fred Dretske, Keith Lehrer, William Lycan, Stephen Schiffer, Stephen P. Stich, and the editor, Radu Bogdan, focus on the mental realization of belief, its cognitive and behavioral aspects, and the semantic aspects of its content. (...) The aim of this paper is to contribute to the understanding of imagistic violence by focusing—by means of a phenomenology open to dialogue with neighboring disciplines, from historiography to semiotics—on the particular case of photographs depicting atrocities, examples of photojournalism or images captured at crime scenes by forensic agents and presented as evidence during trials. To this end, I will implement a three-step analysis. First, I will seek to clarify the meanings associated with photography presented as evidence by adopting Husserl’s (...) phenomenological framework and by following a historiographical and juridical approach while verifying the grounds for the opposition that appears to be emerging between a paradigm of resemblance and a model of indirect, conjectural knowledge. Second, I will focus on how photography’s capacity to sustain a maximum degree of the reproduction of the real is problematized when the pictorial object is a violent scene that suspends, contradicts, and dismantles the order of the viewer’s experience. Finally, I will conclude by offering a hypothesis on the act of “seeing-with-other” and its phenomenological implications for the case of imagistic violence as evidence. Specifically, I will argue that we are more likely to understand imagistic violence at the level of a collective seeing than through a solitary gaze. (shrink)

In this original and provocative book, Bogdan proposes that the ability to interpret others' mental states should be viewed as an evolutionary adaptation.

In this paper I argue that Proclus’ criticism of the causality of Aristotle’s intellect is part of a general attack on Aristotle’s metaphysics. I show how Proclus criticises Aristotle for rejecting the One as a metaphysical principle and the metaphysical confusion that arises from this. Additionally, I claim that for Proclus Aristotle’s understanding of efficient causality differs from Plato’s and I discuss two of his arguments that Aristotle should have accepted the intellect as an efficient cause. As I show throughout, (...) Proclus differs in his approach to Aristotle from the harmonising agenda of Ammonius and Simplicius. (shrink)

In this article, I will describe the evolution of capital punishment and the influence that ideology had during the founding years of Romania’s communist regime, until 1958, when the legislation and application of capital punishment reached its highest peak. Starting with the punishment of war criminals and fascists, I will then describe how the death penalty was used for political motives in a period when the regime had to consolidate, legitimate and fight different enemies. With ups and downs like The (...) Death Penalty Law of 1949 and the abolitionist attempt in 1956, it reached its climax in 1958-1959 after the enactment of Decree no. 318/1958. (shrink)
