Studies of participatory governance generally examine the input and/or output side of policy processes. Often neglected is the throughput: Does the state have the political and technical capacity to implement the decisions that deliberative bodies make? In this study of Brazilian river-basin committees, the authors find that activists inside and outside the state often must collaborate to overcome resistance to change and provide state officials with resources they lack. They argue that this does not constitute the transfer of state responsibility (...) to private actors but rather the mobilization of a state's capacity to defend the public interest. (shrink)

Die Philosophie Johann Baptist Schads – und für sie sei in dieser Untersuchung stellvertretend und ein wenig verkürzend sein Neuer Grundriss der transcendentalen Logik nach den Principien der Wissenschaftslehre aus dem Jahr 1801 herangezogen – beansprucht für sich keine vollständige, sondern nur partielle Eigenständigkeit, indem sie zwar v.a. auf das Gedankengut Fichtes zurückgreift, allerdings für sich reklamiert, die Hauptthesen der Wissenschaftslehre zu Ende zu denken, was in Schads Augen allein dadurch geschehen kann, daß das Übersinnliche, das Absolute, traditionell gesprochen: Gott (...) oder die Gottheit, mit den zu erarbeitenden, überformalen Mitteln der transzendentalen Logik als das gedacht wird, was nicht mehr eigentlich gedacht und nur noch in Negationsbezügen unzutreffend angesprochen zu werden vermag. Der eigenen Aufgabenstellung mit den in ihr zunächst nur enthaltenen, sich aber im Verlauf der folgenden systematischen Analysen bestätigenden Prämissen – etwa einer internen Logikdifferenz oder des grundsätzlichen Wahrheitsziels der Philosophie – folgend erarbeitet Schad eine transzendentale Logik, die diese wahre Philosophie sein soll, womit er sich einerseits dem Vernunftprogramm Kants anschließt, um andererseits die grundsätzlichen Bestimmungen der Wissenschaftslehre Fichtes aufzunehmen – in derjenigen Form, in der sie ihm allein bekannt sein konnten, was zwangsläufig bedeutet, daß Schad die späteren Versionen der Wissenschaftslehre und zumal die Logikausarbeitungen Fichtes in seinen Vorlesungen aus dem Jahr 1812 nicht berücksichtigen konnte, obwohl sie beim Rückvergleich mit Schads Werk sichtbar machen, daß die Wege Fichtes mit denen des Letztgenannten keinesfalls konvergieren, was jedoch nach der schon früh ablehnenden Haltung des Wissenschaftslehrers seinem selbsternannten Nachfolger gegenüber nicht zu erstaunen vermag. Daß hingegen trotz Fichtes negativer Bewertung den Ausführungen Schads durchaus ein Eigenwert sowie eine interessante Weiterführung der Wissenschaftslehre nicht abgesprochen werden können, mögen die folgenden Überlegungen beweisen. Dieses Werk erstmals in vollem Umfang zu erschliessen, das ganze System Bardilis in seiner Entwicklung und seinen Inhalten nachzuzeichnen sowie in seinen Grundzugen, die fur die Debatten (...) der Zeit, etwa mit Fichte, Schelling und Reinhold, bedeutsam sind, aufzuweisen, ist die Absicht des vorliegenden Bandes.'Bislang liegt uber Bardili keine nennenswerte Literatur vor. Husserls Phänomenologie ist als Erscheinungslehre auf den logischen Urteils- und Formenkanon angewiesen und partiell mit ihm identisch. Darüber hinaus ist sie als transzendentale Logik die Begründung jeder formallogischen Urteilstätigkeit, d. h. sie ist eine Wahrheitslehre vor dem Hintergrund der Bestimmung und Anwendung des Urteils sowie seiner Verlaufsgesetze. Die Analyse der einschlägigen Schriften und Vorlesungsmanuskripte Husserls von den Logischen Untersuchungen bis hin zu Erfahrung und Urteil soll dazu dienen, den bislang oftmals zu Unrecht vernachlässigten, aber gleichwohl konstitutiven Zusammenhang zwischen Phänomenologie, Urteilslehre (...) und Wahrheitserkenntnis aufzuweisen. Resilienz wird in der Psychologie und Sozialpädagogik häufig als positiv angesehen. In der Armutsbekämpfung ist diese Sichtweise durchaus nachvollziehbar, insbesondere in der Prävention von Kinderarmut: wenn Resilienz das ist, was ein Kind in die Lage versetzt, die Risiken und negativen Folgen von Armut besser zu bewältigen, scheint es sinnvoll, diese Fähigkeit bei Kindern zu fördern. Mein Beitrag befürwortet diesen Befund, plädiert aber dafür, dass die Resilienzdebatte der Untermauerung durch Argumente aus der praktischen Philosophie bedarf, da das, was häufig als Resilienz (...) bezeichnet wird, nicht immer positiv zu bewerten ist. Ziel meines Beitrags ist es, den Resilienzdiskurs im Rahmen der Kinderarmutsbekämpfung in einer normativen Theorie zu verankern: im Capability Ansatz von Amartya Sen. Resilienz wird damit, so meine These, zu einem fundamental normativen Begriff. Mein Beitrag gliedert sich in drei Teile: Zuerst wird auf die Grundideen des CA und die Stellung von Kindheit darin eingegangen. Im zweiten Teil wird der Resilienzbegriff im Kontext von Kinderarmutsprävention charakterisiert. Der dritte Teil widmet sich den Verbindungslinien zwischen der Resilienzdiskussion und dem CA. Leitgedanke ist dabei, dass der CA die menschliche Handlungsfähigkeit als normativ grundlegend auszeichnet. Auf dieser Basis lässt sich überzeugend beurteilen, warum Armut bei Kindern höchst problematisch ist und welches Ziel in der Resilienzförderung verfolgt werden soll. Wie ich argumentieren werde, ist die Bereitstellung von capabilities auch die gerechtigkeitstheoretische Basis von Resilienzförderung in der Praxis. Der Beitrag schließt mit Impulsen, welche, so meine Hoffnung, für eine weitere Diskussion der Normativität von Resilienz dienlich sein können. (shrink)

This book brings together international academics from a range of Social Science and Humanities disciplines to reflect on how Deleuze's philosophy is opening up and shaping methodologies and practices of empirical research.

This investigation addresses the hypothesis that negative affect is associated with decreased ability to shift attention to a new focus. Thirty-nine participants completed a covert attentional orienting task and then viewed a distressing film clip. Mood was measured by self-report at the beginning and end of the session. Correlations between attentional orienting performance and self-reported mood indicated that participants with greater response time costs on invalidly cued trials reported more negative affect in response to the film. These results support the (...) hypothesis that negative affect is associated with a slowness to disengage attention. (shrink)

Thomas Reid thought of himself as a critic of the representative theory of perception, of what he called the ‘theory of ideas’ or ‘the ideal theory’.2 He had no kind words for that theory: “The theory of ideas, like the Trojan horse, had a specious appearance both of innocence and beauty; but if those philosophers had known that it carried in its belly death and destruction to all science and common sense, they would not have broken down their walls to (...) give it admittance.”3 Many have supposed that his opposition to the representative theory was grounded in his direct realism.4 A direct realist theory of perception holds that perception of external objects is not mediated by any mental entity whose intrinsic character licenses a move from the mental entity to the external object presented in perception. Reid himself, in an oration of 1759, delivered at graduation ceremonies over which he presided as regent and professor of philosophy at King’s College in Aberdeen, said that he did not “understand what need there is of an intermediate object for thought about something to be possible.”5 Hence, if Reid was not a direct realist, philosophers and historians would have to ask whether and to what degree Reid was what he thought himself to be. The deceased's prior consent to posthumous reproduction is a common requirement in many common law jurisdictions. This paper critically evaluates four arguments advanced to justify the presumption against consent. It is argued that, in situations where death is caused by sudden trauma, not only is there inadequate justification for the presumption against consent, but there are good reasons to reverse the presumption. The article concludes that the precondition of prior consent may be inappropriate in these situations.

Realist ideology critique (RIC) is a strand of political realism recently developed in response to concerns that realism is biased toward the status quo. RIC aims to debunk an individual's belief that a social institution is legitimate by revealing that the belief is caused by that very same institution. Despite its growing prominence, RIC has received little critical attention. In this article, I buck this trend. First, I improve on contemporary accounts of RIC by clarifying its status and the role (...) of motivated reasoning. Second, I show that realist ideology critics face a dilemma: either their account makes deeply implausible epistemological assumptions, or they temper its epistemology at the expense of rendering it toothless. I argue for each horn in turn before revealing the dilemma to be a false one by making a novel distinction between varying strengths of RIC based on their underlying epistemological assumptions. I propose Moder-ate RIC as a solution: upon discovering that one reason for your belief that a social institution is legitimate is likely malignantly epistemically circular, the belief should undergo further epistemic testing. I respond to three potential objections and suggest that Moderate RIC would make a fruitful addition to political theorists' methodological toolkit. (shrink)

In this essay I refer to eros as the force that plays on our bodies and connects us to the larger community of life, an embodied form of love that charges the will towards well-being. Analyzing the ways that eros can be engaged and expressed in the "commons" as a life sustaining force, I look to current, on-the-ground work being done in Detroit, MI where a grassroots network of artists, community-builders, educators and neighborhood folk are revitalizing their city. Linking this (...) work and the love I experienced with them to childhood experiences in my own homeplace in northern New York State, I argue for the development of eco-ethical consciousness within an erotic "poetics of place" where the natural world speaks to us within our interpretive, expressive efforts. Finally, in an explication of education as those generative relations that are specifically oriented towards well-being, I look to the relation among eros, language and the creation of the commons as a critical educational endeavor. If we are to stem the tide of ecological destruction now upon us, we will need educators in public schools who recognize and are able to create classroom practices that encourage an "eco-erosic love" and thus inspire students who can protect the fragile relationship of their human communities to the ecosystems upon which we depend. Under higher education’s contemporary consumer model, students are treated as customers and professors are encouraged to increase student engagement through more personal out-of-class interactions, often in social settings. In the course of this more personal student-faculty involvement, students inevitably encounter or learn of their professors’ occasional inappropriate or unethical behavior. In the present study, we investigated the impact of 145 American undergraduate Business students’ perceptions of their professors’ inappropriate out-of-class behavior on student beliefs and in-class behavior. Results indicate that student (...) perceptions of professors engaging in inappropriate out-of-class behavior were associated with students viewing these professors as lower in ethical character and reporting a stronger likelihood of attending these professors’ classes under the influence of alcohol and illicit drugs, swearing and using vulgarity in these professors’ class discussions, and showing disregard for these professors’ rules, time, and effort. These relationships held even when student grade satisfaction and professor in-class behavior were accounted for. Our results suggest professors’ behavior outside the classroom may impact students’ behavior inside the classroom, re-igniting dialogue regarding the professorial role and the boundaries on oversight of that role. We offer suggestions as to how higher education may address these concerns without infringing upon professors’ personal freedoms. (shrink)

The case studies compiled in _Another Way: Decentralization, Democratization and the Global Politics of Community-Based Schooling_ offer a comparative look at how the global politics of educational decentralization have influenced the democratic aspirations of diverse community-based schooling initiatives in Europe, Africa, Asia and the Americas.

This article argues that Vico’s theory of history should be construed as an ontological constructionist account as opposed to its usual realist interpretation. In support of this interpretation I draw upon two important concepts issuing from the body of the Scienza nuova: the notion of ‘‘storia’’ and the verum ipsum factum principle. Both concepts are not only consistent with an ontological constructionist interpretation of Vico’s theory of history but function as powerful explanatory devices in the context of such an interpretation. (...) I show the advantage this interpretation holds for overcoming one of the main charges brought against the Scienza nuova when it is interpreted as presenting a realist conception of history. In highlighting the possibility and, indeed, textual advantages of construing Vico’s theory of history as an ontological constructionist account I claim that Vico may have anticipated the constructionist tradition by some 200 years and may be considered as the founder of constructionism in the philosophy of history. In this Introduction to a special section on ‘Visualizing Surfaces, Surfacing Vision’, the authors argue that to conceive vision in the contemporary world it is necessary to examine its embedding within, expression via and organization on the surface. First, they review recent social and cultural theories to demonstrate how and why an attention to surfaces is salient today. Second, they consider how vision may be understood in terms of surfaces, discussing the emergence of the term ‘surface’, and its transhistorical relationship (...) with vision. Third, they introduce the contributions to the special section, which cover written articles and artworks. They make connections between them, including their exploration of reflexivity and recursion, observation, objectivity and agency, ontology and epistemology, relationality, process, and two- and three-dimensionality. This essay explores the familiar German ideology according to which a revolution in thought would, in varying proportions, precede, succeed, accommodate, and generally upstage a political revolution whose defining feature was increasingly thought to be its founding violence: the slide from 1789 to 1793. Germany thus sets out to quarantine the political threat of revolution while siphoning off and absorbing the revolution’s intensity and energy for thinking as such. The essay holds that this structure corresponds to the psychoanalytic logic of (...) trauma: the dissolution of the event into a missed event, and the hypertrophic investment in the trivial, the non-event, the negligible remainder. An argument that what is usually dismissed as the “mystical shell” of Hegel's thought—the concept of absolute knowledge—is actually its most “rational kernel.” This book sets out from a counterintuitive premise: the “mystical shell” of Hegel's system proves to be its most “rational kernel.” Hegel's radicalism is located precisely at the point where his thought seems to regress most. Most current readings try to update Hegel's thought by pruning back his grandiose claims to “absolute knowing.” Comay and Ruda invert this (...) deflationary gesture by inflating what seems to be most trivial: the absolute is grasped only in the minutiae of its most mundane appearances. Reading Hegel without presupposition, without eliminating anything in advance or making any decision about what is essential and what is inessential, what is living and what is dead, they explore his presentation of the absolute to the letter. The Dash is organized around a pair of seemingly innocuous details. Hegel punctuates strangely. He ends the Phenomenology of Spirit with a dash, and he begins the Science of Logic with a dash. This distinctive punctuation reveals an ambiguity at the heart of absolute knowing. The dash combines hesitation and acceleration. Its orientation is simultaneously retrospective and prospective. It both holds back and propels. It severs and connects. It demurs and insists. It interrupts and prolongs. It generates nonsequiturs and produces explanations. It leads in all directions: continuation, deviation, meaningless termination. This challenges every cliché about the Hegelian dialectic as a machine of uninterrupted teleological progress. The dialectical movement is, rather, structured by intermittency, interruption, hesitation, blockage, abruption, and random, unpredictable change—a rhythm that displays all the vicissitudes of the Freudian drive. This paper presents an overview of the dimensions of unsafe motherhood, contrasting data from economically developed countries with some from developing countries. It addresses many common factors that shape unsafe motherhood, identifying medical, health system and societal causes, including women's powerlessness over their reproductive lives in particular as a feature of their dependent status in general. Drawing on perceptions of Jonathan Mann, it focuses on public health dimensions of maternity risks, and equates the role of bioethics in conscientious medical care (...) to that of human rights in public health care. The microethics of medical care translate into the macroethics of public health, but the transition compels some compromise of personal autonomy, a key feature of Western bioethics, in favour of societal analysis. Religiously‐based morality is seen to have shaped laws that contribute to unsafe motherhood. Now reformed in former colonizing countries of Europe, many such laws remain in effect in countries that emerged from colonial domination. UN conferences have defined the concept of ‘reproductive health’ as one that supports women's reproductive self‐determination, but restrictive abortion laws and practices epitomize the unjust constraints to which many women remain subject, resulting in their unsafe motherhood. Pregnant women can be legally compelled to give the resources of their bodies to the support of others, while fathers are not legally compellable to provide, for instance, bone‐marrow or blood donations for their children's survival. Women's unjust legal, political, economic and social powerlessness explains much unsafe motherhood and maternal mortality and morbidity. (shrink)

Marine interstitial environments are teeming with an extraordinary diversity of coexisting microeukaryotic lineages collectively called “meiofauna.” Interstitial habitats are broadly distributed across the planet, and the complex physical features of these environments have persisted, much like they exist today, throughout the history of eukaryotes, if not longer. Although our general understanding of the biological diversity in these environments is relatively poor, compelling examples of developmental heterochrony (e.g., pedomorphosis) and convergent evolution appear to be widespread among meiofauna. Therefore, an improved understanding (...) of meiofaunal biodiversity is expected to provide some of the deepest insights into the following themes in evolutionary biology: (i) the origins of novel body plans, (ii) macroevolutionary patterns of miniaturization, and (iii) the intersection of evolution and community assembly – e.g., “community convergence” involving distantly related lineages that span the tree of eukaryotes. During the oppressive reign of Louis XIV, Gabrielle Suchon was the most forceful female voice in France, advocating women’s freedom and self-determination, access to knowledge, and assertion of authority. This volume collects Suchon’s writing from two works—_Treatise on Ethics and Politics_ and _On the Celibate Life Freely Chosen; or, Life without Commitments _—and demonstrates her to be an original philosophical and moral thinker and writer. Suchon argues that both women and men have inherently similar intellectual, corporeal, and spiritual capacities, which (...) entitle them equally to essentially human prerogatives, and she displays her breadth of knowledge as she harnesses evidence from biblical, classical, patristic, and contemporary secular sources to bolster her claim. Forgotten over the centuries, these writings have been gaining increasing attention from feminist historians, students of philosophy, and scholars of seventeenth-century French literature and culture. This translation, from Domna C. Stanton and Rebecca M. Wilkin, marks the first time these works will appear in English. (shrink)

This article explores the effectiveness of the decision of the Committee on the Elimination of Discrimination against Women in the case of Alyne da Silva Pimentel Teixeira (deceased) v. Brazil, concerning a poor, Afro-Brazilian woman. This is the first decision of an international human rights treaty body to hold a state accountable for its failure to prevent an avoidable death in childbirth. Assessing the future effectiveness of this decision might be undertaken concretely by determining the degree of Brazil's actual compliance (...) with the Committee's recommendations, and how this decision influences pending domestic litigation arising from the maternal death. Alternative approaches include: determining whether, over time, the decision leads to the elimination of discrimination against women of poor, minority racial status in the health sector, and if it narrows the wide gap between rates of maternal mortality of poor, Afro-Brazilian women and the country's general female population. Determining the effectiveness of this decision will guide whether to pursue a more general strategy of judicializing maternal mortality. (shrink)

Alyne da Silva Pimentel Teixeira died of postpartum hemorrhage following the stillbirth of a 27-week-old fetus on November 16, 2002 in Rio de Janeiro, Brazil. Her death led in 2011 to the first decision of an international treaty body holding a government accountable for a preventable maternal death. The decision, Alyne da Silva Pimentel Teixeira v. Brazil, was given by the Committee on the Elimination of Discrimination against Women, established to monitor compliance by member states with the UN Convention on (...) the Elimination of All Forms of Discrimination against Women.
