Arrhenius and Rabinowicz have argued that Millian qualitative superiorities are possible without assuming that any pleasure, or type of pleasure, is infinitely superior to another. But AR's analysis is fatally flawed in the context of ethical hedonism, where the assumption in question is necessary and sufficient for Millian qualitative superiorities. Marginalist analysis of the sort pressed by AR continues to have a valid role to play within any plausible version of hedonism, provided the fundamental incoherence that infects AR's use of (...) such analysis is removed. But what AR call ‘Millian superiorities’ are never genuine qualitative superiorities in Mill's sense. Mill scholars need to appreciate this point and recognize that the interpretation of qualitative superiorities as infinite superiorities is the only interpretation which is compatible with the text of Mill's Utilitarianism. The continuing failure to appreciate the possibility of infinite superiorities has precluded any adequate understanding of the extraordinary structure of Mill's pluralistic hedonistic utilitarianism. At first glance, it looks like Aristotle can’t make up his mind about the ethical or moral status of non-human animals in his ethical treatises. Somewhat infamously, the Nicomachean Ethics claims that “there is neither friendship nor justice towards soulless things, nor is there towards an ox or a horse” (EN 8.11.1161b1–2). Since Aristotle thinks that friendship and justice are co-extensive (EN 8.9.1159b25–32), scholars have often read this passage to entail that humans have no ethical obligations to non-human animals. By (...) contrast, although the Eudemian Ethics denies that non-human animals can participate in “primary” friendships, EE 7.2 claims that “the other kinds of friendship are also found among animals; and it is evident that utility is present to some extent among them both in relation to humankind, in the case of tame animals, and in relation to each other” (EE 7.2.1236b3–11). Does the Nicomachean account of non-human animals contradict that of the Eudemian Ethics? Ultimately, I believe the Nicomachean account is consistent with the Eudemian account. Nonetheless, I argue that Aristotle’s treatment of non-human animals differs significantly in the two texts. My chapter explores this difference in greater detail and considers the ramifications of such a difference for our understanding of Aristotle’s place in the philosophical tradition concerning the ethical status of non-human animals. Presents an historical analysis of social contract theory by considering the works of prominent philosophers.

If you slide far enough down the slippery slope envisioned by opponents of medical assistance-in-dying (MAiD), you eventually land in a ghastly society with industrialized euthanasia, rampant suicide, and devalued life. But what if the slippery slope leads us somewhere better? This paper explores the benefits of eliminating nearly all MAiD prohibitions and regulations. We anticipate three positive effects for public health: 1. Expanded access to those currently not qualified from MAiD by removing ineffective access criteria; 2. Harm reduction by (...) making MAiD safer and by rerouting suicidal patients into alternate care; and 3. Improvements to the health system through lowered healthcare costs and increased patient activation in end-of-life care. Safeguards and prohibitions deny those who wish to die the ability to do so to prevent the _potential_ danger of a few being subjected to an undesired early death. (shrink)

Geoffrey Scarre has recently argued that the version of qualitative hedonism which I attribute to Mill is unsatisfactory for various reasons. In his view, even if it is formally compatible with value monism, involves non-hedonistic elements and offers an implausible account of the relationship between and pleasures. In this paper, I show that his objections, which are similar in spirit to those pressed earlier by Bradley, Moore and others against Mill, are unfounded where not confused. The Mill/Riley line does (...) not rely on non-hedonistic standards and has sufficient flexibility to account for many different kinds of pleasures and pleasing activities. It remains a coherent version of qualitative hedonism, worthy of further consideration and study. (shrink)

Proposals to release genetically engineered organisms in the wild raise complex ethical issues related to their safe and equitable implementation. While there is broad agreement that community and public engagement is vital to decision‐making in this context, more discussion is needed about who should be engaged in such activities and in what ways. This article identifies Indigenous peoples as key stakeholders in decisions about gene‐editing in the wild and argues that engagement activities need not only include Indigenous peoples but also (...) be designed, conducted, and analyzed in ways that confront longstanding power imbalances that dismiss Indigenous expertise. We offer specific recommendations to guide deliberative activities to not only be inclusive of Indigenous peoples but also to empower their diverse, situated knowledges. We call on those committed to the inclusive design of broad public deliberation to pursue strategies that shift dominant power dynamics to include Indigenous communities in more meaningful ways. In his account of the Persian Wars, the 5th century historian Herodotus reports an exchange between the Persian monarch Xerxes and a deposed Spartan king, Demaratus, who became what Lattimore later classified as a “tragic warner” to Xerxes. On the eve of the battle of Thermopylae, Xerxes asks how a small number of free Spartiates can stand up against the massive ranks of soldiers that Xerxes has assembled. Herodotus has Demaratus reply: So is it with the Lacedaemonians; fighting singly they (...) are as brave as any man living, and together they are the best warriors on earth. Free they are, yet not wholly free; for law is their master (ἐλεύθεροι γὰρ ἐόντες οὐ πάντα ἐλεύθεροι εἰσί· ἔπεστι γάρ σφι δεσπότης νόμος), whom they fear much more than your men fear you. This is my proof—what their law bids them, that they do; and its bidding is ever the same, that they must never flee from the battle before whatsoever odds, but abide at their post and there conquer or die. (Hdt. 7.104) As the outcome of Thermopylae makes clear, Demaratus is hardly guilty of boasting. But Greek political theorists were not only fascinated by the Spartans who fought at the battle of Thermopylae in 480; they also wondered how slightly more than a century later Sparta was ignobly defeated by Thebes at the battle of Leuctra in 371, after which Spartan hegemony collapsed. How did Sparta field citizen-soldiers in the 5th century who were without parallel in their bravery and military prowess? And why did Sparta, predominantly under the same political organization, collapse just over a century later? Such are the main questions that Xenophon, Plato, Aristotle, and Plutarch—what Cartledge (1999, 313–14) has characterized as “political-theoretical” laconophiles—seek to answer in their writings about Sparta. In this paper we outline the activities of young girls in a Toba community of northern Argentina and examine the effect of girl helpers on time allocation of nursing women. Activity budgets were obtained for 41 girls aged 3 to 15 using spot observations. Girls spent substantial portions of observations engaged in helping behaviors. Individual values varied with age, anthropometric characteristics, and birth order. Activity budgets of 21 nursing women were obtained through focal observation sessions. Women living in households with (...) girls aged 7 to 15 allocated 17% less time to domestic work and 9% more time to socializing during afternoon observation sessions. For nursing women in this community, direct childcare (provided by the infant’s own mother) seemed to be a priority. Living with a girl helper did not have any measurable effect on the frequency or duration of nursing, or on the time that women spent caring for their infants. Based on these findings, hypotheses are outlined for future work on the effect of girl helpers on women’s fertility. (shrink)

In this article, we discuss Beauchamp and Childress’s treatment of the issue of moral status. In particular, we introduce the five different perspectives on moral status that Beauchamp and Childress consider in Principles of Biomedical Ethics and explain their alternative to those perspectives, raise some critical questions about their approach, and offer a different way to think about one of the five theories of moral status that is more in line with what we believe some of its leading advocates affirm.

Animalism in its basic form is the view that we are animals. Whether it is a thesis about anything else – like what the conditions of our persistence through time are or whether we're wholly material things – depends on the facts about the persistence conditions and ontology of animals. Thus, I will argue, there are different varieties of animalism, differing with respect to which other theses are taken in conjunction with animalism in its basic form. The different varieties of (...) animalism vary in credibility: some varieties are supported by arguments that are irrelevant to others, and some varieties are susceptible to objections that others can resist. Adequately distinguishing between varieties of animalism is thus an important preliminary to assessing them. In this paper, I'll present and argue for a taxonomy of the most distinctive varieties. This paper defends a hylomorphic version of animalism according to which human persons survive as immaterial, bodiless animals after death. According to the hylomorphism under consideration, human persons have souls that survive death, and according to the animalism under consideration, human persons are necessarily animals. One might think this implies that human persons don't survive their deaths since if they were to survive their deaths, they would be immaterial animals after death, but necessarily animals are material. This paper shows that (...) the hylomorphic animalist can overcome this problem in a way that respects the intuition that animals are material. In addition, the paper defends the hylomorphic animalist survivalist from the objection that her view introduces an insoluble mereological puzzle. (shrink)

Trait Selective Abortions (TSA) have come under critique as a medical practice that presents potential disabled infants as burdens and lacking the potential for meaningful lives. This paper, using the author’s background as a disabled person, contends that the philosophy underpinning TSAs reflects liberal society’s lack of a theory of needs. The author argues for a care ethics based approach informed by disability analyses to engage with TSAs.

I continue my argument that Millian qualitative superiorities are infinite superiorities: one pleasant feeling, or type of pleasant feeling, is qualitatively superior to another in Mill's sense if and only if even a bit of the superior is more pleasant than any finite quantity of the inferior, however large. This gives rise to a hierarchy of higher and lower pleasures such that a reasonable hedonist always refuses to sacrifice a higher for a lower irrespective of the finite amounts of each. (...) Some indication of why this absolute refusal may be reasonable is provided in the course of outlining the content of the Millian hierarchy. It emerges that Mill's hedonistic utilitarianism has an extraordinary structure because it gives absolute priority over competing considerations to a code of justice that distributes equal rights and correlative duties for all. His utilitarianism also recognizes that certain aesthetic and spiritual pleasures may be qualitatively superior even to the pleasant feeling of security associated with the moral sentiment of justice. Thus, for instance, a noble individual may reasonably choose to waive his own rights so as to perform beautiful supererogatory actions that provide great benefits for others at the sacrifice of the right-holder's own vital interests. This chapter sets out an account of tacit knowledge as conceptually structured, situation specific practical knowledge. It sets this out against two claims from Michael Polanyi which conjoin the idea that we know more than we can tell with the suggestion that knowledge is practical. Any account of tacit knowledge which attempts to respond to Polanyi’s first claim faces a twofold test of adequacy. It must be tacit and it must be knowledge. To count as knowledge some content must be (...) known but that puts pressure on its tacit status. What stops such a content being put into words? I reject Polanyi’s attempt to answer this based on a distinction between focal and subsidiary awareness. And I reject Harry Collins’ process-based approach that looks more to ontology than epistemology or reference more than sense. By equating tacit knowledge with conceptually structured, situation specific practical knowledge or know-how, I show the respect in which it remains tacit. Although it can be expressed in demonstrations, and is related to concepts, it cannot be expressed in words alone. (shrink)

The very idea of mental illness is contested. Given its differences from physical illnesses, is it right to count it, and particular mental illnesses, as genuinely medical as opposed to moral matters? One debate concerns its value-ladenness, which has been used by anti-psychiatrists to argue that it does not exist. Recent attempts to define mental illness divide both on the presence of values and on their consequences. Philosophers and psychiatrists have explored the nature of the general kinds that mental illnesses (...) might comprise, influenced by psychiatric taxonomies such as the Diagnostic and Statistical Manual and the International Classification of Diseases, and the rise of a rival biological ‘meta-taxonomy’: the Research Domain Criteria (RDoC). The assumption that the concept of mental illness has a culturally invariant core has also been questioned. This book serves as a guide to these contested debates. (shrink)

In 1994, when persuaded by Bill Fulford to walk down the corridor at Warwick University to join in his teaching of what seemed a newly developing subject—against my protestations that I knew nothing about mental health care—my main interest was in the irreducibility of meaning to the (...) 'realm of [natural scientific] law,' in Sellars's phrase. This had the bonus of complementing Bill's championing of the irreducibility and centrality of values in psychiatry. (It was only later we realized we disagreed about the not inconsequential issue of whether norms and values were subjective preferences or objective features of the world.) It seemed plausible to me that the irreducibility of the space of reasons to the realm of law might have interesting consequences for psychiatry. But mine was a purely disinterested academic interest. This is perhaps the usual approach to what is in part a professionalized academic subject with its formal rules for publication and dissemination of research.It has only been in the last decade that I have experienced things in a more personal way, following what I would term, though psychiatry would not, a nervous breakdown. My image of a breakdown came from reading Saul Bellow's novel Herzog. The titular Herzog has been left by his wife, cruelly, and retires from academic life to write letters. For example, to Heidegger. "Dear Doktor Professor Heidegger, I should like to know what you mean by the expression 'the fall into the quotidian.' When did this fall occur? Where were we standing when it happened?" I thought I would be able to maintain some sort of inquiring mind and write experientially grounded philosophy of psychiatry as a catharsis. I could study my own illness. This immediately proved a ridiculous hope.As a philosopher with a cognitivist bent—language, thought, and intentionality being guiding interests—I had always assumed that madness was only really a matter of what Jaspers calls 'primary delusions,' belief-like states that strain their belief-status, are hard for others to make sense of, and occur only with particularly severe forms of mental illness. But madness is also a matter of doing, saying and feeling as well as pure reasoning. What I would, previously and disinterestedly, have described as a dysregulation of emotional reactions turned out to transform my entire experience of the world and my ability to think rationally about it. I lost the ability to put my experiences into words. In truth, I lost all interest in that project. Only when not distressed could I take a view on my loss of world. Distressed, I did not understand myself.This is a neat illustration of epistemic disjunctivism. But it also highlights a challenge for, and some of the brilliance in those who have contributed to, the philosophy of mental health care, through their expertise by experience. While experience may be a necessary condition for particular forms of expertise, my own case reveals that it is not sufficient. Further, even an everyday and familiar mental illness (like my own) can render the articulation of experience, in a way that makes sense to others, very much harder. The concept of the line of flight is used with striking regularity throughout A Thousand Plateaus where it plays a vital role in connecting the other conceptual innovations of the book, including the concepts of the assemblage and the machine. Despite its importance, Deleuze and Guattari never offer a direct definition of the concept, and the reader of A Thousand Plateaus is left to discern its meaning from its various uses. This is especially frustrating for those whose interest in the (...) text is political and who wish to use the conceptual framework of the book to analyse the socio-political assemblages in which they live. In response to this issue, this paper offers a clear and concise introduction to the concept of the line of flight. Furthermore, by analysing the way in which Deleuze and Guattari use this concept in their political analyses of feudalism and capitalism, this article illuminates the more general meaning of the concept of the line of flight through the more specific question of its usage in Deleuze and Guattari's attempt to think a post-capitalist future. Pulling from theories of social exchange, deonance, and fairness heuristics, this study focuses on the relationship between overall justice climate and both the prosocial and deviant behaviors of groups. Specifically, it considers two contextual boundary conditions on this effect—corporate social responsibility and group moral identity. Results from a laboratory experiment are presented, which show a significant effect for overall justice climate and a two-way interaction between overall justice climate and CSR on group-level prosocial and deviant behaviors, and a marginally significant (...) interaction of group moral identity with overall justice climate on group deviance. The implications of contextual influences on workplace ethics and justice are discussed. (shrink)

Against Schmidt-Petri's claim, I argue that John Stuart Mill is committed to the view that one pleasure is higher in quality than another if and only if at least a majority of those people who are competently acquainted with both always prefer the one no matter how much of the other is offered. I support my reading with solid textual evidence; none such is provided by Schmidt-Petri in support of his contrary interpretation that qualitative superiority exists whenever the experienced prefer (...) less of one pleasure to more of another. The decisive objection to this is its incompatibility with the hedonistic requirement that more pleasure ought to be preferred to less, a requirement so fundamental that it would be uncharitable to suppose that Mill lost sight of it in his doctrine of higher pleasures. Mill's free speech doctrine is distinct from, yet compatible with, his central principle of ‘purely self-regarding’ liberty. Using the crucial analogy with trade, I claim that he defends a broad laissez-faire policy for expression, even though expression is ‘social’ or other-regarding conduct and thus legitimately subject to social regulation. An expedient laissez-faire policy admits of exceptions because speakers can sometimes cause such severe damage to others that coercive interference with the speech is justified. In those relatively few contexts where interference (...) is called for, however, the central principle of self-regarding liberty sets absolute limits to the scope of society's regulatory authority. Regulation can never amount to an outright ban of any type of expression that can be consumed by the individual without direct and immediate harm to others. Nevertheless, and perhaps surprisingly, the central liberty principle admits censorship of certain extraordinary types of expression which necessarily harm others. (shrink)

Values based practice is a radical view of the place of values in medicine which develops from a philosophical analysis of values, illness and the role of ethical principles. It denies two attractive and traditional views of medicine: that diagnosis is a merely factual matter and that the values that should guide treatment and management can be codified in principles. But it goes further in the adoption of a radical liberal view: that right or good outcome should be replaced by (...) right process. John Gray, much influenced by Isaiah Berlin and building on work by the late John Rees and the late Fred Berger, has recently stated three ‘fatal’ objections which virtually all analysts seem to find persuasive against John Stuart Mill's classic doctrine of liberty. First, Gray thinks it ‘an obvious objection to Mill's project that conceptions of harm vary with competing moral outlooks, so that no Principle of Liberty whose application turns on judgements about harm can expect to resolve disputes between (...) exponents of opposed moral perspectives’. Even if we overlook Mill's strange silence in the matter and supply him with a reasonable definition of harm, it remains clear that the liberty principle ‘is not, and cannot be, the very simple principle Mill sought’. For ‘Mill's principle is in its very nature radically incomplete. It tells us what we may not do, but not what we ought to do.’ To know when liberty should in fact be restrained, ‘we must look to other principles—chiefly the Principle of Utility itself’. But if general utility alone can ‘tell us how much liberty may be given up for how much harm-prevention’, then ‘there can be no question of adherence to [an] exceptionless principle such as Mill's Principle of Liberty’. Thus, even if we believe that Mill's version of utilitarianism is coherent, his judgements about the regulation of conduct must depend on a highly complex and controversial moral doctrine. (shrink)

Not all actions that are legal are necessarily morally correct. However, there are few protections for providers who are pressured to comply with actions and procedures that infringe on their religious beliefs regarding human dignity. The right of health care providers to freely act on religious convictions and refrain from cooperating with morally reprehensible tasks is often eschewed in favor of political correctness or is branded as discrimination. Adequate safeguards are urgently needed for health care workers at all levels to (...) ensure that they can continue to care for the sick and most vulnerable members of the community without violating the dictates of their conscience. This article examines the free exercise of religion as it pertains to medical provider conscience protections. The author argues for conscience protection legislation with a right of action. Undertaking research involving vulnerable groups, such as those requiring resuscitation involves careful analysis during the ethical review process. When a person lacks the capacity to make an informed choice about their participation in a research study, a waiver of consent offers an alternative. This paper is based on a doctoral research study using ethnography to explore the resuscitative practices and experiences of rural nurses through observation and interviews. This paper aims to explore the ethical issues raised by the Human Research (...) Ethics Committee relating to consent of vulnerable patients requiring resuscitation within a rural context. In particular, the challenges of addressing risk (privacy) vs benefit (public) associated with a waiver of consent. This paper will consider why the rural context should be championed during the ethical review process, when decisions about public benefit are being deliberated. Utilising a communitarianism approach that advocates for greater rural representation during the ethical review processes will ensure that rural research involving vulnerable groups can be addressed safely and benefit not only the experiences and practices of rural nurses but also the wider rural communities they serve. How does mutual intelligibility impact the political sphere? This paper uses Wittgenstein’s Philosophical Investigations as a means of examining this connection. I argue that Wittgenstein’s paradigm of a dialectical world suggests that his analysis of mutual intelligibility in understanding experiences is necessary in a pluralistic democracy. I conclude that via his theory of social reality politics is a dynamic dialectical process of communicating experiences.

Within the community of inquiry literature, the absence of the notion of genuine doubt is notable in spite of its pragmatic roots in the philosophy of Charles Sanders Peirce, for whom the notion was pivotal. We argue for the need to correct this oversight due to the educational significance of genuine doubt—a theoretical and experiential understanding of which can offer insight into the interrelated concepts of wonder, fallibilism, inquiry and prejudice. In order to detail these connections, we reinvigorate the ideas (...) of Peirce by borrowing the language and concepts of Albert Camus, at the same time demonstrating their unlikely congruence. In particular, we argue for the necessity of genuine doubt along with the need for the presence of a diversity of prejudices as a starting point for genuine inquiry. (shrink)
