Contrary to the widespread concern about over-treatment at the end of life, today, patient preferences for palliative care at the end of life are frequently respected. However, ethically challenging situations in the current healthcare climate are, instead, situations in which a competent patient requests active treatment with the goal of life-prolongation while the physician suggests best supportive care only. The argument of futility has often been used to justify unilateral decisions made by physicians to withhold or withdraw life-sustaining treatment. However, (...) we argue that neither the concept of futility nor that of patient autonomy alone is apt for resolving situations in which physicians are confronted with patients' requests for active treatment. Instead, we integrate the relevant arguments that have been put forward in the academic discussion about ‘futile’ treatment into an ethical algorithm with five guiding questions: (1) Is there a chance that medical intervention will be effective in achieving the patient's treatment goal? (2) How does the physician evaluate the expected benefit and the potential harm of the treatment? (3) Does the patient understand his or her medical situation? (4) Does the patient prefer receiving treatment after evaluating the benefit-harm ratio and the costs? (5) Does the treatment require many resources? This algorithm shall facilitate approaching patients' requests for treatments deemed futile by the physician in a systematic way, and responding to these requests in an ethically appropriate manner. It thereby adds substantive considerations to the current procedural approaches of conflict resolution in order to improve decision making among physicians, patients and families. (shrink)

ZusammenfassungBei den meisten Patienten, die heute erwartet an einer unheilbaren Krankheit versterben, wird vor ihrem Tod eine bewusste Entscheidung zum Therapieverzicht getroffen. Während dem Therapieverzicht auf Wunsch des Patienten ein wichtiger Stellenwert in der medizinethischen Diskussion zukommt, hat der Umgang mit Forderung nach „unangemessener“ Maximaltherapie bislang weniger Beachtung gefunden. In einer empirischen Studie zur Einbeziehung von Patienten in Entscheidungen zum Therapieverzicht konnten wir zeigen, dass etwa ein Drittel der Patienten auch bei infauster Prognose Lebenszeit durch Maximaltherapie gewinnen möchte. Diese Patienten (...) wurden im Gegensatz zu Patienten mit palliativem Therapieziel häufig nicht in Entscheidungen zur Therapiebegrenzung einbezogen. Hier werden die ethischen Implikationen dieser Praxis untersucht und gefragt, ob ein Therapieverzicht am Lebensende auch gegen den Wunsch des Patienten ethisch zu rechtfertigen ist oder ob Ärzte dem Wunsch des Patienten nach Lebenszeitgewinn auch bei infauster Prognose durch Maximaltherapie nachkommen sollen. Vor dem Hintergrund der gängigen Konzepte zur Rechtfertigung eines einseitigen Therapieverzichts, die für sich genommen zu kurz greifen, wird ein alternatives Entscheidungsmodell vorgestellt, das vier bewertungsrelevante Kriterien vorsieht: die Wirksamkeit einer Maßnahme, die Autonomiefähigkeit des Patienten, die patientenseitige Nutzenbewertung und die Kosten für die Solidargemeinschaft. I argue that the hospitality of the foreigner for Heidegger is the condition of possibility of dwelling understood as the happening of history.In the first section I analyze the notions of hospitality in Levinas and Derrida. The second section unpacks some of the senses of the earth in (...) Heidegger as the site of man’s historical dwelling, whereas in the third section I focus on holy mourning as the disposition that reveals the earth as the uncanny ground of history. _The Social Work Psychoanalyst's Casebook_ begins with an interview with Dr. Sanville, who reflects on her evolution as a social work analyst, theoretician, writer, teacher, and leader. These reminiscences are followed by accounts of nine analytic treatments, each of which offers an unusual window into what actually transpired between analyst and analysand during the treatment hours. These case studies concern particularly troubled, often traumatized patients-the very "hard to reach" or "difficult to treat" clients with whom social workers have long been (...) familiar. They include a reanalysis by the same analyst of a patient whose first therapy ended in a stalemate; an account of transference and countertransference phenomena during termination; a report on the analysis of a young woman who experienced both chronic and stress-related trauma; and an account of the special issues involved in the treatment of an aging woman. Most of the case studies reflect the influence of Dr. Sanville, whose work has long evinced the therapeutic imagination and disciplined creativity to which all the contributors aspire. Tthe contributors to this volume offer the salutary reminder that analytic work is built on a relationship of respect and empathy and that treatment success follows from the therapist's willingness to accommodate the unique needs of individual patients. Can differences in corporate codes of ethics arise from the specific situation of transformation in Slovakia in contrast to the stable context of the firms in Western Germany? This paper compares codes of ethics of large‐scale enterprises in both countries in terms of ethical issues addressed. It demonstrates that codes of ethics of the Slovak companies mirror the specific transformational circumstances in the country. Compared with Western Germany the codes of these firms include multiple ethical issues, meaning that they experience (...) a broader range of relevant ethical problems. Furthermore, their codes are internally oriented, in terms of the ethical issues raised most often; they put more emphasis on committing employees, managers and shareholders/owners to the firm. Based on the differences discovered, it is proposed that negative experiences within the past process of transformation and in part the socialist heritage are the main reasons for differences between the two samples. Fern Logan’s collection of photographic portraits documents the emergence of the African American artist into mainstream American art. The Artist Portrait Series captures sixty significant artists from the late twentieth century.

‘Without exaggeration and oversimplification little progress is made in most fields of humanistic investigation.’ With this disarming quotation from A. D. Nock, Albert Henrichs begins his book-length interpretation of P. Colon, inv. 3328. In the same spirit of humanistic progress, I would like to reconsider some aspects of the text and to offer a different assessment of its place in the history of religion and literature.The fragments are from three pages of a hitherto unknown Greek novel, Lollianos'Phoinikika. Frags A and (...) B luckily include book-ends, from whose subscriptions we know the author and title of the work. Frag. C is just scraps which yield no continuous sense. Frag. A brokenly and confusedly mentions youths, women dancing, being thrown off the roof, sobriety, kissing, and then, in a slightly more intelligible scene, the male narrator's loss of virginity with a woman named Persis, her gift to him of a gold necklace which he refuses, the assistance of one Glauketes in taking the necklace elsewhere, and finally what seems to be a confrontation between Persis' mother and the two lovers. This last is similar to Achilles Tatius ii 23–5. Achilles Tatius also offers the closest parallel to frag. B, a ghastly description of human sacrifice and cannibalism. This scene is the focus of most of Henrichs' interpretation and I will limit myself to it in the present article.The central question raised by this new novel fragment is how to assess the relative importance of religious and literary parallels. Is thePhoinikikato be regarded as a document in religious or in literary history, or perhaps somewhere on the borderland of both? There has been a lively discussion in the last half century of the thesis that the ancient novels were written and read as religious documents, deriving their basic structure and many details from the myths and cults of particular religions. Henrichs devotes most of his book to arguing that the sacrifice scene in Lollianos is inspired by an actual rite, probably of a Dionysian character, and that thePhoinikikaserves to illuminate a little-known corner of religious history. His views are based on an extensive collection of liturgical, mythical and ethnological parallels concerning oath rituals, the sacrifice of children, cannibalism, and face-painting. Of all the parallels cited, the two which are closest in every way to Lollianos are Achilles Tatius iii 15 and Cassius Dio lxxi 4. On the strength of these Henrichs asserts that Lollianos' description of a ritual murder represents, more or less directly, the cultic practice of the Egyptian Boukoloi. Without postulating a religious message for thePhoinikikaas a whole, Henrichs does claim that this scene yields valuable information about the structure of ancient mystery rituals and that these new fragments support the methodological correctness of Kerenyi's and Merkelbach's approach to the ancient novels. We make some beginning observations about the category Eq of equivalence relations on the set of natural numbers, where a morphism between two equivalence relations R and S is a mapping from the set of R-equivalence classes to that of S-equivalence classes, which is induced by a computable function. We also consider some full subcategories of Eq, such as the category Eq(Σ01) of computably enumerable equivalence relations (called ceers), the category Eq(Π01) of co-computably enumerable equivalence relations, and the category Eq(Dark*) (...) whose objects are the so-called dark ceers plus the ceers with finitely many equivalence classes. Although in all these categories the monomorphisms coincide with the injective morphisms, we show that in Eq(Σ01) the epimorphisms coincide with the onto morphisms, but in Eq(Π01) there are epimorphisms that are not onto. Moreover, Eq, Eq(Σ01), and Eq(Dark*) are closed under finite products, binary coproducts, and coequalizers, but we give an example of two morphisms in Eq(Π01) whose coequalizer in Eq is not an object of Eq(Π01). This article considers two of the methodological steps in a Community of Philosophical Enquiry: developing the questions and voting on the questions. Both of these practices are enacted by the 8-9 year old children who are the participants in a philosophical enquiry, which I facilitated at a government primary school in South Africa. Matthews (1994) reminds us that children as philosophical thinkers/doers have been left out of the dominant narratives about children and childhood. A question that guides this research is (...) where is the place for philosophical questions (developed by children) and the kind of philosophical thinking/drawing/creating/being for child (and adults) in schools? How do we make space for such questioning–so that the richness of these pedagogical encounters can really matter and make a difference to the teaching and learning taking place? Gandorfer in an interview with Barad (2021), suggests that critical thought “is to encounter what is unrecognizable and imperceptible, yet sensible and constructive of sense without separating it from the physical world” (p. 20). I would agree and apply this to the critical thoughts of child. This thinking is not located in the child, in their mind and does not emerge only through the thoughts, child verbalises. A critical posthumanism theory/practice analysis ensures that as researcher, I do not stand outside of the research peering in at a distance. Similarly the children, the questions, the voting and the enquiries are not separate from the world, they are all already entangled with the world. When the children are voting on the questions, this performs as a pedagogy of interruption (Michaud, 2020). As the facilitator, I do not know which question will receive the largest number of votes for the philosophical enquiry. This makes possible an emergent curriculum in its be(com)ing. Toby Rollo’s (2016) formulations about child as political agent and not just moral agent and the implications for more democratic and just schooling are theorised in this paper through the act of the children voting on the questions. I argue that children are not just excluded from participating in decisions about what and even how they are learning at school but from most pedagogical practices in classrooms and schools. I show how the children creating the questions and voting on the questions can be democratic practices with political and moral implications in a community of philosophical enquiry. (shrink)

Genesis suggests that God is the creator of kinds. Kinds as Locke understands them are what are nowadays called "social constructions". They are social constructions because the boundaries between them reflect our interests, perspectives, and desires, but in Locke's view those boundaries are not altogether arbitrary, because they also reflect natural or God‐given similarities among things. This chapter looks more closely at the story of creation, and explains how, in John Locke's view, kinds in particular, those kinds whose members Locke (...) calls "substances", come to be. It further comments on the simplicity and explanatory strength of Locke's story. In spite of its strengths, Locke's view is open to many objections and attended by many complications, one of which is considered here. One objection is that the story of creation pays only glancing attention to entities that must exist in order for the story to be true. (shrink)

Human ecology - the study and practice of relationships between the natural and the social environment - has gained prominence as scholars seek more effectively to engage with pressing global concerns. In the past seventy years most human ecology has skirted the fringes of geography, sociology and biology. This volume pioneers radical new directions. In particular, it explores the power of indigenous and traditional peoples' epistemologies both to critique and to complement insights from modernity and postmodernity.

After describing the corpuscularian background of Berkeley's work, I consider whether Berkeley can endorse the existence of immaterial atoms or corpuscles. I suggest that he hopes to avoid a definite commitment. He wants his position to ‘float’, its level to be determined by the kind of empirical evidence that would strike materialists and immaterialists with equal force. This chapter foregrounds the role played by the notion of intelligibility, both in the defence of modern corpuscularian science and in Berkeley's critical response (...) to it. (shrink)

Berkeley holds that only spirits can be causes. I trace this conclusion to his belief that minds or spirits are able to render their effects intelligible in a way that unthinking things cannot. Causes and their effects are not necessarily connected, in Berkeley's view, but there is more to causation than constant conjunction or regular association.
