Non-therapeutic genetic testing in childhood presents a “myriad of ethical questions”; questions which are discussed and resolved in professional policy and position statements. In this paper we consider an underdiscussed but strongly influential feature of policy-making, the role of selective case and exemplar in the production of general recommendations. Our analysis, in the tradition of rhetoric and argumentation, examines the predominate use of three particular disease exemplar to argue for or against particular genetic tests. We discuss the influence these choices (...) have on the type and strength of subsequent recommendations. We argue that there are lessons to be drawn about how genetic diseases are conceptualised and we caution against the geneticisation of medical policy making. (shrink)

This paper argues that the various approaches to ethics that bioethicists rely on are not adequate to provide effective moral guidance in how to avoid a series of looming human catastrophes (associated with such threats as environmental degradation, war, extreme poverty, and pandemics). It proposes development of a new approach to ethics, dubbed public ethics, that simultaneously investigates moral responsibilities at multiple levels of human organization from the individual to international bodies. In this important book, Susan Hurley sheds new light on consciousness by examining its relationships to action from various angles. She assesses the role of agency in the unity of a conscious perspective, and argues that perception and action are more deeply interdependent than we usually assume. A standard view conceives perception as input from world to mind and action as output from mind to world, with the serious business of thought in between. Hurley criticizes this picture, and considers (...) how the interdependence of perceptual experience and agency at the personal level (of mental contents and norms) may emerge from the subpersonal level (of underlying causal processes and complex dynamic feedback systems). Her two-level view has wide implications, for topics that include self-consciousness, the modularity of mind, and the relations of mind to world. The self no longer lurks hidden somewhere between perceptual input and behavioral output, but reappears out in the open, embodied and embedded in its environment. Hurley traces these themes from Kantian and Wittgensteinian arguments through to intriguing recent work in neuropsychology and in dynamic systems approaches to the mind, providing a bridge from mainstream philosophy to work in other disciplines. Consciousness in Action is unique in the range of philosophical and scientific work it draws on, and in the deep criticism it offers of centuries-old habits of thought. (shrink)

Wollstonecraft's early works express a coherent view of moral psychology, moral education and moral philosophy which guides the construction of her early fiction and educational works. It includes a valuable account of the relation between reason and feeling in moral development. Failure to recognize the complexity and coherence of the view and unhistorical readings have led to mistaken criticisms of Wollstonecraft's position. Part I answers these criticisms; Part II describes and textually supports her view.

Should the insane and the mentally ill be held morally responsible for their actions? To answer ‘No’ to this question is to classify the mentally abnormal as not fully human: and indeed legal tradition has generally oscillated between assimilating the insane to brutes and assimilating them to children below the age of discretion, neither of these two categories being accountable in law for what they do. In what respect relevant to moral responsibility were the insane held to resemble brutes and (...) children? In the case of brutes, the answer seems to have been that the doings of the insane appeared to lack whatever it is that marks out human actions as distinctively human. What the insane did could not be thought of as issuing from deliberation, or as capable of having issued from deliberation, but seemed rather to be the result of the unbridled operation of nature — if a diseased nature. The natural comparison with insane killings seemed to be, for example, the killing of birds by cats. This distinction between animal doings and human actions does not depend on Cartesian views about the workings of animals; the operation of nature need not be thought of as mechanical. The thought is simply that where there is no room for deliberation there is no room for moral appraisal. Children, on the other hand, though capable of distinctively human action — i.e. of deliberating about what they do — were held not to be capable of the relevant kind of deliberation: for they were held ‘not to know the difference between right and wrong’. This book presents the first full translation of the correspondence of Leo Strauss and Gerhard Krüger, showing for each the development of key and influential ideas, along with seven interpretative essays by leading Strauss scholars. During the early to mid-1930’s, Leo Strauss carried on an intense, and sometimes deeply personal, correspondence with one of the leading intellectual lights among Heidegger’s circle of recent students and younger associates. A fellow traveler in the effort to “return to Plato” and reject neo-Kantian conventions (...) of the day, Krüger was also a serious student of Rudolf Bultmann and the neo-orthodox movement in which Strauss also took an early interest. During the most intense years of their correspondence, each underwent significant intellectual development: in Krüger’s case, through a penetrating series of studies of Kant and Descartes, respectively, ultimately leading to Krüger’s conversion to Catholicism; and, in Strauss’s case, through the complex stages of what he subsequently called his “reorientation,” involving what he for the first time calls “political philosophy.” Readers interested in tracing the development of Strauss’s thoughts regarding a theological alternative that he found helpfully challenging—if not ultimately compelling—will find this correspondence to be an accessible point of entry. For eighteenth-century Europeans, the Lisbon earthquake was manifest evil. Today we view evil as a matter of human cruelty, and Auschwitz as its extreme incarnation. Examining our understanding of evil from the Inquisition to contemporary terrorism, Susan Neiman explores who we have become in the three centuries that separate (...) us from the early Enlightenment. In the process, she rewrites the history of modern thought and points philosophy back to the questions that originally animated it. Whether expressed in theological or secular terms, evil poses a problem about the world's intelligibility. It confronts philosophy with fundamental questions: Can there be meaning in a world where innocents suffer? Can belief in divine power or human progress survive a cataloging of evil? Is evil profound or banal? Neiman argues that these questions impelled modern philosophy. Traditional philosophers from Leibniz to Hegel sought to defend the Creator of a world containing evil. Inevitably, their efforts—combined with those of more literary figures like Pope, Voltaire, and the Marquis de Sade—eroded belief in God's benevolence, power, and relevance, until Nietzsche claimed He had been murdered. They also yielded the distinction between natural and moral evil that we now take for granted. Neiman turns to consider philosophy's response to the Holocaust as a final moral evil, concluding that two basic stances run through modern thought. One, from Rousseau to Arendt, insists that morality demands we make evil intelligible. The other, from Voltaire to Adorno, insists that morality demands that we don't. Patriarchal theologies which obstruct women’s leadership in the Anglican Church and impede ‘collaborative’ ministry prompt this exploration of the reluctance to relinquish male metaphors for God, even when intimate relationship rather than gender is stressed as the crucial concept of Trinitarian theology. Despite the ambiguities of using female terms for the divine and of establishing the oft-neglected Holy Spirit as female imaginary in the Godhead, Father-idolatry and sub-ordinationism in the Trinity need to be challenged. ‘Midwife’ is suggested as a feminine (...) term for the 3rd Person, signifying non-gendered action but retaining personhood. This would creatively renew Trinitarian doctrine, the Church and its leadership as reflections of the perichoretic Godhead. (shrink)

This Element examines the entirety of Kant's Critique of Taste with particular emphasis on its political and moral aims. Kant's critical treatment of aesthetic judgment is both an extended theoretical response to influential predecessors and contemporaries, including Rousseau and Herder, and a practical intervention in its own right meant to nudge history forward at a time of civilizational crisis. Attention to these themes helps resolve a number of puzzles, both textual and philosophic, including the normative force and meaning of judgments (...) of taste, and the relation between natural and artful beauty. Two decades of literature and discussion on the topic of therapist-client sexual relationships have revealed much about the nature and consequences of these relationships and have produced an explicit prohibition against such relationships in American Psychological Association (APA) Ethical Principle 6a. This article reviews the literature as it relates to the ethically gray area of sex with former clients. The relative lack of an empirical basis for extending the prohibition of Principle 6a to posttermination relationships is noted. The book is an investigation of the semantics of numericals, counting and measuring, and its connection to the mass/count distinction from a theoretical and crosslinguistic perspective. It reviews some recent major linguistic results in these topics, and presents the author's new research including in-depth case studies of a number of typologically unrelated languages.

The population of most non-dominant ethnic groups in the USA is growing dramatically. Faculty members are challenged to develop curricula that adequately prepare our future nurses. An increased focus on clinical ethics has resulted from the use of sophisticated technology, changes in health care financing, an increasing elderly population and the shift of care from inpatient to outpatient settings. Nurses frequently face situations demanding resolution of ethical dilemmas involving cultural differences. Nursing curricula must include content on both ethics and cultural (...) sensitivity. Active student participation is an important element providing a foundation for ethical practice. A proposed educational format was introduced with graduating baccalaureate students. In a pilot study, curricular content on cultural sensitivity and ethical practice was taught in separate modules. Students were then asked to identify and problem solve an ethical dilemma involving patients and professional caregivers from vastly different cultures. Course faculty members provided discussion questions to guide the students' thinking. (shrink)

PGD to avoid serious and early-onset illness in the child-to-be is widely accepted. PGD prevents gestation of an affected embryo and reduces the chance that the parents (...) will be faced with a difficult decision of whether to terminate the pregnancy. More controversial have been PGD to select the sex of the child-to-be for “family balancing”, PGD for mere susceptibility to disease and for late-onset disorders such as Alzheimer diseas, and most controversially, PGD to create a donor child who is Human Leukocyte Antigen (HLA-matched with a preexisting sibling in need of stem cell transplant. In his recent book The Advancement of Science, Philip Kitcher endorses eliminative induction, or the view that confirmation of hypotheses proceeds by the elimination of alternatives. My intention here is to critically examine Kitcher's eliminativist view of confirmation, and his rejection of the widely held Bayesian position, according to which an hypothesis H is confirmed by evidence E just in case the probability of H conditional on E is greater than the simple unconditional probability of H [i.e. p > p]. (...) Here, I will maintain that while there are aspects of the eliminative approach which Bayesianism must incorporate, as has been argued by John Earman, the eliminativism advocated by Kitcher is unsatisfactory. In addition, I will suggest that Kitcher's reasons for rejecting Bayesian confirmation theory are unconvincing and depend on an overly restrictive version of the position and that indeed Bayesianism has resources needed by an eliminativist account of confirmation. Debate over the relationship of law and bioethics is growing - what the relationship has been and what it should be in the future. While George Annas has praised law and rights-talk for creating modern bioethics, Carl Schneider has instead blamed law for hijacking bioethics and stunting moral reflection. Indeed, as modern bioethics approaches the 40-year mark, historians of bioethics are presenting divergent accounts. In one account, typified by Albert Jonsen, bioethics largely grew out of philosophy and theology, not law. (...) In another account, law has deeply shaped bioethics from the start, forging its central commitment to the rights of patients and research subjects and the fields imposition of broad fiduciary responsibilities on health care professionals and researchers.In addition to debating how to properly describe laws historical relationship to bioethics, commentators have argued over whether laws influence in bioethics is now good or bad. This paper reports on a particular aspect of a larger ethnographic study of nursing culture in an intensive therapy unit (ITU), accomplished through participant observation over a 12‐month period, followed by interviews with 15 nurses. The paper suggests that the ITU environment is perceived as ‘dangerous’, its dangerousness stemming from the ambiguity of its patients’ conditions. Drawing on anthropological concepts of liminality, pollution, anomaly and breaching of boundaries, the paper identifies various ambiguities inherent in ITU patients’ conditions. It then explores (...) the ways in which these anomalies are managed through sequestration and other ritual and symbolic practices. Notwithstanding the undoubted scientific reasons for particular nursing practices, the paper argues that there are also ritual and symbolic elements serving other more complex purposes, both protecting patients and staff and symbolising the highly valued phenomenon of keeping patients safe. The paper identifies a contradiction inherent in nursing work in this locale inasmuch as rituals and symbolism coexist with technical and research‐based elements of nursing care. (shrink)

Judith Butler claims to have based her theory of gender performance on Simone de Beauvoir’s path-breaking idea that one is not born, but rather becomes, a woman. However, Butler’s interpretation of Beauvoir’s work departs considerably from Beauvoir’s own expressed view which is that women are shaped by an interplay of femininity (construed by cultural and structural norms) and sexed bodies and that the concept of woman is a mutable one that can accommodate increasing degrees of freedom. In this paper I (...) explore Beauvoir’s theories further, showing how they depart from Butler’s interpretations of them and in the process exploring the contribution that Beauvoir and Butler respectively make towards understanding ongoing gender inequality. Finally, I compare and contrast the role of temporality and the life course in ‘becoming a woman’ and in performing gender respectively, focusing on the figure of the post-menopausal woman in particular. How could it happen that the very processes intended to assure ethical research in Australia might, themselves, undermine good research practice?This paper describes one PhD candidate’s recent experiences of multicentre review for a Human Research Ethics Committee approved, low/negligible risk, qualitative study, at the crossroad of health services research and organisational research.A retrospective review of international literature about multi-centre review processes revealed that many of these experiences were not unique and might have been expected, notwithstanding Australian efforts at harmonisation of (...) multi-centre review. This paper examines not only the burden of red-tape that was applied to a small doctoral study, but also the way in which the red-tape threatened the anonymity of potential study participants and risked exposing them to undue pressure and distress.These experiences support the view that harmonisation initiatives have not yet developed as the Australian National Health and Medical Research Council may have hoped and that further attention is needed to harmonise research governance processes.
