This essay criticizes John Norton's 2010 defense of the thesis that “all induction is local.” Norton's local inductions are bound, if cogent, to involve general principles, and the need to accredit these general principles threatens to lead to all the usual problems associated with the ‘problem of induction’. Norton, in fact, recognizes this threat, but his responses are inadequate. The right response involves not induction but a sophisticated version of hypothetico-deduction. Norton's secondary thesis—that if there is a general account of (...) cogent scientific reasoning, then it is certainly not the one supported by personalist Bayesians—is also criticized. (shrink)

In a material theory of induction, inductive inferences are warranted by facts that prevail locally. This approach, it is urged, is preferable to formal theories of induction in which the good inductive inferences are delineated as those conforming to some universal schema. An inductive inference problem concerning indeterministic, non-probabilistic systems in physics is posed and it is argued that Bayesians cannot responsibly analyze it, thereby demonstrating that the probability calculus is not the universal logic of induction.

In this paper we provide an interpretation of Aristotle's rule for the universal quantifier in Topics Θ 157a34–37 and 160b1–6 in terms of Paul Lorenzen's dialogical logic. This is meant as a contribution to the rehabilitation of the role of dialectic within the Organon. After a review of earlier views of Aristotle on quantification, we argue that this rule is related to the dictum de omni in Prior Analytics A 24b28–29. This would be an indication of the dictum’s origin (...) in the context of dialectical games. One consequence of our approach is a novel explanation of the doctrine of the existential import of the quantifiers in dialectical terms. After a brief survey of Lorenzen's dialogical logic, we offer a set of rules for dialectical games based on previous work by Castelnérac and Marion, to which we add here the rule for the universal quantifier, as interpreted in terms of its counterpart in dialogical logic. The book covers a broad range of philosophical issues spanning the philosophy of mind and language, the epistemology of metaphysical modality and the philosophy of philosophy. It will be of considerable interest to many, since there is something in it for just about everyone. This paper investigates how Schleiermacher’s universal hermeneutics can be considered as a better alternative to both, German rationalist aesthetics as pioneered by Christian Wolff, and Kant’s transcendental idealism, to the extent of overcoming the problematics of rule-following. A general account of the necessity of a universal hermeneutics and its meaning from historical practices of exegeses is given. This is then followed by the account of rule-following in the tradition of both German rationalist aesthetics and Kant’s transcendental idealism with (...) latter as expounded in Kant’s Critique of Pure Reason. Probabilities in quantum theory are traditionally given by Born’s rule as the expectation values of projection operators. Here it is shown that Born’s rule is insufficient in universes so large that they contain identical multiple copies of observers, because one does not have definite projection operators to apply. Possible replacements for Born’s rule include using the expectation value of various operators that are not projection operators, or using vari-.

"The golden rule" (Matthew 7:12) is a formulation of natural moral law, a logical way to divide good from evil. It has been attacked by J.W. Hennessey, Jr. and Bernard Gert as a "particularist preachment." On the contrary, it remains a useful, universal guide to moral conduct and cannot be considered a self-centered, subjective guide to the moral life. We must agree with Jeffrey Wattles that there are multiple possible meanings to the "rule", some legitimate and some spurious. The (...) legitimate meanings, such as the "standard of God-like behavior," all yield the same judgment on morally doubtful actions such as forgery. The so-called "platinum" rule, "Do unto others as they would have you do unto them" has face appeal, but is fatally flawed in its logic, and does not supercede "the golden rule" because part of the treatment I wish from others is a full understanding of my true needs and wishes, even when I do not judge my own needs correctly. This is a three-page refutation of the Rachels's denial of moral diversity. In sections 2.5 and 2.6 of ‘The Challenge of Cultural Relativism,’ James and Stuart Rachels argue that diversity amongst cultures with regard to moral rules is overstated because all cultures have some values in common. I show that their argument is invalid and otherwise unsound and that cultures differ substantially with regard to their moral rules.

The Telecommunications Act of 1996 is considered landmark legislation, especially in the area of universal service. However, the FCC performed even more groundbreaking activity. The FCC was given wide latitude by the Act to interpret the universal service provisions of the Act either narrowly or broadly; the FCC chose the latter. The FCC's interpretation of the Act will have a significant impact on the level of technology implementation and use in American classrooms and libraries. In March 1996, the (...) FCC issued a Notice of Proposed Rulemaking on Universal Service. The NPRM also established a Federal-State Joint Board composed of three FCC Commissioners, four state public service commission representatives nominated by the National Association of Regulatory Utility Commissioners, and one utility consumer advocate nominated by the National Association of State Utility Consumer Advocates. On November 8, 1996, the Joint Board released its Recommended Decision and the FCC adopted its rules based on that recommendation in May 1997. The FCC ruled that all eligible schools and libraties should receive discounts of between 20 and 90 percent on all telecommunications services, Internet access, and internal connections, subject to a $2.25 billion annual cap. In addition, any funds not disbursed in a given year may be carried forward and disbursed in subsequent years without regard to the cap. This provision, according to the FCC, will provide schools and libraries with the maximum flexibility to purchase the services that will meet their communications needs most effectively. In a separate section of the rules, the FCC defined "core services" as: • Voice-grade access to the public switched network, with the ability to place and receive calls • Dual Tone Multifrequency signaling or its functional equivalent • Single-party service • Access to emergency services • Access to operator services • Access to interexchange services • Access to directory assistance. • Support for toll limitation services for low-income consumers. However, as stated in the Act, the FCC was given the latitude to include additional services for schools and libraries. It could have chosen to provide schools and libraries with discounts on only core telecommunications services; core services plus some complement of additional services; or all telecommunications services. The FCC adopted the third option, that discounts be provided on all telecommunications services. It stated that this guideline would provide schools and libraries the maximum flexibility to purchase whatever package of telecommunications services they believe would meet their telecommunications service needs most effectively and efficiently. _Current Status:_ The FCC ruled that it will permit schools to begin using discounted services on January 1, 1998. He sought to demonstrate that the concepts of metaphysics, considered in themselves, are mere logical functions, that is, ways of synthesizing concepts to form judgments Accordingly, the metaphysical concept of substance/accident contains nothing more than the logical form of subject/predicate, whereby any arbitrary pair of concepts may be united in a judgment; cause and effect merely the hypothetical form of judgment, whereby any arbitrary pair of judgments (...) may be united as condition and conditioned; totality the form of subordination of one concept to another whereby any species of the one has the other as its genus; and so forth. Logical functions are what remain after we abstract from all content of the concepts in a judgment; they are merely the various ways in which any concept, or judgment, may be combined with any other, and so are utterly devoid of objective sense or signification. More importantly, they comprise the totality of that which may be attributed to the understanding taken by itself, in isolation from the other faculties of the mind: sensibility, desire, and feeling. The understanding, for Kant, is the capacity to judge ; it is not, when considered without relation to other faculties, a faculty of concepts, rules, principles, or even categories. Indeed, if categories may be said to express any content at all, it is simply and solely the relation of the understanding to another faculty. In the case of sensibility--a faculty comprising the manifold of the senses and its synthesis in imagination--categories are obtained when this synthesis is represented universally and a priori, and so represent the "pure synthetic unity of the manifold in general." Similarly, the categories tabulated in the Critique of Practical Reason express the relation of the capacity to judge to the capacity of desire. ABSTRACTThis article critically examines the value and scope of the cab rank rule in England and Australia. Despite the laudable non-discrimination principle underpinning it, the cab rank rule is subject to so many exceptions it is debatable whether the rule has any effect, positive or negative, on access to justice. On the other hand, when the rule is followed, it has the potential to unnecessarily distort the legal services market. Despite legitimate questions about its continued relevance, the paper argues that (...) the rationale for the cab rank rule remains critically important in an age where most people are unable to afford private legal representation and are ineligible for public legal assistance. The cab rank rule could play a greater role in delivering access to justice for all, by ‘rebooting’ it as a limited universal service obligation to provide legal representation for all who genuinely need it but cannot obtain it privately. People accept conclusions of valid conditional inferences (e.g., if p then q, p therefore q) less, the more disablers (circumstances that prevent q to happen although p is true) exist. We investigated whether rules that through their phrasing exclude disablers evoke higher acceptance ratings than rules that do not exclude disablers. In three experiments we re-phrased content-rich conditionals from the literature as either universal or existential rules and embedded these rules in Modus Ponens and Modus (...) Tollens inferences. In Experiments 2 and 3, we also used abstract rules. The acceptance of conclusions increased when the rule was phrased with “all” instead of “some” and the number of disablers had a higher impact on existential rules than on universal rules. Further, the effect of quantifier was more pronounced for abstract rules and when tested within subjects. We discuss the relevance of phrasing, quantifiers and knowledge on reasoning. (shrink)

In Rules and Representations, first published in 1980, Noam Chomsky lays out many of the concepts that have made his approach to linguistics and human cognition so instrumental to our understanding of language.Chomsky arrives at his well-known position that there is a universal grammar, structured in the human mind and common to all human languages. Based on Chomsky's 1978 Woodbridge Lectures, this edition contains revised versions of the lectures and two new essays.

The universal generalization problem is the question: What entitles one to conclude that a property established for an individual object holds for any individual object in the domain? This amounts to the question: Why is the rule of universal generalization justified? In the modern and contemporary age Descartes, Locke, Berkeley, Hume, Kant, Mill, Gentzen gave alternative solutions of the universal generalization problem. In this paper I consider Locke’s, Berkeley’s and Gentzen’s solutions and argue that they are problematic. (...) Then I consider an alternative formulation of universal generalization which depends on the view that mathematical objects are individual objects and are hypotheses introduced to solve mathematical problems, and that mathematical proofs are argument schemata. I argue that this alternative formulation allows one to overcome the problems of Locke’s, Berkeley’s and Gentzen’s solutions, and is related to the approach to generality in Greek mathematics. I also argue that there is a connection between the present formulation of universal generalization and a special form of the analogy rule which is implicit in Proclus’ approach to the universal generalization problem. The reason for physics’ failure to find a final theory of the universe is examined. Problems identified are: the lack of unequivocal definitions for its fundamental elements (time, length, mass, electric charge, energy, work, matter-waves); the danger of relying too much on mathematics for solutions; especially as philosophical arguments conclude the universe cannot have a mathematical basis. It does not even need the concept of number to exist. Numbers and mathematics are human inventions arising from the human predilection for measurement. (...) Following Aristotle, a single fundamental cause is proposed to explore the efficacy of using pure non-mathematical philosophy to explain the universe, contrary to current quantum physical views. The cause is taken as Time, which is then defined, surprisingly leading automatically to a definition of a three-dimensional space answering the question into what can a universe be placed (space before space seems non-sensical). This enables the philosophical arguments to derive a universal rule giving clear-cut descriptions (definitions) of force (both gravitational and electromagnetic), motion, energy, and particles. The formation of atomic nuclei and atomic properties together with an unexpected role for neutrinos follow. In particular, a Popper-test can be prepared by introducing the concept of measurement to allow the philosophy arguments to be tested in another discipline - mathematics. The solution agrees with human physical observations to a remarkable degree of accuracy, automatically explaining and predicting values for Planck’s and the fine-structure constants. Although mathematical, it is included as confirming the efficacy of philosophy in attaining a final theory. (shrink)

The aim of the paper is to formalize I. Bellert's proposal to characterize distinct nonequivalent readings of quantificationally ambiguous sentences with help of two features: absoluteness and distributiveness. The formalisation makes use of set theoretical and model theoretical standard notions. Foundamental rules, proposed by Bellert, govering the interpretation of cooccurring quantifiers are quoted and outlines of proofs of important derived rules are given.

Rule-Consequentialism faces “the problem of partial acceptance”: How should the ideal code be selected given the possibility that its rules may not be universally accepted? A new contender, “Calculated Rates” Rule-Consequentialism claims to solve this problem. However, I argue that Calculated Rates merely relocates the partial acceptance question. Nevertheless, there is a significant lesson from this failure of Calculated Rates. Rule-Consequentialism’s problem of partial acceptance is more helpfully understood as an instance of the broader problem of selecting the ideal (...) code given various assumptions—assumptions about who will accept and comply with the rules, but also about how the rules will be taught and enforced, and how similar the future will be. Previous rich discussions about partial acceptance provide a taxonomy and groundwork for formulating the best version of Rule-Consequentialism. (shrink)

In this paper I analyse how procreative freedom poses a challenge for rule-consequentialism. First, I reconstruct the rule-consequentialist case for procreative freedom. Second, I argue that population scenarios resulting from very low fertility pose a problem for rule-consequentialism since such scenarios cannot secure population growth or even avoid human extinction in the long run. Third, I argue that population scenarios resulting from excessive procreation also pose a problem for rule-consequentialism since they are incompatible with the promotion of optimific consequences in (...) various ways. Were the rule-consequentialist to avoid these types of scenarios, the challenge would consist in doing so while retaining the liberal approach to individual rights and freedoms that made rule-consequentialism an advantageous competitor against moral theories like act-consequentialism. These population scenarios raise more general questions about how rule-consequentialism ought to conceptualise the application of universal rules in the long-term, intergenerational context. This is an important place for inquiry given that rule-consequentialism is originally conceived as a forward-looking theory. (shrink)

This article presents a rule-utilitarian theory which lies much closer to the social contract tradition than most other forms of consequentialism do: calculated-rates rule preference utilitarianism. Being preference-utilitarian allows the theory to be grounded in instrumental rationality and the equality of agents, as opposed to teleological assumptions about impartial goodness. The calculated-rates approach, judging rules’ consequences by what would happen if they were accepted by whatever number of people is realistic rather than by what would happen if they were (...) accepted universally or by exactly 90% of the population, allows it to select rules based not just on their ability to give good advice to their followers but also on their ability to attract followers in the first place. The result is a theory that, although fully utilitarian and not at all pluralistic or intuitionist, nevertheless offers a principled justification for giving some weight to seemingly non-utilitarian considerations: Lockean natural rights, Kantian respect for autonomy, and Scanlonian distributive justice. Boston Medical Center/Boston University Medical Campus recently reduced certain requirements for human subjects research where this could be done without adversely affecting the rights and welfare of participants, in anticipation of changes in the Final Common Rule. Modifications affected exempt and expedited categories, approval periods, ceding review, Quality Improvement/Quality Assessment activities, and some requirements for pregnant women, prisoners, and children. This case study may assist other institutions in responding to the Final Common Rule.

It examines the unprecedented visual language adopted in a female Franciscan context to authorize their way of life, and places the manuscript in context, exploring how it relates to other early representations showing Saints Francis and Clare together and documenting the production of this and comparable early rule manuscripts, including a previously unpublished copy now in Venice.2Thousands of manuscript copies of rules of life were produced in and for late medieval religious houses and their members, good numbers of which remain extant, though these are scarce remnants of what must originally have been produced. The large, illuminated initials have been recognized as painted by Nerius da Rimini and his workshop but the case has never been set out and PUL MS 83 has [End Page 77] not been included in accounts of this artist's production.12 Better known as "Neri," he is a comparatively well-documented manuscript illuminator whose signatures sometimes survive on his work, a rare practice at this date.13Historians of medieval women religious are by now familiar with books produced by women themselves.14 A beautiful manuscript, for example, containing Bonaventure's Legenda Maior of Saint Francis, the Vita beati Antonii and documents relating to the Portiuncula indulgence was written in Latin in 1337 by two sisters, Elspet von Amberk and Katerina von Purchausen, perhaps living in the Paradies convent in Diessenhofen (Switzerland).15 Other women have been identified as skilled illuminators.16 The prolific activity of... Rule consequentialism is usually taken to recommend a single ideal code for all moral agents. Here I argue that, depending on their theoretical mo- tivations, some rule consequentialists have good reasons to be relativists. Rule consequentialists who are moved by consequentialist considerations ought to support a scheme of multiple relativized moral codes because we could expect such a scheme to have better consequences in terms of impartial aggregate well- being than a single universal code.
