This article examines the debate about the normative relevance of social constructivism, arguing that the criticisms of Winner, Radder, and others are fundamentally accurate. The article argues that a combination of Radder's notion of nonlocal values and Martin's concern for deliberative interventions may offer a theoretical exit from the normative irrelevance that marks constructivism. The article goes on to suggest that theoretical and praxeological developments in two other literatures, participatory public policy analysis and deliberative democracy, may provide fruitful (...) initiatives for constructivist scholars eager to address normative concerns. Deliberative democrats seek to link political choices more closely to the deliberations of common citizens, rather than consigning them to speak only in the desiccated language of checks on a ballot. Sober thinkers from Plato to today, however, have argued that if we want to make good decisions we cannot entrust them to the deliberations of common citizens. Critics argue that deliberative democracy is wildly unworkable in practice. Deliberative Democracy between Theory and Practice cuts across this (...) debate by clarifying the structure of a deliberative democratic system, and goes on to re-evaluate the main empirical challenges to deliberative democracy in light of this new frame. The development of the theory of deliberative democracy is connected to the completion of two tasks. The first is to combine broad political participation with the rationality of the political process. The second is to ensure the political unity of modern societies, which are characterized by a pluralism of often incompatible values, norms, and lifestyles. Within the framework of this theory, the key democratic procedure is rational deliberation open to all interested parties. The purpose of this procedure (...) is to reach an agreement, as stated in the theory of Jurgen Habermas. However, experimental studies of deliberative practices show that they may result not in agreement but in the radicalization of positions. Unlike Habermas, John Rawls believes that a consensus on values and norms is unattainable. His theory of political liberalism attempts to answer the question of how political unity is possible in practically insoluble conflict, that is, in a situation of disagreement. He proposes the ideal of a well-ordered society with the assumption that a just society is one in which there is no agreement on comprehensive doctrines, but there is a consensus on the basic principles of justice. However, Rawls’s theory, in turn, faces a number of significant problems. For example, he was forced to admit that the democratic culture of society is a prerequisite for the formation of basic principles of justice in a well-ordered society. Rawls’s idea about the connections among disagreement, political freedom, and democracy influenced the further development of the theory of democracy, stimulating the search for different models of decision-making and the formation of political will without rational agreement. After all, the possibility of democracy lies in the conflict of ideas about justice and good. (shrink)

Organizations routinely make choices when addressing conflicting stakes of their stakeholders. As stakeholder theory continues to mature, scholars continue to seek ways to make it more usable, yet proponents continue to debate its legitimacy. Various scholarly attempts to ground stakeholder theory have not narrowed down this debate. We draw from the work of Juergen Habermas to theoretically advance stakeholder theory, and to provide practical examples to illustrate our approach. Specifically, we apply Habermas’ language-pragmatic approach to extend stakeholder (...) theory by advancing seven sets of normative axioms. We conclude that a deliberative approach, with its focus on the conditions of legitimation and deliberative democracy, has the potential to become a cornerstone of stakeholder theory. The need for global stakeholder discourse and its internalization in corporate structures and institutions is exemplified by a multitude of CSR and stakeholder initiatives that have mushroomed in response to global risk scenarios such as climate change, nuclear warfare, or terrorism. Further research may help to build a functioning global governance system in order to provide guidance for management in the 21st century. (shrink)

The two most influential traditions of contemporary theorizing about democracy, social choice theory and deliberative democracy, are generally thought to be at loggerheads, in that the former demonstrates the impossibility, instability or meaninglessness of the rational collective outcomes sought by the latter. We argue that the two traditions can be reconciled. After expounding the central Arrow and Gibbard-Satterthwaite impossibility results, we reassess their implications, identifying the conditions under which meaningful democratic decision making is possible. We argue that deliberation (...) can promote these conditions, and hence that social choice theory suggests not that democratic decision making is impossible, but rather that democracy must have a deliberative aspect. Deliberative democracy has been castigated by those who regard it as exclusive and elitist because of its failure to take into account a range of structural inequalities existing within contemporary liberal democracies. As a result, it is suggested, deliberative arenas will merely reproduce these inequalities, advantaging the already powerful extolling mainstream worldviews excluding the interests of the less powerful and those expounding alternative worldviews. Moreover, the tactics employed by those excluded social movements seeking to right an injustice are (...) typically those – involving various forms of protest and direct action – which are incompatible with the key characteristics of deliberatively democracy. This paper seeks to examine the case against deliberative democracy through the prism of animal rights. It will be argued that the critique of deliberative democracy, at least in the case of animal rights, is largely misplaced because it underestimates the rationalistic basis of animal rights philosophy, misunderstands the aspirational character of deliberative theory and mistakenly attributes problems that are not restricted to deliberation but result from interest group politics in general. It is further argued that this debate about the apparent incompatibility between the ideals of deliberative democracy and non-deliberative activism disguises the potential that deliberative democracy has for advocates of animal rights and, by extension, other social movements too. Integrative Social Contracts Theory is a popular framework to assist managers in making decisions on international moral dilemmas. Although the theory has been praised for its comprehensiveness and sophistication, commentators have raised concerns regarding the justification and identification of substantive hypernorms, fundamental moral principles valid across cultures. This paper introduces the deliberative test, a new method for testing the cross-cultural validity of ethical norms in ISCT. The test relies on the concept of Deliberative Capacity, arising from (...) new developments in system-level deliberative democracy research, which studies deliberation at the level of national societies and over time. Based on this recent stream of research, the deliberative test has the potential of providing better guidance for managers to decide which norms to follow in case of conflicting standards between home and host countries. In this paper, we examine whether it is possible to improve democracy by encouraging ordinary citizens to participate in political decision-making and if participation in deliberative institutions can make citizens more competent decision-makers. By using qualitative data, we analyze the discussion from the Belgrade citizens? assembly focused on the topic of expanding the pedestrian zone in the city center. The CA was organized in Serbia for the first time, as part of a research project aimed at promoting and advancing (...) innovative democratic practices in the Western Balkans. The goal was to encourage the involvement of citizens in discussions of public interest. Our hypothesis was that, through the process of participation and deliberation in CA, ordinary citizens can make reasonable and informed choices, increase their knowledge of the issue discussed, and become more motivated to participate in political decision-making on the local level. Our qualitative content analysis suggests that deliberation had a positive impact on participants? knowledge of the chosen topic of the assembly. It also shows that citizens used exhaustive explanations rather than brief statements, could differentiate the good arguments from the bad, and more often appealed to general rather than private interests. Participants in the assembly reported a significant increase in interest in political decision-making that affects their lives, as well as a sense of being informed about politics. Finally, we wanted to draw attention to the challenges and open questions that remain, namely those that concern the impact of a deliberative body on political decision-making in the real world. This article uses the lens of deliberative democracy to examine the argument of the permanent minority as a possible ground for secession. According to this argument, Catalans are permanent minorities which, under no circumstances, could obtain the parliamentary majorities that would enable them to secede. Historically, this fact has created the conditions for sustained abuse. Nowadays, it prevents the success of secession processes which leaves Catalans with no alternative but to circumvent democratic means. The article concludes that this argument (...) is either incompatible with deliberative democracy or collapses into an argument that justifies secession as reparation. The argument goes like this: if the interests of the minority have been adequately considered in a deliberative process, the decisions of the majority are justified and thus do not generate a right to secede; if those interests have been ignored, the decisions fail to meet the deliberative standards and generate a remedial right to secession. Both use as theoretical constructions rational individuals and the concept of consensus for legitimacy. Whereas discourse theory emphasizes the conditions of a legitimate consensus and could thus enable institutional economics to escape the infinite regress of judging a consensus legitimate, institutional economics has a tested (...) social science paradigm (rational choice) of explaining and predicting the functioning of institutions. The article outlines a theoretical synthesis of the two theories by finding points in common and possibilities of fruitful combinations concerning the problem of legitimacy, institutional design and effectiveness of legal norms. Revisioning macro-democratic processes in light of the processes and promise of micro-deliberation, Innovating Democracy provides an integrated perspective on democratic theory and practice after the deliberative turn.

IN the last decade deliberative democracy has developed rapidly from a “theoretical statement” into a “working theory.”1 Scholars and practitioners have launched numerous initiatives designed to put deliberative democracy into practice, ranging from deliberative polling to citizen summits.2 Some even advocate deliberation as a new “revolutionary now.”3 Deliberative democracy has also experienced the beginning of an empirical turn, making significant gains as an empirical (or positive) political science. Deliberative or discursive models of democracy have recently enjoyed a revival in both political theory and policy practice. Against the picture of democracy as a procedure for aggregating and effectively meeting the given preference of individuals, deliberative theory offers a model of democracy as a forum through which judgements and preferences are formed and altered through reasoned dialogue between free and equal citizens. Much in the recent revival of deliberative democracy, especially that which comes through (...) Habermas and Rawls, has Kantian roots. Deliberative institutions are embodiments of the free public use of reason that Kant takes to define the enlightenment project. Within the Kantian model the public use of reason is incompatible with the use of rhetoric. While this paper rejects strong rhetorical criticisms of deliberative democracy which render all communication strategic, it argues that rhetorical studies of deliberation have highlighted features of deliberation which point to significant weaknesses in Kantian approaches to it. Two features are of particular importance: the role of testimony and judgements of credibility in deliberation; and the role of appeal to emotions in public discourse. Both from the Kantian perspective are potential sources of heteronomy. However, the appeal to testimony and emotion are features of public deliberation that cannot and should not be eliminated. For those committed to the enlightenment values that underlie the deliberative model of democracy the question is whether these rhetorical features of deliberation are incompatible with those values. The paper argues that they are compatible. It does so by defending an Aristotelian account of rhetoric in public deliberation which denies the Platonic contrast between reasoned discourse and rhetoric which the Kantian model inherits. The following essay begins by outlining the pragmatist link between truth claims and democratic deliberations. To this end, special attention will be paid to Jeffrey Stout’s pragmatist enfranchisement of religious citizens. Stout defends a deliberative notion of democracy that fulfills stringent criteria of inclusion and security against domination. While mitigating secular exclusivity, Stout nonetheless acknowledges the new visibility of religion in populist attempts to dominate political life through mass rule and charismatic authorities. In response, I evaluate recent innovations in (...) deliberative democratic systems theory (DDST). In this article, I identify some good-making features of a deliberative democratic theory. The article will proceed as follows: First, I present both some important insights and some shortcomings of Rawls’ theory. I then present Robert Talisse’s account, focusing on how Talisse both accommodates what is right about Rawls while avoiding some of Rawls’ weaknesses. Finally, some positive claims are made about what an adequate deliberative theory might look like.

Deliberative Democracy theory is an ever-expanding field in political theory. In the present article, I aim to present the significance of Gandhian thought for the theory of deliberative democracy. Gandhi never used the term deliberation or articulated a theory of deliberative democracy specifically while expressing his notion of ideal democracy. For him, discussion, exchange of thoughts, reasoning, etc. was instinctive for democracy and not something that required to be defended within the boundaries of (...) scholarship. I trace the central elements of democracy in Gandhian thought and examine them through the lens of deliberative democracy theory. I also examine the implication of Gandhi’s formulations in India. In doing so, I would develop a richer understanding of democracy by bringing clarity to the contribution of Gandhi to the cause of deliberative democracy. (shrink)

How should liberal democratic states respond to cultural practices and arrangements that run afoul of liberal norms and laws? This article argues for a reframing of the challenges posed by traditional or nonliberal cultural minorities. The author suggests that viewed from up close, such dilemmas are revealed to be primarily intracultural rather than intercultural conflicts, and reflect the political and practical interests of factions of communities much more than deep moral differences. Using the example of the reform of customary marriage (...) laws in post-apartheid South Africa, this article makes the case for a more pragmatic, politically focused approach to resolving conflicts of culture that it is argued is both more democratic and effective than alternatives recently advanced by liberals and deliberative democracy theorists. This article defends deliberative democracy against the problem of tacit knowledge. It has been argued that deliberative democracy gives a privileged position to linguistic communication and therefore excludes tacit forms of knowledge which cannot be expressed propositionally. This article shows how the exclusion of such knowledge presents important challenges to both proceduralist and epistemic conceptions of deliberative democracy, and how it has been taken by some to favour markets over democratic institutions. After pointing to the limitations of (...) market alternatives, deliberative democracy is defended by arguing that tacit knowledge can be brought into deliberation through the mechanism of trust in testimony. By trusting the testimony of a speaker, deliberators are able to act on knowledge even without it being explicitly expressed. The article then goes on to discuss the implications of this defence for deliberative theory, and particularly, the forms of reason which deliberative democrats must see as legitimate. (shrink)

John Dryzek's justification of deliberative democracy rests on a critique of instrumental rationality and a defence of Habermas's idea of communicative rationality. I question each stage of Dryzek's theory. It defines instrumental rationality broadly but only criticises narrow applications of it. It conflates communicative rationality with Habermas's idea of ‘discourse’ – the real motor of Dryzek's democratic theory. Deliberative democracy can be better defended by avoiding overstated criticisms of instrumental rationality, by altering the emphasis on communicative (...) rationality, and by focusing more on different models of politics than different models of rationality. Dryzek's theory can thus present deliberative democracy as a better means to better ends – a more powerful and more positive position. (shrink)

This chapter talks about ethical deliberations that may be individual, potentially based on thought experiences or overhanging and discusses a real confrontation of evaluations and the deliberations of other individuals. This is one of the new elements introduced by participatory technology assessment (PTA), particularly in Europe. Stakeholder participation has been promoted by European agencies as a pillar of responsible research and innovation (RRI), confirming the need to consider the risks of exposure to the deliberations of others. The chapter describes the (...) resources offered by certain political philosophers who considered proposing the best possible systems for managing pluralism. It discusses the criteria of one of the most promising political theories: deliberative democracy. The qualification of this theory will prove useful in managing the cohabitation of individual and collective evaluation. Taken as a model for how groups should make collective judgments and decisions, the ideal of deliberative democracy is inherently ambiguous. Consider the idealised case where it is agreed on all sides that a certain conclusion should be endorsed if and only if certain premises are admitted. Does deliberative democracy recommend that members of the group debate the premises and then individually vote, in the light of that debate, on whether or not to support the conclusion? Or does (...) it recommend that members individually vote on the premises, and then let their commitment to the conclusion be settled by whether or not the group endorses the required premises? Deliberative-democratic theory has not addressed this issue, and this is a problem. The discursive dilemma of my title--a generalisation of the doctrinal paradox from analytical jurisprudence--shows that the procedures distinguished can come apart. Thus deliberative democrats must make up their minds on where they stand in relation to the issue; they cannot sit on the fence. This paper is an attempt to address the issue and look at the grounds on which it may be resolved. (shrink)

Jonathan Aldred shares our desire to promote a reconciliation between social choice theory and deliberative democracy in the interests of a more comprehensive and compelling account of democracy.1 His comments on some details of our analysis – specifically, our use of Arrow’s conditions of universal domain and independence of irrelevant alternatives – give us an opportunity to clarify our position. His discussion of the independence condition in particular identifies some ambiguity in our exposition, and as such is useful. (...) Deliberative democracy is an embattled political project. It is accused of political naiveté for it only talks about power without taking power. Others, meanwhile, take issue with deliberative democracy’s dominance in the field of democratic theory and practice. An industry of consultants, facilitators, and experts of deliberative forums has grown over the past decades, suggesting that the field has benefited from a broken political system. This book is inspired by these accusations. It argues that deliberative (...) democracy’s tense relationship with power is not a pathology but constitutive of deliberative practice. Deliberative democracy gains relevance when it navigates complex relations of power in modern societies, learns from its mistakes, remains epistemically humble but not politically meek. While deliberation does manifest a universal competence, its character varies substantially across time and space, a variation partially explicable in cultural terms. We deploy an intersubjective conception of culture in order to explore these differences. Culture meets deliberation where publicly accessible meanings, symbols, and norms shape the way political (...) actors engage one another in discourse. Fuller understanding of political deliberation requires comparative and historical studies of particular contexts. We look at one case from Egypt in some depth and provide shorter illustrations from Botswana, Europe, India, Japan, Madagascar, the United States, Yemen, and elsewhere. Cross-cultural learning can enrich the theory of deliberative democracy, and give democratic theory a more universal reach. (shrink)

The article elaborates an original intertwined reading of republican theory, deliberative democracy and political equality. It argues that republicans, deliberative democrats and egalitarian scholars have not paid sufficient attention to a number of features present in these bodies of scholarships that relate them in mutually beneficial ways. It shows that republicanism and deliberative democracy are related in mutually beneficial ways, it makes those relations explicit, and it deals with potential objections against them. Additionally, it elaborates an (...) egalitarian principle underpinning the resulting model that I label Equality of Access and Deliberation. The upshot of these considerations is a novel and mutually reinforcing interrelated three-tiered theoretical and institutional proposal. (shrink)
