In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at (...) the City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. Expressive theories of state action seek to identify and assess the ‘meaning’ implicit in state action, such as legislation and public policies. In expressive theories developed by relational egalitarians, state action must ‘express’ equal concern and respect for citizens. However, it is unclear how precisely we can determine and assess the meaning of what states do. This paper considers how an expressive theory could be developed, given the commitments of a relational account of equality, and how such a theory (...) would relate to relational egalitarianism more broadly. I suggest that expressive considerations should be tied more closely than they are in the current literature to agents’ attitudes and to their intentions. I discuss a range of real-world policies that are problematic for what they can be taken to express. (shrink)

Abstract: One oft-cited feature of speech acts is their expressive character: Assertion expresses belief, apology regret, promise intention. Yet expression, or at least sincere expression, is as I argue a form of showing: A sincere expression shows whatever is the state that is the sincerity condition of the expressive act. How, then, can a speech act show a speaker's state of thought or feeling? To answer this question I consider three varieties of showing, and argue that only one of them (...) is suited to help us answer our question. I also argue that concepts from the evolutionary biology of communication provide one source of insight into how speech acts enable one to show, and thereby express, a psychological state. (shrink)

In this paper, I argue that hate speech expresses hate, and answer some objections to expressivist views. First, I briefly comment on some limitations of pragmatic accounts of harmful speech. I then present an expressive-normative view of derogatory discourse according to which it is expressive of an affective state by presupposing it. A linguistic act expressive of an affective state inherits the normativity that is constitutive of that state, as directed to its intentional object. If the act is successful, it (...) updates the conversational context with the normative appraisal conditions of the affective state presupposed. I argue that this model can be applied to hate speech. I rely on current research on the psychology of hate to identify the appraisal conditions, action tendencies, and motivational goals characteristic of hate. In this paper, the aim is to explore how there can be a role for expression of affect in illocution, drawing upon some ideas about expression put forward by Karl Bühler. In a first part of the paper, I map some active discussions and open questions surrounding phenomena that seem to involve “expression of affect”. Second, I home in on a smaller piece of that larger puzzle; namely, a consideration of how there may be non-conventional expression of affect. I provide (...) some examples of what I take that to involve and set out some premises for approaching it. In a third section, I motivate such an interest by pointing to a question in speech act theory concerning ‘force conventionalism’. This is whether and how illocution can be performed non-conventionally—that is, whether (at least some) utterances can be communicated with illocutionary force without need of convention. I propose that where expression of affect may occur non-conventionally, it may in turn constitute one important route through which at least some kinds of illocution are achieved. In the fourth part of the paper, I sketch an account of such non-conventional expression of affect for the purposes of illocution, by exploring a broadly Bühlerian account of some affects; namely, that some affects are teleological in character, that coordinations may be involved in their satisfactional states, and that uptake of the expressed affect constitutes one subset of such satisfactional states. The normal justification of authority, as examined in Ch. 3, yields the conclusion that the extent of governmental authority varies from person to person. It cannot justify the authority that governments, in fact, claim for themselves in the case of most people. An analysis of consent is provided in order to explore the prospect that consent might serve to extend the scope of the authority of states. It is argued that consent can ground an extension of political authority only (...) so far as it is non‐instrumentally valuable. Those who, as a mode of expressing identification with their community, consent to the authority of reasonably just governments or respect their laws, are subject to that authority since such modes of consent have non‐instrumental value. The field of my inquiry is the field of judgement. I focus primarily on the difficulties involved in the act of judging. What I emphasize, after Kant, is the absence of preexisting rules for judgement in its purest form. ;I interpret Cavell's discussion of Rawls' theory of justice as probing the implications of the fact that there will always be for the individual a judgement to be made of the distance between our own society and the ideal well ordered society. (...) It is here I claim that the concept of the example comes into play. To elaborate this I show how Rousseau uses his experience of consent to the Republic of Geneva to provide an example, or a standard of judgement to the individual's seeking whether and how to express consent to their society. ;In my paper on the Kant's Third Critique I argue that what is most central in the judgement of taste is that it is the reflection and expression the individuality of the judge of taste and its function is to provoke one to rely on one's own sense of the world. It is primarily through the analysis of the relation of genius to taste that I elaborate the centrality of individuality but my claim is that this relation manifests itself also between the judge of taste and a community of taste. ;The concept of exemplarity leads me to the distinction between what can be said and what can be shown. In the paper on Wittgenstein's Tractatus I want to combat what I take to be a false understanding of the distinction between showing and saying which makes what is shown to be some property of the world that cannot be stated in language. I explain what Wittgenstein means by the notion of form and how it is that form only shows itself through language. I further see the overall design of the text as an exemplary reworking of Wittgenstein's philosophical experience. I thus interpret the idea of throwing away the ladder as a claim that the propositions of the book are of use only as an example to provoke one to thoughts of one's own. (shrink)

The European Union policy is geared towards fostering the diversity of cultural expression in its member states. Globalisation, cosmopolitanism and increasing mobility of the population have been destroying the fundamental values of nation-based states. The preservation of the ethnicity of the nation is becoming an increasing challenge. In Lithuania, where ethnicity has deep roots, many prominent representatives of the Lithuanian national revival, cultural figures, philosophers and pedagogues have emphasised the importance of national culture and the development of national (...) identity in the educational space in order to preserve the foundations of the state and its future sovereignty. This is, therefore, becoming an important educational challenge. In 2009, the Ministry of Education, Science and Sport of the Republic of Lithuania adopted the “Strategy for the Development of Ethnic Culture in Educational Institutions”, which was specified in the action program in 2012. However, the modelling of civic education, especially the practical implementation process, faces challenges in the area of education, one of which is the lack of proper attention from participants in education and media. The empirical research reveals that the interest of Lithuanian youth in the history of the national and ethnic culture remains low. This shows that when implementing reforms in the country’s education system, it is appropriate to impart fundamental provisions of citizenship and nationality to the young generation in a consistent and attractive manner. The aim of the article is to present the expression of citizenship and nationality in the educational space of Lithuania and to provide guidelines for improvement of civic education based on research. A persistent feature in Jesuit reports about the late Ming and early Qing was the notion that an enduring peace and concord pervaded the Chinese political system. Although the Jesuits did not invent this association, which was rooted in Greco-Roman historiography, the Jesuit encyclopaedist Antonio Possevino was the first to link the ‘perpetual peace’ and ‘supreme concord’ of the Chinese state to the Confucian intellectual tradition. As the Jesuits’ missionary strategy developed under the tutelage of Matteo Ricci, ‘public peace’ and (...) ‘the calm of the Republic’ came to be perceived as the ultimate purpose of the Confucian precepts and one of the hinges on which the aims of Christianity, Confucianism and natural law can be reconciled. The supreme expression of the link between Confucianism and peace can be found in the Confucius Sinarum philosophus, which presented for the first time an accessible translation of three of the four Confucian classics. Yet while retaining the view that pre-Qin Confucianism espoused peace as a central political aim, the Confucius Sinarum philosophus challenged the view that contemporary China could be regarded as a utopic actualization of Confucian peace. This paper will discuss this shift as an attempt to coopt the Chinese political experience as an argument against the pragmatic political philosophy known as ‘reason of state’, which was perceived by Jesuit thinkers as atheistic and immoral. This paper uses a non-distributive system of Boolean fractions (a|b), where a and b are 2-valued propositions or events, to express uncertain conditional propositions and conditional events. These Boolean fractions, 'a if b' or 'a given b', ordered pairs of events, which did not exist for the founders of quantum logic, can better represent uncertain conditional information just as integer fractions can better represent partial distances on a number line. Since the indeterminacy of some pairs of quantum events is due (...) to the mutual inconsistency of their experimental conditions, this algebra of conditionals can express indeterminacy. In fact, this system is able to express the crucial quantum concepts of orthogonality, simultaneous verifiability, compatibility, and the superposition of quantum events, all without resorting to Hilbert space. A conditional (a|b) is said to be "inapplicable" (or "undefined") in those instances or models for which b is false. Otherwise the conditional takes the truth-value of proposition a. Thus the system is technically 3-valued, but the 3rd value has nothing to do with a state of ignorance, nor to some half-truth. People already routinely put statements into three categories: true, false, or inapplicable. As such, this system applies to macroscopic as well as microscopic events. Two conditional propositions turn out to be simultaneously verifiable just in case the truth of one implies the applicability of the other. Furthermore, two conditional propositions (a|b) and (c|d) reside in a common Boolean sub-algebra of the non-distributive system of conditional propositions just in case b = d, their conditions are equivalent. Since all aspects of quantum mechanics can be represented with this near classical logic, there is no need to adopt Hilbert space logic as ordinary logic, just a need perhaps to adopt propositional fractions to do logic, just as we long ago adopted integer fractions to do arithmetic. The algebra of Boolean fractions is a natural, near-Boolean extension of Boolean algebra adequate to express quantum logic. While this paper explains one group of quantum anomalies, it nevertheless leaves no less mysterious the 'influence-at-a-distance', quantum entanglement phenomena. A quantum realist must still embrace non-local influences to hold that "hidden variables" are the measured properties of particles. But that seems easier than imaging wave-particle duality and instant collapse, as offered by proponents of the standard interpretation of quantum mechanics. (shrink)

This paper is devoted to an examination of issues concerning the persistence and linguistic re-expression of indexical singular belief. I discuss two approaches to the topic: the directly referential approach, which I take as best represented in Kaplan's views, and the neo-Fregean approach, which I take as best represented in Gareth Evans's views. The upshot of my discussion is twofold. On the one hand, I argue that both Kaplan's account and Evans's account are on the whole defective. On the other, (...) I claim that a broadly Fregean account is still to be preferred, since by positing semantically efficacious modes of presentation it is clearly better equipped to deal with the phenomena in the area. In particular, I argue that the notion of a memory-based mode of presentation of an object (a spatio-temporal particular, a region in space, a period of time, etc.), as introduced by Christopher Peacocke, turns out to be indispensable to account for the persistence and re-expression of intentional mental states over time. Hate groups are often thought to reveal a paradox in liberal thinking. On the one hand, such groups challenge the very foundations of liberal thought, including core values of equality and freedom. On the other hand, these same values underlie the rights such as freedom of expression and association that protect hate groups. Thus a liberal democratic state that extends those protections to such groups in the name of value neutrality and freedom of expression may be thought to be undermining (...) the values on which its legitimacy rests. In this paper, I suggest how this apparent paradox might be resolved. I argue that the state should protect the expression of illiberal beliefs, but that the state (along with its citizens) is also obligated to criticize publicly those beliefs. Distinguishing between two kinds of state action—coercive and expressive—I contend that such criticism should be pursued through the state’s expressive capacities in its roles as speaker, educator, and spender. Here I extend the familiar idea that law, to be legitimate, must be widely publicized; I contend that a proper theory of the freedom of expression obligates the legitimate state to publicize the reasons that underlie rights, in particular reasons that appeal to the entitlement of each citizen subject to coercion to be treated as free and equal. My theory of freedom of expression is thus “expressive” in two senses: it protects the entitlement of citizens to express any political viewpoint, and it emphasizes a role for the state in explaining these free-speech protections and persuading its citizens of the value of the entitlements that underlie them. In particular, I argue that the liberal state’s deployment of symbols to promote its members’ commitment to liberal ideals is in need of special justification. This is because the state’s exercise of its capacity to use (...) symbols may be in tension with respecting individual autonomy, particularly in cases in which the symbols exert influence without engaging citizens’ rational capacities. But despite the fact that the state’s deployment of symbols may circumvent citizens’ rational capacities, I argue that it may nonetheless be permissible when surrounded by certain liberal institutions and brought about via democratic procedures. This paper shows how self-inflicted pain enabled the expression of love for God among Christian monastic flagellant ascetics in medieval central Europe. As scholars have shown, being in a state of pain leads to a change in or a destruction of language, an essential attribute of the self. I argue that this transformation allows the self to transcend its boundaries as a conscious object, even if only in part, in a limited manner and temporarily, thereby enabling the expression of love (...) for God, a non-object. To substantiate my argument, I show that the self’s transcendence of its boundaries as a conscious object and its consequent experience of being a non-object enable the imitation of God: not solely in the sense of imitatio Christi, of the physical and visual representations of God incarnate in the flesh of His son Christ, but also in the sense of the self’s experience of being a non-object, just like God, the telos of the self’s love. Upon consideration of the unconditioned and particularly the conditioned stimuli that have been proposed to participate in the generation of incentive motivational states and, by extension, of extraversion, the nature of the contribution of NAS DA becomes less clear. Different kinds of conditioned stimuli can also exert strong control over the expression of behavioral sensitization. How might such stimuli affect the ability of experience-dependent processes to introduce stable individual differences in the development and expression of extraversion trait levels?

This study examines the visual representation of diegetic time in visual narrative stories, and explores why the invisible diegetic time flow could be expressed through visible elements, and how patterns and textures could be used to specify states of happenings. The study demonstrates that metaphorical relations between time and space are visually realized in visual narratives, leading to the representation of diegetic time and its related concepts on different levels of two-dimensional space. The segmentation of page space and the (...) visual components within panel space are employed to build a diegetic timeline as well as specify temporal aspects of actions and states in visual narrative stories. Neuroscientific evidence which suggests that a common metric is used to compute magnitudes of time and space in the human brain might help explain why time as an abstract concept could undergo visual materialization in visual narratives. Understanding the historical retrospective of state-confessional relations becomes especially relevant in connection with socio-political changes of the XX - the beginning of the XXI centuries. The Roman Catholic Church, as one of the subjects of these relations, increasingly expresses its attitude to socio-political events. Historical experience of the existence of the Roman Catholic Church testifies that the mentioned institution has had a significant impact on all spheres of public life, in particular political. In this context, we note that the beginning (...) of the XXI century. once again reveals the tendencies of the influence of the religious-church factor on the political life of many countries of the world, in the middle of which Ukraine. This influence is characterized by tension, a very complex dynamics, an increase in the interference of the political structure of religious affairs. The article aims to study of one of the relevant issues in the field of the modern post-history, namely, the virtualization of society. The latter is considered as a result of the postmodern worldview and the simulative nature of knowledge about social reality. The subject of the research involves the forms of virtual culture reflected in today’s Ukrainian society. Given the specifics of the identified issue, the author of the article draws attention to the specific methodological apparatus of the research. (...) The narrative background of the research, as well as the principle of historicism, allows one to consider virtualization as a process of modelling social reality using computer technologies, whose image or prototype is a historical reality. It is important to note that the virtualization of society has a historical conditionality, which makes it possible to consider it as the next stage of the historical and cultural development of society. At the same time, the modern type of culture is a virtual culture, whose main creator and consumer is human. Its main feature is a pronounced innovative character. The main forms of Ukrainian society virtualization are focused on virtual communities and virtual states. Importantly, each of them mimics the social reality, whose prototype is an image characterizing the cultural identity of society. (shrink)

ABSTRACTAlthough social anxiety symptoms are robustly linked to biased self-evaluations across time, the mechanisms of this relation remain unclear. The present study tested three maladaptive emotion regulation strategies – state post-event processing, state experiential avoidance, and state expressive suppression – as potential mediators of this relation. Undergraduate participants rated their social skill in an impromptu conversation task and then returned to the laboratory approximately two days later to evaluate their social skill in the conversation again. This paper is concerned with the issue of authenticity in Wittgenstein’s philosophy of psychology. In the manuscripts published as Letzte Schriften über die Philosophie der Psychologie – Das Innere und das Äußere, the German term Echtheit is mostly translated as ‘genuineness’. In these manuscripts, Wittgenstein frequently uses the term as referring to a feature of the expression of feeling and emotion: -/- […] I want to say that there is an original genuine expression of pain; that the expression of pain (...) therefore is not equally connected to the pain and to the pretence. (LW II, p. 55) -/- “This weeping gives the impression of being genuine” – so there is such a thing as genuine weeping. […]. (LW II, p. 87) -/- […] Genuineness and falseness are not the only essential characteristics of an expression of feeling. […]. (LW II, p. 90) -/- Wittgenstein contrasts the genuineness of the expressions with the possibility that the expressions are feigned. It seems to me that Wittgenstein is trying to discredit a specific version of the sceptical claim that we do not know other minds. I will refer to it as the sceptical innuendo. The sceptical innuendo says that every expression of feeling and emotion may be pretended. Wittgenstein’s approach to the issue reflects his later interest in the philosophy of psychology and, in particular, the problem of the ascription of psychological states (P-ascriptions) on the basis of someone else’s expression of feeling or emotion. Thus, the attempt to reject the sceptical innuendo is done mainly by means of conceptual and psychological arguments. Let’s look at this short dialogue between the sceptic and Wittgenstein. The former asks „How do you know that someone else is in a certain psychological state?“ Wittgenstein’s first reply is „I know that he is glad because I see him“. But the sceptic cannot be very happy with this reply. The sceptic’s next question is: „How do you know that he is really glad and he is not pretending?“ Wittgenstein’s response is not a direct refutation but is composed of a number of related reasons. These may be summed up in three arguments: -/- (i) A psychological argument from the very nature of the expressions. The expressions are meant to be natural symptoms of someone else’s psychological state (P-state). -/- (ii) A conceptual argument about the nature of pretence. It claims that pretence is a psychological property which is rightly ascribed when an observer has evidence for it. -/- (iii) A psychological argument from genuineness. This article explores how the thought that language is expressive, in the sense of bearing emotional or affective meaning, can be made sense of, with particular attention to two authors for whom this thought plays an important role. It begins by introducing the idea of language being “expressive” and using Charles Taylor's work to consider its potential interest, before showing how the expressiveness of language might be accounted for by a position that seems particularly suited to this task, namely Merleau‐Ponty's (...) view of embodied expression in Phenomenology of Perception. I then set out a significant challenge to that position based on Wittgenstein's “private language argument,” which implies there is no necessary connection between language use and a subject's internal (affective) states, thus contesting Merleau‐Ponty's explanatory emphasis on the body. I therefore propose a revised “complex” view of language's expressiveness that meets this Wittgensteinian challenge by reconceiving the body's role. Finally, I draw out some implications of this revised view, arguing that while language itself cannot be considered expressive, it remains significant that we can experience language as expressive. I also suggest that, although apparently threatened, Taylor's position can not only accommodate, but be better understood with, this revised view. (shrink)

Higher states of consciousness in which the human mind can transcend the boundaries of logic and reason are envisioned as natural to the experience and potential growth of every human being. So far they have been mostly monitored by electrophysiological methods. In this study we were particularly interested in discovering the molecular transcriptional basis of higher states of consciousness. In addition to phenomenological reports of meditators who participated in this study the generated higher states of consciousness were (...) also EEG recorded. We assessed the whole genome gene expression analysis of long-term meditators in four separate trials and detected significant differential gene expression in association with higher states of consciousness. The number of differently expressed genes as well as high proportion of genes themselves differed between meditators. Despite this, gene ontology enrichment analysis found significant biological and molecular processes shared among meditators’ higher state of consciousness. (shrink)

A substantial body of research has established that even when we are not consciously aware of the faces of others we are nevertheless sensitive to, and impacted by their facial expression. In this paper, we consider this body of research from a new perspective by examining the functions of unconscious perception revealed by these studies. A consideration of the literature from this perspective highlights that existing research methods are limited when it comes to revealing possible functions of unconscious perception. The (...) critical shortcoming is that in all of the methods, the perceived facial expression remains outside of awareness. This is a problem because there are good reasons to believe that one important function of unconsciously perceived negative faces is to attract attention so that they are consciously perceived; such conscious perception, however, is never allowed with existing methodologies. We discuss recent studies of emotional face perception under conditions of visual search that address this issue directly. Further, we suggest that methodologies that do not examine cognitive processes as they occur in more natural settings may result in fundamental misunderstandings of human cognition. (shrink)

R. G. Collingwood thought that to express emotion is to come to understand it and that this is something art can enable us to do. The understanding in question is distinct from that offered by emotion concepts. I attempt to defend a broadly similar position by drawing, as Collingwood does, on a broader philosophy of mind. Emotions and other affective states have a profile analogous to the sensory profiles exhibited by the things we perceive. Grasping that one's feeling exhibits (...) such a profile is to understand it. That understanding differs from any involved in conceptualizing the affect in question. And, I argue, engagement with the expressive character of works of art is one way to gain it. (shrink)

This article discusses how the persistence of child labor, especially in Brazil and the United States of America, constitutes a current facet of neo-colonialism. Cultivated as an educational and dignifying activity, exploited child labor persists and is naturalized. Schools, religions, and the legislation contribute to making the working class come to love and naturalize what in the past was understood as torture and punishment, thus jointly acting as a fundamental means of forming a new cultural form: the love of (...) work. Initially, the article discusses how the culture of work is historically founded and then argues against the idealist and postmodern explanations that naturalize it. The argument is based on the understanding that culture has a material basis and is linked to the production and social reproduction of life. Data from the empirical research on child labor in tobacco farming in Brazil and the USA reveal the persistence of the problem among Latino children and families. We conclude with the need to found a new culture for contemporary society, based on other social and economic relations, which allows the working class to free itself from what dominates and exploits it. Although there has been growing awareness among historians of ideas of a close relationship between eighteenth-century religious and political argument, there is still no clear understanding of this kind of relationship. Despite its historical plausibility, the transition from religious to political thinking encounters serious logical obstacles stemming mainly from the traditional distinction between spiritual and temporal matters. This distinction, as articulated in the initial attempts to establish religious toleration, would make it untenable to extend arguments in defence of religious liberty (...) directly to the defence of political liberty. Religious and political liberty cannot be governed by the same rationale, which is man's conscientious relationship to God. Any attempt, therefore, to explain how it was possible to pass from religious to political argument has rather to focus on the, as it were, external characteristics of these two kinds of liberty. It is argued in this article that religious and political liberty appear to be similar in that they both refer to rights that concern the expression of opinions, the so-called ‘intellectual rights’ or ‘rights of mind’. Investigating the meaning of ‘right of private judgement’ shows it to have three dimensions, which refer to the mental process of thinking, to its external manifestation through speech, and to other, non-verbal actions prompted by thought. In relation to fundamental rights could easily be dismissed as irrelevant, could be interpreted as a relapse to a Hobbesian state of nature, while was considered suitable for serving as a basis of a defensible theory of natural rights which could easily cover religious liberty, as well as political liberty, the right to free speech, or the liberty of the press. Unlimited and universal exercise of this type of rights was not only believed not to involve mutual harm, but it was also backed further by an appeal to the public good. (shrink)

The purpose of this article was to comprehensively explore the phenomenon of the narrative of the Decalogue in its fundamental principles in the context of the theological understanding of Jewish law. For this purpose abstract-logical methods, historical-legal, phenomenological, axiological, epistemological methods, method of critical and systematic analysis and method of comparative theology were used. The result is a theological understanding of the basic moral and legal principles and reducing to a single, systematic; a study of the correlation between the normative (...) and the moral side of such a narrative was conducted. Of particular importance is the establishment and isolation of the basic initial principle in the defined context that underlies both Sinai law and all the biblical law. Because with the change of historical realities, which coincided with the destruction of the Temple and the termination of sacrifices, the law has also changed. However, the biblical law was of particular ideological importance, it set the tone and revealed and formed the basic principles for the further development of all Jewish law. Therefore, in our study we have drawn attention to the main ideological features of the biblical laws, because in our opinion, the basic formative essence is hidden in them and only by understanding it − will we be able to understand Jewish law itself. However, the phenomenon of law and even more so of Jewish law, is one of the best regulators and exponents of the educational principle that is designed to raise a person in love. Of course, morality is called for it and it should take precedence over everything else, but the legal part should not be ignored. Law should serve as a socially just, integrative, fundamental, binding, most effective, most respected regulator. Therefore, the problem of combining legal principles and moral precepts for biblical law did not stand basically. The significant part of the adopted legal norms initially was characterized by moral prescriptions, confirmed and expressed by law. Such a transition, the shift from morality to law, and the close relationship between them are one inseparable whole. And apart from Halacha, which was responsible for the legal aspect, there were also the writings of the prophets whose task was to illuminate the transition from law to morality, because precisely morality is the essence of everything. Here is the true meaning of the existence of a legal expression of such an educational principle. Thus, the basic educational principle of the Decalogue, in particular, and of biblical law in general, was to educate a high-moral person who had restrictive precepts that would not allow him to fall into lawlessness, and the formative commandments that would allow a person to be educated in the search for God, and to stabilize himself in the godlike state commanded by God through Moses. That is the essence of the Decalogue and Jewish law. The educational principle, both basic and effective, though not so familiar to the modern understanding of the nature of law, is precisely the principle that laid down both the basis of the Decalogue and the foundation of all Jewish law at least in its biblical part. This article explores the evolution of consciousness as directly correlated to hunting, gathering, tool-making and art. The methodology is qualitative theoretical analyses, articulated around Jean Gebser’s seminal work, The Ever-Present Origin. Hunting and gathering are expressions of a magical, unitary, ‘self-dissolving’ consciousness. Tool-making on the other hand is depicted as evolving from a mythical consciousness of duality, polarity, symbolism and a state of being qualified by ‘crystallisation of the I’. Lastly, art is a function of a consciousness of ‘self-transcendence’, ‘I (...) and I’, idealisation and a transpersonal state of being. The article concludes by positing that hunting, gathering, tool-making and art can be reframed as ‘forms of the movement of consciousness’. (shrink)

The article investigates the problem of Kant's proposal for a final global legal order. Kant expressed his stance very vaguely in the consecutively published texts On the Common Saying, Toward Perpetual Peace and The Metaphysics of Morals, which enabled numerous, often contradictory interpretations. The aim of the paper is to propose an alternative method of analysis of Kant's texts, which on one side reconciles textual discrepancies in his writings and on the other throws new light on many of the previous (...) interpretations. In order to accomplish this goal, I draw distinctions between four perspectives, from which the philosopher considers this issue in his writings. This allows me to give the final form of Kant's world peace, explain the character of the international state of nature vs the original one, and understand the role of the principles of politics and the status of Kant's teleological understanding of history. A natural landscape can look serene, a shade of colour cheerful and a piece of music might sound heartrending. Why do we ascribe affective qualities to objects that can't entertain psychological states? The capacity that objects, and especially artworks, have to express affective states is a bizarre phenomenon that needs to be clarified in numerous respects. Philosophers are still struggling with the phenomenon of expressiveness being a matter of imagination, perception, or mnemonic association, and usually do not agree (...) on the role that emotions and human bodily expressions play in it. Benenti questions the main theories that populate the aesthetics domain using the tools of philosophy of mind. This study deals with crucial debates concerning seeing-in, cognitive penetration, the relation between phenomenal character and representational content and between emotions and expressions. It aims at providing a viable account of the experience we have of expressive properties by casting light on its fundamentally perceptual nature. The outcome is an empirically informed and critical overview of a topic which has been rather neglected in the philosophy of mind. The book will be of interest to scholars of the philosophy of mind, aesthetics, the cognitive sciences, and psychology. (shrink)
